EASEMENT FOR STORM WATER DETENTION BASIN
THIS INSTRUMENT, Mare this 3rd day of May , 19 88,
by and between Harry M Rogers and K ; t; Rogers Husband and-Wife
, of the County of Hennepin
and State of Minnesota, parties of the first part, and the City of
Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do Grant, Bargain, Sell, Convey, and Warrant
to said party of the second part an Easement in perpetuity for storm
water detention basin purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and recon-
structing a storm water detention basin system in, under, and over
the following described property situate in the County of Hennepin
and State of Minnesota, to -wit:
For Lot 15, Block 3, Killarney Shores
Commencing at the Northwest corner of said Lot 15, Blk 3 said
point being the beginning of the parcel to be described; thence East along the
North line of said Lot 15 26.80 feet; thence South 39 degrees 19 minutes 39
seconds West 53.46 feet to the Southerly line of said Lot 15; thence North-
westerly along the Southerly line 25.00 feet to the Southwest corner of Lot 15;
thence Northeasterly along the North line 38.33 feet to the Northwest corner
of said Lot 15 and there terminating.
The Grantors, for themselves, their heirs, executors, sucessors
and assigns do hereby covenant and agree that they will permit the above described
property to remain as a part of a storm water detention basin for the drainage
and storage of surface waters and that they will not fill the same nor will they
in any manner attempt to change the grade level of the same nor interfere with the
natural drainage, flowage and storage of surface water on the above described
property.
