Amendment to the Comprehensive Plan
The Commission and Council considered the rezoning request of Hedberg
and Sons on September 28 and November 7, 1983, respectively. One of
the issues discussed on these occasions was the City's need for park, open
space, and storm water storage areas on land in Hedberg's ownership.
Although Hedbergs were rezoning only a small portion of their land, it was
mutually agreed to resolve parkland dedication issues for all of their property
at this time.
Following the September 28, Commission meeting, Staff and Hedbergs tentatively
agreed upon a conveyance of land to the City for park and open space purposes.
The area which would be acquired by the City is shown on the attached exhibit.
The major portion of this area is located northerly of Parklawn Avenue and
measures about 8.25 acres. (included in this acreage is approximately 314 acre of
surplus land which the South Haven elderly housing project has tentatively
agreed to convey to the City) . An 80 foot wide green strip extends southerly
and northerly from the proposed park to provide a continuation of the Yorktown
green strip.
The proposed park varies in location and size from that illustrated by the Land
Use graphic of the Comprehensive Plan. This graphic schematically shows a
park measuring about 13 acres in area located southerly of Parklawn Avenue.
This park is likewise connected to previously dedicated green strips to the
north.
We believe that the Comprehensive Plan should be-finally amended to reflect the
proposed relocation of the park. Such an amendment must be considered by
the Commission and Council at public hearings.
Recommendation
In Staff's opinion, either park location satisfies the park, open space, and storm
water -ponding needs of this area. Vie cannot identify any significant advantage
of either site. It can be argued that the proposed park north of Parklawn is
closer and more accessible to more residential units and that it would maintain
a more logical distance from Edinborough Park to the south. It can likewise
be argued that the park .south of Parklawn Avenue has been shown in this
location for many years and maintains a more suitable distance from Yorktown
Park. In our view, however, neither side exhibits a clear superiority over
the other from an urban design standpoint.

Staff's reason for suggesting the relocation of the park to the north of
Parklawn Avenue is based upon our ability to achieve the acquisition of
this property at this time. In our opinion, we are not now able to acquire the
property south of Parklawn via dedication due principally to the large
volume of gravel remaining on this site. An acquisition. of this area would
not be likely in the foreseeable future except by condemnation.
We, thus, recommend amending the Comprehensive Plan to illustrate "Public"
uses for the area north of Parklawn Avenue as shown on the attached exhibit.
The area presently shown as "Public" should be redesignated as "High Density"
residential.

Factors
o Analysis of the Vernon Avenue at Eden Avenue intersection indicates
that there are too many design problems to allow a redesign at the
existing location. Therefore, all design alternatives involve a new
Intersection at a new location.
Design Recommendations
Alternative 1 - Major Features
o Eliminates the existing intersection at Eden
Avenue /Eden Circle/Sherwood Road.
• Eliminates Link Road.
• Creates a new intersection midway between W. 53rd
Street and Link Road.

o Down plays W. 53rd Street and should not encourage =
additional through-trips in .the Grandview
neighborhood....

to Eden Avenue.
o Intersection design i.s appropriate for future traf-
fic signal control.
- Disadvantages
o Separation, along Eden, Avenue, between Vernon Avenue
and Sherwood Road is still less than desirable.
o .Would still have 3 intersections along Vernon Avenue
within 600 feet.
o Condominium developers of the Biltmore Motel site
would probably have to revise their site plan to
provide an additional access opposite the new Eden
Avenue.
Alternative 2 - Major Features
o; ..Eliminates the existing intersection at Eden
Avenue /Eden Circle /Sherwood Road.

o The design is compatible with the plan for the pro -
posed condominium development at the Biltmore Motel

o Does not create any additional Intersections along
Vernon Avenue.
o Probably the least e>q) ensive intersection
modification.
o - Should not encourage any additional through trips in
the Grandview neighborhood.
• Down plays access to the Sherwood Road neighborhood.
• Intersection design is appropriate for future traf-
fic signal control.
- Disadvantages
o The Link Road corridor is narrow and the roadway
would have to be widened to almost the full right-
of -way width.

o The separation between Vernon Avenue and the
Frontage Road is less than desirable, although the
median will minimize this problem by allowing access
in but restricting the turns out.
o The Eden Avenue /Link Road intersection would have to
be controlled by an all way stop.
o Due to the difference in elevation between Vernon
Avenue and Eden Avenue and to the alignment of the
roadways it may not be apparent to motorists that
Link Road is the.access between Vernon Avenue and
Eden Avenue.
Alternative 3 - Major Features =
• Eliminates the existing intersection at Eden
Avenue /Eden Circle /Sherwood Road.
• Provides a direct connection. between Eden Avenue and
Vernon Avenue via the Link Road alignment.
- Advantages
o Creates a typical intersection with four legs.
o The design is compatible with the plan for the pro-
posed redevelopment of the Biltmore Motel site.
o Does not create any additional intersections along
Vernon Avenue.

o Provides the most direct and best designed connec-

o Intersection design is appropriate for future traf-
fic signal control.
= Disadvantages
o The Link Road corridor is.narrow and the roadway
would have to widened to almost the full right -of-
way width.
o The separation between Vernon Avenue and the
Frontage Road is less than desirable.

Factors
o The sight distance at the intersection of Summit Avenue and
Interlachen Boulevard w6s determined to be approximately 4 seconds.
This is about 50 to 60% less than the recommended minimum.
Design Recommendations
Alternative 1 - Major Features
o Leaves the intersection of Interlachen Boulevard and
Summit Avenue open but provides a one -way southbound
operation.
- Advantages
o Maintains the current operation.
Disadvantages
o The one -way operation is somewhat unusual for a
residential street.
o The one -way operation relys on signs which are not
the most effective means of traffic control.
Alternative 2 - Major Features
o Closes the intersection of Interlachen Boulevard and
Summit Avenue.

o Positively eliminates the use of a potentially
hazardous intersection.
- Disadvantages --
o Results in access only to Vernon Avenue.
ISSUE AREA 3 - VERNON- AVENUE AT INTERLACHEN BOULEVARD
Issues
o Capacity - Poor level :of, service, with forecast traffic volumes due
to only two lanes of approach westbound, very heavy right
turn volumes and a significant left turn volume.
o Safety - Acc1dents involving the unprotected westbound to south-
bound left -turn are the most common type of accident at
the intersection.
Factors
o The width of the existing Vernon Avenue bridge over the railroad and
the proximity of the bridge to the intersection preclude any rede-
sign efforts. Any significant improvement to the intersection will
require widening the bridge.

Design Recommendations
- Major Features
o Widens the westbound approach to the intersection in
order to provide -..two through lanes and left and
right turn lanes..
o Eliminates the high speed free right turn from the
T.H. 100 ramp.
- Advantages
o Improves the capacity situation by providing
separate turning lanes.
o Improves the safety situation by removing left
turning vehicles from a through lane and allows for
the addition of a protected left turn phase.
o Maximizes the separation, along Vernon Avenue, bet-
ween the T.H. 100 ramp terminal and the Interlachen
Boulevard intersection.
- Disadvantages
o Requires widening the bridge over the railroad.

o Access to Arcadia Avenue.

Design Recommendations
- Major Features
o Eliminates the right turn in /right turn out access
to Vernon Avenue.
o Provides a direct connection to an existing, signa-
lized intersection.
Advantages
• Eliminates an intersection along Vernon Avenue.
• Provides a greater separation between conflict
points along Vernon Avenue.
o Provides complete access instead of only partial
access at the northern terminus of Arcadia Avenue.
o Allows the northerly 200 feet of Arcadia Avenue to
be vacated which results in a parcel with almost 400
feet of frontage along Vernon Avenue.

ISSUE AREA 5 - VERNON AVENUE ACCESS TO JERRY'S SHOPPING AREA
Issues
o Improve the design of the access to the shopping area.
Factors
o Provide better access to /from both directions of Vernon Avenue.
o Provide a design which would accommodate future signalization.
Design Recommendations
Major Features
o Provides a single major entrance approximately mid-
way between the two existing entrances.
o Eliminates the existing entrances and median
openings.
- Advantages
• Creates a typical intersection with four legs.
(The fourth leg is the entrance to the bank on the
northerly side of Vernon Avenue.)
• The intersection design would accommodate future
signalization.

• Two intersections along Vernon Avenue are eliminated
and the separation between conflict points is
increased.
• The elimination of the two entrances would allow for
the reorgarLization of the parking lot and provide
some additional area for parking.
— Disadvantages
o Acces to the Frontage Road is restricted.
o The parking operation at the bank may have to be
modified.
SUMMARY
o Three major intersections along Vernon Avenue are provided:
1) The existing signalized intersection at Interlached Boulevard,
2) A new,major entrance to Jerry's Shopping area,
3) A new major intersection with Eden Avenue.
• Four access points along Vernon Avenue are eliminated.
• The existing Vernon Avenue /Eden Avenue intersection is eliminated
and an improved direct connection is provided in the -Link Road
corridor.

o Access to the Sherwood Road neighborhood is down played and a better
connection to Eden Avenue is-provided.
• The recommendations are compatible with the plans for the proposed
redevelopment of the Biltmore Motel site.
• The intersection of Vernon Avenue and W. 53rd Street is downplayed
and the recommendations should not encourage any additional trips
through the Grandview area neighborhood.
• A single major entrance to Jerry's Shopping area is provided which
is compatible with future signalization and which allows for the
reorganization of the parking area.
• The potentially hazardous intersection of Interlachen Boulevard and
Summit Avenue is closed.
• A direct connection between Arcadia Avenue and Vernon Avenue is pro-
vided which has complete access in all directions.
• A new westbound Vernon Avenue approach to Interlachen Boulevard is
provided which has two through lanes and separate right and left
turn Lanes.
• The high speed free right turn from T.H. 100 is eliminated.

ON VACATION OF EASEMENT FOR UTILITY PURPOSES
WITHIN
LOTS 15 AND 17, BLOCK 1, PARKWOOD KNOLLS 8TH ADDITION
NOTICE IS HEREBY GIVEN that the City Council of the City of Edina, Hennepin
County, Minnesota, will meet at the Edina City Hall, 4801 W. 50th Street on
December 5, 1983, at 7 o'clock p.m., for the purpose of holding a public
hearing on the proposed vacation of the following easements for utility
purposes:
All of the 10 foot utility easement adjoining the northerly line
of Lot 17 and its easterly extension into Lot 15, all in Block 1,
Parkwood Knolls 8th Addition.
All of the..IO foot utility easement adjoining the westerly line of
Lot 15, Block 1,::Parkwood Knolls 8th Addition.
All persons who desire to be heard with respect to the question of whether
or not the above proposed easement vacation is in the public interest and
should be made shall be heard at said time and place. The Council shall
consider the extent to which such proposed easement vacation affects existing
easements within the area of the proposed vacation and the extent to which
the vacation.affects the authority of any person, corporation, or munici-
pality owning or controlling electric or telephone poles and lines, gas and
sewer lines, or water pipes, mains, and hydrants on or under the area of the
proposed vacation, to continue maintaining the same or to enter upon such

SUBJECT: 1984 and 1985 Hennepin County Community Health Service Agreement
Attached are three copies of the Community Health Services Agreement from
Hennepin County. This agreement sets forth the conditions which Hennepin
County and the, City of Edina must meet to remain eligible for the CHS
subsidy funding in 1984 and 1985. The City wi.11 receive $86,405
for 1984 and -1985.
This Agreement is basically the same as the agreements which we have signed
in the past.
Also, at this time, it appears that the negotiations with Bloomington and the
negotiations with Metropolitan. Visiting Nurse Association are drawing to
a close. I expect we will have a recommendation for the nursing contract
by December 19, 1983.

SUBJECT: Cooperative Project No. CP -8 Minnehaha Creek Watershed
Attached is a copy of the cooperative agreement with the Minnehaha Creek
Watershed District and Minnesota Department of Transportation involving
the Cascade Lane area.
I would recommend that a resolution be passed authorizing the Mayor
and Manager to sign the agreement subject to the changes marked in
ink on the agreements. We have met with the Watershed Engineer and
he will present these changes to the Board at their next meeting. Also
attached is a copy of a letter from William Crawford of MNDOT regarding
MNDOT's position on this project.
Please review Article 7 in the agreement and I will update the Council
on my conversations with the Cascade Lane neighbors and the "berming"
issue.

AGREEMENT
COOPERATIVE PROJECT NO. CP --8
MINNEHAHA CREEK CHANNEL IMPROVEMENTS AT HIGHWAY NO. 100
1. Purpose
The purpose of this Agreement is to set forth the terms, conditions and
responsibilities of the Minnehaha Creek Watershed District ( "MCWD "), the
City of Edina ( "Edina "), and the Minnesota Department of Transportation
( "MNDOT ") in constructing an improvement proJect entitled Cooperative
Project No. CP -8 ( "CP -8 ") in the vicinity of Highway No. 100 and
Minnehaha Creek within the corporate limits of Edina. The purpose of
CP -8 is to reconstruct the creek channel banks and profile to that which
was originally planned in conjunction with construction of the Highway
No. 100 bridge.
2. Present Conditions in Project Area
The project area contains a limited number of improved properties located
below the 100 year floodplain elevation. Under normally occuring high
water conditions, overbank flow in this reach of Minnehaha Creek causes
flooding of backyards.
3. Investigations and Conclusions
MCWD and Edina have cooperatively investigated present conditions. The
investigations indicate channel bank and profile reconstruction under the
Highway 100 bridge owned by MNDOT would lower the surface water profile
upstream of the bridge approximately 1.5 inches for a discharge of 200
cubic feet per second and approximately 2.5 inches for the bridge design
discharge. Dredging of the creek channel outside the limits of the

bridge section would have no effect on water surface profiles but would
maintain the benefit of channel bank and profile reconstruction under the
bridge. While CP -8 will_ reduce the .extent of overbank flow in the
Cascade Lane area, other work outside the scope of this project would be
required to adequately reduce overbank flow.
4. General Description of Cooperative Project No. CP -8
CP -8 generally consists of:
1. maintenance work to restore the existing creek channel under the
Highway. -.No. 100 bridge to the elevations and dimensions shown on the
construction plan for Bridge No. 27103, prepared by MNDOT, dated
April 30, 1970; and
2. maintenance dredging in the channel of Minnehaha Creek, beginning at
a point near an existing structure generally known as the "Cascade"
and proceeding downstream to a point located near the easterly
right -of -way limits for Highway No. 100, to remove sediment which
has accumulated in the creek bed.
5. Agreement to Undertake Project
MCWD, Edina and MNDOT do hereby agree to construct CP -8 and to share the
total cost of the project in accordance with this agreement. The project
shall be constructed according to the plans and specifications prepared
by MCWD dated November 1, 1983, copies of which are attached as
Exhibit "1". The parties agree that MCWD will construct and pay for the
project subject to funding contributions by Edina and MNDOT. This will
allow the project to be constructed in the winter of 1983 -84.

6. Responsibilities of MCWD
MCWD shall be responsible for bidding and preparation of contract
documents including technical specifications and all plans for the
project. The MCWD shall act as the contracting agent, shall secure
all necessary permits and approvals required to construct CP -8, and shall
be responsible for supervising and inspecting the project. The procedure
by which MCWD shall contract and administer the project is as described by
attached Exhibit "1 ". MCWD shall approve and execute all payments to its
Contractor and shall maintain records of the total project cost for CP -8.
7. Responsibilities of Edina
Edina shall be responsible for securing all access and temporary
construction easements necessary to gain access across private properties
to the creek channel, in order for the District and its Contractor to

Exhibit "2",_ prepared by Edina and attached hereto. Edina shall identifyr
one member of Edina's staff who shall serve as liaison between MCWD's
Engineer and affected property owners. This staff person shall be
responsible for coordinating construction of CP -8 with affected property
owners and Edina. This staff person shall in no way be authorized for
supervision or construction inspection, nor shall he have authority to
issue change orders, either written or verbal, to the contractor for MCWD.
Upon substantial completion of CP- 8,. Edina agrees to perform all restora-
tion work necessary within the limits of the on
ee-"ent -s and access areas shown on attached Exhi bit "2 ", to restore
private properties to a condition equalling or exceeding that which
existed prior to initiation of CP -8. Edina further agrees to construct,

or cause to be constructed, minor grading and landscaping work along and

near the creek waterline in the vicinity of the4properties accessed from
Cascade Lane cul -de -sac, the purpose of such work being to prevent
encroachment of overbank flow unto improved properties whenever the creek
water surface profile is at an elevation equal to or less than toe —i$- OfS. $

completed as soon as possible after construction and completion of CP -8.
8. Responsibilities of MNDOT
MNDOT shall-be responsible for providing any necessary access from and to
MNDOT right -of -way to the creek in order for MCWD and its contractor to
perform the project. MNDOT further agrees to grant any permit necessary
to allow the District to perform that portion of the CP -8 lying within
MN /DOT right -of -way and agrees to maintain the improvements as required.
9. Financing
The estimated total project cost for CP -8 is $49,276. The estimated
construction cost for CP -8 is $38,800. MCWD shall pay all costs as they
become due and payable under the contract documents, subject to funding
contributions by Edina and MNDOT as described below.
MCWD, Edina and MNDOT hereby agree that the contributions of the parties
shall be in accordance with this paragraph. Upon completion of CP -8 and
after MCWD has made final payment to its contractor, MCWD shall document
the total actual construction cost.
Edina hereby agrees to make payment to MCWD in the amount equal to 100
percent of the actual construction cost for all contract work outside the
limits of MNDOT right -of -way, provided the total cost to Edina does not
exceed $6,000.

MNDOT hereby agrees to make payment to MCWD.in the amount equal to 100
percent of the construction costs for all contract work lying within MNDOT
right -of -way, provided the total cost to MN /DOT does not exceed $35-,-8@O.
MCWD agrees to bear all other costs including engineering, legal and
administrative costs required by the contract documents.
10. Duration
This Agreement shall continue until completion of the work or until
terminated by mutual consent of the parties.

Dear Mr. Panzer:
This letter is to confirm the responsibilities of Mn /DOT regarding
Minnehaha Creek Watershed District Cooperative Project No. CP -8. It is
understood that the Watershed District will be responsible for administer-
ing the project. Mn /DOT will be responsible for providing any necessary
access from and to Mn /DOT right -of -way in order for the Watershed District
and its contractor to perform the project. Mn /DOT will also issue the
necessary permits to allow the Watershed District to perform that portion
of the project lying within Mn /DOT right -of -way and agrees to maintain the
improvements.
It is understood that Mn /DOT will make payment to the Minnehaha Creek
Watershed District in the amount equal to the total construction costs

The Edina City Council Members:
Thank you for your effort and support in helping to solve our
flooding problem. A special thank you to Mrs. Turner, Mr. Hoffman,
and Mr. Hughes for their extra time and involvement.
I would like to propose to-the council the following:
1) To postone or eliminate the building of a Berm on the
Cascade Lane property, since I feel that the 1984 dredging and
cleaning out under the Hwy. 100 bridge might eliminate our high
water problem.
2) If the Berm must be built, I would like to propose that the
City of Edina and the Watershed District of Minnetonka share
the expense. To protect the city and the watershed district
from building Berms up and down stream, may I suggest that only
homes that have an elevation of 886.00 or below should be
assisted by the city and the watershed.
My reasons for this proposal are:
a) We are the lowest home on the flood plane.
b), Dredging along this area should have been done four years
ago. This past spring the creek water sat on our property for
three and a half months, resulting in further lowering our
entire backyard.
c) The function of the New Gray °s Bay Dam is responsible for
much of the flooding in our area.

The homes on 56th street and further down stream had flooding
problems before the new dam. They had spring ice jams. resulting
in flooding. Today their problem is much better, but the
residents on Cascade are now flooding. Remember, our homes
are being threatened not just our property.

This project :is on our current 5 year Municipal State Aid Construction
Plan. The project.would be funded by special assessment, municipal
state aid gas tax, and, hopefully, a MNDOT grant which involves replace-
ment of .railroad crossings on state aid streets. Additionally, an
agreement would have to be reached with Soo Line Railroad on the re-
furbished railroad crossing.
Upon acceptance of this report by City Council, I recommend a public
hearing be scheduled for Janauary 16, 1984. .

SUBJECT: Placing Snow in.the Streets /Sidewalk Shoveling
This winter has struck early and has caused some problems usually
related to late winter.
Two problems have arisen that are not new but probably more frequent than
in past years:.
First, the incidence of residents blowing snow back into the streets
and commercial company snow removal has caused a problem in keeping the
streets clean. The Staff would propose that a letter be delivered to
people who do this as a "warning ". After a warning is issued and not
adhered to.a citation be issued by the City.
Second, sidewalk snow shoveling is going to be a problem due to the
great quantity of snow early in the year. I am attaching a copy of
Ordinance 1202, regarding this issue. The ordinance is somewhat
outdated and even the City forces cannot meet the intent of the ordinance
with all the miles of sidewalks which we now maintain. I would suggest
that we descuss these issues briefly with the Council Monday evening.

ORDINANCE NO. 1202
An Ordinance Requiring The Removal of Accumulations of Snow and Ice From
Sidewalks and Providing a Procedure and a Penalty in Case of Failure of Property
Owner or Occupant to do so.
Section 1. Snow and Ice a Nuisance. All snow and ice
remaining upon public sidewalks is hereby declared to con-
stitute a public nuisance, and shall be abated within 12 hours
after such snow or ice has ceased to be deposited,
(a) in the case of snow and ice remaining on a sidewalk in
front of a building, by the owner or occupant of such building;
(b) in the case of snow and ice remaining on a sidewalk in
front of vacant property, by the owner of such property.
Sec. 2. Superintendent of Public Works to Remove Snow
and Ice. The Superintendent of Public Works shall cause to be
removed from all public 'sidewalks, beginning 12 hours after
any snow or ice has ceased to fall, all snow and ice which may
be discovered thereon, and he shall keep a record of the cost
of said removal and the lot or lots adjacent to which such
accumulations were found and removed, and shall deliver such
information to the Clerk as soon as the work of removal is
completed.
Sec. 3. Cost of Removal to be Assessed. The Clerk shall,
upon direction of the Council, on receipt of the information

provided for in the preceding section to be delivered to him by
the Superintendent of Public Works, extend the cost of said
removal of snow or ice as a special tax against the lots or
parcels of ground abutting on walks which were cleared, and
such special tax shall at the time of certifying taxes to the
county auditor be certified for collection as other special taxes
are certified and collected.
Sec. 4. Civil Suit for Cost of Removal. The Village Attor-
ney shall, at the direction of the Council, bring suit in any
court of competent jurisdiction to recover from the person
owning land adjacent to which sidewalks were cleared, as
provided in Section 2 hereof, the cost of such clearing and the
cost of suit.
Sec. 5. Penalty. Any person who violates or fails to comply
with any provision of this ordinance shall be guilty of a
misdemeanor, and subject to a fine of not to exceed $300, or
imprisonment for a period not to exceed 90 days, with costs
of prosecution in either case to be added. Such penalty may be
imposed in addition to any other penalty or remedy herein
prescribed.

ORDINANCE NO. 1403 -A1
AN ORDINANCE AMENDING ORDINANCE NO. 1403 TO ALLOW
USE OF POUNDKEEPERS WITHOUT ADVERTISING FOR BIDS,
TO DELETE USE OF TRAFFIC TAGS ON TOWED VEHICLES, TO
CLARIFY PROCEDURE FOR RELEASE OF IMPOUNDED VEHICLES,
TO CHANGE VILLAGE TO CITY, AND MAKING OTHER CHANGES.
THE CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA, ORDAINS:
Section 1. Section 2 of Ordinance No. 1403 is hereby amended
to 'read as follows:
"Sec. 2. Pound, Towing and Storage Bids and Charges. The
City Manager or his designate may advertise for bids by persons,
firms or corporations desiring to act as poundkeepers of vehicles
impounded under the provisions of this ordinance, or may, without
advertising for bids, designate various persons, firms or corporations
who meet the requirements of this ordinance, and so long as they
comply with the provisions of this ordinance, to act as such pound -
keepers. Such poundkeeper must obtain or provide adequate facilities
and equipment, within or near to the City of Edina, to handle the
tows and the storage of vehicles requested by the City. Towing service
must be available at any hour.and response to requests must be prompt.
Each poundkeeper shall provide a schedule of charges for the towing,
storage and impoundment of vehicles impounded under the provisions
of this ordinance. A copy of this schedule shall be on exhibit in
the Edina Police Department. The City Manager reserves the right
to reject all bids and to terminate at any time, with or without
cause, any poundkeeper designated hereunder by the City Manager.
Sec. 2. Section 3 of Ordinance No. 1403 is hereby amended
to read as follows:
"Sec. 3. Charge When Owner Appears Before Towing. When a
police officer has ordered a vehicle to be impounded, and when the
owner or operator thereof appears before the vehicle has been towed
to the pound, the tow truck operator shall release the said vehicle
without the payment of any fee or towing charge."
Sec. 3. The last sentence in Section 5 of Ordinance No. 1403
is hereby amended to read as follows:
"All vehicles which have been involved in criminal proceedings,
and which are designated by the Police Department as being held
for that reason, shall be held and stored in a City storage facility."

Sec. 4. Section 6 of Ordinance No. 1403 is hereby deleted
in its entirety.
Sec. 5. Sections 7 and 8 of Ordinance No. 1403 are hereby
renumbered to Sections 6 and 7, respectively.
Sec. 6. Section 9 of Ordinance No. 1403 is hereby renumbered
to Section 8, and is hereby amended to read as follows:
"Sec. 8. Reports of Police Officers. It shall be the duty
of the police officer to make an Automobile Impoundment Report on
all vehicles impounded. This report shall give the description of
the vehicle with an inventory of any personal properties visible
therein at the time of impoundment. The description and inventory
must include the make and license number of the motor vehicle and
a statement of condition with regard to damaged parts. The report
shall include the date, time, location and reason for impoundment
and any further information which the Chief of Police shall deem
necessary and advisable. The original and one copy of the Automobile
Impoundment Report will be retained by the police department and
two copies delivered to the poundkeeper. Traffic citations may be
issued by the police officers for violations of law which resulted
in the towing and impoundment of a vehicle."
Sec. 8. Ordinance No. 1403 is hereby amended by adding thereto
a new Section 9 as follows:
"Sec. 9. Release of Impounded Vehicle. Upon return of the
vehicle to the owner, the poundkeeper shall release the same by
the owner signing and dating the release on the Automobile Impoundment
Report and providing the owner a copy of that report. He shall also
provide a receipt with the charges enumerated thereon and the purpose
for which such charges were made. He shall retain the original copy
of this receipt and provide a copy to the vehicle owner. No person
shall remove any vehicle from the lawful custody of the poundkeeper,
without first having signed the release and having paid impounding
and storage charges."
Sec. 9. Section 11 of Ordinance No. 1403 is hereby amended
to read as follows:
"Sec. 11. Ordinance to be Included in Bid. This ordinance
shall be and constitute part of any:bid approved by the City Manager
or his deputy and of any contract entered into by the City with
any poundkeeper, and shall be deemed agreed to by any poundkeeper
designated by the City Manager at the time such poundkeeper tows
any vehicle pursuant to this ordinance, as fully and to the same
effect as if set forth at length in said bid or contract or made

a part of a written contract with any such designated poundkeeper.
If a contract is entered into, and if any part or portion of any
such contract entered into shall be inconsistent with the terms
of this ordinance, the provisions hereof shall in all respects prevail."
Sec. 10. Section 12 of Ordinance No. 1403 is hereby amended
to read as follows:
"Sec. 12. Penalty. Any person violating this ordinance shall
be guilty of a misdemeanor, and subject to a fine and penalty as
set out in Ordinance No. 175 of the City of Edina, as from time
to time amended:"
Sec. 11. All references to the word "Village" in Ordinance
No. 1403 are hereby amended to read "City."
Sec. 12. This ordinance shall be in full force and effect
immediately upon its passage and publication.

Lance Leupold (representing Cablesystems Southwest), Officer Chris
Hamren, and myself will be in Los Angeles on Monday, December 12th,
to attend the ACE Awards ( "Achievement in Cable Excellence ") Ceremony,
which is sponsored annually by the National Cable Television
Association.- Our program, "The Edina Police Report," is one of five
award nominees in the "Best Local Access Production Involving Community
Awareness" category.
The ceremony will be presented live from the Cocoanut Grove on
Cablesystems channel 31 (WTBS), and begins at 8:05 P.M. The program
is scheduled to run two hours. Winners are not announced in advance
of the telecast.
I would like to thank each -of you for your continued support of our
project. The success of "The Edina Police Report" can certainly in part
be attributed to your initial willingness to take a chance with it. Win
or lose Monday, I think that we have even better programming ahead!

To Members of the Edina City Council
At the Edina Community Development and Planning Commission meeting on.
November 30, 1983, the Edina Heritage Preservation Board presented a
proposal that the Wooddale School be rezoned for classification to a Heritage
Preservation District. The Planning Commission, on a 6 to 5 vote, approved
a motion to recommend this action to the City Council. This rezoning request
will likely be scheduled for Council hearing on December 19, 1983.
The Edina City Council will soon be facing some important decisions regarding
the future use of the Wooddale property. It is a complex issue with many
aspects to be considered such as: the residential zoning requirement: park
needs of the area; historical importance; compatibility of any option with the
residential character of the neighborhood; traffic and parking considerations;
financial responsibility for the maintenance of the structure and property.
The restrictions that would occur from the rezoning that has been requested
would make it difficult to fairly consider all options. The historical importance
of the structure is one factor that needs to be considered, but it is one of many
equally important considerations. We do not think. that this rezoning request
should be considered apart from, or prior to, discussion on the other issues
that must go into making a final resolution of the property.

individual and group opinions will be heard. Tom Oye, Pat Llona
and I are planning to attend and we encourage any other interested
persons to attend also. The hearing should provide a good forum for
us to express our views on an important subject and also to gain
information on current human rights concerns. Call me if you have
any questions or suggestions. (See enclosure for details).
3. A Reminder: The Bloomington HRC and the Chamber of Commerce are
sponsoring an Employers Seminar.
