LTD, a Minnesota General Partnership, hereinafter referred to as "Grantor ", located in
Hennepin County, State of Minnesota.
WITNESSETH:
WHEREAS, Grantor is the owner in fee simple of the real estate hereinafter described.
That for in consideration of the sum of Five Hundred Fifty and no /100 Dollars ($550.00)
and other good and valuable consideration, the receipt of which is hereby acknowledged, Grantor
has this day bargained and sold, and by these presents does bargain, sell and transfer unto the
City of Edina, its successors and assigns the following:

AND TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTURE, made this day of 2002, by
and between the City of Edina hereinafter referred to as "Grantee ", and William J Hargis,
hereinafter referred to as "Grantor ", located in Hennepin County, State of Minnesota.
WITNESSETH:
WHEREAS, Grantor is the owner in fee simple of the real estate hereinafter described.
That for in consideration of the sum of Twenty Five Thousand One Hundred Ninety and
no /100 Dollars ($25,190.00) and other good and valuable consideration, the receipt of which is
hereby acknowledged, Grantor has this day bargained and sold, and by these presents does
bargain, sell and transfer unto the City of Edina, its successors and assigns the following:
A perpetual non - exclusive easement for public street, sidewalk and utility purposes with
the right to enter upon the real estate hereinafter described at any time that Grantee may see fit,
and construct, maintain and repair any materials, or other items for public purposes over, under,
across and through the land hereinafter described, together with the right to excavate for the
location of said public street, sidewalk and utility, and the further right to remove trees, bushes,
undergrowth, and other obstructions interfering in the location, construction and maintenance of
said public street, sidewalk and utility.
"It is the intention and agreement of the parties hereto that the Grantee shall in the
construction and maintenance of the public right of way, public utilities and public sidewalk
within easement areas, repair and replace all damage to any landscaping, private utilities, curbs,
driveways and improvements in connection with such construction and maintenance work, tias
nearly as possible the same condition as before such construction and maintenance."
