Dear Mr. Crouch:
This letter is written in response to your letter of January 13, 1983, in
which you requested execution of a quit claim deed by the City of Edina for
the above referenced property.
At its Regular Meeting of February 7, 1983, the Edina City Council authorized
execution of the quit claim deed. I am therefore enclosing two signed copies
of the deed. This should now enable you to have the document filed in the
office of the Registrar of Titles.

for the drainage and storage of surface waters and that they will
not fill the same nor will they in any manner attempt to change the

The Grantors, however, expressly reserve the right to th elve ,
their successors and assigns, to construct, reconstruct, use,
maintain and repair a private driveway to extend from Evanswood
Lane across the above - described easement area to serve a single
family residence to be constructed upon Tract A of said Registered
Land Survey No. 1404 ; provided that said construction, use,
reconstruction, maintenance or repair shall not diminish the
capacity of the ponding area located within said easement area for
the storage of surface water; but provided further that if such
capacity would be diminished thereby, the Grantors, their successors
or assigns may deepen said ponding area or create and grant easements
to the City of Edina over additional adjacent land for a ponding
area so that the total capacity of the resulting ponding areas for
the storage of surface waters is at least equal to the capacity of
said ponding area before such construction, reconstruction, use,
maintenance or repair of said private driveway, and may then construct,
reconstruct, use, maintain or repair said private driveway across
said easement area.
This instrument is exempt from State Deed Tax.

The Grantors further agree for themselves, their heirs,
successors, and assigns that the City of Edina will have no duty to
maintain or service the above described property nor shall they be
liable in any manner or to any panty in connection with the mainten-
ance of the above described property as part of a pond for the drain-
age and storage of excess surface water.
