EASEMENT FOR ROADWAY RIGHT -OF -WAY UTILITY PURPOSES
THIS INSTRUMENT, made this L�day of � &( P r , 2005, by
Carlson Custom Homes Inc., a corporation under the law of the State of Minnesota, party
of the first part, and the City of Edina, a municipal corporation organized under the laws of
the State of Minnesota, party of the second part;
WITNESSETH, that the said parties of the first part, in consideration of One and
No /100 Dollars ($1.00), to them in hand paid by the said party of the second part, the
receipt whereof is hereby acknowledged, do grant, bargain, sell, convey and warrant to
said party of the second part an easement in perpetuity for roadway right -of -way purposes,
in, under, and over the following described property situate in the County, including the
right to enter for the purpose of constructing, maintaining, altering, repairing and
reconstructing drainage and utilities in, under, and over the following described property
situate in the County of Hennepin and State of Minnesota, to wit:
An easement for Roadway right -of -way purposes over, under and across
that part of LOT 32 AUDITOR'S SUBDIVISION NUMBER 325, HENNEPIN
COUNTY, MN, is described as follows:
Beginning at the Southeast corner of the NE %., Section 30, Township 117
North, Range 21 West, Hennepin County, MN; thence South 86 degrees 08
minutes 27 seconds West along the north line of said Lot 32 and being the
South line of said NE Y4 a distance of 408.97 feet to the Southwesterly
right-of-way line of lnterlachen Boulevard per plat of D.C.I. ADDITION,
HENNEPIN COUNTY, MN; thence Southeasterly a distance of 140.89 feet
along the arc of a non - tangential curve that has a radius of 750.00 feet, a
central angle of 10 degrees 45 minutes 48 seconds and a chord that bears
South 85 degrees 25 minutes 20 seconds East; thence North 87 degrees 48
minutes 39 seconds East, a distance of 268.11 feet to the East line of said
Lot 32; thence North 00 degrees 13 minutes 18 seconds West, a distance of
28.51 feet to the point of beginning.
Subject to easements of record, if any.
