Re: Outlot B, Dewey Hill Estates Addition - Tax Forfeited Land
I enclose herewith the original of the Conveyance of Forfeited Lands
from the State of Minnesota to the City of Edina of Outlot B, Dewey Hill Estates
Addition. You will note this has been recorded in the office of the Registrar of
Titles, Hennepin County, Minnesota as Document No. 2162972. You should keep
this deed in your file.
You will note the property is torrens title. That means that there is a
Certificate of Title outstanding at the Courthouse in Hennepin County which
names, as the owner of the property, the owner prior to the tax forfeiture. Do you
wish to have us bring a proceeding subsequent to obtain a new Certificate in the
name of the City? The cost of obtaining such a new Certificate in the name of the
City, assuming a default on the part of the prior owner, would be approximately
$400.00. Of course, if the prior owner objected and raised issues to be contested the
cost could be considerably more. Please let me know whether or not you wish to
have that proceeding subsequent brought.

CONVEYANCE OF FORFEITED LANDS
THIS INDENTURE, made this 22nd day of March, 1991, between the State of Minnesota,
as party of the first part, and the City of Edina, a Municipal Corporation, as party of the second
part, WITNESSETH:
WHEREAS, the land hereinafter described was duly forfeited to the State of Minnesota
to be held in trust in favor of the taxing districts for the nonpayment of taxes, and,
WHEREAS, pursuant to Minnesota Statutes Section 282.01, Subdivision la. the party of
the second part has applied to the Commissioner of Revenue for the conveyance of lands
hereinafter described to be used by it exclusively to enlarge and preserve the adjacent ponding
and open space area, and,
WHEREAS, unless not required under Minnesota Statutes Section 282.01, Subdivision
lb(b), the Board of County Commissioners of the County of Hennepin, State of Minnesota, has
recommended to the Commissioner of- Revenue by resolution adopted on the 26th day of

that if such use shall cease said land shall revert to the party of the first part as provided by
law.

same nor will they in any manner attempt to change the grade level of
the same nor interfere with the natural drainage, flowage and storage
of surface water on the above described property.
It is the intention and agreement of the Parties hereto that
the City of Edina shall in the construction, or maintenance of said
storm sewer replace any shrubs or sod removed by any excavation in
connection with such construction or maintenance work,, in as nearly
-as possible the same condition as before such excavation.
