A* FINAL PLAT APPROVED FOR DE14EY HILL FOURTH ADDITION (FORMERLY DEWEY HILL THIRD ADDN.) Mr. Hughes presented the petition for final plat approval for Dewey Hill Fourth Addition generally located north of W. 78th Street and east of Shaughnessy Road, recalling that the property has been the subject of numerous Council zoning hearings. At the meeting of November 21, 1983, Council approved a revised overall development plan for the PRD -3 zoned site from a 114 unit condominium plan to allow construct- ion of a 34 -unit townhouse development. Laukka and Associates, the proponent, has now returned with a final plat for the westerly portion of the site, that portion that fronts on Shaughnessy Road and are requesting final plat approval for town- house type lots in keeping with the final rezoning that they received. After this initial phase of the project, it is presumed they would return with subsequent final plats (Dewey Hill Fifth Addition, Sixth Addition, etc.) until the project is complete. Mayor Courtney asked what the density was for the plat. Mr. Hughes recalled that the density was 35 units on about.13 acres of property, or less than 3 units per acre. In response to Member Turner, Mr. Hughes indicated there are no changes since last reviewed by Council. No further comment being heard,•Member Turner offered the following resolution and moved its adoption: RESOLUTION APPROVING FINAL PLAT. FOR DEWEY HILL FOURTH ADDITION BE IT RESOLVED by the Edina City Council that that certain plat entitled "Dewey Hill Fourth Addition ", platted by Laukka and Associates, Inc. a Minnesota corporation, and First Edina National Bank, a national banking association, and presented at the Regular Meeting of May 21, 1984, be and is hereby granted final plat approval. Robert Clark, 7701 Glasgow Drive, asked what happened to Dewey Hill Third Addition. Mr. Hughes explained that Dewey Hill Third Addition was a single lot plat of this property for construction of a 114 unit condominium building. There was then a change in the plan with new zoning for a different development type which then necessitates a further platting of the property. Request "STOP" sign be installed at West 66th Street and Ridgeview Drive for westbound traffic. Petition received from several neighborhood residents. ACTION TAKEN: The Committee discussed current traffic flow, signing, and problems existing at the intersection. Mrs. Fuhr moved the installation of a "STOP" sign as requested. Mrs. Coon seconded the motion. Motion was defeated 2 ayes - 3 nays. Captain Kleven offered the fact of one intersection related accident at the location since January 1, 1983. Mr. Hoffman discussed the probable history of the current controls which were based on West 66th Street as a primary arterial to TH 100 prior to the '70's TH 100 reconstruction. Mr. Hoffman moved that double -arrow warning signs be erected to bring attention to the "T" configuration of the .intersection to increase driver awareness. Mr. Swanson seconded the motion. Request for installation of "PREPARE TO STOP" sign on northbound Tamarac Avenue and "STOP" sign at Tamarac Avenue at Aspen Road. Petition received from numerous area residents. ACTION TAKEN: The request by the petitioning residents was reviewed. Captain Kleven reported that the area had had two reportable accidents since January 1, 1983. Mrs. DonFrancesco stated that an increase in teenage drivers in the area has contributed to the problem. Mrs. Lipetzky reported that evenings and weekends, when drivers not familiar with the intersection are driving in the area, seems to be the most critical time. Captain Kleven explained a 1985 change in State Statute that clarifies right -of- way at "T" intersections; non - turning traffic has the right of way, turning traffic must yield. The Committee further discussed the appropriateness of a "YIELD RIGHT -OF -WAY" sign, other warning signs, and the value of marking lanes. Mr. Swanson moved that a "YIELD RIGHT OF WAY" sign be erected controlling northbound traffic on Tamarac Avenue at Aspen Road .along with appropriate warning signs r —nort oun amarac venue traffic Wrs .Coon seconded the motion. Mrs. Fuhr amended the motion to include lane markings on amarac venue . Motion carried 4 -1. 3. . Discuss modification of on- street parking near the Edina Community Center. (Continued from September 1985 Traffic Safety Committee meeting. ACTION TAKEN: Mr. Doug Johnson, Edina Community Center, assessed current Center parking patterns and needs currently existing: Newly constructed parking lots seem to be utilized as designed. Evening parking for Community Education creates the greatest parking need. Administrative steps, including reduced class overlap, have eased the greatest potential need for spaces. Convenient "drop -off" areas are needed where parking "turn- .over" should be encouraged. Greater "Handicap" parking is needed. TRAFFIC SAFETY COMMITTEE MEETING October 15, 1985 Page 3 (Continued) Safety for exiting traffic to Southview Lane could be improved by restricting parking at and near the driveways. On- street parking on Normandale could be restricted by time to encourage "turn- over ". The Community Center does not want to encourage parking in the residential areas. Certain large school events such as football games and graduation. may cause residential area parking. Mr. Hoffman noted earlier assessments and discussions which included a total prohibition of parking on Southview Lane. Mr. Swanson explained the difficulty of enforcing short time parking zones. Mr. Hughes moved that "NO PARKING ANYTIME" signs be erected for the entire length of Southview Lane, "TWO HOUR PARKING" s�icns be erected along Normandale Road adjacent to the Community Center, and the "NO PARKING HERE TO CORNER" sign south of Southview Lane on Normandale Boulevard be moved 25 feet further south to enhance safety. Mr. Swanson seconded the motion. Motion carried 5 -0. 4. Discuss "NO TURN ON RED" restriction (hourly or permanent) when semaphores are installed at West 70th Street and Cornelia Drive. Recommended by Traffic Safety Committee members. ACTION TAKEN: Mr. Swanson moved that "NO TURN ON RED" restrictions, consistent with park a-3 school pedestrian traffic, -be included when the semaphores are installed at West 70th Street and Cornelia Drive. Mrs. Coon seconded the motion. Motion carried 5 -0. 5. Request for "NO PARKING - TRUCK LOADING ZONE" be installed at 3939 West 50th Street. Request made by Captain L. Kleven, Edina Police Department. ACTION TAKEN: Captain Kleven explained that the current loading zone is not definitive enough to be enforceable and requested language that would clarify the issue. Also, there is a need for such a zone to service the commercial area. Discuss traffic concerns on Gleason Road, north and south of Valley View Road. Requests received from L. Thomas Gartner, 6500 Gleason Road and Robert Miller, 6905 Gleason Road. ACTION TAKEN: Captain Kleven reported 12 accidents occurring on the subject roadway since January 1, 1983...eight accidents north of Valley View Road and four accidents south of Valley View Road. During the same period, 58 enforcement contacts were made. Captain Kleven further stated that because of the character of the roadway (narrowness, hills, curves) enforcement action is difficult. Mr. Hoffman reported considerably higher traffic volumes north of Valley View Road than the south segment. Also, he stated the engineering solutions to the roadway as being reconstruction and /or "super- elevation" of the curves. These solutions might enhance safety but would not decrease speed on the roadway. Mr. Miller stated that one problem south of Valley View Road was the lack of a defined walkway or sidewalk for pedestrians. Also, he had made measured observations of traffic and found that few, if any, motorists travel at the advisory 25 MPH speed. Mr. Miller suggested one or more "STOP" signs to slow traffic south of Valley View Road. Mr. Swanson explained the reluctance of the Committee to install unwarranted "STOP" signs to control speed. Mr. Hoffman further stated that "STOP" signs on steeply graded roadways can in and of themselves become hazardous. Mrs. Fuhr questioned the nature of traffic on Gleason Road as to it being local or related to the industrial areas of the City. Mr. Hoffman stated that volumes of traffic would suggest TRAFFIC SAFETY COMMITTEE October 15, 1985 Page 5 (Continued) local traffic south of Valley View Road and local and other traffic north of Valley View Road. Mr. Miller again mentioned "STOP" signs as a way to deter non -local traffic. Mrs. Coon stated that the neighborhood of Schey Drive and Gleason Road had received a mixed reaction when a "STOP" sign was installed. She stated it created a false sense of security. Mr. Swanson moved that a speed analysis study and a point of origin study of traffic south of Valley View Road on Gleason Road be conducted. Results should be reported to the Committee during the November meeting for review. Mrs. Fuhr seconded the motion. Motion carried 5 -0. Miller M.D. 6905 Gleason Road Edina, MN. 55435 (612)944 -0630 Francis Hoffman City Engineer Chairman Traffic Safety Council 4801 West 50th Street Edina Minnesota 55424 Dear Mr. Hoffman: I am writing to you and the members of the traffic safety committee to express my concern with the dangerous speeds of traffic on Gleason Road south of Valleyview. I recently purchased a home at 6905 Gleason Road, and although I anticipated the volume of traffic on Gleason Road, I have been shocked by the frequent occurrence of excessive speeds from Valleyview to Braemar Park. This stretch of Gleason Road is not ideally designed as a through street, with no walkway, houses located fairly close to the street, and a relatively narrow roadway. Compounding the problem is the reduced visibility due to curves and hills through this area. If all of the drivers observed the suggested 25 miles per hour limit, there would be no real danger. Although the majority of the people do observe the legal limit, there are a significant number of "test drivers" who far exceed the legal limit and pose a significant hazard. I have spoken with a representative of the police department in the hopes of increasing the patrol of this area, but sense a lack of concern. I am aware of a fatality occurring in this area recently, and have also been in contact with a neighbor on the north side of Valleyview, Mr. Thomas Gartner, who has expressed concern with the traffic in front of his home. Must we wait for another fatality until some action is taken? I appreciate the fact that it is difficult to come up with a solution for a complex problem such as this. Attempts to decrease the volume of traffic may be difficult unless alternate routes can be devised. It may be possible to decrease the volume and the speeds of the traffic by installing frequent stop signs along the route, for example at Scotia Drive, Lochmoor, etc. More frequent patroling of the area and use of radar and ticketing of violators would help to remind people of the residental nature of the street. Captain Kleven claimed parking on Gleason Road with a patrol car would itself constitute a hazard. I suggest he position a patrol car at the junction of Scotia and Gleason which would allow him to monitor the traffic from either the north or the south. I would like to thank you for your concern and prompt responses to these past action alerts. I also sincerely wish I did not have to send the following action alert to you, but once again we are faced with a proposal that could severely impact Minnesota's cities. As bizarre as it may sound, the following is actually under consideration. The Clean Water Act of 1972 requires the Federal Environmental Protection Agency to issue a permit and control pollution levels entering the waters of the United States from every manmade discharge point. So far, the EPA has-- concentrated on the the big pollution pro5ems, which include municipal sewage systems and waste water generated by industrial processes. Now, in response to a federal court ruling, EPA has said it will require storm water collection systems to obtain a permit similar to those issued to waste treatment facilities and major industrial plants, even though by EPA's own estimate the overwhelming majority of storm systems are relatively a minor pollution concern and deserve low priority attention. Given the limited resources available for water pollution cleanup and the enormous number of separate storm water permits required, doggedly pursuing a policy of requiring permit applications and issuing cleanup requirements for storm water discharges threatens to make a mockery of the Clean Water Act itself. EPA estimates that there are more than one million separate storm water discharge points within the country's 366 major urban areas. EPA has given municipal agencies two years to complete a complex and expensive permit application for each discharge pcint which includes detailed sampling and laboratory test procedures. The cost of merely completing the applications easily could exceed $8.5 billion; or $1 billion more than the Federal Government plans to contribute to water pollution treatment facilities construction over the next three years. The enormity of-the problem for cities across the nation strains credibility. Kansas City, Missouri's, waste treatment system requires just 12 permits, and annual monitoring costs $160,000. The city estimates it will need to apply for 20,000 storm water permits, at a cost of more than $90 million] The cost impact will vary for each of Minnesota's cities, depending on how many identifiable storm sewer discharge points there are in the community. The Minnesota Pollution Control Agency would issue the permits. There is the possibility of issuing one or several permits to cover all the cities in the state, as well as modifying the proposal to mitigate the consequences of requiring permits but no League staff member is confident that the EPA regulations can be written to ensure that Minnesota's cities will not be faced with another expensive federal regulatory system. Cities should also know that the issuance of regulatory permits is the first step to requiring "best management practices" -or treatment of storm water discharges to eliminate any possible pollution. Cities contemplating separation of their storm and sanitary sewer systems may want to ask their Congressmen whether the systems should be separated or whether the city should seek federal funds to increase their treatment facility so that all storm writer can be treated. I know it is difficult to take such an absurd proposal seriously. Many potentially affected parties whom I have talked to have thought.the proposal totally insane and were amused to think.that Congress might actually do something so damaging to the goals of the Clean Water Act. I am afraid, however, that unless city officials speak up, and loudly, that there is a very real possibility that Congress will allow the permitting to begin. It seems clear to League staff that the best solution to this problem is to admit that the proposal to permit, regulate, monitor and /or treat storm sewer discharges is not feasible at this time. The costs and difficulties of applying the permit process to intermittent storm water discharges are only now coming into focus. Congress must be requested to act to ensure that the letter of the Clean Water Act does not overwhelm the spirit of the law -- to clean up the waters of the United States effectively, efficiently and in a manner which addresses the highest priority pollution control needs first. I " What City Officials Should Do Congress is currently completing work on a revision of the Clean Water Act. House and Senate members are meeting in Conference Committee to put the finishing touches on a bill. Minnesota is lucky to have three members of our Congressional delegation on the Conference Committee: Senator Dave Durenberger, Representative James Oberstar, and Representative Arlan Stangeland. Call or write Senator Durenberger and Representatives Oberstar and Stangeland and ask them to suspend the permit requirements for separate municipal storm sewers pending a better understanding of the task, the need and the best approaches to controlling the storm water discharges that.need to be controlled. It makes little sense to start taking money out of the pockets of city residents if we don't know the extent of the problem or its solution. City officials should also ask that our Conferees continue to push hard for Minnesotal's fair share of waste water treatment construction grant funds. There is a proposal to change the allocation formula which would result in Minnesota losing millions of dollars in grant funds to other states. As I'm sure you know, the Edina Historical Society wants to establish a permanent museum facility and Society headquarters. Research and a report rela- tive to that need has been requested and will be submitted to you relatively soon. In the meantime, the Grimes home at 4200 West 44th Street has become available for purchase. The Edina Historical Society, through the City of Edina, would like very much to purchase the Grimes home as a museum and historical records depository. We would propose to execute the enclosed purchase agreement and to further negotiate on the purchase price as necessary. You'll note that the addendum to the purchase agreement makes the purchase assignable to the City, and that the contingencies contained there- in "must be performed or satisfied before the date of closing: ". The contingencies cover the zoning and other permits which would be necessary, the financing (in other words, can the City and the Historical Society afford to do this), and (c) the proposal and the proposed use fit with the neighborhood. The asking price is $229,000, we have offered $180,000, our assumption is that there is room for negotiation on both sides. Under this agree- ment we would have until January 20 to perform or satisfy the contingencies. If you want more information relative to the potential for purchase price, I would be happy to discuss that with you privately. Mr. Day is concerned about a piece of property to the rear of his home which is between his property and Minnehaha Creek. According to Mr. Day, his concern for this piece of property goes back to 1951 when the street to the rear of his home along the Minnehaha Creek was vacated. Half of the property was given to the home owners and the other half went to an Outlot A between the road and the creek. This little strip of property paralleled Minnehaha Creek between the home owner on 55th Street and Minnehaha Creek. Mr. Day had contacted the county and had a Quit Claim whereby this outlot was divided and adjoined to each one of the property owners along the creek. All these small lots were attached to the home owners except Mr. Day's property by an oversight by the county. In June of 1957 it was brought to Mr. Day's attention that he did not own this property and an oversight was made by the county and through a county board meeting the property was then signed over to Mr. Day. Between June, 1957 and 1966, there were no taxes paid on this piece of property by Mr. Day who thought he had been paying taxes, but in fact had not. The property in 1966 was picked up by the city as tax forfeited land. Mr. Day always had felt that this property was his until he started looking into his papers and realized that the city owned this property along the creek. It is now Mr. Days request that he would like to have this matter cleared up and have the property become his. The procedure to have this done would be as follows: BK:mk 1. This program shall include sufficient projects to utilize all existing and anticipated funds accruing during the life of the program. The program will be updated at 3 -year intervals and a review made at that time to ascertain program implementation. The requirements were reviewed and it was determined that this information is valuable to the Unencumbered Construction Fund Subcommittee, as well as, useful to the City Engineers in making the city councils more aware of State Aid funding To comply with this directive, each city is requested to submit a council- approved, itemized 5 -year program of proposed construction by priority, showing the termini, length, estimated cost, and type of anticipated projects on the enclosed forms. Include only State Aid expenditures in this report. This submittal should be returned to the District State Aid Engineer by Aug. 15, 1985.
