EASEMENT FOR PUBLIC
UTILITY PURPOSEb
THIS INSTRUMENT, Ma _ today of May, 1984, by
and between WALLACE B. KENNETH and JEAN M. KENNETH, husband and
rife, of the County of Hennepin and State of Minnesota, parties
of the first part, and the CITY OF EDINA, a municipal
corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part,
An consideratin of One Dollar ($1.00) to them in hand paid by
the said party of the second part, the receipt whereof is
,hereby acknowledged, do Grant, Bargain, Sell, Convey and
*hmverrtt to said party of the second part an Easement in
perpetuity for all utility and drainage purposes. including,
but not being limited to, sanitary sewer, storm sewer, and
water pipes, including the right to enter for the purpose of
constructing, maintaining, altering, repairing and
reconstructing said utility and drainage systems and pipes in,
on, under and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wit:
(i) Those parts of Lots 34 and 35, Block 1, that part :1f
Lot 2, Block 2, that part of Outlot A, and that part
of Lincoln Drive, all in the recorded plat of
INTERLACHEN HILLS 3RD ADDITION, being a 30.00 foot
strip of land, and being 10.00 feet westerly of, and
20.00 feet easterly of the following described lines
Commencing at the southwest corner of said Lot 34,
Block l; thence on an assumed bearing of North 89
degrees, 48 minutes 41 seconds East, along the south
line of said Lot 34, Block 1, a distance of 145.73
feet to the point of beginning of the line being
described; thence North 0 degrees 11 minutes 49
seconds West, a distance of 442.00 feet; thence North
38 degrees 25 minutes 49 seconds West, a distance of
40.00 feet and there terminating; and
(ii) That part of Lot 34, Block 1, INTERLACHEN HILLS 3RD
ADDITON, according to the recorded plat thereof, lying
easterly of the east line of the land described in (i)
above and westerly of the west line of Lincoln Drive.
This deed is exempt from payment of state died-stamps..
pursuant to Minnesota-Statutes Section 287.22.
