EASEMENT
For and in consideration of the sum of One Dollar ($1.00) and
other valuable consideration, the receipt whereof is hereby acknowledged,
Edward G. Thernell and Beverly M. Thernell, husband and wife, (herein
called "Grantor "), do hereby grant, bargain, sell, convey and warrant to
the Village of Edina, a municipal corporation, in the County of Hennepin,
State of Minnesota, the following:
A perpetual easement for the installation and maintenance of
a storm drain over and in the property hereinafter described (herein
called "Easement Area "); and the right and privilege to enter upon the
Easement Area, with such men and equipment as are necessary in the opinion
of Edina, for the doing of such acts, including construction, reconstruction
and maintenance, as Edina deems necessary or desirable for accomplishment
of the purposes of this easement.
The easement and rights hereby granted, bargained, sold, released
and warranted are over, upon, across and in, the tracts of land situated in
Hennepin County, Minnesota, described as follows, to -wit:
The Southerly 5 feet of Lot 12, the Northerly 5 feet
and the Westerly 10 feet of the Southerly 15 feet of
the Northerly 20 feet of Lot 13, all in Block 3,
Killarney Shores, all according to the plat thereof
on file in the office of the Registrar of Titles,
Hennepin County, Minnesota.
Grantors do covenant with Edina, its successors and assigns,
that they are well seized in fee of the Easement Area aforesaid, and have
good right to sell and convey the same in manner and form aforesaid. And
the said Easement Area in the quiet and peaceable possession of Edina, its
successors and assigns, against all persons lawfully claiming or to claim
the whole or any part thereof, the Grantor will warrant and defend.
All of the provisions hereof shall run with the land and shall
extend to and bind and inure to the benefit of the heirs, representatives,
successors, grantees or assigns of the respective parties hereto.

leased and warranted are over, upon, across and in, the tracts of land
situated in Hennepin County, Minnesota, described as follows, to -wit:
The Southerly 5 feet of Lot 12; Northerly 5 feet and the
Westerly 10 feet except the Northerly 5 feet thereof of
Lot 13; the Westerly 20 feet of Lot 14;. the Northwesterly
30 feet of Lots 15 and 16; the Northerly 30 feet of Easterly
10 feet of Lot 17; the Southeasterly and Easterly 10 feet of
Lot 18, all in Block 30 Killarney Shores, all according to
the plat thereof on file in the office of the Registrar of
Titles, Hennepin County, Minnesota.
2. All rights of the Grantor to construct any building or
improvement of any kind on, or to dump upon, fill or otherwise grade or
change the level of the Easement Area.
Grantors do covenant with Edina, its successors and assigns,
that they are well seized in fee of the Easement Area aforesaid, and have
good right to sell and convey the same in manner and form aforesaid. And
the said Easement Area in the quiet and peaceable possession of Edina, its
successors and assigns, against all persons lawfully claiming or to claim
the whole or any part thereof, the Grantor will warrant and defend.
