EASE14ENT FOR SANITARY SEWER
THIS INSTRUMENT, Made this I If"% day of A 1974,
by and between CARL R. POHLAD and ELOISE O. POHLAD, husband and
wife, and KATHLEEN T. MOORE, a widow, of the County of Hennepin
and State of Minnesota, parties of the first part, and the CITY
OF EDINA, a municipal corporation organized under the laws of
the State of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and no /100 Dollar ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof
is hereby acknowledged, do Grant, Bargain, Sell, Convey and War-
.
rant to said party of the second part an Easement in perpetuity
for sanitary sewer purposes, including the right to enter for
III the purpose of constructing, maintaining, altering, repairing
and reconstructing a sanitary sewer system in and over the
following described property situate in the County of Hennepin
and State of Minnesota, to -wit:
That part of Lots 1, 2 and 3, Block 1, Mirror Lake
Plat No. 2, lying within the following described
easements:
Beginning at a point on the North line of said
Lot 2, which point is 45.87 feet East of the
Northwest corner of said Lot 2; thence Southerly
at right angles to the North line of said Lot 2,
a distance of 25 feet; thence Westerly, parallel
with the North lines of said Lots 1 and 2, a
distance of 130 feet; thence Northerly at a
deflection angle of 90 degrees.to the right, a
distance of 25 feet to the North line of said
Lot 1; thence Easterly to the point of beginning.
A 15 foot wide strip of land, the center line of
which begins at a point on the Southerly line of
said Lot 3, which point is 311.72 feet Easterly of the
Southwest corner of said Lot 3 (the intersection of
the easterly line of Blake Road and the Southerly
line of said Lot 3) as measured along a bearing of
South 82 degrees 23 minutes 00 seconds East to
the actual point of beginning of said 15 foot

strip of land; thence Northwesterly on a bearing
of North 39 degrees 54 minutes 00 seconds West,
a distance of 206.0 feet; thence continuing
Northwesterly on `a bearing of North 9 degrees
14 minutes 00 seconds West to the South line of
the easement first described above and there
terminating.
Also a temporary construction easement 10 feet
in width, lying Westerly of and abutting the
easement described in the preceding paragraph
within said Lot 1; temporary construction ease-
ments 10 feet in width lying Northeasterly of
and Southwesterly of and abutting the easement
described in the preceding paragraph within
said Lot 3. Said temporary construction ease-
ments shall terminate on December 31, 1974.
. It is the intention and agreement of the parties hereto
that the party of the second part shall, in the construction or
maintenance of said sanitary sewer, replace any shrubs or sod
removed by any excavation in connection with such construction
or maintenance work, in as nearly as possible the same condition
as before such excavation.

have hereunto set their hands and seals the day and year first
above written.
