Sheldon and Cheryl S. Sheldon, husband and wife of the County of Hennepi , State of Minnesota (hereinafter called the "Owners ") whose address is 5308 Broo iew Avenue, and the City of Edina, a municipal corporation organized under the la s of the State of Minnesota, party of the second part ( "Edina "): WITNESS TH, that the said parties of the first part, in consideration of One and No /100 Dollar ($1.00), to them in hand paid by the said party of the second part, the receipt where f is hereby acknowledged, do grant, bargain, sell, convey and warrant to said party of the second part an easement in perpetuity for utility purposes in, under, and over th following described property (the "Property ") situate in the County of Hennepin and State of Minnesota, to -wit: A permanent easement for Utility Purposes is described as follows: That part of Lot , Block 6, "South Harriet Park, Hennepin County, Minnesota ", according to the recorded plat thereof Hennepin County, Minnesota. Said easement is desc ibed as the south 10 feet of said Lot. 1 It is the intention and agreement of the parties hereto that the party of the second part shall pay all costs of construction of the utilities including, without limitation, the costs of restoration of any irrigation, sod, vegetation or tree replacement, and pavement replacement that is disturbed in conjunction with said construction and from Edina's maintenance, repair, and replacement of the utilities and from future construction of such utilities.
