- WHEREAS, there is an increasing awareness on the part of individuals of
.the need to assume greater responsibility for their own well being and
greater involvement in health care decision making; and
.WHEREAS, health promotion and wellness are practical, promising and
beneficial approaches to curbing the upward spiral of health care costs;
and
WHEREAS, Albert H. Quie, Governor of the State of Minnesota, has proclaimed
October 3 through October 9, 1982, to be Wellness Week;

Dear Sirs:
Reference is made to the aquatic clean -up and its
assessment (see enclosure). The property for
which the enclosed check is presented to you is
located at 4820 W. Sunnyslope Rd., which is within
the district being assessed.

It remains my continuing belief that an effort should
be made to stock the creek area with herbivirous fish,
the presence of which would greatly contribute to the
cleaning up of the water.
At the time this idea was put forth last year, a
response was made that "since it is a creek and fish
can migrate, stocking was regarded as of little value"
If this were really a true evaluation, fishing in
Minnesota creeks and rivers would be a waste of time.
All the fish would migrate downstream to some other
State.

While the cutting machine does a reasonable job, I
would believe that since it cannot possibly retreive
_ all that which is cut, it probably aids the continuing
propagation of the aquatic plants. Just ask any
horticulturist about propagating plants from cuttings.
I would urge you to consider the planting of plant-
eating fish to assist in the aquatic weed control.
It would make good ecological sense and earn you the
respect of the environmentalists.

SUBJECT: Grace Church
You have asked that I describe the expansion plans of Grace Church and
the provisions of the Edina Zoning Ordinance which govern this expansion.
We have met with officials of and architects for Grace Church on several
occasions during the past year to discuss both long range and short range
expansion plans. This memo is based upon these meetings.
Property Ownership
Attached is a survey of the property that Grace Church states they control.
As shown, the Church apparently owns all of the dwellings fronting on France
from the existing Church building to West 52nd Street except the building on
lot 9 which is apparently not now owned by the Church but is subject to a
life estate. The Church also owns portions of the rear yards of many homes
fronting Halifax Avenue. Church officials have also stated that they are
negotiating the purchase of the home on the rear portion of lots one and two
which fronts on West 52nd Street.
Long Range Plans
At our urging, the Church has prepared the attached schematic site plan
which illustrates their long range plans. (It should be stressed that this
plan was given to me by the Church's architect and has not been formally
submitted by Church officials.) This plan illustrates an expansion to the
main sanctuary to provide total seating for approximately 1,750 people. The
existing sanctuary seats about 900 people. Also a new Christian Education
addition is planned. In conjunction with these expansions, the Church would
extend its bituminous parking lot northerly to West 52nd Street. A one level
parking ramp would also be placed in the center of the parking lot. The
proposed parking expansion would result in 627 total parking spaces. A
secondary access to West 52nd Street is proposed.
Schedule of Development and Immediate Plans
We do not know the Church's schedule for implementing its long range plans.
During past meetings, the Church has indicated that their immediate plans
involve the construction of addtional surface parking across the rear portions
of lots 3 -7. As you know, the Church has petitioned for the installation of
storm sewer in West 52nd Street. This sewer will accommodate the drainage
needs for the short term parking expansion as well as the ultimate long range
plans.

Zoning Provisions
The Zoning Ordinance allows religious institutions as a principal use in the
R -1 Single Family Dwelling District. Conditional or special use permits
are not required for this use.
The following standards are imposed by the R -1 section of the Zoning
Ordinance relative to Churches:

The propsed addition to the Church building appears to comply with the setback
and lot coverage requirements of the Zoning Ordinance. The lot area and width
likewise comply. The parking lot setback is 24 feet on France Avenue and 20 feet
on West 52nd Street. This setback is proposed based upon Staff's comments that
it will support a reduced parking setback requirement in the revised Zoning
Ordinance. The parking setback from interior lot lines is 10 feet which exceeds
present requirements. The proposed parking quantity complies with ordinance
requirements.
The proposed parking ramp in the central portion of the site is subject to
interpretation. The ordinance requires "parking facilities" on the site. It does
not preclude ramps or underground parking. We cannot cite reasons for
disallowing a ramp as long as it does not exceed height and setback limitations.
The plans are too schematic at present to analyze landscaping, building height,
drainage, surfacing material and so forth. The Church is aware of our requirements
and presumably will comply with them.
Summary
Grace Church is and has been willing, able and successful in acquiring property
to facilitate an expansion program. Our Ordinances do not specify a "maximum"
size to which they can grow as long as they acquire enough property to support
our parking, lot coverage and setback standards. We do not limit hard surface
coverage in this district or in any zoning district. We likewise do not require
special permits or procedures for church uses in the R -1 District. If such controls
are desired, amendments to the Zoning Ordinance should be considered.

Dear Ms. Hallberg:
As owners of Lot 18, Block 1, Dewey Hill Addition, we wish
to object to the proposed assessment for street improvements on
Dewey Hill Road and request that you place this written objec-
tion before the Council prior to the September 20 meeting.
The improvements do not specially benefit our property nor
enhance its value. Any benefit which they might provide is
general only and is no different than the benefit they bring to
all other property owners in the Dewey Hill Addition.
Living at the end of the Shannon Drive cul de sac, the only
way we have to reach our home is by driving on Dewey Hill Road.
All of our neighbors have the same circumstance however. The
resurfaced street is a general benefit to all of the homeowners
on our block of Shannon Drive and those on Shannon Circle, but
only a few are being assessed. The assessment is therefore
lacking in constitutional considerations of equality and uniform-
ity.
The rear of our property (which parallels Dewey Hill Road)
is burdened by a recorded perpetual easement, a copy of which is
attached. This easement provides, among other things, for con-
struction of a fence which has, in fact, been in place for some
time. We do not own the fence nor are we permitted to remove,
alter or even maintain it. It is owned and maintained by the
Dewey Hill Homeowners Association. The property on the other
side of the fence, contiguous to the road, is also maintained by
the Dewey Hill Homeowners Association. We, therefore, have no
present control over the 20 -foot strip nor any present access to
Dewey Hill Road through the rear line of our property. We

would be prepared to enter into any appropriate agreement or
declaration foregoing access to Dewey Hill Road through the rear
property line in exchange for dropping the assessment or defer
ring the assessment until such time as actual access may be
effected by any subsequent owners.

solely for the purposes set forth herein.
3. No structures or improvements of any kind may be placed
or erected upon the Easement by Owners of the Servient Lots until
application therefor, with plans and specifications of such structures
or improvements, together with a statement of the purpose for which the
structure will be used, has been filed with and written approval obtained
from the Association. No trees, bushes, vegetation, fencing or other
landscaping existing on said Easement may be cut or removed without
first obtaining the written consent of the Association.
4. Except as herein. specifically provided, the Owners of the
Servient Lots shall have the unfettered and unrestricted right to the
use and enjoyment . of that part of their lots encumbered by the Easement
granted herein.
S. In consideration of the creation of the easements contained
hereby by Declarant, the Association hereby undertakes and arrces to
assume the responsibility for and the costs of the replacement and the
maintenance of the Improvements. The Association shall abide by all of

1. The commercial structures that haven
been built west of the subject property
did not directly affect any Edina
residents and thus were not formally
opposed by the.Tanglewood Court
residents.

land does not lend itself to
Commercial Development.
30 The subject parcels are adjacent to
residential owner occupied units of
substantial value.
4. Commercial structures and parking would
substantially detract from the value and
thus saleability of the Tanglewood Court
residences; and therefore have an impact on
the tax base to the City of Edina.
5. It is virtually impossible to have adequate
access to the subject property for Commercial

6. The layout of the existing parcel lends
itself as a natural barrier from Hwy 494
and West 78th Street not only to Tanglewood
Court but to the Braemar Park Preserve.
7. The existing parcel lends itself to be
developed for "twin home" sites which
would complement the existing structures
on Tanglewood Court.
The occupants of Tanglewood Court, Edina Minnesota, hereby
-petition the aid of the City of Edina officals both appointed
and elected to make known to the City of Bloomington that
the City of Edina and the Tanglewood Court residents totally
reject the idea that the parcel north of West 78th Street
be zoned Commercial of anykindj but rather it remain
residential in nature.

Dear Mr. Kremer:
It has come to our attention that the Board of Commissioners is considering the
funding request of the Hennepin County Soil and Water Conservation District
as part of its budgetary process. The Soil and Water Conservation District i.s
charged with undertaking certain water management and erosion and sedementa-
tion control activities within the County.
As you know, Edina lies within the jurisdictions of the Nine Mile Creek Watershed
District and the Minnehaha Creek Watershed District. These Districts likewise
are charged with certain water management and erosion control responsibilities.
In addition, their responsibilities appear to be substantially increased due to
the surface water management bill recently enacted by the legislature.
In this day of ever - increasing real estate taxes and our respective attempts to
hold the line on government spending, it is inperative that we search out and
eliminate the duplication of services by governmental agencies. The aforemen-
tioned watershed districts have been instrumental in implementing a sound
water management program in Edina and throughout the district. Also, they hava
undertaken many worthwhile projects whose benefits extend well beyond basic
water management goals. Although the Soil and Water Conservation District may
offer similar benefits to other parts of the County, we must advise you that their
activities do not appear to benfit Edina in any material way. We thus cannot
help butconclude the Edina tax payers are in essence paying twice for the same
service.
We would respectfully ask that you consider the above thoughts in your deliber-
ations concerning the 1983 County budget.

R E S O L U T I O N
WHEREAS, the City of Bloomington is considering the rezoning to B -1:
Limited Business District of certain properties located in the
vicinity of West 78th Street- and Gleason Road as shown on the
attached exhibit; and
WHEREAS, that portion of the above property lying northerly of West 78th
Street, (the "North Property ") abuts properties in the City of
Edina which are used for low density residential purposes; and
- WHEREAS, that portion of the above property lying south of Wes. 78th Street,
(the "South Property") is bisected by Nine Mile Creek and is
characterized by floodplain lands and important natural amenities;
and
WHEREAS, a petition for rezoning has been submitted by the owner of
only a portion of the South Property, and the City of Bloomington
by its initiative is proposing the rezoning of the balance of the
South Property and all of the North Property; and
WHEREAS, the rezoning to B -1 of the North Property would cause serious
economic and environmental impacts to residential properties in
Edina on Tanglewood Court; and
WHEREAS, the rezoning to B -1 of the South Property may adversely impact
Nine Mile Creek and abutting lands; and
WHEREAS, the City of Bloomington is under no obligation to rezone the North
Property and part of the South Property as this time.
NOW, THEREFORE, BE IT RESOLVED, that the City of Edina hereby requests
the City of Bloomington to maintain the present residential zoning of
the North Property in order to protect adjacent residential areas in
Edina. Be it further resolved that the City of Edina urges the
City of Bloomington to restudy the South Property to ensure a land
use which is compatible with the physical characteristics of the site
and harmonious with surrounding residential uses in Edina.
