Call To Order Chair Nemerov called the meeting to order at 7:00 PM. II. Roll Call Answering the roll call were: Commissioners Miranda, Berube, Strauss, Cullen, Olsen, Bennett, Agnew, and Chair Nemerov. Staff Present: Cary Teague, and Liz Olson, Administrative Support Specialist. Absent from the roll call: None. Chair Nemerov noted Commissioner Thorsen resigned from the Commission. III. Approval Of Meeting Agenda Commissioner Agnew moved to approve the November 18, 2020, agenda. Commissioner Strauss seconded the motion. Motion carried. IV. Approval Of Meeting Minutes A. Minutes: Planning Commission, October 24, 2020 Commissioner Berube moved to approve the October 24, 2020, meeting minutes. Commissioner Agnew seconded the motion. Motion carried. V. Public Hearings A. Preliminary Rezoning from PCD-3 to PUD, Overall Development Plan, Preliminary Development Plan and Consideration of EAW for 7001 and 7025 France Avenue Director Teague presented the request of preliminary rezoning from PCD-3 to PUD. Staff recommends approval of the rezoning, as requested subject to the findings and conditions listed in the staff report. Ms. Ashley Payne, Environmental Scientist at Kimley-Horn, introduced herself and addressed the Commission on the EAW process. Mr. Mike Spack, CEO of Spack Solutions, introduced himself and addressed the Commission on traffic and pedestrian connections. Appearing for the Applicant Mr. Ted Carlson, and Mr. Neal Reardon, ESG Architecture and Design, introduced themselves and addressed the Commission. Mr. Jeff Hysjulien, RSP, addressed the Commission regarding the drive-through and site lines within the US Bank development. The Commission asked questions of the applicant. Public Hearing It was noted the Planning Commission and staff have received comments via email and through Better Together Edina. Ms. Julie Risser, 6112 Ashcroft Avenue, addressed the Commission with concerns about the non- compliant development. Commissioner Strauss moved to close the public hearing. Commissioner Berube seconded the motion. Motion carried. The Commission reviewed the proposed rezoning request. • Maintain the fifty-foot setback on France Avenue • Would like to see green space rather than the public space south of the Tower Building • Liked the North/South thorough fare ability in the future • Would like to see more green space and wider sidewalks with less on street parking • Emphasize alternative modes of transportation if possible • Disappointed seeing an increase of parking at US Bank • This project gets the City on its way and questions about density and parking were answered • Affordable housing was addressed • Desire for fewer drive-throughs • The project is excellent overall • Height and shadows did not seem to be an issue • Need to give priority to pedestrians and biking • Great improvement to the area and attractive • This will benefit the retail Motion Commissioner Miranda moved that the Planning Commission recommend approval to the City Council of the request as outlined in the staff memo subject to the conditions and findings Draft Minutes☒ Approved Minutes☐ Approved Date: ___, 2020 Page 3 of 4 therein. Conditions added included providing ten-foot wide drive lanes, additional green space and a fifty-foot setback on France; the motion included that an EIS not be required. Commissioner Agnew seconded the motion. Motion carried 5-2 (nays were Commissioner Agnew and Bennett). Chair Nemerov noted this will go to the City Council on December 1, 2020. B. Zoning Ordinance Amendment/Preliminary Rezoning, Revised Overall Development Plan, Preliminary Development and EAW consideration for 6600-6800 France Avenue Director Teague presented the request of a Zoning Ordinance Amendment/Preliminary Rezoning, Revised overall Development Plan, Preliminary Development and EAW consideration. Staff recommends denial of the Zoning Ordinance Amendment/Preliminary Rezoning, as requested subject to the findings and conditions listed in the staff report and that an EIS not be required. S ign O rdinance AT TAC HME N T S : Description Staff Report Applicant Submittal Aerial Map The applicants, Paster Properties and Dr. Richard Anderson, DDS, are requesting sign variances to place two 15 square foot signs on a wall of a building for that are not tenant walls in which the signs are for. 3917 50th Street West has two tenant spaces on the south side of the building that are accessed from a private walkway on the east side of the building. The proposed signage would be for these two tenants. The applicant is proposing using the walkway as the wall area to calculate the allowable signage and shows two 13.8 square foot signs. Wall signs in the PCD-2 zoning district are allowed to be up to 15% of the wall area. For multi- tenant buildings, staff uses the tenant wall the sign is located on to calculate the allowed signage area. Therefore, the code is interpreted that signs be placed on a tenant wall in which the sign is advertising. Buildings in the PCD-2 District are also allowed freestanding signs. There are not many freestanding signs in the 50th and France area due to the required 20-foot setback from the traveled portion of the street. The subject property has an existing non-conforming freestanding sign that is allowed to remain and be refaced. Planning Guide Plan designation: Mixed Use Center Zoning: PCD-2, Planned Commercial District 2 Compliance Table Signs in the PCD-2 District *Requires a variance PRIMARY ISSUES & STAFF RECOMENDATION Primary Issues Is the proposed variance justified? No. Staff does not believe the variance criteria is met. Minnesota Statues and Edina Ordinances required that the following conditions must be satisfied affirmatively to grant a variance. The proposed variance will: 1) Relieve practical difficulties that prevent a reasonable use from complying with ordinance requirements. Reasonable use does not mean that the applicant must show the land cannot be put to any reasonable use without the variance. Rather, the applicant must show that there are practical difficulties in complying with the code and that the proposed use is reasonable. Sign Standards- PCD-2 District Proposed Signs Maximum Wall Sign Area 15% of wall area The code is interpreted as 15% of the tenant wall the sign is located on *Two 13.8 sf signs located on a wall that is not a tenant wall Walkway area was used by the applicant to determine the size of the proposed signs STAFF REPORT Page 3 Staff questions if the proposal is reasonable. Allowed signage placed on a tenant walls identify the tenant space on which the sign is located. Tenant signage is not allowed on space where the use is not located. An extreme example of this would be allowing an outside wall sign on Southdale advertising for an individual tenant within Southdale. Should the proposed signage be allowed, it could set a precedent for similar signage to advertise tenant space outside of the tenant walls where the use exists. There is space on a nearby freestanding sign that would direct customers to the business. 2) There are circumstances that are unique to the property, not common to every similarly zoned property, and that are not self-created? Access to tenant space off a private or public walkway in the 50th and France area is not unique to this property or these tenant spaces. 50th and France is a walkable commercial area and not all tenant spaces have frontage on a street. The 50th and France District has multiple buildings and tenant spaces that are accessed off public or private walkways. 3) Will the variance alter the essential character of the neighborhood? Allowing signs that are oriented towards 50th Street West would alter the essential character of the 50th and France district. The 50th and France area is pedestrian oriented. Many businesses whether they be commercial, or office space are accessed from different public or private walkways. Signage oriented towards pedestrians and wayfinding would help guide people towards different tenant spaces. The building owner may consider adding these tenant spaces to the existing freestanding sign to direct pedestrians to the tenant spaces that are accessed on the east side of the building. These tenant spaces would be allowed 15% of the tenant wall in building signage. Staff Recommendation Deny the requested sign variances to allow two signs up to 15 square feet on a wall of the building that is not a tenant wall at 3917 50th Street West based on the following findings: 1. The variance criteria for the proposed sign variances are not met. Allowing wall signage to advertise a business on a non-tenant wall is not reasonable in this instance and could set a precedent for similar requests. 2. Signs placed on the tenant wall to meet city code would clearly identify the location of the tenants to pedestrian traffic. 3. Directional signage could be added to the existing freestanding sign for this building, which would help with wayfinding and directing pedestrians to tenant spaces off the private walkway. 4. Tenant spaces located off public or private walkways are not unique to this property. STAFF REPORT Page 4 Variance request for exterior signage made by Dr Richard Anderson, DDS and Paster Properties Description of Request: Paster Properties is the owner of the building located at 3917 West 50t h Street. Dr. Richard Anderson DDS, Anderson Dentalcare is a tenant in this building. We are requesting a variance for the installation of two exterior signs. One of the signs would serve Dr Anderson and the other would serve the space adjacent to his. Each of these spaces face the west side of the Edina Theater and are accessed by the private walkway running between the city of Edina's south parking ramp and 50th Street. (See Attachment -A). We are requesting a variance to place identification signage above and adjacent to the north end of the private walkway facing 50th street. The location of the proposed signage is within the building property lines. The signage locations we are requesting are shown on Attachment — B. The signage we are proposing meets the allowable area calculation for this portion of the building frontage. Each sign would be a maximum of 15 square feet which meets the total allowable area of 30 square feet. The area calculation for the proposed signage is also shown on Attachment B. Dr Andersons sign would be mounted directly above the entrance to the walkway. The sign for the adjacent space would be a blade sign mounted on the side of the building with the face oriented to 50th street. The proposed blade sign does not extend beyond the property line as shown in the attached signage elevation, Attachment B. Precedents: There is a precedent for the variance we are requesting. There are 2 exterior signs located on the building at 3939 West 50t h Street. This building is directly to the west of our building at 3917 West 50t h Street. The signs are for "B Sharp Hair" and "Edina Endodontics". The B Sharp Hair sign faces west 50t h Street and the Edina Endodontics sign faces Halifax Ave/City-Lund's Parking lot. The zoning for the building housing these 2 tenant spaces is PCD-2 which is the same as the zoning for our building. Neither of the two signs being referenced are attached to a wall that houses the tenant space noted on the signage. Both of these tenant spaces are accessed through private internal walkways. Unique Circumstances for granting a Variance: The Edina sign code does not address the location of exterior signage on a building as it relates to the tenant space being identified. The code only addresses the allowable sign area as it relates to the exterior elevation area of the building that the sign is to be located on. The code is silent on any requirement stating that a sign may only be installed on a perimeter wall of the tenant space. The spaces we are requesting a signage variance for are unique in that they are both first floor exterior spaces that face the side of an adjacent building rather than a street front. They are both accessed through a private covered walkway that is a part of the building they inhabit. This walkway is their frontage to West 50t h, the public street. The requested signage is key to someone passing by on 50t h Street being able to locate these businesses.
