The following facts and points will support this: 1. Our property is.bounded on the north by Shephard of the Hills Lutheran Church and a parking lot joins to our back yard. Traffic is heavy in and out of this parking lot due to meetings and various church activities, both daytime and evening. 2. To the east we are bounded by an overflow parking lot for the church, which is poorly maintained, is very tacky and is a source of many complaints by all neighbors. 3. To the east also is Blake Road with a very high traffic flow of cars and trucks and is also a county road. 4. Our property is located in the area of Edina, which is assigned to the Hopkins School District, and we have found it to be detrimental in selling our home. 5. Finally and certainly very important, we attempted to sell our property over a span of 18 months with no success in the $150,000 range.. The above four reasons were why we.could not move it'and based on these reason, I believe a fair evaluation range is $120,000 to $125,000. The property, as it exists by itself, has a limited use because of its odd shape and front- age on Vernon Avenue. The City will allow only one right of ingress to the property from Vernon Avenue, which will cause a certain amount of addi- tional expenses and ground use to gain access to the property for development. 2. As the City has minimum requirements for lot depth and frontage, there is probably only two develop- able lots available if this property were to be developed by itself. 3. The property is owned by four separate individuals with varying degrees of ownership. 4. The property has a tentative approval for a multi- dwelling zoning on condition that the property is combined and developed simultaneously with the ad- jacent property. This is assuming that the adjacent property, Assessor's Parcel 32- 117- 21 -24-0004, is developable. As of the date of writing this letter, the adjacent property is tied up in litigation in an effort to determine the correct boundary lines of said property. - 2 - 5. As the rpoperty now stands, it is not develop- able as designated in the tentative subdivision map on file with the City of Edina. In reference to Assessor's Parcel 32- 117 -21 -24 -0004, I received a notice of increased assessment valuation from $285,000 to $340,000. I feel that the property is being over - assessed for the following reasons: 1. The property, as it presently exists, is not developable because the existing legal descrip- tion does not describe the property as it exists on the Assessor's Maps. For a more detailed ex- planation of the problems involved, you should contact the Attorney, Mark Wood, whose phone number is (612) 224 -4911. 2, The property cannot be developed as shown on the tentative subdivision map because the legal description, as it now exists, does not encom- pass the property to be developed. 3. I placed my home on the market for sale over a year ago and it has been continuously on sale since that time. Initially I tried to sell it myself during the month of May of 1983 and was unsuccessful so that in June of 1983 I turned it over to the Krieser Realty Company and at their recommendation I initially placed it on the market at $330,000 but it was obvious that this was too high a value and I shortly thereafter reduced it to $309,000 asking price. The asking price was placed simply to allow room for price reduction. Eberhardt continued to have the house on the market and in the beginning of May of 1984 it has been reduced to an asking price of $275,000 with clear indications that we will reduce that price still further to obtain a sal'e. Nelson, an appraiser in real estate and not a realtor involved in the sale of my home, indicates a square footage on the first floor of finished space of 2,560 feet and 800 feet upstairs for a ;total of 3,360 feet of finished living space. I have been looking at homes in Edina to scale down my cost of living and have found several homes with the square footage in the $4,000 tax range and recently looked at a double bungalow on France Avenue with 4,000 square feet of finished space and taxes in approxi- mately the $4,000 range. I paid $67,500. in 1978. It will cost $20,000. to do the following items: new carpeting in the living room, dining room, den and the two bedrooms. The present carpeting is soiled and worn. the walls of the dining room, living room, and den, and the ceilings of all three rooms need redecorating. The screen doors going out to the porch do not fit properly and can't be moved. The six closet doors don't fit properly, and the kitchen should have new cabinets as the present ones don't fit. In addition, the electric range is twelve years old and the refrigerator is about twenty years old. The cost of the garbage disposal put in this year was $187.999 and the new dishwasher put in two years ago was about $500. The cost of running the building per quarter this year was raised to $636. It was only about $300. per quarter when I purchased the apartment. There are now five apartments for sale in the building. I purchased 10M Standard Oil of Indiana Bonds 7 7/86 in 1977 at $99.58• On Friday, May 18, 1984 they closed at $59.50• We purchased 10M Commonwealth Edison on 12/18/78 at $80. They closed last Friday at $56.25. I purchased 10M Gulf Oil 81% due in 1995 at par and on May 18th they closed at $70.5/8. We purchased 5M AT &T 8.80% on 5/7/75 at $99. and they closed Friday at $65.5/8• I would like to make these repairs on this apartment, but don't feel I can sell these bonds at such a loss to do so at this time. I don't think-it is possible to lk find a buyer who whould pay $104,300 for the apartment who would be anxious to pay interest at the rate of 13% on a mortgage. Because there was not time to complete that review before the date for payment of the first half of the 1984 taxes, we caused a petition to be filed in the Minnesota Tax Court with respect to the taxes payable in 1984. The tax statement indicates that your office placed a total value of $2,108,000 on the property as of January 1, 1983, and Carl tells me that you have continued the same value as of January 1, 1984. I would like to deal with both the petition and the 1984 assessment in the same presentation. I do not believe there has been any significant change in values of undeveloped property in Edina between January 1, 1983, and�January 1, 1984, so that any adjustment we might agree upon should properly be applied as of both valuation dates. I think it clear that we are unlikely to be able to establish value of the 62.4 acres represented by Parcel A through any compara- tive sale approach or by any income or replacement cost analysis. My experience tells me that the most efficient way to establish what would be paid in the market place for a parcel of undeveloped land is to examine the expenditures that would be required in order to subdivide the property and make the lots salable. It is my understanding that the entire parcel is presently classified R -1 and would be limited to single family residents unless the zoning authorities could be persuaded to establish some other zoning classi- fication. The possibility of a change in zoning is so speculative that I have not considered that possibility. Mr. Ralph Johnson -2- May 23, 1984 When Carl Hansen established the platting of his last addition (I believe it was either the 20th or.21st addition to Parkwood Knolls), he also presented a tentative platting for Outlot A. It,is unlikely that Outlot A could ever be developed according to the tentative plat because no consideration was given to the character of the land included in each lot or the cost that might be incurred in order to make any of the lots buildable. Having walked the parcel, it is my impression that at least 20 - 25 of the 112 lots identified on the preliminary plat could never be sold. Either they are located in swamps or in gullies or slopes with an incline so steep that building would be too costly. Therefore, I think it reasonable to conclude that Outlot A will not produce more than 90 salable lots. I think it obvious that immediate installation of all utilities to produce the 90 lots would be not only uneconomical but foolhardy. The carrying costs of those improvements over the period of time neces- sary to dispose of the entire subdivision would destroy any prospect for profitability the owner might have. Nevertheless, it seems reasonable to determine what the costs would be and project the impact of those costs, the carrying costs including interest and real estate taxes that would result from those improvements so as to determine how much one could afford to pay for the raw land. Since Carl has relied upon Egan, Field & Nowak, Inc., for his engineering services, I requested that they provide an estimate of the costs necessary to complete streets, water,. sewer and all related expenses. I attach a copy of Bruce Grivna's letter addressed to me on May 17, 1984. Notice that his estimate merely relates to the installation of the common services necessary for all lots to be developed in Outlot A. It makes no provision for any "cost to cure" that might be necessary with respect to the 90 lots I believe to be the maximum that could be achievedout of the parcel. The next stage in my analysis was to try to determine the price at which one paying $2,108,000 for Outlot A would have to sell his lots after the improvements had been installed in order to break even. For that purpose I assumed we would have 90 salable lots requiring various "costs to cure" after the improvements had been accomplished. I made no estimates of costs to cure. I assumed that the entire purchase would have to be financed and that interests costs would be 15% per annum. I also assumed that Edina real estate taxes would continue at their present rate of approximately 3.6% of market value. Of course, I also assumed that when the improvements had been ac- complished, market value of the property would be increased by at least the amount of the cost of improvements. That would mean the lots sold at the end of the second year would have to bring approximately $69,000, and would increase the price at roughly $10,000 a year until they were sold. When I called for you yesterday, Jo Provo was able to provide me with the information I was seeking. I understand that Carl still has 13 unsold lots in his presently platted addition. Jo gave me the values placed on those various lots. Those values indicate that the maximum price that might be attained after all costs to cure have been expended would be $60,000 a lot. Taking into account the various costs to cure the 13 lots involved results in an average value for advalorem taxes of $31,922. It is Carl's view (with which I agree based on merely a casual walk through of Outlot A) that the average lot of the 90 that might be produced in Outlot A would have about the same average cost to cure as is thought appropriate with Mr. Ralph Johnson -4- respect to the 13.
