DRAINAGE AND
UTELITY EASEMENT
THE UNDERSIGNED, Parkwood Knolls Construction Company, a Minnesota
corporation ( "Grantor "), for valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, hereby grants and conveys unto City of Edina, a Minnesota municipal
corporation ( "Grantee "), an easement permitting Grantee, its successors and assigns, to
construct, operate, maintain, repair and replace underground utility lines, including storm sewer,
water and sanitary sewer, upon, and to direct surface drainage over and across, the following
described real property that is owned by Grantor (collectively, the "Burdened Property"):
Outlot One and Outlot Two, Parkwood Knolls 9th Addition,
Hennepin County, Minnesota, according to the plat thereof that is
of record in the office of the Hennepin County Recorder.
Grantee and its successors and assigns shall be required, at its sole cost and expense, to
repair and replace any landscaping or other improvements that may be situated upon the
Burdened Property and that may be damaged by reason of any such construction, operation,
maintenance, repair, replacement or other use of such easement by Grantee. This easement shall
run with title to the Burdened Property and inure to the benefit of Grantee and its successors and
assigns.
