EASEMENT
THIS INDENTURE, Made this ?Otl day of October, 1970, between
CONCORD DEVELOPMENT CORPORATION, a corporation under the laws of the State
of Minnesota, party of the first part, and VILLAGE OF EDINA, a Minnesota
Municipal corporation, party of the second part,
WITNESSETH, That Lhe said party of the first part, in consider-
ation of the sum of One ($1.00) Dollar and other valuable consideration to
it in hand paid by the said party of the second part, the receipt and
sufficiency whereof is hereby acknowledged, does hereby Grant, Bargain,
Quitclaim, and Convey unto the said party of the second part, its successors
and assigns, Forever, an easement for constructing, reconstructing, maintaining
and using a retaining wall on, under and across the tract or parcel of land
lying and being in the County of Hennepin and State of Minnesota, described
as follows, to -wit:
That part of lot 49, Auditor's Subdivision No. 172,
Hennepin County, Minnesota described as follows:
Beginning at a point in West line of said lot 49,
distant 53.22 feet South of Northeast corner of lot
52 in said Subdivision; thence South along West line
of said lot 49-, a distance of 122.78 feet to South-
west corner thereof; thence East along South line of
said lot 49, a distance of 0.49 of a foot to a point
300 feet West of Southeast corner of said lot 49; thence
Northeasterly deflecting to the left 7 °02' a distance of
91.33 feet to the actual point of beginning of the tract
of land to be described; thence Northeasterly, along an
extension of the last described line, a distance of 23
feet; thence Northwesterly on a line running to the
originally described point of beginning (A point in the
West line of said lot 49, distant 53.22 feet South o= the
Northeast corner of lot 52, in said Subdivision) a distance
of 13 feet; thence Southwesterly to the actual point of
beginning of the tract described.
TO HAVE AND TO HOLD THE SAME, Together with all the hereditaments
nd apnurtenances thereunto belonging or in anywise appertaining, to the said
party of the second part, its successors and assigns, Forever.
This instrument is exempt from State Deed Tax.
IN TESTIMONY WHEREOF, The said first party has caused these
presents to be executed in its corporate name by its ' Vice President
and its Vice President and its corporate seal to be hereunto affixed
the day and -year first above written.

and for said County, personally appeared Reuben I. Hovland and
Luther J. Hovland to me personally known, who, being each by me duly
sworn did say that they are respectively the Vice President
President and the Vice President of the corporation named in the
foregoing instrument, and that the seal affixed to said instrument is the corporate
seal of said corporation, and that said instrument was signed and sealed in behalf
of said corporation by authority of its Board of Directors and said
Reuben I. Hovland and Luther J. Hovland acknowledged said instrument
to be the free act and deed of said corporation.
