GRANT OF EASEMENT
IN CONSIDERATION OF THE SUM OF ONE DOLLAR AND OTHER VALUABLE
CONSIDERATION, the receipt and sufficiency of which is hereby acknowledged, Norman.M.
Jones and Eunice M. Jones, husband and wife ( "Grantors ") hereby grant to James L. Ecker
and Joan M. Ecker, husband and wife, ( "Grantees ") and Grantees' successors and assigns, a
perpetual easement for drainage and drainage control structure maintenance purposes over, under
and across real property of the Grantors situated in the City of Edina, Hennepin County,
Minnesota, and legally described as follows:
Beginning at the southwesterly corner of Lot 6, -Block 1, INTERLACHEN
BLUFF, 'thence South 58 degrees 40 minutes 40 seconds East, bearing
oriented to said plat of INT'ERLACHEN BLUFF, along the southwesterly line
of said Lot 6, a distance of 47.71 feet, more or less, to an angle point in said
line; thence East along the southerly line of said Lot 6, a distance of 124.18
feet, more or less, to the southeasterly corner thereof; thence North -70
degrees - West 73.10 feet; thence West,-51.29 feet; thence North 70 degrees
West 41.53 feet, more or less, to the westerly line of said Lot 6; thence
southerly along said westerly line 15.63 feet, more or less, to the point of
beginning.
This easement contains 3071 square feet, more or less, subject to drainage and
utility easements heretofore dedicated on said plat of INTERLACHEN BLUFF.
to maintain, repair and replace the earthen mound or berm, together with the landscaping
thereon, in the location the same were initially constructed or installed. This easement benefits
Grantees' property, legally described as follows:
Lot 5, Block 19 IN'M- RLACHEN BLUFF,. Hennepin County, Minnesota.
It is understood by and between Grantors, Grantees and their respective successors and
assigns that:
1. Indemnification
Grantees will. protect and save and keep the Grantors forever harmless and indemnified
against and from any and all claims, loss, cost, damage or expense arising out of or from
Grantees' use of this easement.
2. Maintenance
Grantees will maintain this easement including the associated earthen mound or berm and
landscaping thereon, in a manner compatible with Grantors' residential use of said Lot 6, and
Grantees shall have the right of reasonable access across the property of Grantors adjacent
thereto for such purpose.
3; Termination
This easement will terminate in the, event that it is no longer being used by Grantees for
'ihe drainage purposes for which it is intended. Grantors and Grantees agree to execute whatever
documents or instruments which may be required or necessary to terminate this easement of
record upon such occurrence.
THIS EASEMENT shall run with the land and shall be binding upon the respective heirs,
successors and assigns of the parties hereto.
IN WITNESS. WHEREOF, the parties hereto have caused these presents to be executed
