under the laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said party of the first part, in
consideration of One and No /100 Dollars ($1.00), to it in hand paid
by the said party of the second part, the receipt whereof is hereby
acknowledged, does Grant, Bargain, Sell, Convey, and Warrant to
said party of the second part an Easement in perpetuity for storm
sewer purposes, including the right to enter for the purpose of
constructing, maintaining, altering, repairing, and reconstructing
a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota,
to -wit:
That part of the Northwest Quarter of the Southwest Quarter,
Section 8, Township 116, Range 21, lying West of the East
1569.92 feet of the Southwest Quarter of said Section 8 and
lying East of the East line of Hyde Park Addition which lies
within the following described tracts of lands:
Beginning at a point which is the intersection of the centerline
of Bonnie Brae Drive and the East line of Hyde Park Addition;
thence Easterly, along an extension of the centerline of Bonnie
Brae Drive, a distance of 250 feet; thence Northerly, deflecting
90 degrees to the left, a distance of 64.5 feet; thence South-
easterly, deflecting 120006'18" to the right, a distance of
31.97 feet to the actual point of beginning of the centerline
of a 15 foot wide strip of land; thence Southeasterly along the
Southeasterly extension of the last described line, a distance
of 150 feet and there terminating.
Also a temporary construction easement, 20 feet in width, lying
on each side of the above described 15 foot wide easement. Said
temporary construction easement shall terminate on December 31,
1975.
It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said storm sewer replace any shrubs or sod removed
by any excavation in connection with such construction or mainten-
ance work, in as nearly as possible the same condition as before

8) When notices of assessment hearings are mailed out, a statement explaining
deferment policy will be sent along. Notices will be sent out 30 days
before hearing instead of two weeks. Application for deferment must be made
to City Assessor's office by 4:30 p.m. of the last working day before the
day of the assessment hearing.

BENTON AVENUE /T.H. 100 INTERCHANGE CONTINUED INDEFINITELY. Mr. Dunn advised
Council that he would recommend the "folded diamond" type of interchange for
.Benton Ave. at T.H. 100, based on the recommendation of the Metropolitan Council
Mayor Van Valkenburg said that it appeared that there is no chance of the inter-
change being approved and that further discussion at this time would be a waste
of everyone'e time. Councilman Richards' motion continuing action indefinitely
was seconded by Councilman Courtney.

STORM SEWER IMPROVEMENT NO. ST.S -132 ABANDONED. Mr. Dunn advise.l Council that
residents had taken no action as suggested when Storm Sewer Improvement No.
ST.S -132 on Juanita Ave. was reviewed by the Council on February 3, 1975, and
recommended that the improvement be abandoned. Councilman Shaw's motion to
abandon Storm Sewer Improvement No. ST.S -132 as recommended by Air. Dunn was
seconded by Councilman Courtney.

HEARING DATE SET FOR WATERTHAIN IMPROVEMENT NO. P- WM -319B. Being advised by
Mr. Dunn that new petitions have been received for watermain on Oxford Ave., Van -
dervork Ave. and Hollywood Road, Councilman Courtney offered the following
resolution and moved its adoption:
