MINUTES
OF THE REGULAR MEETING OF THE
EDINA CITY COUNCIL MEETING
OCTOBER 5, 2021
7:00 P.M.
I. CALL TO ORDER
Mayor Hovland called the meeting to order at 7:08 p.m., then shared the procedure for public hearing and
community comment in the hybrid meeting format.
II. ROLLCALL
Answering rollcall were Members Anderson, Jackson, Pierce, Staunton, and Hovland.
Absent: None.
III. PLEDGE OF ALLEGIANCE

Member Jackson made a motion, seconded by Member Staunton, to approve the meeting
agenda as presented.

V. COMMUNITY COMMENT
Steve Anderson, 4405 Grimes Avenue South, spoke about an open letter published in the Sun Current and
impacts to the Morningside flood plan.
Carmen Rosland, 6033 St. John’s Avenue, shared frustrations regarding property violations at 4516 and 4518
Valley View Road and the need to enforce.
V.A. CITY MANAGER’S RESPONSE TO COMMUNITY COMMENTS
Assistant Manager Schaefer responded to Community Comments from the last meeting.

Member Jackson made a motion, seconded by Member Pierce approving the consent agenda
as presented:

VII. SPECIAL RECOGNITIONS AND PRESENTATIONS
VII.A. HENNEPIN COUNTY SHERIFF DAVID HUTCHINSON UPDATE – RECEIVED
Hennepin County Sheriff David Hutchinson updated the Council on activities in the Sheriff's Office. The
Council thanked Sheriff Hutchinson for the partnership that existed.
VIII. PUBLIC HEARINGS - Affidavits of Notice presented and ordered placed on file.
VIII.A. RESOLUTION NO. 2021-88, PRELIMINARY REZONING AND PRELIMINARY
DEVELOPMENT PLAN WITH MULTIPLE VARIANCES FOR CITY HOMES AT 4630 FRANCE
AVENUE – CONTINUED TO OCTOBER 19, 2021
Community Development Director Teague stated on September 22, 2021, the Planning Commission
recommended approval of the request per staff recommendation, which included denial of the rear yard
setback and the building coverage variance for a redevelopment proposal to tear down the existing single-
family home and construct two villa style homes at 4630 France Avenue. He outlined the request in detail
which included a shared driveway off France Avenue which would provide access for both homes.
Jeff Ziebarth, Perkins+Wills, shared about the proposed project that would provide an alternative housing
product for the City with house plans that were more user-friendly at a reduced size and other elements.
Mayor Hovland opened the public hearing at 7:40 p.m.

Member Staunton made a motion, seconded by Member Anderson, to extend the public
hearing to noon on October 11, 2021, and take final action on Resolution No. 2021-88
approving preliminary rezoning from R-1, single-dwelling unit district to PRD-2 planned
residential district, preliminary plat, side yard setback variance from 20 feet to 7 feet and 15
feet, lot size variance from 7,300 sf to 5,016 sf and denial of the rear yard setback variance
from 35 feet to 25 feet and the building coverage variance from 25% to 26% at 4630 France
Avenue at the October 19, 2021, Council meeting.

VIII.B. RESOLUTION NO. 2021-89, SITE PLAN REVIEW WITH VARIANCES AT 6500 BARRIE ROAD
– CONTINUED TO OCTOBER 19, 2021

Mr. Teague stated the City Council was asked to hold a public hearing, consider a redevelopment proposal
to tear down the existing 16,032 square foot medical office building, and build a new 3-story, 24,000 square
foot medical office and surgery center. He outlined the current site and said the height overlay district
allowed up to 12 stories. The site was very small and narrow for a medical office site and given the required
setbacks, a variance would be likely for any new structure. He outlined the request in detail, the site plan
review and variances to front and side yard setbacks, building coverage, floor area ratio, and parking stalls.
Don Rolf, Pope Architects, presented further about the proposed project.

Member Staunton made a motion, seconded by Member Pierce, to extend the public hearing
to noon on October 11, 2021, and take final action on Resolution No. 2021-89 approving a site
plan review with variances at 6500 Barrie Road for construction of a new medical office and
surgery center at the October 19, 2021, Council meeting.

VIII.C. RESOLUTION NO. 2021-85, WEST 58TH STREET NEIGHBORHOOD ROADWAY
RECONSTRUCTION SPECIAL ASSESSMENT, IMPROVEMENT NO. BA-456 – CONTINUED
TO OCTOBER 19, 2021
City Engineering Millner shared the proposed project area for the West 58th Street project then reviewed
the intense public engagement process. He spoke about the France Avenue traffic signal and turf
establishment and referred to one objection received by the property owner at 5733 Beard Avenue who
was instructed on the process. He outlined the costs and assessable portion of $361,129.65 with a per REU
rate of $9,653.29, a 2.5% decrease in the estimate.

VIII.D. RESOLUTION NO. 2021-80, WEED MOVING SPECIAL ASSESSMENT, IMPROVEMENT
NO. WD-21 – CONTINUED TO OCTOBER 19, 2021
Assistant Director Parks and Natural Resources Swenson stated in the fall of 2020 and summer of 2021, the
Parks & Recreation Maintenance Department cut the weeds on 12 properties. The properties and cost
associated with the use of a tractor and staff time to cut the weeds was provided. Each cost should be
assessed to the property owner for the payment to the City and shared the proposed assessments for each
property.

VIII.E. RESOLUTION NO. 2021-81, TREE REMOVAL SPECIAL ASSESSMENT, IMPROVEMENT
NO. TR-21 – CONTINUED TO OCTOBER 19, 2021
Mr. Swenson stated the list of properties collectively had diseased trees that were removed in accordance
with City Code. All property owners were first given an opportunity to remove any diseased trees within
a three-week period of time. If the trees were not removed within the period of time, the City then contracts
the removal and assesses the property owner. He shared that the property owners listed in the proposed
assessment roll chose to have the City contract to remove their trees in 2020 and 2021 and stated the
practice prevented the spread of tree diseases or was completed for safety. He outlined the guidelines used
to set the assessment and said additional time was allotted for payment if requested.

assessment cost for a particular tree removal which involved use of a crane.

assessments for Improvement No. TR-21 tree removal at the October 19, 2021, Council
meeting.

VIII.F. RESOLUTION NO. 2021-82, GRANDVIEW BUSINESS DISTRICT SPECIAL ASSESSMENT,
IMPROVEMENT NO. G-21 – CONTINUED TO OCTOBER 19, 2021
Mr. Swenson shared the proposed assessment roll and documentation for the Grandview Business District
maintenance assessment. He said the amount changed from $0.00617 per square foot in 2020 to $0.0010013
in 2021 and that as of today no comments had been submitted. He shared assessment history and
breakdown of proposed assessments.

VIII.G. RESOLUTION NO. 2021-83, AQUATIC VEGETATION SPECIAL ASSESSMENT,
IMPROVEMENT NO. AQ-21 – CONTINUED TO OCTOBER 19, 2021
Water Resources Coordinator Wilson shared about the proposed aquatic vegetation special assessment for
aquatic vegetation management services in Arrowhead Lake, Indianhead Lake, Lake Nancy, and Minnehaha
Creek Mill Pond as requested by groups eligible for the service. She said these groups agreed to pay for the
services by special assessment then outlined the change to the assessment period last year that simplified
the assessment preparation process. She shared more detail on the services provided and said waterbodies
were eligible for City-funded algae treatments and had been credited accordingly. She shared the price per
REU for Arrowhead Lake, Indianhead Lake, Lake Nancy, and Mill Pond.
Ms. Wilson discussed Mill Pond services and ramp condition for harvesting access. Ms. Wilson recommended
that for services to continue beyond 2023, the residents must form an association consistent with the 2015
Lakes & Ponds policy amendment to the Comprehensive Water Resources Management Plan.

VIII.H. RESOLUTION NO. 2021-84, 50TH AND FRANCE BUSINESS DISTRICT SPECIAL
ASSESSMENT, IMPROVEMENT NO. M-21 – CONTINUED TO OCTOBER 19, 2021
Facility Manager Otten stated the City provided service to the 50th & France Business District. These services
included general maintenance and upkeep performed by City employees and management of contracts for
other repairs as needed. Services included waste and litter removal, snow and ice management, and upkeep
to City owned spaces throughout the district. He shared how the maintenance assessment changed from
$0.81503 per square foot in 2020 to $0.98472 per square foot in 2021 which was attributed to additional
maintenance requirements of the Nolan Mains Complex and COVID-19 precautions then noted as of today
no comments had been submitted.

VIII.I. RESOLUTION NO. 2021-86, 50TH AND FRANCE BUSINESS DISTRICT SPECIAL
ASSESSMENT, IMPROVEMENT NO. M-21- CONTINUED TO OCTOBER 19, 2021
Finance Director McAndrews shared the proposed assessments to certify the delinquent utility accounts for
collection with 2022 real estate taxes. She reviewed the process based on Statute which included notification
and said property owners could pay until November 19 to avoid assessments. She said the certified amounts
would be paid at an interest rate of 6.5% for one-year assessments then reviewed utility certification history
since 2016.
The Council asked questions and provided feedback.

to noon on October 11, 2021, and take final action on Resolution No. 2021-86 authorizing the
certification of delinquent utility charges to the Hennepin County auditor at the October 19,
2021, Council meeting.

IX. REPORTS/RECOMMENDATIONS
IX.A. 2022 BOARD AND COMMISSION INTERVIEW PROCESS – REVIEWED
Community Engagement Coordinator Lamon stated staff was seeking feedback from Council on how to
proceed with the 2022 Board and Commission interview process. Staff reviewed background of the current
process, goals, and recruitment strategy for 2022.
The Council asked questions and provided feedback that supported a panel of two council members and
two commissioners with no recording of interviews.
