EASEMENT
THIS INSTRUMENT, Made this_ 2Zst day of September , 2973
and between C. J. Danens and Marion-G. Danens,
husband and wife of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in con-
sideration of One and No /100 Dollars ($1.00), to them in hand ,paid lwy
the said party of the second part, the receipt whereof is hereby
acknowledged, do Grant, Bargain, Sell, Convey and Warrant to said
party of the second part an Easement in perpetuity for all utility
and drainage purposes including, but not being limited to, sanitary
sewer, storm sewer, water pipes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and recon-
structing said utility and drainage systems in and over the following
described property situate in the County of Hennepin and State of
Minnesota, to —wits
That part of the Northeast Quarter of the Northwest Quarter lying West
of a line extending from a point on the North line thereof 264.53 feet
East along the said North line from the Northwest corner of the said
Northeast Quarter of the Northwest Quarter to 'a point on the South line
of the said Northeast Quarter of the Northwest Quarter 264.53 feet East
along the said South line from the Southwest corner of the said Northeast
Quarter of the Northwest Quarter, except the North 255 feet thereof, in
Section 8, Township 116, Range 21, according to the Government Survey
thereof, which lies within a 20 foot wide strip of land being 5 feet
North of and 15 feet South of the following described line:
Beginning at a point on the West line of Hondo 2nd Addition, which
point is also on the centerline of Shannon Drive as platted in said
Hondo 2nd Addition; thence Northwesterly, along an extension of
said centerline of Shannon Drive, a distance of 175 feet; thence.
Southwesterly, at a deflection angle of 40 degrees to the left, to
the East line of Lot 16, Prospect Hills.
Also temporary construction easements, 10 feet in width, lying
Northerly and Southerly of and abutting the above described
permanent easement. Said temporary construction easements shall
terminate iDs ct%e intention 'and agreement of the Parties hereto
that the party of the second part shall in the construction, or '
maintenance of said utility and drainage systems g y replace any shrubs
or sod removed by any excavation in- connection with such construction
or maintenance work, in as nearly as possible the same condition as
