NOTICE OF COMPLETION OF PROCEEDINGS ON VACATION OF
PUBLIC UTILITIES AND DRAINAGE (ARROWHEAD POINTE)
PURPOSES IN THE CITY OF EDINA, HENNEPIN COUNTY, MINNESOTA
NOTICE IS HEREBY GIVEN that the City Council of Edina, Hennepin County, Minnesota, on
November 19, 2002, adopted a Resolution Vacating the Easement for Public Utilities after public
hearing and notice thereof as required by law and after determining it to be in the best interest of
the City and of the public that said easement vacation be made, which resolution ordered the
vacation of the following described easement for public utility purposes:
That part of the drainage and utility easement within Lot 3, Block 1, Arrowhead Pointe,
according to the recorded plat, Hennepin County, Minnesota, described as follows:
Commencing at the northwest corner of said Lot 3; thence on an assumed bearing of
South 14 degrees 44 minutes 00 seconds East along the southwesterly line of said Lot
3, a distance of 125.00 feet; thence North 55 degrees 04 minutes 45 seconds East a
distance of 44.92 feet to the point of beginning of easement area to be vacated; thence
continue North 55 degrees 04 minutes 45 seconds East, a distance of 24.34 feet;
thence South 14 degrees 44 minutes 00 seconds East 8.40 feet; thence South 75
degrees 16 minutes 00 seconds West 22.84 feet to the point of beginning.
The time of completion of proceedings and the effective date of said vacation is 19th day of November 2002.

EASEMENT FOR DRAINAGE AND UTILITY PURPOSES
THIS INSTRUMENT, made this 2-3 day of 2004, by and
between John L. Sabre and LAt 1\t y- sole -KE , husband and wife, of the County of
Hennepin and State of Minnesota, parties of the first part, and the City of Edina, a municipal
corporation organized under the laws of the State of Minnesota, party of the second part;
WITNESSETH, that the said parties of the first part, in consideration of One and
No /100 Dollars ($1.00), to them in hand paid by the said party of the second part, the receipt
whereof is hereby acknowledged, do grant, bargain, sell, convey and warrant to said party of
the second part an easement in perpetuity for drainage and utility, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and reconstructing drainage
and utilities in, under, and over the following described property situate in the County of
Hennepin and State of Minnesota, to wit:
Said easement is described as follows:
That part of Lots 2 and 3, Block 1, MARK DALQUIST ADDITION, which lies easterly of
the East line of the West 7.50 feet of said Lots 2 and 3, westerly of a line drawn parallel
with and 10.00 feet westerly of the right of way line of Harold Woods Lane, as said Lane
is dedicated to the public in said MARK DALQUIST ADDITION, and which lies within
10.00 feet on each side of the following described line: Commencing at the most
southerly corner of said Lot 3; thence on an assumed bearing of North 0 degrees 28
minutes 37 seconds West a distance of 49.65 feet to the point of beginning of the line

being described; thence North 89 degrees 31 minutes 08 seconds East to its intersection
with said westerly right of way line, and said line there terminating.
It is the intention and agreement of the parties hereto that the party of the second
part shall in the construction, or maintenance of said drainage and utility easement, replace
any shrubs or sod removed by any excavation in connection with such construction or
maintenance work, in as nearly as possible the same condition as before such excavation, but
not including any landscaping improvements made by the party of the first part.
IN WITNESS WHEREOF, the said parties of the first part have hereunto set their
hands the day and year first above written.
