GRANT
(Heritage Preservation District)
THIS GRANT, Made and entered into this -2-6 day
of JU 1987, between PHILIP F. CAMPBELL and JANE H.
CAMPBELL, husband and wife (hereinafter called "Owners "),
and the CITY OF EDINA, a municipal corporation under the
laws of the State of Minnesota (hereinafter called "Edina ").
WITNESSETH, THAT:
WHEREAS, Owners are the fee simple record owners
of the property situated in the City of Edina, County of
Hennepin, and State of Minnesota described as follows:
Lot 2, except the West 5 feet thereof, Block 1,
"Beverly Hills Second Addition," according to the
recorded plat thereof on file or of record in the
office of the Registrar of Titles in and for Hennepin
County, Minnesota,
(hereinafter called the "Subject Property "); and
WHEREAS, the Subject Property and the buildings,
structures and improvements thereon (all hereinafter called
the "Improvements ") are of great historical value and importance
to Edina and the State of Minnesota; and
WHEREAS, it is important and desirable that the
Subject Property and Improvements, having such historical
value, be retained in their present condition, and Owners
and Edina are both desirous of having the Subject Property
and Improvements preserved as an hi3toric site in their present
condition; and
WHEREAS, to so preserve the Subject Property and
Improvements, the Subject Property has been transferred by
Edina to the Heritage Preservation Overlay District (the
"District ") pursuant to Ordinance No. 825 (the "Zoning
Ordinance "), and Owners desire to evidence of record their
agreement with such transfer and the subjecting of the Subject
Property to the terms, provisions and requirements of the
District as set out in the Zoning Ordinance, as now or hereafter
amended.
NOW, THEREFORE, for and in consideration of One
dollar ($1.00) and other good and valuable consideration,
in hand paid by Edina, the receipt and sufficiency of which
is hereby acknowledged by Owners, and in order to accomplish
and assure the preservation of the Subject Property and
Improvements as an historic site in their present condition,
Owners do hereby agree and consent to the transfer of the
Subject Property to the District and to the subjecting of
the Subject Property to the terms, provisions and requirements
of the District as set out in the Zoning Ordinance as now
or hereafter amended, including, without limitation, the
requirement that permits be obtained before certain specific
work, as set out in the Zoning Ordinance, is done on or to
the Subject Property, or in, on or to the Improvements.
The terms and provisions hereof shall run with
the land and shall be binding on all present and future owners
of the Subject Property, and shall inure to the benefit of
Edina, its successors and assigns.
IN TESTIMONY WHEREOF, Owners have caused these
presents to be executed the day and year first above ritten.

Philip F. Campbell and Jane H. Campbell, husband and wife,
to me known to be the persons described in and who executed
the foregoing instrument, and acknowledged that they executed
the same as their free act and deed.
