EASEMENT FOR PUBLIC ROAD PURPOSES

THIS INSTRUMENT, Made this �Q ✓ day of 19r;
by and between CURTIS E. AUSTIN and VALBORG J. AUSTIN, husband and wife, of
the County of Hennepin and State of Minnesota, parties of the first part,
and the City of Edina, a municipal corporation organized under the laws of
the State of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 Dollars ($1.00) to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment for public road purposes in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:
Those parts of Lot 2, Block 1, and Lots 3 and 4, Block 2, Warden
Acres Austin Replat, according to the recorded plat thereof, which
lie within the circumference of a circle having a radius of 50.0
feet, the center of which circle is described as follows:
Commencing at the Northwest corner of said Lot 4, Block 2, thence
south along the west line thereof 23.0 feet; thence west at right
angles with said west line a distance of 20.0 feet to the center
of said circle.
Party of the second part shall execute and deliver a recordable
release of the easement hereby granted, promptly after, but not before, (i)
party of the second part has obtained of record, and in form and substance
acceptable to party of the second part, a perpetual easement for public
road and utility purposes, extending, in a location acceptable to party of
the second part, the public road now ending at the circle described in this
easement, to another then existing public road, and (ii) said public road
extension has been improved and opened by the party of the second part for
use by the public.

IN WITNESS WHEREOF, the said parties of the first part have hereunto
set their hands and seals the day and year first above written.
