REQUEST TO TRANSFER ASSESSIP/11ENTS
1. The undersigned, LAUKKA & ASSOCIATES, INC.,
a Minnesota corporation, is presently the owner of lands
legally described as Outlot "B ", Dewey Hill Second Addition,
according to the plat thereof on file or of record in the
office of the Registrar of Titles, Hennepin County, Minnesota
(hereinafter, " Outlot 'B'"
2. The undersigned, FIRST EDINA NATIONAL BANK,
a national banking association, is presently the record
owner and holder of a mortgage dated April 14, 1978, recorded
April 14, 1978, as Document No. 1268161, files of the Registrar
of Titles, Hennepin County, 'Minnesota, from Laukka & Associates,
Inc., securing the original amount of $1,755,500, which mortgage
is a lien against Outlot "B" and other lands.
3. The undersigned, LAUKKA & ASSOCIATES, INC.,
and FIRST EDINA NATIONAL BANK, herewith jointly make request
to the City of Edina and its City Council ( "City "), pursuant
to Minn. Stats. 429.071, Subd. (3)
(a) that the City so transfer and apportion
special assessments currently levied
against lands in Dewey Hill Second Addition
in such manner that two- thirdsof the
outstanding amount thereof shall be
divided equally between and remain a
lien against individual platted lots
in Dewey Hill Second Addition (said
lots being more particularly described
as Lots 1 through 16, inclusive, Block 1;
Lots 1 through 4, inclusive, Block 2;
and Lots 1 through 28, inclusive, Block
3, Dewey Hill Second Addition) and one-
third of the outstanding amount thereof
shall be and remain a lien against
Outlot "B "; and

(b) that the City transfer and apportion all
special assessments presently pending
against lands in Dewey Hill Second
Addition entirely to Outlot "B
4. The undersigned, and each of them, herewith
jointly and severally waive any and all claim that any
special assessments as to which transfer or apportionment
have been requested herein have been unfairly or unequally
levied, assessed or apportioned between and among the re-
spective properties described herein and jointly and severally
waive any and all claim that such special assessments have
been levied, assessed or apportioned with respect to any
property herein described- in an amount greater than the
benefit received by such property from the improvement or
improvements to which such assessments relate.
5. Special assessments presently levied against
Dewey Hill Second Addition total $69,952.62 and pending
special assessments against Dewey Hill Second Addition total
$73,567.60. The nature of the assessments is as set forth
on the attached assessment search marked Exhibit "A" and
incorporated herein by this reference.
IN WITNESS WHEREOF, the parties have executed this
request to transfer assessments this F//) day of of May, 1979.
