Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;

consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant to
said party of the second part an Easement in perpetuity for utility
purposes, including the right to enter for the purpose of construct-
ing, maintaining, altering, repairing and reconstructing utility
systems in and over the following described property situate in the
County of Hennepin and State of Minnesota, to -wit:
That part of Lots 56 and 58, Auditor's Subdivision No. 172, accor-ding
to the recorded copy thereof, described as follows:
Beginning at the Southwest corner of the East 135 feet of said Lot
58; thence East along the South line of said Lot 58 a distance of 15
feet; thence North to a point on the North line of said Lot 58, which
point is 120 feet West of the Northeast corner of said Lot 58; thence
Northwesterly to a point 130 feet West of the East line and'25•feet North
of the South line of said Lot 56; thence North, parallel with the East
line of said Lot 56 to the South Line of West 51st Street as described in
Warranty Deed Document No. 3786923, Hennepin County, Minnesota; thence
Northwesterly along the South line of West 51st Street to an intersection
with a line 143 feet West of and parallel with the East line of said Lot 56;
thence South to the Southeast corner of the West 157 feet of the East 300
feet of the North 72 feet of said Lot 56; thence West to the.Northeast
corner of the West 155 feet of the East 300 feet of the South 60 feet of said
Lot 56; thence South to the Southwest corner of the East 145 feet of said
Lot 56; thence East to the Northwest corner of the East 135 feet of said
Lot 58; thence South along the West line of said East 135 fe to

It is the intention and agreement of the Parties he
that the party of the second part shall in the construction, or
maintenance of said utilities replace any shrubs or sod removed by
any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such
excavation'.

NOTICE OF ADVERSE CLAIM
(Section 508.70, Minnesota Statutes)
David E. Thomas, Jr. and Virginia S. Thomas, husband and
wife, have given an Easement for Utilities dated September 24, 1976,
to the City of Edina, a Minnesota municipal corporation, (hereinafter
called "Edina "), a copy of which is attached hereto as Exhibit A and
hereby made a part hereof, covering property in Hennepin County,
Minnesota.
The registered owner of the portion of the, property described on
Exhibit A that is registered is David E. Thomas, Jr., as evidenced by Certi-
ficate of Title No. 442947. Edina has been unable to obtain the owner's
Duplicate Certificate of Title from said registered owner.
Said Easement for Utilities given to Edina grants to
Edina an interest in the property described on Exhibit A adverse
to said registered owner.
The address of Edina is 4801 West 50th Street, Edina,
Minnesota, 55424 and any notice.or notices to be served upon it
under this Notice of Adverse Claim may be served upon it at such
address.
