HomeMy WebLinkAbout2544COPY 3454266 PUBLIC STREET, SIDEWALK, AND UTILITY EASEMENT THIS INDENTURE, made this 1944 day of 040,41 , 2001, by and between the City of Edina hereinafter referred to as "Grantee ", and Rovick Realty Company, a Minnesota General Partnership, hereinafter referred to as "Grantor ", located in Hennepin County, State of Minnesota. WITNESSETH: WHEREAS, Grantor is the owner in fee simple of the real estate hereinafter described. That for in consideration of the sum of Forty Five Thousand Two Hundred Twenty Five and no /100 Dollars ($45,225.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, Grantor has this day bargained and sold, and by these presents does bargain, sell and transfer unto the City of Edina, its successors and assigns the following: A perpetual non - exclusive easement for public street, sidewalk and utility purposes with the right to enter upon the real estate hereinafter described at any time that Grantee may see fit, and construct, maintain and repair any materials, or other items for public sidewalk purposes, for the purpose of maintaining, repairing or replacing said public street, sidewalk and utility over, under, across and through the land hereinafter described, together with the right to excavate for the location of said public street, sidewalk and utility, and the further right to remove trees, bushes, undergrowth, and other obstructions interfering in the location, construction and maintenance of said public street, sidewalk and utility. That said public sidewalk easement located in the City of Edina, Hennepin County, State of Minnesota, is described as follows, to -wit: s �.
