THIS INSTRUMENT, Made this �/� day of Q C 7 , 1978,
by and between Edina Development Associates, a Wisconsin General
Partnership consisting of John J. Vincent and Ronald P.
Siepmann, general partners, party of the first part, and the
City of Edina, a municipal corporation organized under the laws
of the State of Minnesota party of the second part;
WITNESSETH, That the said party of the first part, in
consideration of One and No /100 Dollars ($1.00), to it in hand
paid by the said party of the second part, the receipt whereof
is hereby acknowledged, does. Grant, Bargain, Sell, Convey and
Warrant to said party of the second part Utility Easements in
perpetuity for all utility and drainage purposes including, but
not being limited to, sanitary sewer, storm sewer, water pipes,
including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility
and drainage systems in and over the following described property
situate in the County of Hennepin and State of Minnesota to -wit:
1. A 14 foot utility easement across that portion of
Lots 6 and 7, Block 7, BRAEMAR HILLS 9TH ADDITION, the center
line of which is described as follows: Beginning at a point
in the Northwesterly line of said Lot 7, distant 1.50 feet
Northerly, as measured along said Northwesterly line, from the
most Westerly corner of said Lot 7; thence Southeasterly to a
point in the Southeasterly line of said Lot 7 distant 46..67 feet
Southwesterly, as measured along said Southeasterly line, from
the Southeast corner of said Lot 7.
2. A 14 foot easement for utility purposes across that
portion of Lots 8, 9, and 10, Block 7, BRAEMAR HILLS 9TH ADDITION,
the center line of which is described as follows: Beginning at
the most Westerly corner of said Lot 9; thence Southeasterly
along the Southwesterly line of said Lot 9 to the Southeast corner
thereof; thence Northeasterly along the Easterly line of said
Lot 9 to a point 23.50 feet Southerly of the Northeast corner of
said Lot 9; thence Northeasterly to a point in the Northeasterly
line of Lot 10, distant 12.60 feet Southeasterly, as measured

The undersigned, mortgagee under that certain mortgage dated
December 20, 1977, filed for record in the office of the County
Recorder in.and for Hennepin County on December 22, 1977, as
Document Number 4343491, of certain real property located in the
County of Hennepin, State of Minnesota, described as follows:
Braemar Hills 9th Addition, according to the
plat thereof on file in the office of the County
Recorder in and for said County
hereby consents and agrees to the attached Grant of Utility
Easements dated October 26, 1978, by and between Edina Develop-
ment Associates, a Wisconsin General Partnership consisting of
John J. Vincent and Ronald P. Siepmann, as fee owner and the
City of Edina, a municipal corporation organized under the laws
of the State of Minnesota, as the grantee of the easements
therein, which easements cover a portion of the above-described
