We have met with officials of and architects for Grace Church on several occasions during the past year to discuss both long range and short range expansion plans. This memo is based upon these meetings. Property Ownership Attached is a survey of the property that Grace Church states they control. As shown, the Church apparently owns all of the dwellings fronting on France from the existing Church building to West 52nd Street except the building on lot 9 which is apparently not now owned by the Church but is subject to a life estate. The Church also owns portions of the rear yards of many homes fronting Halifax Avenue. Church officials have also stated that they are negotiating the purchase of the home on the rear portion of lots one and two which fronts on West 52nd Street. Long Range Plans At our urging, the Church has prepared the attached schematic site plan which illustrates their long range plans. (It should be stressed that this plan was given to me by the Church's architect and has not been formally submitted by Church officials.) This plan illustrates an expansion to the main sanctuary to provide total seating for approximately 1,750 people. The existing sanctuary seats about 900 people. Also a new Christian Education addition is planned. In conjunction with these expansions,. the Church would extend its bituminous parking lot northerly to 'Vest 52nd Street. A one level parking ramp would also be placed in the center of the parking lot. The proposed parking expansion would result in 627 total parking spaces. A secondary access to West 52nd Street is proposed. Schedule of Development and Immediate Plans We do not know the Church's schedule for implementing its long range plans. During past meetings, the Church has indicated that their immediate plans involve the construction of addtional surface parking across the rear portions of lots 3 -7. As you know, the Church has petitioned for the installation of storm sewer in West 52nd Street. This sewer will accommodate the drainage needs for the short term parking expansion as well as the ultimate long range plans. Memorandum September 15, 1982 Page two Zoning Provisions The Zoning Ordinance allows religious institutions as a principal use in the R -1 Single Family Dwelling District. Conditional or special use permits are not required for this use. The following standards are imposed by the R -1 section of the Zoning Ordinance relative to Churches: Minimum lot area Minimum lot width Maximum lot Coverage (building).. Building Setback Maximum height Parking Parking Setback Parking Design 3 acres 300 feet 250 50 feet from all lot lines 3 stories 1 space per 3 seats in Sanctuary 50 feet from streets. 5 feet from other lot lines lots must be hard surfaced, well drained and landscaped The propsed addition to the Church building appears to comply with the setback and lot coverage requirements of the Zoning Ordinance. The lot area and width likewise comply. The parking :lot setback is .24 feet on France Avenue and 20 feet on West 52nd Street. This setback is proposed based upon Staff's comments that it will support a reduced parking setback requirement in the revised Zoning Ordinance. The parking setback from interior lot lines is 10 feet which exceeds present requirements. The proposed parking quantity complies with ordinance requirements. The proposed parking ramp in the central portion of the site is subject to interpretation. The ordinance requires " parking facilities" on the site. It does not preclude ramps or underground parking. We cannot cite. reasons for disallowing a ramp as long as it does not exceed height and setback limitations. The plans are too schematic at present to analyze landscaping, building height, drainage, surfacing material and so forth. The Church is aware of our requirements and presumably will 'comply with them. Summary Grace Church is and has been willing, able and successful in acquiring property to facilitate an expansion program. Our Ordinances do not, specify a "maximum" size to which they can grow as long as they acquire enough property to support our parking, lot coverage and setback standards. We do not limit hard surface coverage in this district or in any zoning district. We likewise do not require special permits or procedures for church uses in the R -1 District. The improvements do not specially benefit our property nor enhance its value. Any benefit which they might provide is general only and is no different than the benefit they bring to all other property owners in the Dewey Hill Addition. Living at the end of the Shannon Drive cul de sac, the only way we have to reach our home is by driving on Dewey Hill Road. All of our neighbors have the same circumstance however. The resurfaced street is a general benefit to all of the homeowners on our block of Shannon Drive and those on'Shannon Circle, but only a few are being assessed. The assessment is therefore lacking in constitutional considerations of equality and uniform- ity. The rear of our property (which parallels Dewey Hill Road) is burdened by a recorded perpetual easement, a copy of which is attached. This easement provides, among other things, for con- struction of a fence which has, in fact, been in place for some time. We do not own the fence nor are we permitted to remove, alter or even maintain it. It is owned and maintained by the Dewey Hi11,Homeowners Association. The property on the other side of the fence, contiguous to the road, is also maintained by the Dewey Hill Homeowners Association. We presently have pending with the City, plans for a parish hall and educational wing to be built as an extension eastward from the present sanctuary building. In the event that you see fit to propose a moratorium on church building, we do respectfully request that you exempt from that moratorium our pending building project. Wayne Courtney Mayor City of Edina 4801 West 50th Street Edina, MN 55424 Dear Mr. Courtney: We have heard that the Edina City Council may be asked to give some thought to the possibility of invoking a building moratorium for the purpose of thwarting growth of our church. It seems almost inconceivable that this kind of action against our church would even be considered, but in case it is a serious proposal, we are sending this letter to you and to the other Council members to provide some important background information: 1) Over the years, we have tried to be a spiritual, moral and social asset to the community, particularly with our strong youth program. As a progressive non - denominational church, we believe we help give a good name and reputation to the city. We have always had excellent relationships with city government and, in fact, have been encouraged by the city in the growth of our ministries to the community. 2) Several years ago, we had a number of meetings with members of the city planning staff to determine an over -all plan for additional facilities and parking. The city ordinances were explained to us, and we were told that we could buy adjacent land'and expand along the County Highway (France Avenue) in accordance with those ordinances. 3) Consequently, we worked for two years to acquire the houses on France Avenue between our present northerly driveway and 52nd Street for the specific purpose of providing adequate facilities and off - street parking for the church. It was a difficult and costly task, but the land acquisition was successfully completed a year ago. 4) This past year, we have spent considerable time and money with Leonard Parker Associates (architects), in close consultation with the city planning staff, developing the site plan and building plan. A summary diagram of each phase is.enclosed. After acquiring the property, designing the building, and securing financing, we are now ready to obtain the footing and foundation permit and begin work next week. Every step of the way, we have been led to believe that a permit will be issued to us if we comply with all provisions of state law and city ordinances. At this stage of our progress, we think it would be grossly unfair -- and would be perceived as an attack on our church and, indirectly, an attack on all the churches of Edina -- for the city Council to invoke a moratorium against us. Since we do not know for sure whether this will even be discussed by the Council, and to avoid stirring up unnecessary controversy or misunderstandings, we are not telling our congregation that a moratorium is even a thought. Our hope is that it will never become an issue and that the administration will grant a permit in accordance with present ordinances. If there is even the slightest possibility that a moratorium against us may be seriously considered by the Council, we respectfully request a preliminary meeting to try to understand the rationale for proposing such untimely and detrimental action. M E M O R A N D U M DATE: September 29, 1982 TO: Kenneth Rosland FROM: Gordon Hughes SUBJECT: Moratorium Concerninc Reliqious Institutions On September 20, 1982, the City Council requested that the Community Development and Planning Commission study and make recommendations concerning the regulation of churches in the R -1 District. It was agreed that such recommendations would be included within an overall revision to the Zoning Ordinance which would be submitted for consideration in early 1983. The City Council inquired as to the possibility of imposing a moratorium on church improvements pending the adoption of a new zoning ordinance. Mr. Erickson and I agree that the City Council may if it desires, impose a moratorium on church improvements. Such a moratorium may be imposed for up to one year and may be extended thereafter for an additional 18 months. As you know, Grace Church is anticipating the start of a major expansion of their facilities in the near future. St. Peter's Lutheran Church is like- wise proposing a major education facility for their property. This expansion has been considered on several occasions by the Board of Appeals and Adjustments. If the Council desires, it may exempt churches with building plans presently before the City from the moratorium. If the Council wishes to impose a moratorium, we suggest that a duration of six months would be appropriate. We also believe that the above referenced churches have spent considerable time and money in the .preparation of their plans and therefore should be exempt from a moratorium.
