Since my stepmother lives out of state she has asked me to attend to all of the closing requirements. When I asked her Realtor at Edina Realty to take a "dry run" through the closing documents, Commonwealth Land Title Insurance Company raised the following issue: "Document #6082116, which has been recorded in the Abstract Department, indicates that the alley and /or street adjacent to the land has been vacated. In order to have this vacation included on the Certificate of Title, an Examiner's Directive must be obtained. Contact the Hennepin County Torrens Department for assistance in resolving this matter." I contacted the Hennepin County Torrens Department, who assigned Beth, one of their Examiners. She told me that she needs us to provide her with certified copy of the City of Edina's Resolution of April 5, 1993. After several trips to the Hennepin County Government Center and one trip to the Edina City Hall, Hennepin County finally concluded that what happed is that the City of Edina recorded a Notice of Completion of Proceedings, document 46082116 (a copy of which is enclosed herewith, but never recorded the Resolution relating to that Notice of Completion of Proceeding document. The City of Edina needs to record that resolution. Once that resolution has been recorded then I can obtain a certified copy of that document from the Document Department, which is located on the 5tl' floor, A -Tower of the Hennepin County Government Center. It is my understanding that this Title defect applies not only to the property at 5020 Oxford Avenue but also to the adjoining properties. Civil Trial Specialist.
