EASEMENT FOR UTILITY PURPOSES
THIS INSTRUMENT, made this ` day of U%'r-f , 2006, by
and between Independent School District 273, party of the first part and the City of Edina, a
municipal corporation organized under the laws of the State of Minnesota, party of the second
part ( "Edina "):
WITNESSETH, that the said parties of the first part, in consideration of One and
No /100 Dollars ($1.00), to them in hand paid by the said party of the second part, the receipt
whereof is hereby acknowledged, do grant, bargain, sell, convey and warrant to said party of
the second part an easement in perpetuity for utility purposes in, under, and over the following
described property (the "Property ") situate in the County of Hennepin and State of Minnesota,
to -wit:
A 5.00 foot permanent easement for underground Utility Purposes over,
under and across that part of the following property.
That part of the Northwest Quarter of the Southwest Quarter of Section 19,
Township 28, Range 24, Hennepin County, Minnesota, lying south of the north
25.00 acres and lying north of the north line of SOUTH CONCORD 2ND ADDITION,
Hennepin County, Minnesota and which lies easterly of the east line of SCHOOL
MANOR, Hennepin County, Minnesota; excepting there from roads.
The westerly line of said easement is described as follows: Beginning at the
northeast corner of Lot 1, Block 1, said SCHOOL MANOR, Hennepin County,

Minnesota; thence southerly along the easterly line of said Block 1 and its
southerly extension to the southerly line of the above described land and said line
there terminating. The side lines of said easement are to terminate on the south
line of said north 25.00 acres and the north line of said South Concord 2"d
Addition, Hennepin County, Minnesota.
It is the intention and agreement of the parties hereto that the party of the second part shall pay all
costs of construction of the utilities including, without limitation, the costs of restoration of any
irrigation, sod, vegetation or tree replacement, and pavement replacement that is disturbed in
conjunction with said construction and from Edina's maintenance, repair, and replacement of the
utilities and from future construction of such utilities. It is also the intention that the utilities shall be
placed 5.0 feet below the existing surface.
IN WITNESS WHEREOF, the said parties of the first part have hereunto set their hands the day
