PLAN AMENDMENT APPROVED FOR VERNON WOODS 2ND ADDITION. Affidavits of Notice were
presented by Clerk, approved and ordered placed on file. Planner Hughes advised
that final rezoning to PRD -2 Planned Residential District and plat approval was
granted by the Council in 1983. The approval was for a five -unit townhouse project
(, for the property. Since the approval three of the units have been constructed
on the easterly portion of the site and the applicants now are proposing to start
Q the westerly two townhouse units. The plans as originally approved showed a tennis
court on the southerly portion of the site. The applicants now wish to delete the
tennis court and relocate the westerly two townhouses further south to provide a
better separation of the buildings and to provide a more generous entry courtyard.
The plan amendment also requires a minor replatting of the property which has the
effect of moving the front lot lines for the two buildings further to the south
and east to provide new lots.. Mr. Hughes stated that the Community Development
and Planning Commission has reviewed the request at their meeting of January 30,
1985, and recommends approval of the plan amendment and the replat. No objections
being heard, Member Bredesen introduced the following resolution and moved adoption:
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL
. FOR VERNON WOODS 2ND ADDITION
BE IT RESOLVED by the Edina City Council that that certain plat entitled "Vernon
Woods 2nd Addition ", platted by Vernon Woods Investments, Inc., a Minnesota
General partnership consisting of G. William Pearson and Paul J. Elmer, owners
and proprietors, and Citizens State Bank of St. Louis Park, a Corporation organized
and existing under the laws of the State of Minnesota, - mortgagee, and presented at
the regular meeting of the City Council of February 25, 1985, be and is hereby
granted preliminary plat approval.

CONDITIONAL USE PERMIT APPROVED FOR EDINA PUBLIC SCHOOLS IDS NO. 273 (5701 NORMAN-
DALE ROAD; IMPROVEMENTS NO. P -14 AND N0. P -15 AUTHORIZED. Mr. Hughes presented the
request of the Edina Public Schools, IDS 4273, for a Conditional Use Permit. He
advised that the Edina Community Center, 5701 Normandale Road, proposes to construct
additional off - street parking to support the present and future parking needs of the
Center. The lots proposed are an east parking lot and a parking lot on the south
side of the Center. Since'review by the Community Development and Planning Commission,
there have been some revisions to the design of the lots. He presented a graphic
showing the south lot and pointed out the existing east frontage road of T.H. 100,
advising that the access.to the lot would be maintained at approximately the same
location and would be constructed where there is now an existing shot put and discus
throw area. The plan shows substantial landscaping in the area between the frontage
road and the parking lot. He noted that the lot complies with the requirements of
the Zoning Ordinance with the exception of the setback. A 20 foot setback from the
property line is required and an 8 -10 foot setback is proposed. In order to comply,
many of the parking spaces in the adjacent row would have to be eliminated. There-
fore, staff would suggest that a variance be granted for a setback in that area.
Mr. Hughes then presented a graphic showing the east lot with three diagonal rows
of parking, and with circulation from Southview Lane. The net addition of parking
spaces of the two proposed lots is between 230 and 240 new spaces. The Community
Development and Planning Commission reviewed the request at their meeting of
January 30, 1985, and recommended that a Conditional Use Permit should be granted
for the project. Mr. Hughes then pointed out several issues. First, there is a
one -way circulation system between the lot on the east side to the previous lot
on the south side caused principally by the location of the two temporary buildings

PRELIMINARY PLAT APPROVED FOR WILLIAM C. HANSEN ADDITION. Affidavits of Notice were
resented by Clerk, approved and ordered placed on file. Mr. Hughes presented the
petition for preliminary plat approval for the William C. Hansen Addition, generally
located south of Grove Street and east of Johnson Drive. The proponent is requesting
a two -lot subdivision of the property resulting in one new building site. The new
lot would measure approximately 92 x 121 feet and contain 11,137 square feet in area.
The subject property measures approximately 200 x 121 feet and is 24,206 square feet
in area. It is developed with a single dwelling fronting on Johnson Drive and located
on the southerly portion of the site. The lot retained for the existing dwelling
would measure 108 x 121 feet and would be 13,069 square feet in area. The dwelling
on the site complies in all respects with the zoning ordinance from the standpoint of
lot coverage and setback from the new lot line. Mr. Hughes pointed out that the
dwelling on the site is served with sanitary sewer and water from Grove Street. It
would be necessary to relocate these services if a dwelling were constructed on the
new lot. The proponent has agreed to the relocation of those utility lines to a new
easement provided along the east property line. The Community Development and Plan-
ning Commission reviewed the plat on March 27, 1985,-and recommended approval of the
subdivision, subject to 1) subdivision dedication, 2) relocation of existing utilities,
3) relocation of existing driveway to Johnson Drive. The proponent has agreed to
relocate the utilities and driveway prior to final plat approval. In response to a
question of Member Turner regarding lot size in the neighborhood, Mr. Hughes stated
that neighboring lots are comparable in size. No objections or comments being heard,
Member Turner introduced the following resolution and moved adoption, subject to
1) subdivision dedication, 2) relocation of existing utilities prior to final plat
approval, and 3) relocation of existing driveway:

SUBJECT: FRANCE AVENUE ENGINEERING AGREEMENT
The France Avenue construction project between W. 492 Street and Excelsior
Boulevard has been preliminarily approved by the Minnesota Department
of Transportation. As you recall, the City Council acted on a preliminary
plan approval earlier this year.
The project now needs to undergo the engineering design which the staffs
of Minneapolis, St. Louis Park and Edina believe would be best accomplished
by using the Minneapolis staff to conduct the design work. The City Councils
of Minneapolis and St. Louis Park have approved the design agreement
at this time. The staff at St. Louis Park and Edina will coordinate with
the Minneapolis staff to provide engineering input for the respective city's
side of the project. The design cost split is based on the proportional
length of France Avenue that lies within each city. The percent of cost
sharing is as follows:
Minneapolis 50%
Edina 32.55%
St. Louis Park 17.45%
As such, the staff recommends that the City Council authorize the Mayor
and Manager to sign the design agreement for this project. This author-
ization should be in the form of a resolution.

In 1973 a state law passed (Minnesota State Statute 343.11) allowing
governmental bodies to appropriate funds not to exceed $4,800 per year
for the maintenance and support of humane societies. In the spirit of
this State Statute, the Animal Humane Society of Hennepin County wishes
to seek a grant in the amount of $ 685.00 from the City of Edina.
During 1984 the Animal Humane Society received 20,000 unwanted pets
at the Shelter, and 274 of these animals came from the city of Edina.
Specifically, there were 89 dogs, 144 cats, and 41 other animals.
This represents a slight decrease over 1983, when 297 animals were
received from Edina. In addition to caring for animals here at the
Shelter, the Humane Society visits with over 55,000 students and

In 1973 a state law passed (Minnesota State Statute 343.11) allowing
governmental bodies to appropriate funds not to exceed $4,800 per year
for the maintenance and support of humane societies. In the spirit of
this State Statute, the Animal Humane Society of Hennepin County wishes
to seek a grant in the amount of $ 685.00 from the City of Edina.
During 1984 the Animal Humane Society received 20,000 unwanted pets
at the Shelter, and 274 of -these animals came from the city of Edina.
Specifically, there were 89 dogs, 144 cats, and 41 other animals.
This represents a slight decrease over 1983, when 297 animals were
received from Edina. In addition to caring for animals here at the
Shelter, the Humane Society visits with over 55,000 students and
senior citizens yearly through its humane education programs and pet

RE: Proposed Amendments to the League of Minnesota Cities Constitution
Enclosed is the package of proposed constitutional amendments endorsed by the
League of Minnesota Cities Board of Directors for your review.
On May 16, the LMC Board of Directors unanimously approved a package of proposed
constitutional amendments for consideration at the annual - meeting on June 13,
during the LMC 1985 Annual Conference. In keeping with the practice of prior
years, I am happy to transmit these amendments to you so that city officials may
be aware of amendments well before the annual meeting.
The most important of the amendments involves the dues structure, establishing a
new three -year dues schedule as part of the constitution. Those city officials
who attended LMC's annual meeting in Duluth in 1984 will recall that the 1984
Dues and Services Committee proposed that the LMC Board of Directors be charged
with setting the dues, beginning in 1985. The membership rejected this
proposal.
As a result, the Dues and Services Committee was called back into session to
develop a recommendation concerning the dues schedule. That committee
recommended a three -year schedule involving a 7.5 percent increase for 1986 and
a six percent increase for 1987 and 1988.
The Dues and Services Committee concluded, and the Board of Directors agreed,
that these increases would be the minimum necessary funding for the League to
maintain the quality and quantity of services which the membership desires and
expects. The Committee understood that the proposed increase exceeds the
current rate of inflation, but reviewed the fact that the League's budget is not
100 percent financed by dues income; and that a 7.5 percent dues increase is
necessary to produce a five percent overall funding addition.
Secondly, the League must purchase a number of services and goods (for example
postage and printing supplies), which exceed the current inflation rate.
Finally, the Board has devoted additional resources to certain activities in
response to member service demand, particularly, regional meetings and
computerization.

In the course of the 1984 debate on the dues proposal, some other issues were
identified. These included the fact that, should the membership reject a future
proposal dues adjustment, the LMC would have no applicable dues schedule. Other
concerns emerged concerning the lack of a more complete ability to offer
alternatives and amendments to constitutional amendments under consideration at
the annual meeting.
LMC convened a Constitutional Committee to consider these problems. The
committee recommended amendments which would 1) leave the last adopted dues
schedule in effect should the members reject the proposed adjustment; 2) provide
for a limited process to amend proposed constitutional amendment during the
annual meeting; 3) clarified that the annual meeting could adopt special rules;
and 4) produced a comprehensive technical amendment which would make the
constitutional gender neutral.

Following are several proposals for amending the League Constitution at the
Annual Conference. When any change to a section is proposed, the entire
section is set out with deletions indicated with strike outs and additions
shown by underlining.
1. Gender neutral language
ARTICLE IV OFFICERS AND COMMITTEES
Section 2. The president and vice president shall each be elected
annually for one -year terms. Twelve directors shall be elected for three -year
overlapping terms. In 1974 four of these shall be elected for three -year
terms, four for two -year terms and four for one -year terms; thereafter four
shall be elected annually for three -year terms. Elections shall be held at the
official business meeting at the annual convention. Officers shall hold office
for their designated terms, and until their elected or appointed successors
have signified their acceptance. The newly elected officers shall take office
immediately after the close of the annual convention. The immediate past
president shall serve as a member of the board of directors ex officio for one
year, so long as he or she holds municipal office, and the president of the
Association of Metropolitan Municipalities shall serve ex officio.
Section 5. The president shall be chairman of the board of directors. He
The president shall preside pres4dese at the annual business meeting and all
other meetings of the League, but he may designate others to preside instead

Section 3. The annual dues for each member municipality shall be based on
the schedule or schedules set out as appendices to this constitution, which
shall be adopted or amended in the same manner as other parts of this
constitution. If no new dues schedule is adopted for a given year, the dues
schedule in effect for the most recent prior year shall remain in effect
The total dues for each member as thus calculated shall be rounded to the

that the proposed amendments shall have been prepared in writing on or before
the first day of the meeting and distributed to the delegates. An amendment in
writing, offered from the floor without prior notice to the delegates shall be
permissible if it is an amendment to a proposed amendment, is on the same
subject as the amendment it is proposed to amend, is germane to the amendment
it is proposed to amend and is approved by a two - thirds vote of delegates in
attendance and voting.

Sunnyside Road, Edina, would appreciate your solution to the
following problem.

1) Loud parties almost every night, far after 10:00
p.m. weekdays and much later (2:00 -3:00 a.m.) on weekends.
Isn't there a law which prohibits such activity?
2) Between 5 -12 cars and motorcycles parked on
Sunnyside for eighteen hours at a -time. There is no space
for our visitors to park. Is there an on- street parking rule
which could be enforced? Also, several of these vehicles have
poor or no mufflers, thereby making sleeping difficult when they
race about in the middle of the night.
3) As the number of vehicles in #2 suggests, at least
6 -12 individuals live /frequent the house. Many others come and
go at other times. Are there city ordinances which. limit the
number of unrelated inhabitants of a rental-single amily"
home? Small children (ages 2 -3 ?) appear to be living there also.
4) It is obvious that minors are participating in these
nightly, drunken parties. As bizarre and tragic as it sounds,
we'have also seen a number of parents (some of whom we know)
drop off their children carrying suitcases for these all -night
parties.
5) About midnight, May 24, two young males from the
house were seen beating (with their hands and fists) a.young
woman (also from the house). The incident took place on the
sidewalk in front of the house. The Edina police were called

immediately. The young men and woman appeared to be thoroughly
intoxicated and left prior to the arrival of the police.
6) The garage behind the house has been the scene
of late -night explosions. The renters and partygoers seem .
to be amusing themselves with a welding torch. The fire hazard
to all of us is obvious.
7) They have recently added a large dog which they
either chain to the front door of the house (where it barks
much of.the night) or let it run loose in the neighborhood.
8) Most important, there are ten children under 10
years of.age in our block, a number of whom must walk in front
of 4008 Sunnyside on the way to and from their school bus stop.
We, as.parents, are terrified-that one of these children will
be struck by one of their cars or motorcycles as it races into
or out of the driveway. At times, the motorcycles simply roar
through the front yard and into the street.
Mr. Rosland, we would like these people evicted.
If not, it is difficult for us to justify the Edina house
prices we paid and the Edina taxes we are currently paying.
Many of us have spent a great deal of money restoring our old
houses. Your city assessor evidently has.noticed, since our
taxes have doubled and in some cases tripled over the past
five years.
We would appreciate a prompt and satisfactory solution
for this very unpleasant and unsafe situation.

AN ORDINANCE PROHIBITING CONSTRUCTION,
INSTALLATION, ERECTION OR PLACEMENT
OF ANTENNAS, DISH ANTENNAS AND TOWERS
THE CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA ORDAINS:
Section 1. Purpose. The Edina Comprehensive Plan (the "Plan ") was
approved by the Edina City Council on December 21, 1981 and approved by
the Metropolitan Council on October 8, 1981, all pursuant to Minnesota
Statutes Sections 473.851 through 473.872 (the "Metropolitan Land
Planning Act "). Pursuant to the Plan and the Metropolitan Land Planning
Act, Edina is now conducting studies for the purpose of considering adoption
of official controls to implement the Plan. Among the official controls
under consideration is an ordinance which will regulate the size, height,
number, location and construction of radio, television and communication
antennas and their supporting towers. However, while the new ordinance
is being considered, new antennas and towers are continuing and may continue
to be installed or constructed. Therefore, in order to protect the
planning process and the health, safety and welfare of the citizens of
Edina, it is necessary and desirable to impose the following moratorium.
Sec. 2. Moratorium. From the effective date of this ordinance to and
including October 2, 1985, subject to earlier termination or extension by
the Edina City Council, no antennas, dish antennas or towers shall be
constructed, erected, installed or placed on any land or on the exterior
of any building. Further, the Edina City Council, any Board or Commission
of the City of Edina and the Edina City staff shall not accept or continue
to process or issue any permit or variance which will or may result in the
construction, erection, installation or placement of any antennas, dish
antennas, or towers. For purposes hereof, antennas and towers are defined
as follows:
"Antennas" - Equipment used for transmitting or receiving telecommuni-
cation, television or radio signals.
"Dish Antennas" - Antennas of a parabolic shape which are used for
receiving or sending telecommunication, television
or radio signals.
"Tower" - Any pole, spire or structure, or any combination thereof,
to which an antenna, dish antenna or equipment for the
collection of energy from wind power is attached or
designed to be attached, including all supporting lines,
cables, wires and braces.
Sec. 3. Exemptions. All antennas, dish antennas and towers erected or
constructed by the City of Edina or other governmental subdivisions shall be
exempt from the provisions of Sec. 2 of this ordinance.
Sec. 4. Effective Date. This ordinance shall be in full force and
effect upon its passage and publication.
