EASEMENT FOE STORM. SEWER
THIS INSTRUMENT, Made this 9th day of January ,
19 81, by and between Crossroads of Edina, a limited partner-
ship under the laws of the State of rinnesota, party of the
first part, and the City of Edina, a municipal corporation
organized under the laws of the�State of Minnesota, party of
the second part;
11ITNESSETH, that the said party of the first part,
in consideration of One and No /100 Dollars ($1.00), to it in
hand paid by the said party of the second part, the receipt
whereof is hereby acknowledged, does Grant, Bargain, Sell,
Convey, and Warrant to said party of the second part an
Easement in perpetuity for storm sewer purposes, including
the right to enter for the purpose of constructing, maintaining,
altering, repairing and reconstructing a storm sewer system
in, under, and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:
An easement for storm sewer purposes over and across I.ot 1, Block 1; Lot
1, Block 2, FINDELL SECOND ADDITION, and also over and across vacated
Amundson Avenue as dedicated on the plat of FINDELL SECOND ADDITION,
said easement being 10 feet in width, the centerline of which is described
as follows:
Beginning at a point on the North line of said Lot 1, Block 1, distant
10.0 feet West of the Northeast corner at said Lot 1, Block l; thence
South 0 degrees 09 minutes 30 seconds West, parallel with the East line
of said Lot 1, Block 1, a distance of 223.0 feet; thence South 22 degrees
43 minutes 55 seconds West, 95.0 feet; thence North 88 degrees 20 minutes
30 seconds Nest, 207.0 feet and there terminating.
It is the intention and agreement of the Parties
hereto that the party of the second part shall in the con-
struction, or maintenance-of said storm sewer replace any
shrubs or sod removed by and any blacktop or concrete
surfacing damaged or removed by, any excavation in con-
nection with such construction or maintenance Work, in as
nearly as possible the same condition as before such ex-
cavation.

WITNESSETH, That the said parties of the first part, in
consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is

utility and drainage purposes including, but riot being limited to,
sanitary sewer, storm sewer, water pipes, including the right to
enter for the purpose of constructing, maintaining, altering, re-
pairing and reconstructing said utility and drainage systems in
and over the following described property situate in the County of
Hennepin and State of Minnesota to-wit: That part of Lot 1, Block 1,
and of vacated Amundson Avenue, and of Lot 1, Block 2, FindeZZ Second Addition
described as follows: Beginning at the Northeast corner of Lot 1, Block 1,
FindeZZ Second Addition; thence Southerly along the East line of said Lot 1
and its Southerly extension, a distance of 215 feet; thence Westerly, at an
angle of 90 degrees to the right, a distance of 25 feet; thence Northerly, at
an angle of 90 degrees to the right, to -the North line of said Lot 1, Block 1;
thence Easterly along the North line of said-Lot 1, to the.point of beginning.
It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said utility and drainage systems replace any shrubs
or sod removed by any excavation in connection with such construc-
tion or maintenance work, in as nearly as possible the same con-
dition as before such excavation,
