GRANT OF PERMANENT EASEMENT
FOR PUBLIC SIDEWALK,
DRAINAGE AND UTILITY PURPOSES
SCOTT D. FORSBERG and CYNTHIA B. DELLA SANTINA, husband and wife
("Grantors"), in consideration of One Dollar ($1.00) and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, do hereby grant unto the CITY OF
EDINA, a Minnesota municipal corporation, the Grantee, hereinafter referred to as the "City", its
successors and assigns, forever, a permanent easement for public sidewalk, drainage and utility
purposes over, on, across, under and through the land situated in the County of Hennepin, State of
Minnesota, legally described on the attached Exhibit "A" (the "Easement Premise?).
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter upon
the Easement Premises at all reasonable times to construct, reconstruct, inspect, repair, and maintain
said public sidewalk, drainage and utility systems over, across, on; under, and through the easement
premises, together with the right to grade, level, fill, drain, pave, and excavate the Easement Premises,
and the further right to remove trees, bushes, undergrowth, and other. obstructions interfering with the
location, construction; and Maintenance of said public sidewalk, drainage and utility systems.
The above-named Grantors, for themselves, their successors, heirs and assigns, do covenant •
with the City, its successors and assigns, that they are well seized in fee title of the Easement Premises;
that they have the sole right to grant and convey the easement to the City; that there are no unrecorded
interests in the Easement Premises; and they will indemnify and hold the City harmless for any breach
of the foregoing covenants.

hereby consents to the grant of the foregoing Grant of Permanent Public Sidewalk,
Drainage and Utility Purposes Easement dated NA and signed by Scott Forsberg and

CONSIDERATION FOR EASEMENT
Scott D. Forsberg and Cynthia B. della Santina, husband and wife ("Grantors"), affiim and
state under oath that they granted the City of Edina, Minnesota ("City"), an easement for
public sidewalk, drainage and utility purposes; a copy of which is attached hereto as Exhibit
"A" (".Easement") and further state tat the City did not provide the Grantors any monetary
consideration for the Easement.
2. The City affirms and states under oath that it did not provide the Grantors any consideration
for the grant of the Easement to the City.
3. Wells Fargo Bank N.A., a national banking association, which holds a mortgage dated
October 6, 2011, filed October 18, 2011 with the office of the County Recorder for Hennepin
County, Minnesota, as Document No. A9705029, executed by Scott D. Forsberg and Cynthia
B. Della Santina, husband and wife, in favor of Wells Fargo Bank N.A. in the amount of
$178,500.00, on all or part of the property more particularly described in the Easement
without consideration, consented to the Easement pursuant to the Mortgage Holder Consent
attached to the Easement, and is subject to the Easement. ,
