by and between
WALLY IRWIN CONSTR., INC.,
a corporation under the laws of the State of Minnesota, party of the
first part, and the City of Edina, a municipal corporation organized
under the laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said party of the first part, in con-
sideration of One and No /100 Dollars ($1.00), to it in hand paid by
the said party of the second part, the receipt whereof is hereby
acknowledged, do Grant, Bargain, Sell,Convey, and Warrant to said
party of the second part an Easement in perpetuity for storm water
detention basin purposes and /or holding pond, including the right
to enter for the purpose of constructing, maintaining, altering,
repairing and reconstructing a storm water detention basin and /or
holding pond system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota,
to -wit:
That part of Lot 16, Block 3, Killarney Shores, described
as follows:
Commencing at the most Northerly corner of said Lot 16,
said point being the beginning of the parcel to be
described; thence Southeasterly along the Easterly line
25.00 feet; thence South 62 degrees 22 minutes 58 seconds
West. 48.60 feet to the West line of said Lot 16; thence
North along the West line 10.11 feet to the most Westerly
corner of said Lot 16; thence Northeasterly along the
Northerly line 39.98 feet to the Northeast corner of said
Lot 16 and there terminating.
The Grantor, for itself, its heirs, executors, succes-
sors and assigns, does hereby covenant and agree that the above -
described property will be and remain as a part of a storm rater
detention basin for the drainage and storage of surface waters and
that it and they will not fill the same nor will it and they in
any manner attempt to change the grade level of the same nor
interfere with the natural drainage, flowage and storage of sur-
face water into or on the above - described property.
