FIRST SUPPLEMENTAL DECLARATION
WHEREAS, SELA INVESTMENTS, LTD., LLP, a limited liability partnership under the
laws of the State of Minnesota (hereinafter referred to as "Declarant "), filed for record on
December 28, 2006, a Declaration of Common Interest Community ( "Declaration ") for France Way
Condominiums, Common Interest Community ( "CIC ") Number 1731, as Document No.4341756,
files of the Hennepin County Registrar of Titles; and
WHEREAS, the Declarant, under Section 17 of the Declaration, reserved an option
pursuant to Section 515B.2- 106(1) of the Minnesota Common Interest Ownership Act (hereinafter
"Act ") to add additional real estate, in the manner set forth in Section 51513.2 -111 of the Act and
said Section 17, said additional real estate being legally described on Exhibit "A" hereto; and
WHEREAS, the period of Declarant control has not yet terminated; and
WHEREAS, Declarant desires to subject that part of said real property described on Exhibit
"B" attached hereto (the "Property ") to the terms of the Declaration and otherwise add the Property
to the CIC, pursuant to Section 515B.2 -111 of the Act; and
WHEREAS, upon the addition of the Property to the CIC by this First Supplemental
Declaration of Common Interest Community Number 1731 ("First Supplemental Declaration'), the
legal description of real estate which Declarant may (but need not), under Section 17 of the
Declaration, add at future times to the CIC, is that set forth on Exhibit "C," attached hereto.
NOW, THEREFORE, Declarant hereby declares that the Property described on Exhibit "B"
is and hereafter shall be subject to the tenns, declaration, covenants; conditions, easements,
charges, and liens set forth in the Declaration and the Bylaws. This First Supplemental Declaration
is made upon the following further terms and conditions:
1. Definitions. Terms used herein shall have the same meanings as in the Declaration;
unless the context otherwise requires.
2. Contents of Amendment Required by Section 515B.2- 111(a) of the Minnesota
Common Interest Ownership Act. The following terms and conditions of this First Supplemental
Declaration are set forth pursuant to the requirements of Section 515B.2 -111 of the Act:
(a) Description of Real Estate Added by this First Supplemental Declaration and
Assignment of Unit Identifier for Each Unit Formed in the Property. The units to be
formed in the Property (hereinafter "Additional Units ") are identified as Units 101A
through 106A, inclusive, and 207A through 212A, inclusive, and Unit G14, which
Additional Units are more particularly described on the First Supplemental CIC Plat,
CIC Number 1731 for the Property filed contemporaneously herewith in the office
of the Hennepin County Registrar of Titles ( "First Supplemental CIC PIat ");
(b) Description of Boundaries of Additional Units Created. The boundaries of each
Unit shall be the interior unfinished surfaces of its perimeter walls, floors and
ceilings. Wallpaper, paneling, tiles and other finishing materials adhered to the
interior of the Unit boundaries shall be a part of the Unit; provided, that any load
bearing portions of any interior or perimeter walls, columns, ceilings or floors, and
any common utility lines or other common facilities located in or passing through a
Unit, shall be Common Elements. The boundaries of each Unit shall also extend
along the inside unfinished surfaces of its perimeter doors and windows, and their
frames, and said perimeter doors, windows and frames, and their hardware, shall be
deemed to be Limited Common Elements appurtenant to such Unit. Subject to
Section 2.2 and Section 3.2 of the Declaration, all spaces, interior partitions, and
other fixtures and improvements within the boundaries of a Unit are a part of the
Unit.
(c) Additional Common Elements of CIC. Additional Common Elements added to the
CIC, if any, are as shown on the First Supplemental CIC Plat.
(d) Reallocation of Common Element Interests. Votes in the Association and Common
Expense Liabilities According to Section 515B.2 -108 of the Act. The reallocation of
common element interests, votes in the Association and common expense liabilities
of all Units in the CIC, including the Additional Units, shall be as set forth on
Exhibit "D" attached hereto.
(e) Description of Delineation of Any Limited Common Elements Formed Out of the
Property. A portion of the Common Elements in the Property is hereby set aside and
allocated for the exclusive use of one or more but fewer than all of the Additional
Units, in the manner set forth hereinafter in this First Supplemental Declaration, said
areas to be known as "Limited Common Elements." The Limited Common Elements
allocated for the exclusive use of the respective Additional Units are as follows:
i) Chutes, Flues, Etc. If any chute, flue, duct, pipe, wire, conduit,
bearing wall, bearing column, or any other fixture lies partially within
and partially outside of the designated boundaries of a Unit, any

portion thereof serving only that Unit is a Limited Common Element
allocated solely to that Unit, and any portion thereof serving more
than one Unit or any portion of the Common Elements is a part of the
Common Elements, all as provided in Section 515B.2- 102(d) of the
Act.
iii) Doors, Windows, Balconies, Air Conditioners, Etc. All exterior
doors and windows and any shutters, awnings, window boxes,
doorsteps, stoops, sidewalks, porches, balconies, patios, decks,
courtyards, perimeter doors and windows, air conditioners or other
improvements constructed as part of the original construction to
serve a single Unit and authorized replacements and modifications
thereof, but located outside the Unit's boundaries, are Limited
Common Elements allocated exclusively to that Unit, all in
accordance with Section 515B.2- 102(1) of the Act, except that
structural elements of- porches and balconies shall be Common
Elements.
3. Other Additional Real Estate Not Affected. This First Supplemental Declaration
shall not apply to or affect any real estate described in Section 17 of the Declaration other than that
described on Exhibit "B" hereto. The right of the Declarant to add further additional real estate,
legally described as set forth on Exhibit "C" hereto, to the CIC under such Section 17 is not
modified by this First Supplemental Declaration.
4. All other Terms. Covenants. and Conditions Applicable to the Property. All of the
terms, covenants, and conditions set forth in the Declaration and Bylaws shall apply to the Property
and shall otherwise be and remain unmodified hereby.
