PUBLIC STREET, SIDEWALK,
AND UTILITY EASEMENT
THIS INDENTURE, made this ?"'day of , 2001, by
and between the City of Edina hereinafter referred to as " tee ", and Lloyd S. Sorem and
Fidelity Bank Contract Seller, and John O. Murrin, III and DeVonna K. Murrin, Contract
Purchaser, hereinafter referred to as "Grantor ", located in Hennepin County, State of
Minnesota.
WITNESSETH:
WHEREAS, Grantor is the owner in fee simple of the real estate hereinafter described.
That for in consideration of the sum of Twenty Five Thousand Two Hundred and no /100
Dollars ($25,200.00) and other good and valuable consideration, the receipt of which is hereby
acknowledged, Grantor has this day bargained and sold, and by these presents does bargain, sell
and transfer unto the City of Edina, its successors and assigns the following:
A perpetual non - exclusive easement for public sidewalk purposes with the right to enter
upon the real estate hereinafter described at any time that Grantee may see fit, and construct,
maintain and repair any materials, or other items for public sidewalk purposes, for the purpose of
maintaining, repairing or replacing said public sidewalk over, under, across and through the land
hereinafter described, together with the right to excavate for the location of said public sidewalk,
and the further right to remove trees, bushes, undergrowth, and other obstructions interfering in
the location, construction and maintenance of said public sidewalk.
That said public sidewalk easement located in the City of Edina, Hennepin County, State
of Minnesota, is described as follows, to -wit:

Made a part thereof.
TO HAVE AND TO HOLD, said perpetual easement and rights -of -way unto the City of
Edina, Hennepin County, State of Minnesota, its successors and assigns, forever.
Grantor does hereby covenant with the City of Edina, that it is lawfully seized and
possessed of the real estate above described.
IN WITNESS WHEREOF, the said parties have caused this instrument to be executed the
day and year first above written.

ROPERTY DESCRIPTION:
Lot 1, Block 1, SOUTHDALE OFFICE PARK SECOND ADDITION, according to the recorded
plat thereof
EASEMENT DESCRIPTION:
A perpetual easement for roadway and utility purposes over, under, across and through part of the
following described property:
Lot 1, Block 1, SOUTHDALE OFFICE PARK SECOND ADDITION, according to the
recorded plat thereof.
Said perpetual easement is described as beginning at the southeast corner of said Lot 1; thence
North 0 degrees 23 minutes 53 seconds West, assumed bearing, along the east line of said Lot 1
to the intersection with a line run parallel with and distant 5.0 feet northerly of the south line of
said Lot 1; thence westerly along said parallel line a distance of 111.59 feet; thence North 80
degrees 30 minutes 12 seconds West, a distance of 67.91 feet to the intersection with a line run
parallel with and distant 5.0 feet northeasterly of the southwesterly line of said Lot 1; thence
northwesterly along said parallel line a distance of 35.80 feet; thence southwesterly along a line
