RESOLUTION ADOPTING AND CONFIRMING
SPECIAL ASSESSMENT LEVIED ON ACCOUNT OF
PUBLIC IMPROVEMENT
BE IT RESOLVED by the City Council of the City of Edina, Minnesota, as follows:
1. The City has given notice of hearing as required by law on the proposed assess-
ment rolls for the improvement hereinafter referred to, and at such hearing held
on October 3, 1983, has considered all oral and written objections presented
against the levy of such assessment.
2. Each of the assessments as set forth in the assessment rolls on file in the
office of the City Clerk for the following improvement:
Street Improvement No. BA -255
does not exceed the local benefits conferred by said improvement upon the lot, tract
or parcel of land so assessed, and all of said assessments are hereby adopted and
confirmed as the proper assessments on account of said improvement to be spread
against the benefited lots, parcels and tracts of land described therein.
3. The assessments shall be payable in equal annual installments, the first of
said installments, together with interest at a rate of 112% per annum, on the entire
assessment from the date hereof to December 31, 1984, to be payable with the general
taxes for the year 1984. The number of such annual installments shall be as follows:

4. The City Clerk shall forthwith prepare and transmit to the County Auditor a copy

by a county, by a political subdivision, or by the owner of any right -of -way as
required by Minnesota Statutes, Section 429.061, Subdivision 4, and if any such
assessment is not paid in a single installment, the City Treasurer shall arrange for
collection thereof in installments, as set forth in said section.

EDINA CITY COUNCIL HELD AT CITY HALL
OCTOBER 3, 1983
Answering rollcall were Members Bredesen, Richards, Schmidt, Turner and Mayor Courtney..
WILLIAM MCMAHON COMMENDED. City Manager Rosland introduced William McMahon and
commended him for his years of service to the City. He noted that Mr. McMahon
began his employment with the City of Edina in September of 1966 with the Sewer
Department, duties included lift station maintenance and sewer maintenance. Since
the summer of 1969 he has been employed in the Park and Recreation Maintenance
Department until present, with his responsibilities including the planting of
trees, planting from seed the 50 flower beds within the City, and operating the
greenhouse. Mr. Rosland stated that Mr. McMahon has been a faithful, hardworking
employee to the City of Edina and he presented him with a silver pen bearing the
Edina Logo. Mr. Rosland along with the Council Members congratulated and thanked
Mr. McMahon for his dedicated service.
MINUTES of the Regular Meeting of September 19, 1983 were approved as submitted
by motion of Member Turner, seconded by Member Schmidt.

approved as submitted by motion of Member Schmidt, seconded by Member Bredesen.

PUBLIC HEARING CONDUCTED ON STREET IMPROVEMENT NO. BA -255. Mr. Rosland indicated
that the Public Hearing of Street Improvement No. BA -255 had been continued from
the September 19, 1983 meeting so that staff could review the cost figures for
this construction project. Mr. Rosland presented Analysis of Assessment for Street
Improvement No. BA -255 showing total construction cost of $37,207.65, proposed to
be assessed against 580.76 assessable feet at $64.07 per foot against estimated
assessment of $73.83 per foot. Mr. Hoffman explained that the total construction
cost listed on the revised analysis of assessment is less the State aid contri-
bution. No further comments being heard, Member Bredesen offered the following
resolution and moved its adoption:

APPEAL OF DECISION BY BOARD OF APPEALS AND ADJUSTMENTS WITHDRAWN. Mr. Hughes advised
Council that Mr. Lyall Olson has withdrawn his appeal from the Board of Appeals
and Adjustments decision approving a 4.6 percent Lot Coverage Variance and a
4 foot Side Street Setback Variance for Kathleen Knutson at 5445 York Avenue
South. No formal action was taken.

Generally located: North of Radisson South Hotel and west of Highway 100.
The Commission and Council reviewed and approved preliminary plans for this
project on August 31, 1983 and September 19, 1983, respectively, The proponents
have now returned with final plans and request final rezoning to PC -2, Planned
Commercial District. The final plans contain site, landscape, utility and grading
plans as well as building elevations.
Recommendation
We recommend final rezoning approval conditioned upon final platting and increase
in the number of landscape materials along the interior -property Jines where
appropriate.

Mr. Hughes told the Commission that the subject property
measures 2.75 acres in area and is zoned PID, .Planned Industrial
District. The easterly one -third of the property is improved
wltn an ottice building w is cuple y Minnesota Federal
Savings and Loan. The westerly two - thirds of the property is
vacant. East of the property is a service station and
restaurant. South of the property is the Radisson South. To the
north and across the street is the First Southdale Bank. To the
northwest and southwest are office and office warehouse uses.
The proponents are requesting a rezoning to PC -2, Planned
Commerical District for the property which would facilitate the
construction of a 15,000 square foot building on the westerly
portion of the site. About 60% of this building would be
occupied by three, complementary fast food restaurants which
would share seating facilities. The remainder of-the building
would be occupied by unspecified retail uses. Based upon the
floor area of the proposed building and the seating capacity of
the restaurant (about 120) seats, 110 parking spaces are provided
on the property which complies with ordinance standards.
Mr. Hughes explained that the proponents. have also
included the Minnesota Federal building and lot in their petition
for rezoning at Staff's suggestion because 1.) the parcel
occupied by Minnesota Federal is below the minimum lot size for
PID lots; and 2.) a finanacial institution is more appropriately
zoned PC -2 rather than PID. Also requested is a lot subdivision
of the property to separate the reatil site from the Minnesota
Federal parcel.
Staff believes the proposed use will provide a needed
service facility for the adjacent office and industrial district
and that the site is appropriate for the retail uses due to its
proximity to adjoining commerical uses and collector and arterial
streets. The Comprehensive Plan shows this site as a potential
commerical site.
Mr. Hughes recommended preliminary rezoning approval
conditioned upon acceptable final development plans and final
platting. Final platting is subject to subdivision dedication.
Mr. Chip Glaser and Mr. Peter Jarvis were present to
answer any questions.
Mr. Jarvis told the Commission that Dairy Queen would
occupy one of the restaurant spaces along with a chicken and a
bakery type restaurant in the other two spots. A travel agency
and beauty shop would also be located in this one story
structure. He displayed plans of the project for the Commission
and noted that upon approval, construction would begin this fall.
Mr. Gordon Johnson wondered if there was a curb cut
across from Metro Boulevard and Mr. Jarvis noted that it was
straight across, would be located from Metro Boulevard.
Gordon Johnson moved for rezoning and preliminary plat
approval subject to subdivision dedication. John Skagerberg
seconded the motion. All were in favor, the motion carried.

Industrial District. The easterly one -third of the property is improved with an office
building which is occupied by Minnesota Federal Savings and Loan. The westerly
two - thirds of the property is vacant. East of the property is a service station and
a restaurant. South of the property is the Radisson South. To the north and across
the street is the First Southdale Bank. To the northwest and southwest are office
and office warehouse uses.
The proponents are requesting a.rezoning to PC -2, Planned Commerical District
for the property. Such a rezoning would facilitate the construction of a 15,00o
square foot building on the westerly portion of the site. About 600 of this building,
would be occupied by three, complementary fast food restaurants which would
share seating facilities. The remainder of the building would be occupied by
unspecified retail uses. Based upon the floorarea of the proposed building and the
seating capacity of the restaurant (about 120 seats), 110 parking spaces are provided
on the property which complies with ordinance standards. Other requirements of
the Zoning Ordinance - appear to be met.
The proponeras have also included the Minnesota Federal building and -lot in their
petition for rezoning at our suggestion. We recommended this because 1.) the
parcel occupied by Minnesota Federal is below the minimum lot size for PID lots;
and 2.) a financial institution is more appropriately zoned PC -2 rather than PID
The proponents are also requestinq a two lot subdivision of the property to
separate the retailsite from the Minnesota Federal parcel.
Recommendation
We believe that the proposed restaurant and retail uses will, provide a needed service
facilitiy for the adjacent office and industrial district. We also believe that the site
is appropriate for the retail uses due to its proximity to adjoining commerical uses
and collector and arterial streets. This site was also shown as a potential commerical
site by the Comprehensive Plan.
Staff recommends preliminary rezoning approval conditioned upon acceptable
final development plans and final platting. Final platting is conditioned upon subdivisior
dedication.

Mr. Hughes recommended approval; however, pointed out
that the owner of Lot 6 should be cautioned that Staff will be
very reluctant to recommend approval of a variance for Lot 6
which would be necessitated by the reduction of lot width caused
by this division.
Mr. Runyan moved for approval and Gordon Johnson seconded
the motion. All were in favor; the motion carried.

Mall, I herewith petition the City Council to lift a restriction,
as it applies to the above referenced property, which is found in
the Yorktown Declaration of Restrictions and Protective Covenants
(adopted May 3, 1972) and pertains to restaurants.
The restriction reads, in part, as follows:
"Only restaurants which are designed for customers to sit down to
order and to eat shall be constructed and maintained on any Yorktown

an ancillary use, in a building not designed or used primarily for

The reason we want the restriction lifted is to allow for the oc=

Wendy's is to be a-sit down restaurant in all respects, customers
do stand to order much as they do in a cafeteria.
We feel very strongly that this addition to the center will increase
it's drawing power and thereby strengthen a center that has been
plagued by frequent tenant turnovers.
We feel the lifting of the restric-tion is warranted in this case
because the restaurant proposed will be integrated with the center,
not a freestanding facility which we assume the restriction was
originally intended to prohibit.

Be it Resolved, That
The Board of Education
Approve of maintaining public ownership of the Wooddale School
property, and convey the property to the City of Edina under
terms that reflect the value of the property to the community
at large and to the school district. Further, that such property
be kept in public ownership by the City of Edina; and if at any
future time the school district would need the property, it would
have the right as established to re- acquire the property from
the City.

NUISANCES AND OFFENSES AGAINST THE PUBLIC HEALIH,'WELFARE AND SAFETY

PART 1. NUISANCES - GENERAL.
10.01. PUBLIC NUISANCES.
Subdivision 1. Definition. Whoever by his act or failure to perfcr:a a legal duty
intentionally does any of the following is guilty of maintaining a public nuisance:
(1) Maintains or permits a condition which necessarily annoys, injures or en-
dangers the safety, health, morals, comfort or repose of any considerable number of
members of the public; or
(2) Interferes with, obstructs or renders dangerous for passage any public high-
way or right -of -way, or waters used by the public; or
(3) Is guilty of any other act or omission declared by law or by this code to
be a public nuisance.
CROSS - REFERENCE: The definition contained in this section is based
upon the definition of nuisance contained in state law.
Subd. 2... Public :Nuisances= Affecting-Health.:. -The following are hereby declared to
be nuisances affecting health:
(1) Exposed accumulation of decayed or unwholesome food or vegetable matter;
(2) All diseased animals running at large;
(3) All ponds or pools of stagnant x7ater;
(4) Carcasses of animals not buried or destroyed within 24 hours after death;
(5) Accumulations of manure or rubbish;
(6) Privy vaults and garbage cans which are not rodent free or flytight, or
which are so maintained as to constitute a health hazard, or to emit foul and
disagreeable odors;
(7) The pollution of any public well or cistern, stream, lake, canal or body
of water by sewerage, creamery or industrial wastes, or other substances;
(3) All poisonous plants including but not limited to poison ivy, poison oak
and ragweed; all plants detrimental. to health, -any growth of weeds; grass; brushy -'_
,or other rank vegetation to a greater height than.six: "inches;on the average, or'
`any accumulation of'dead ,ieeds,`grass or brush..:(1972 =3) 4- 24 -72.
(9) Dense smoke, noxious fumes, gas and soot, or cinders in unrerscr.able
quantities;
(10) Offensive trades and businesses as defined by statute not licensed by the
city board of health as provided by law; -
(11) All public exposure of persons having a contagious disease.
Subd. 3. Public Nuisances Affecting Morals and Decency. The following are hereby
declared to be nuisances affecting public morals and decency:
(1) All gambling devices, slot machines and punch boards;
(2) All houses kept for the purpose of prostitution or promiscuous sexual inter-
course, gambling houses, houses of ill fame, and bawdy houses;
(3) All domestic animals in the act of coupling, exposed to public view;
(4) All places where intoxicating liquors are manufactured, sold, bartered, or
given away in violation of law, or where persons are permitted to resort for the
purpose of drinking intoxicating liquors as a beverage, or where intoxicating liquors
are kept for sale, barter or distribution in violation of the lace, and all liquors,
bottles, kegs, pumps, bars and other property kept at and -:used for maintaining such
a place;

Dear Mr. Rosland:
I had a meeting today with Ernie Peterson and Manning Camilon, inspector
..with the city of St. Louis Park, on the subject of 'weed elimination'.
Mr. Peterson gave me the enclosed St. Louis Park City Ordiences. Section
6 -153, 6 -154 and C -155 deal with the subject.
Mr. Camilon stated that he will give 7 days notice to a property owner
if his grass is over 6" in height. He will, however, work with the
owner if it is inconvenient for them to abide by the ordience within
the 7 day period and reschedule an inspection within a reasonable time.
The reason for grass cutting in order of importance includes:
1. the breeding of insects and mosquitoes and related
health problems.
2. possible breeding grounds for rodents (if people
don't take care of their lawn, they may not be
caring about their garbage area and these places
are used by rodents for shelter).
3. Impairs property value.
My wife, Betty, and I will plan to attedn the City Council meeting on
Monday night.

Section 6 -152. Sidewalk in Disrepair a Public Nuisance - Duty of
Owner.
(1) A public sidewalk in such a condition of disrepair
as to render its use by a pedestrian unsafe is hereby
declared a public nuisance.
(2) The owner or occupant of any property within the City
abutting a public sidewalk shall keep the sidewalk in
repair and safe for use by pedestrians. Repairs shall
be made in accordance with standard specifications
on file in the office of the city clerk.
Section�.6 -153. Weed Elimination - Duty of Owner.
(1) Any weeds, whether noxious or not as defined by state
law, growing upon any privately owned lot or tract
• of land in the City or upon any public boulevard or
similar public property alongside the traveled
portion of a street or alley abutting the private
property at a height greater than 6 inches are hereby
declared to be a nuisance.
(2) The owner or occupant of any such property or abutting
property shall prevent such nuisance on the property
or on the abutting public boulevard or similar public
property alongside the traveled portion of a street
or alley and,, if such nuisance occurs, shall cut and
remove the weeds from the property.
(Sec. 6- 153(2) Amended by Ordinance 1335, Mau 1, 1976
Section 6 -154. Weed Elimination - Notice. On or before June I
of each year, and at such other times as ordered by resolution
of the Council, the City Clerk shall publish once in the official
newspaper a notice directing owners and occupants of property
within the City to destroy all weeds declared by Section 6 -153
to be a nuisance and stating that if not so destroyed the weeds
will be destroyed by the Director of Public Works at the expense
of the owner and if expenses thereof be not paid prior to the
following September 1 the charge for such work will be -made a
special assessment against the property concerned.
Section 6 -155. Notice:
(1) Snow, Ice and Rubbish Removal. When an owner or
occupant permits a nuisance to exist in violation
of Section 6 -151, the City Clerk may service a
notice on the owner of the property ordering

�..... removal, elimination, or repair of the nuisance within
seven days after the service of the property. The
notice shall state that in the event of non - compliance,
removal or elimination may be done by the City of St.
Louis Park at the owner's expense, and that if the
expenses are not paid prior to the following September 1
the charge for the work will be made a special
assessment against the property. When no owner
or agent of the owner can be found, notice shall
be sent by certified mail to the person who is
listed on the records of the County Auditor or
County Treasurer as the owner. Service will be
completed upon mailing.
(Sec. 6- 1550) Amended by Ordinance 1335, May 24, 1976)
(2) Sidewalk Repair and Weed Elimination. When an owner or-
occupant permits a nuisance to exist in violation of
Sections 6 -152, 6 -.153 or 6 -154, the City Clerk shall
serve a notice on the owner of the property ordering
removal, elimination, or repair of the nuisance
within seven.days after the service of the property.
The notice shall state that in the event of non -
compliance, removal or elimination will be done by
the City at the owner's expense, and that if the
expenses are not paid prior to the following

Section 6 -156. Abatement by City. If the owner or occupant fails
to comply with the notice within the period allowed for compliance
after service, or if no owner, occupant or agent can be found
the Director of Public `Works may:
(1) Cause the snow or ice or rubbish constituting the
nuisance to be removed;. or
(2) In the case of a public sidewalk which is unsafe
and in need of repairs, report the facts to the
City Manager who in turn shall report them to the
City Council. The Council thereupon, by resolution,
may order the City Manager to cause the sidewalk to
be repaired and made safe for pedestrians by city
crews or by contract let in accordance with law; or

(3) Cause the weeds constituting the nuisance to be -
removed.
Abatement by the City after failure of the owner or
occupant to do so shall not relieve such owner
or occupant of a violation of the Ordinance Code.
(Sec. 6 -156 Amended by Ordinance 1335, May 24,.1976)
Section 6 -157. Personal Liability. The owner of property for
which a current service has been performed shall be personally
liable for the cost of such service. As soon as the current
service has been .completed and the cost thereof determined, the
City Manager shall prepare a bill stating the amount due for
such current service and stating that if the bill is not paid
prior to September 1st the same will be made a special assessment
against the property concerned and shall mail the bill and notice
to the owner and thereupon the amount shall be immediately due
and payable to the office of the City Treasurer.
Section 6 -158. Assessment. After September 1st of each year,
the Clerk shall list the total unpaid charges for each type of
current service against each separate lot or tract of land to
which they are attributable under this ordinance. The Council
may then spread the charges against property benefited as a
special assessment under Minnesota Statutes, Section 429.101
and other pertinent statutes, for certification to the County
Auditor and collection for the following year along with current
taxes.

Snow, Rubbish Removal
Section 6 -150.' Definition. The term "current service" as used-
'in this ordinance means one or more of the following activities
by the City of St. Louis Park: removal of dangerous snow, ice
or rubbish from public sidewalks; elimination of weeds from
public or private property; and repair of unsafe sidewalks.
Section 6 -151. Snow, Ice and Rubbish a Public Nuisance on
idewalks - Removal by Owner.
(1) All snow, ice and rubbish being on a public sidewalk
in such quantities, or in such a manner, as to render
the use of the sidewalk by a pedestrian unsafe, is
hereby declared a public nuisance.
(2) The owner or occupant of any property abutting a
public sidewalk shall remove and clear away all
snow, ice and rubbish from so much of the sidewalk
as is in front of or abuts on the property as follows:
(i) Snow and ice shall be removed from all
sidewalks in all business and industrial
districts within 4 business hours after
the cessation of any fall of snow, sleet
or freezing rain or by the beginning
of business hours of the next business day
following such fall, whichever period is
shorter. Snow and ice shall be removed
from all other sidewalks on the same day
of the cessation of any fall of snow,,
sleet or freezing rain when at least
6 hours of daylight remain after the
cessation, or otherwise by noon on the
following day, whichever period is longer.
(ii) Rubbish shall be removed from all sidewalks
within 12 hours after its accumulation
thereon.

COUNCIL INTERGOVERNMENTAL POLICY
(Strategic Objective #6)

Council Representation
Council Members representation to other policy bodies take on two
forms. The first is representing the City on official positions taken
by the policy body. The second is when Council Members are present on
boards but are serving to represent only their particular interests.
It is the intent of this policy to differentiate these two by the fact
that the Council will actively begin endorsing offical positions of
the Council on issues that are brought to it. Such positions would be
taken at Council meetings and would be done by Council acting on
proposed positions developed by staff. For the second type of
representation it will be the incumbent on each of the Council Members
to indicate that they are acting as representatives only of their
viewpoint when the Council is not taking an official position.
Staff Representation
In the past, staff has represented the Council in view of policy
bodies both on an issue by issue basis, and on an ongoing
representative basis for the City. It is the desire of the Council,
as to the role of staff in these matters, to be in the role of:
Identifying issues
Proposing policies to the Council in line with the Council's
general philosophy, and
Acting as support personnel when Council Members are
representing official City positions and so requested by
that Council member.
Additionally, staff will be utilized to serve, particularly on
advisory boards when the Council feels such is appropriate for those
people to so represent the City as staff members.
In order to maintain an ongoing relationship with the various policy
bodies, Council has established two means by which to maintain that
relationship. The first is establishment of a scheduled series of
meetings with its legislative representatives and also joint meetings
with the School Board. In addition, the Council is represented when
Council members do serve as the key representative to a major
governmental policy body. Such representation is on the following:

In addition, selected staff members, principally in administration,
will each be assigned a "level of government" in which they will
generally stay abreast of developments at that level which are
pertinent to the City and its departments and inform the department
heads in whose responsibility area it lies. These persons will serve
as resources to other Council and staff members in an understanding of
that particular "level's" system as it relates to policy changes.
Department heads will serve as resources for issues in their area of
expertise.
When either a Council member or staff member has been requested to
serve on the advisory board that involves policy matters, and by
status of their position, they could be construed to represent the
official City position, such should be reviewed by the Council.

SUBJECT: Tree Trimming Program
The following persons were contacted to get a concensus of the best time of the
year to trim trees: Jayne McKinnon, Horticulturist, U of MN, Extension Division;
Meg Hamish, Urban Forester for the DNR, State of MN; Ken Brackee, Davey Environ-
mental Services; Forester at Elm Research Institute, New Hampshire. The concensus
was that tree trimming should be done during the dormant period for elms, which
would be spring, fall and winter. Approximately from the 1st of May to the 15th
of September- summer months are not recommended for trimming, although under
a study conducted in the State of Michigan by the Elm Research Institute, there
was no evidence found to show that trimming of elm trees year -round causes any
increase of Dutch Elm Disease. There are other diseases that elms are susceptible
to when they are trimmed during the growing period, however.
According to Dave Davota, Mpls. Forester, the City of Minneapolis trims trees the
year round. Under their policy, it would be impossible for them, and prohibitive
in cost to only trim during the winter, spring and fall. 'They have not found
evidence that Dutch Elm Disease has increased because of their trimming elms during
the summer months.
RECOMMEND that we use Davey Environmental Services to proceed immediately with a
tree inventory of the City of Edina, and that they start in thea(Country Club area
where the largest trees in the community are located.
RECOMMEND that the inventory should show us a break down'`ih' the community of 5 or
6 areas that we would write specifications for and bid at different times.
RECOMMEND to trim trees for the City of Edina between the 15th of September and
1st of April. Cost of trees - estimates from tree companies average approximately
$75 /tree for trimming and shaping of the entire tree.
RECOMMEND that the tree inventory, trimming of trees, and supervision of tree
trimming program be assessed to the residents with trees on boulevard.
