HomeMy WebLinkAbout2120EASEMFNT FOR WATERMAIN THIS INSTRUMENT, Made this 9th day of January , 1981 , by and between Crossroads of Edina, a limited partnership under the laws of the State of Minnesota, party of the first part, and the City of Edina, a municipal corporation organized under the laws of the State of Minnesota, party of the second part; W�TNESSETH, That the said.party of the first part, in consideration of One and No /100 Dollars ($1.00), to it in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, does Grant, Bargain, Sell, Convey, and Warrant to said party of the second part an Easement in perpetuity for watermain purposes, including the right to enter for the purpose of constructing, maintaining, altering, repairing, and reconstructing a watermain in, under and over the following described property situate in the County of Hennepiff and State of Minnesota, to -wit: Easements for water main over and across Lot 1, Block 1; Lot 1, Block 2; FINDELL SECOND ADDITION, and over and across all that part of Amundson Avenue, now or hereafter vacated, lying within the plat of said FINDELL SECOND ADDITION, said easements being 10 feet in width, the centerlines of whirl are described as follows: Beginning at a point on the Southerly extension of the East line of Lot 2, Block 1; FINDELL SECOND ADDITION distant 17 feet South of the Southeast corner of said Lot 2, Block 1; thence South 89 degrees 55 minutes 19 seconds West, par- allel with the South line of said Lot 2, Block 1, a distance of 295.0 feet; thene-6 Soutl 60 degrees 25 minutes 10 seconds West, 49.33 feet;; thence South 39 degrees 55 minutes 1`' seconds West, 15.00 feet to a point at which the centerline extends additionally at rig! angles North a distance of 25.00 feet and there terminates; thence continuing from a- foresaid point South 89 degrees 55 minutes 19 seconds.West, 202.43 feet; thence North 4` degrees-04 minutes 41 seconds West, 68,,00 feet; thence South 65 degrees 16 minutes 06 seconds West, 46.00 feet to a point at which the centerline extends additionally at rigl angles Northwesterly 21 feet and there terminates; thence continuing from aforesaid poi- South 65 degrees 16 minutes 06 seconds West, 143.59 feet to the Westerly line of said L( 1, Block 1 and there terminating, the Northerly and Southerly lines of said 10 foot easement to be lengthened or shortened accordingly to terminate on said Westerly line. Also an easement for water main 10 feet in width the centerline of which begins at a po. on the North line of Lot 1, Block 1, FINDELL ,SECOND ADDITION, distant 20 feet West of tl Northeast corner of said Lot 1; thence South O degrees 09 minutes 30 seconds West, par- allel with the East line of said Lot 1, a distance of 150.54 feet; to terminate on the centerline of previously described water main easement. Also an easement for watermain, being 10 feet in width, the centerline of which is des- cribed as follows: Commencing at a point on the Southerly extension of the East line o' Lot 2, Block 1, FINDELL SECOND ADDITTON distant 1.7 feet South of the Southeast corner of said Lot 2, Block 1; thence South 89 degrees 55 minutes 19 seconds West, parallel with South line of said Lot 2, Block 1,, a distance of 124.0 feet to the actual point of be- ginning; thence South 0 degrees 04 minutes 41 seconds East, 69.0 feet; thence South 28 degrees 55 minutes 19 seconds [Jest, 17.0 feet and there terminating. It is the intention and agreement of the Parties hereto that the party of the second part shall in the construction, or maintenance of said water main replace any shrubs or sod removed by and any blacktop or concrete surfacing damaged or removed by, any excavation in connection: with such construction or maintenance work, in as nearly as possible the 4 2 (Continued, Easement for Watermain) awe condition as before such excavation.
