GRANT OF PERMANENT EASEMENT
FOR PUBLIC DRAINAGE & UTILITY PURPOSES
PARKWOOD KNOLLS CONSTRUCTION COMPANY, a Minnesota corporation,
hereinafter referred to as "Grantor", in consideration of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby
grant unto the CITY OF EDINA, a municipal corporation organized under the laws of the State of
Minnesota, the Grantee, hereinafter referred to as the "City", its successors and assigns, forever,
a permanent easement for public drainage and utility purposes over, across, on, under, and
through land situated within the County of Hennepin, State of Minnesota, as described on the
attached Exhibit "A ".
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the easement premises at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systems over, across, on, under, and through the
easement premises, together with the right to grade, level, fill, drain and excavate the easement
premises, and the further right to remove trees, bushes, undergrowth, and other obstructions
interfering with the location, construction, and maintenance of said public drainage and utility
systems.

The above named Grantor, its successors and assigns, does covenant with the City, its
successors and assigns, that it is well seized in fee title of the above described easement
premises; that it has the sole right to grant and convey the easement to the City; that there are no
unrecorded interests in the easement premises; and that it will indemnify and hold the City
harmless for any breach of the foregoing covenants.

EASEMENT DESCRIPTION
A permanent easement for public drainage and utility purposes over, across, on under and
through that part of Lot 2, Block 1, Parkwood Knolls Cougar Addition, Hennepin County,
Minnesota, described as follows:
Commencing at the northwest corner of said Lot 2; thence southerly, along the west line of
said Lot 2, a distance of 21.20 feet to the beginning of the line to be described; thence
easterly, to a point on the east line of said Lot 2, said point being 17.60 feet southerly of
the northeast corner of said Lot 2, and said line there terminating. Except the north 10 feet
and the west 10 feet of said Lot 2.

Dear Sir/Madam:
This office is legal counsel for the City of Edina. Enclosed herewith for filing with
your office please find Grant of Permanent Easement for Public Drainage and Utility
Purposes from Parkwood Knolls Construction Company in favor of the City of Edina
over a portion of Lot 2, Block 1, Parkwood Knolls Cougar Addition. The property
subject to this easement is torrens and it appears that the easement needs to be
recorded against the above referenced certificate of title. Please charge your recording
fees against our deposit with your office per the enclosed "green" charge slip, and feel
free to change the amounts if my calculations are incorrect.
Once the recording process has been completed, please return the original recorded
easement to me in the self - addressed envelope provided. HOWEVER, SINCE TIME
IS OF THE ESSENCE, I ASK THAT AN ATTESTED COPY OF THE
RECORDED EASEMENT BE PROVIDED TOME ASAP — I HAVE PROVIDED
A SECOND ORIGINAL EASMENT FOR THIS PURPOSE AS WELL AS A
SECOND SELF ADDRESSED ENVELOPE.
