WHEREAS, the following described property is at present a single tract of land:
Lot 4, Block 7, Braemar Hills 9th Addition; and
WHEREAS, the owners have requested the subdivision of said tract into sep-
arate parcels (herein called "Parcels ") described as follows:
That part of Lot 4, Block 7, Braemar Hills 9th Addition, lying Westerly
of a line run from a point on the South line of Lot 4, a distance of 63.63
feet East of the Southwest corner of said Lot 4,to a point on -the North
line of Lot 4, a distance of 32.23 feet East of the Northwest corner of
said Lot 4; and
That part of Lot 4, Block 7, Braemar Hills 9th Addition, except that
part lying Westerly of a line run from a point on the South line of Lot
4, a distance of 63.63 feet East of the Southwest corner of said Lot 4,
to a point on the North line of Lot 4, a distance of 32.23 feet East of

WHEREAS, the requested subdivision is authorized under Ordinance No. 801 and
it has been determined that compliance with the Subdivision and Zoning Regu-
lations of the City of Edina will create an unnecessary hardship and said
Parcels as separate tracts of land do not interfere with the purpose of the
Subdivision and Zoning Regulations as contained in the City of Edina Ordi-
nance Nos. 801 and 811;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL of the City of Edina
that the conveyance and ownership of the second above described Parcels as
separate tracts of land is hereby approved and the requirements and provisions
of Ordinance Nos. 801 and 811 are hereby waived to allow said division and
conveyance thereof as separate tracts of land, but only to the extent per-
mitted under Ordinance No. 801 and Ordinance No. 811 and subject to the limi-
tations set out in Ordinance No. 811 and said Ordinances are not waived for
any other purpose or as to any other provisions thereof, and further, subject,
however, to the provisions that no further subdivision be made of said Par-
cels unless made in compliance with the pertinent ordinances of the City of
Edina or with the prior approval of this Council as may be provided for by
those ordinances.

Dear Dirk:
Thanks for. accepting our invitation to attend the City Council meeting
-of January 4 at 7: 00 p.m. .
As I explained on the telephone, the City Council adopted Edina's Compre-
hensive Plan on December 21st. Some Council members expressed concern
,as to the implementation of the Plan as well as efforts to monitor the Plan
during upcoming years. The Council seems to express a genuine interest
in continually updating the Plan and thus avoiding a stagnant document.
-As 1 noted, two members voted against -the Plan adoption. 1 am not certain
�. -of their reasons. One member expressed concern that the Plan was the
"Met Council Plan" not really "our" Plan. However, he did not cite any
particular items. The other member thought that more time should be
spent discussing issues associated with implementing the Plan before it was
adopted.
Dirk, perhaps you could briefly explain how future amendments to the Plan
will be handled - i.e. "local" amendments versus "system" amendments.
Also, perhaps you could discuss the general issue of implementation.

MEMORANDUM

SUBJECT: Fire - 7500 York Ave. S. - 01/04/82

At 0525 hrs., Monday, January 4, 1982, Edina Public Safety was summoned
to a fire at 7500 York Ave. Two one -man police units were first on the
scene and confirmed the existence of both a fire and the potential hazard
to occupants of the building. Immediate steps were taken by these officers
to update responding units, summon additional assistance, and initiate
evacuation and rescue procedures.
Additional police and fire units arrived and were aided by the first
officers' observations and actions. The two first responding officers
will be considered for Police Department commendation awards based on
their fast action and bravery in a smoke - filled environment. Positive
aspects of the incident included excellent command and control of the police
function, along with reliable dispatcher communications which is often a
problem during emergencies.
Additionally, mutual -aid police assistance from Richfield, Bloomington, and
the Minnesota State Patrol was readily available. Negative aspects were
primarily in the area of access problems due to locked doors in the complex.
Overall, the Police Department performed effectively, both in its function
and coordination with Fire Department personnel.

SUBJECT: Ebenezer Fire
Attached is a copy of the preliminary fire report from the Ebenezer apartment fire
we had this morning. I think we are safe to say that this was a very successful
operation with a good final outcome considering the potential for disaster that we
had in this facility.
The net result was: one resident to the hospital with smoke inhalation, $40,000
interior damage to the involved apartment unit, $50,000 -- $100,000 in smoke damage
throughout the building and a disruption to the facility for a few hours while we

an automatic smoke detector woke the resident in the involved unit and can be
credited with saving her life
a corridor smoke detector went off, alerting the rest of the building occupants,
providing early warning for evacuation
the early warning detection system can be credited with giving the fire department
an opportunity to fight a relatively small fire before it gained too much headway
the initial response crew did an excellent job of an interior fast attack with a
hand line and using the interior built -in standpipe system, stopping the forward
progress of the fire and controlling it along with full extinguishment and a very
minimal time period
the built -in fire resistive construction, including the walls, floor, ceiling,
and door to the corridor, functioned well and contained the fire (not smoke) to
one unit
overall fireground tactics, including the quick response of the off -duty paid fire-
fighters, volunteer firefighters, and the Mutual Aid companies from St. Louis Park
and Richfield, allowed us to take a good command position and maintain control of
the situation. We didn't have to retreat or play catch -up
!se had excellent cooperation and assistance by the Police Department in our search
and rescue operations
our overall communications at this fire were considered to be excellent. This
includes both the hardware in the form of mobile and portable radios, along with
the command post procedures and reporting system of the various companies in
operation
we were able to effectively coordinate a fire attack along with search and rescue
operations supported by ventilation crews, without any significant delays.
no panic occurred within the entire operation while over a hundred people were
evacuated, both horizontally and vertically, to safety by police, firefighters,
and security personnel.

On the negative side:
1. we found that this building is extremely vulnerable to rapid smoke spread and the
trapping of occupants in their apartment units
2. smoke compartmentation features of the building did not function as expected and
many apartment units filled to an untenable level with toxic smoke during the
operation. We are very concerned about smoke spread in this type building with
the elderly and invalids
3. the interior furnishings burnt with such rapid heat build up that the window unit
broke open before the firefighters arrived, feeding the fire with additional oxygen
and allowing flames to start up the side of the building which would have shortly
impinged on other window units, possibly spreading fire to upper floors.
I think this fire again demonstrated to us the importance of the control we need over
building design and construction. It also pointed out that we need better control over
the required installation of automatic sprinkler systems in certain occupancies. For
example, in this past year, we have had three similar fires occur at 7151 York, 7201
York, and the Edina Care Center. These three fires were extinguished by a single
sprinkler head located in the apartment unit with literally no smoke spread in the
building and very minimal damage from water or fire.

SUBJECT: Position Statement: Ebenezer -- 7500 York Avenue South
Because of the large area and height of the Ebenezer building, and
particularly the age of the prospective occupants, this structure
represents a serious fire risk, potentially beyond the scope and
strength of the Edina Fire Department. As such, the structure should
be fully protected with an automatic fire suppression system.
Present design provides only for a partially protected building (public
areas), omitting sprinklers from the high fire - incident locations --
the apartment living units. Such a design will meet the minimum
requirements of the law, but relies completely on building construction
to control upward fire extension until manual fire attacks can be imple-
mented. As such, the design requires that special attention be given
to potential vertical avenues of fire extension. Highest priority
should be given to firestopping and safeing of exterior walls, utility
penetrations, and shaft-construction.
It is imperative that the individual apartment units be built to with-
stand full involvement.

SUBJECT: PARAMEDIC TRANSPORTATION FEES
DATE: DECEMBER 30, 1981
At the time fees were set for 1982, the fee for paramedic transportation
services was purposely left off as the County had not set their fee or had
any indication as to the amount the fee might be increased. While the County
Board has not yet set the fee, the County has now indicated that it will be
increased from their present $143.00 to $165.00 (15 %). The City has remained
at $122.00 since we started charging in March of 1980.
Doing cost pricing of our service for 1982 would put it in the range of
$155/160 per run. It is the recommendation of staff that the City increase
its rate from $122.00 to $155.00. While this is a large jump, it is the
intention to adjust it annually from now on out.
Those on Medicare end up paying about $20 -25 as required by Medicare. Those
not on Medicare who have no insurance and have limited financial means are
handled on a case by case basis.
