MEMORANDUM
TO: Mayor and City Council DATE: December 20, 1982
FROM: Craig G. Swanson, Chief of Police
SUBJECT: Bids for Civil Defense Warning Siren
Five bids were received and opened on Thursday, December 2, 1982
for the acquisition and installation of anew Civil Defense air -
warning siren and the reconditioning and relocation of two previously
installed sirens.
The equipment specified and the costs bid were not within expectations.
I recommend that all bids be rejected and a new process be, initiated
in the near future.

IN THE "CONSTRUCTION BULLETIN"
STATE OF MINNESOTA,
County of Hennepin
L. Robert King, being first duly sworn, on oath says that he is and during all
times herein stated has been the publisher of the trade journal known as
"Construction Bulletin ", and has full knowledge of the facts herein stated as
follows:
1. Said journal is printed in the English language in magazine format.
2. Said journal is a weekly publication and is distributed at least once each
week.
3. Said journal has fifty percent (50 %) of its news columns devoted to building
and construction news of interest to contractors in this state and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter
and advertisements.
4. Said journal contains general and local news, shall contain building and
construction news of interest to contractors, among whom it shall have a general
circulation.
5. Said journal has a general circulation throughout the states among contractors
with at least twenty -five hundred (2500) copies regularly delivered to paying
subscribers.
6. Said journal is circulated throughout the state of Minnesota as well as the
-states of North Dakota and South Dakota and has its known office of issue in the
City of Golden Valley, County of Hennepin, established and open during its regular
business hours for the gathering of news, sale of advertisments, and sale of subscrip-
tions and maintained by the publisher and persons in his employ and subject to his
direction and control during all regular business hours.
7. Said journal files a copy of each issue with the State Historical Society.
Affiant further states under oath that the printed advertisement for bids hereto
attached as a part hereof was cut from the columns of said journal, and was printed
and published therein in the English language, once each week for 1 successive
weeks, that it was first so published on Friday the 19th day of Noverribex ,
1982 and was thereafter printed and published on every Friday to and including
the day of , 19 and that the following is a printed
copy of the lower case alphabet from A to Z, both inclusive, and is hereby
acknowledged as being the size and kind of type used in the composition and

The Commission considered a rezoning request to PRD -3 for the subject property
.on September 1, 1982. At that time, the proponent requested approval of a 13
unit townhouse development for the site. The Commission recommended denial
of the plan based upon its proposed density of about 11.5 units per acre. The
property is designated by the Comprehensive Plan as "low density attached
residential" which allows a maximum density of six units per acre.
The City Council considered the rezoning at its October 4, 1982, meeting.
The Council agreed with the Commission's recommendation and advised the
proponent that, if he wished, he could present a revised plan to the Commission
which conformed with the Comprehensive Plan. The Council thereupon continued
the request indefinitely.
The proponent has now returned with a plan illustrating a ten unit townhouse
plan for the site. This plan is very similar to the prior submittal in terms
of the style of development, access, and parking. The proposed density equates
to about nine units per acre.
RECOMMENDATION
In our view, the proposed plus continues to exhibit the same density concerns
as the prior plan. We would direct your attention to the September 1, 1982,
staff report for a more complete discussion of these density issues. In short,
Staff cannot support a Milan that exceeds seven units on the site. We, therefore,
recommend denial of the request based upon non - conformance with the
Comprehensive Plan.

PRD -3 Planned Residential District, Generally located 4600 France Avenue
REFER TO: Attached preliminary development plan and survey.
The subject property measures 1.14acres in area and is zoned R -1 Single Family
Dwelling District. The property is improved with a single family dwelling and
various accessory buildings. The property is quite level and rather heavily
vegetated. A masonary wall extends along the east, south, and west sides of
the property.
Immediately south of the property are two relatively new two family dwellings.
To the west are single family dwellings which front on Meadow Road. To the
north are three single family dwellings and to the north of these dwellings are
two single family homes which were rezoned several years ago for office uses.
North of these homes is a service station.
The proponent is requesting a rezoning to PRD -3 Planned Residential District.
A preliminary plan has been submitted which illustrates a thirteen unit townhouse
development for the property. Access to the project would be by way of a
private drive on the northerly portion of the site. Although elevation drawings
have not been submitted, (they are not required at this stage) we assume that
the units will be composed of two stories above a tuck -under garage. The plans
note 23 garage stalls and 23 exposed spaces. This appears to be a typo. We
believe 26 garage and surface stalls are proposed which conforms with the
ordinance.
In our view, the Comprehensive Plan designates this area for low density attached
residential.: The proponent submits that the subject property is in fact included
in a "high density" area on the land use graphic and, thus, the requested density
is appropriate.
Recommendation
The purpose of the preliminary development plan for a PRD rezoning is to evaluate
the general style of development and its density. While we concur with the
proposed townhouse use we disagree with the proposed density.
As noted above, the proponent believes that the graphic for the land use plan
illustrates high density usage for this property. The division between high density
and low density areas on the plan is admittedly difficult to define precisely with
reference to this property. It must be stressed, however, that the land use map
is not a "zoning map ". Its purpose is to illustrate the preferred relationship of
— land uses, not to impart a rezoning. It's for this reason that property lines are
not illustrated and streets, etc. are schematically shown.

We believe that it is appropriate to consult the• text of the Plan to ascertain
the preferred use of this property. The Plan states the following policies
concerning residential uses in the 44th and France area:
- Encourage redevelopment of obsolete or vacant commercial properties
and service station sites on the periphery of 44th and France for
multiple residential housing.
- Allow redevelopment or retro fitting of existing dwellings fronting on
France Avenue for low density attached residential uses.
The general policies of the Plan likewise advocate higher density housing for
obsolete commercial uses.
In our view, therefore, the Plan intends that sites such as the subject property
should be used for low density attached residential 0-6 units per acre. Therefore,
the property should be developed with approximately seven units rather than
thirteen.
The proponents note that the two family dwellings to the south maintain a higher
density than six units per acre. This is true. These dwellings equate to
approximately 9.5 units per acre. These units, however, were constructed upon
two pre- existing, legally established lots. The decision was made that each
should be developed with a double bungalow rather than a single family dwelling.
This resulted in an R -2 density which was somewhat higher than normally
expected. More importantly, the R -2 rezoning was approved prior to preparation
of the Comprehensive Plan. There was not an earlier land use plan in effect for
this area when the R -2 zoning was granted.
Based upon the above analysis, we recommend denial of the request based upon
non- conformance with the Comprehensive Plan. Staff 'would generally support
A rezoning to PRD -2 rather than PRD -3.

On November- 30, 1982, the Edina Health Advisory Committee met to consider -
three public health nursing proposals submitted by Bloomington Public Health
Nursing Service, Visiting Nurse Service and Fairview Southdale Hospital.
Listed below are the bid proposals submitted by the three agencies:

submitted estimated bids which may be

The proposal from FSH meets specifications with an extra program specifically

In considering the three proposals, the Committee took into account the
following issues:
1. By staying with BPHNS we avoid the transferring of records, change
of personnel and we maintain continuity of care.
2. VNS will merge with Suburban Public Health Nursing Service as
of January, 1983, and become Metropolitan Visiting Nurse Association.
With this merger, they will serve all of Hennepin County with the
exception of Bloomington, Richfield and possibly Edina.
3. VNS projects that Edina has about 400 patients with unmet Home Health
care needs and will actively seek new patients. Their proposal is not
based on these additional patients and if this projection is true, the
cost for the Home Health component will probably increase.
4. The Fairview - Southdale Hospital proposal was the most expensive
but could be reduced by utilizing a different mixture of personnel.
5. BPHNS did submit a flat rate proposal and they are assuming the
risk of increased demands without affecting the contract price.
BPHNS and VNS are currently involved in the delivery of public health nursing
services and both agencies have an excellent reputation. Fairview- Southdale
presently is delivering Home Health services but would have to develop the
other- nursing programs and train or hire personnel for the otherprograms.
The Edina Health Advisory Committee came to the conclusion that Edina should
stay with BPHNS for at least another- year. This would give VNS a period of
a year to reorganize after the merger.
Also, after a year's experience in expanding the service area, VNS may be in
a better- position to develop a bid package with a maximum dollar- amount for
the contract.
For those reasons, the Edina Health Advisory Committee recommends the Nursing
Contract for 1983 be awarded to BPHNS.

Request to change the "NO PARKING" area on France Avenue South adjacent.
to 4936 France Avenue South to allow short-term parking.
Request made by Haagen -Dazs Dessert Shoppe of Edina, Inc.
PREVIOUS ACTION:
This request was discussed at length with the proponents during the
November 9, 1982 Traffic Safety Committee meeting (see minutes for
details). In summary, the request was not inconsistent with current
parking provisions on France Avenue South, however, it is contrary to
the Commercial Area Redevelopment Plan of 1974. That plan calls for
the elimination of on- street parking in the subject area. At the November
meeting the item was continued pending contact from the 50th Street
Merchants Assn.
ACTION TAKEN:
Correspondence was received by the Committee from the proponents which
indicated support for the request. The Steering Committee of the 50th
Street Merchants Assn. unanimously endorsed one -hour parking in front
of 4936 France Avenue South.
Mr. Hughes moved denial of the request with reference to reaffirmation
of the Commerical Area.Redevelopment Plan of 1974. Mr. Hoffman seconded
the motion.
Discussion of the motion highlighted the previous action on the matter
and the November minutes were read. Mr. Hughes withdrew his motion.

Mrs. Coon moved that the request be approved by recommending the addition
of two one -hour parking spaces adjacent to 4936 France Avenue South based -
on current parking practices and precedents. However, the Traffic Safety_
Committee reiterates its position in support of the Commercial Area
Redevelopment Plan of 1974 due to its enhancement of traffic movement and
safety. Mr. Hoffman seconded the motion. Motion carried 3 -1.
2. Request for approval of.mid -block pedestrian access and crosswalk on West
70th Street between the Galleria Shopping Center and First Southdale
National Bank.
Request made,by Gabbert & Beck, 3510 West 70th.Street.
PREVIOUS ACTION:
The request was discussed at length during the November 1982 Traffic
Safety Committee meeting (see minutes for details). The outcome of that
discussion was the delay for one month to explore other options.
ACTION TAKEN:
Mr. Hoffman reported the details of meetings with representatives of
Gabbert & Beck. Added to the question of a crosswalk was traffic flow
and traffic control entering and exiting the Galleria parking lot in
proximity to the West 70th Street median east of France Avenue South.
Mr. Steve Yearneau, representative of Gabbert & Beck, was present and
reported that a private consultant had recommended the median be extended
and signs erected to preclude left turns into the parking area and left
turns exiting the parking area. Also, the east end of the median should
be signed "No U- Turn."
.Mr. Hoffman summarized future action:

seconded the motion. Motion carried 4 -0.

1. Request to change the placement of "STOP" signs at the corner of West 66th
Street and Hillside Lane from West 66th Street to Hillside Lane.
Request made by Linda Kuntz, 6725 Cahill Road.
ACTION TAKEN:
The intersection and traffic flow in the general area was discussed by the
Committee. No history was obtainable on the reasons for the original
installation of the "STOP ".signs.. The intersection does not have a high
incidence of accidents or complaints.
Mrs. Coon moved denial for lack of warrant. Mr. Hughes seconded the motion.
Motion carried 4 -0.
SECTION C
Requests which are deferred to a later date or referred to others.
1. Request for "NO PARKING - HERE TO CORNER" or "NO PARKING - 30 FEET" signs
on Halifax Avenue at West 54th Street.
Request made by Mr. Ralph Calloway, 5324 Halifax Avenue.
ACTION TAKEN: '
Mr. Swanson reported that in response to the request and-its relationship
to two nearby churches, two actions had been taken by the Police Department.
..The West 54th Street intersection was monitored on Sunday mornings and one
violator had been issued a warning tag. Secondly, the churches were
contacted and asked to include parking information in their respective
bulletins. The Committee surmised that the problem was of short duration
per week and could be managed short of signing the roadways.
Mr. Hughes moved that the item should be continued for two months, during
which time it would be monitored for voluntary compliance. Mrs. Coon
seconded the motion. Motion carried 4 -0.

SUBJECT: Neighbors' Home Watch - Update
"Neighbors' Home Watch" came into being during November of 1982. At the
outset a small number of participants were anticipated with an eye toward
slow and consistent growth.
The Edina Sun and the Minneapolis Star and Tribune gave excellent initial
coverage. Approximately 20 Neighbors' Home Watch clusters were formed and
small -group home presentations were initiated.
During this same time period, mid- November, the Edina Crime Prevention Fund
made the annual mail -out of its newsletter. Featured in the newsletter was_
Neighbors' Home Watch, which is sponsored by the Crime Prevention Fund. The
response to the newsletter and the program was overwhelming. Over 200 clusters
will be formed as a result of the newsletter and second-year objectives will
be met during the first few months of the program.
Needless to say, responses far exceeded resources of the program. From the
outset, on -duty police personnel have not been used for delivery of the program.
It.was planned as a community- based, volunteer activity with police guidance.
However, the high level of response dictated an immediate need for more workers.
On November 22, 1982, the long - standing Edina Senior Police Reserve was
mobilized to deliver the program. These retirees are now making the majority
of the presentations and contacts and will eventually take over Neighbors' Horne
Watch entirely. Other citizen- volunteers will work with them and .I am very
optimistic about the future.
Again, due to the large number of participants, a variation in the initial.
organizational meeting has been made. A mass meeting or an open meeting for
new clusters is being held at City Hall with the small group meetings to
follow. The next such meeting is scheduled for Tuesday, December 21, 1982,
7:30 P.M.

Attached are copies of the Hennepin County Laboratory Services Agreement
for 1983. Please ask the City Council to approve this Agreement on
December- 20, 1982.
We have increased the fee for well water testing from $8.00 to $8.50. This
will allow for a surplus of $1.40 per sample.
We will continue to charge $12.00 for food sample which allows a surplus
of $1.88 per sample.
All costs, including labor, supplies, autoclave time and space rental have been
considered in determining the total cost per sample. The agreement with the
County allows for up to $8,000 in laboratory services. The net surplus on $8,000
of testing will be about $1,280.

RE: STATE BUDGET BILL PASSED
The Legislature today approved a bill to solve the state's budget crisis. This
bill is a slightly modified version of the bill that was turned down by the
House on December 7.
I. EFFECT ON CITIES .
A:
The bill has two major.effects on cities:
1. Local government aid cuts.. Cities' December payments of homestead credit,
local government aid and attached_machinery..aid will -be reduced by a total of
$5.78 million. Each city's December check will be cut by an amount equal to
1.15% of 'the sum of i.ts local government aid (not including homestead credit
reimbursement) and its payable 1982 levy limit. The actual payment of the
December aid and credit will be delayed one week, to December 22.
2:.''Pensi:on funding. -chan es. During all of calendar 1983, city employees will be
requi- red to contribute an additional 2% of salary to PERA. (This is reduced.from
the 2z% originally proposed.) This brings a "coordinated" employee's total PERA
contributi.on,to -6%. The city will continue to make its 52% contribution for
"coordinated° members to PERA as well. PERA will then pay to the state.general
fund an amount equal to 4 %. of salary, for the first six months of 1983. Members
of PERA police and fire fund and "basic" fund will be similarly treated;. i.e., they
will contribute an, additional 2% of their 1983 salary to PERA, which will be passed
on to the state., Members of all other public pension plans, including local police
and fire relief associations, the Minneapolis municipal employees' retirement fund,
the state employees' retirement system, the teachers' retirement plan, the
legislators' retirement system and the judges' retirement system will also make the
same additional 2% contribution.
The additional 2% contribution is treated by PERA as an employee contribution; thus,
if the employee leaves his job, he may withdraw his entire 6% contribution from
PERA...The bi,11 also provides for restructuring of PERA so that the employee's entire
6% contribution will be deductible for federal income tax purposes. (The federal
deductibility is contingent on a favorable IRS ruling. However, as restructured the
plan appears to meet.the IRS requirements, and thus a favorable ruling is expected.)

These contributions are subject to the state income tax, however.

income tax. The bill increases state income taxes by imposing an additional 3%
surcharge, bringing the total surcharge to 10 %; as it stands the surchage will
expire June 30.
Sales tax. The bill raises the sales tax to 6% for January 1 through June 30.
The bill does not make clothing taxable; or contain other broadening features.
Provisions in the original bill for a 6% telephone tax were elminated.
Property tax. The original bill would have moved the property tax payment dates
up one month. These provisions were dropped from the bill as passed.
III. OTHER CUTS AND SHIFTS
The bill includes other cuts as follows: school aids, $17 million; state agencies
and institutions, $46 million; county, township, and.special district aids,
$8.3 million. The bill also shifts $100 million of school aids into the next
biennium.
COMMENTS
Final passage of this bill in the House occured by a bare 68 -57 majority. For_
cities, passage of the bill was crucial because of the Governor's announcement
Friday that if no bill was passed, he would unallot the entire amount of cities'
December aid and credit payments. Earlier indications had been that cities would
share equally with other entities in taking a 29% cut. The announcement that all
of the December money was at stake raised cities' ante from about $16 million
to nearly $50 million.,
Despite the amendment decreasing the employees' PERA contribution from 22% to
2 %, a 20% reduction, there was still strong opposition to this bill from most
public employee unions. City officials should recognize that it was difficult
for legislators to vote for this bill.
city officials certainly will find distasteful the idea of the state in effect .
stepping in and adjusting cities' payrolls. Nevertheless, the end result presents
the least institutional damage to cities'.

INFORMATION BULLETIN: STATE -LOCAL FINANCIAL CRISIS
Negotiators.representing the Governor, the Legislature, and the Governor -elect recessed
Friday night without producing an agreed upon program to deal with the state government
budget deficit.
The group will meet again on Saturday in another effort to solve the problem. The question
of whether there will be a special session of the legislature on Tuesday is undecided at
this time..
As of this. writing, all agreements are tentative and subject to change. The proposed pay
cut to all' (teachers, state, and local) public employees (including city employees) is
sufficiently significant and confusing that it is presented here. Remaining issues criti-
cal to cities include the size and allocation of cuts in payments to city governments.
This is unresolved although the size of this cut is currently relatively low - -a talking
figure of�$4- 8.million-- because the cut to employees generated $70 -90 million. It appears
that all the negotiators approve of the proposed employee pay cut.
The Cut to Employees: The proposal is to shift the major part of pension costs for the
next six months from the employer to the employee. The savings in the employer's cost
would then be forwarded to the state. For example, on a gross salary of $100, the employee
under the'social security- coordinated plan contributed $4.00 to PERA while the city pays
$5.50. The proposalwould have the employee contribute $9.00 to PERA; the city woul& pay
$.50 to PERA. The city then saves $5.00; this $5.00 would then be paid by the city to
the state's general fund. The end result is no direct effect on the city or PERA: the
employee has $5.00 less and the state has $5.00 more. (In practice, rather than deducting
the.additional 5% from the employee's salary for six months, the city would instead
deduct 2z% for the next 12 months).
Members-of the PERA police and fire fund, and "basic" PERA members would.be treated the
same way; i.e ,they;_'' too, would contribute an additional 2.5% of their gross salary to
PERA for the next -12 months. It is not yet clear what the effect would be on members
of local police and fire relief associations.
The League is recommending that the plan, if it is enacted, be structered so that the
employee's contribution would be deductible for federallincome tax purposes. If this
is possible, it would mitigate somewhat the effect on city employees.
Should the,negotiatorsresolve the balance of the issues on Saturday or Sunday, including the
size and allocation of the cut in payments to cities, the League will publish an Action
Alert on Monday with the details and recommendations.

over a year. However, only recently have all potential Edina subscribers had the oppor-

all of Edina and at the request of many residents who have heard that the hockey game is
on, or that the Mayor has his own show but until recently could not watch; all local Edina

"Neighbors' Home Watch" came into being during November of 1982. At the
outset a small number of participants were anticipated with an eye toward
slow and consistent growth.
The Edina Sun and the Minneapolis Star and Tribune gave excellent initial
coverage. Approximately 20 Neighbors' Home Watch clusters were formed and
small -group home presentations were initiated.
During this same time period, mid - November, the Edina Crime Prevention Fund
made the annual mail -out of its newsletter. Featured in the newsletter was
Neighbors' Home Watch, which is sponsored by the Crime Prevention Fund. The
response to the newsletter and the program was overwhelming. Over 200 clusters
will be formed as a result of the newsletter an secon -year objectives will
be met during the first few months of the program.
Needless to say, responses far exceeded resources of the program. From the
outset, on -duty police personnel have not been used for delivery of the program.
It was planned as a community- based, volunteer activity with police guidance.
However, the high level of response dictated an immediate need for more workers.
On November 22, 1982, the long- standing Edina Senior Police Reserve was
mobilized to deliver the program. These retirees are now making the majority
of the presentations and contacts and will eventually take over Neighbors' Home
Watch entirely. Other citizen - volunteers will work with them and I am very
optimistic about the future.
Again, due to the large number of participants, a variation in the initial
organizational meeting has been made. A mass meeting, or an open meeting for
new clusters is being held at City Hall with the small group meetings to
follow. The next such meeting is scheduled for Tuesday, December 21, 1982,
7:30 P.M.

SUBJECT: A BRIEF'REPORT ON THE EMPLOYEES EXTRA 2% PERA CONTRIBUTION

The December 1982, special session of the Minnesota Legislature enacted_a
temporary provision which requires all PERA employees (and the other
public employees) to contribute an extra 2% of gross pay to PERA. .Following
are some brief highlights:
1. For the year 1983, your PERA deduction will be increased.by 2 %;
2. The extra '2 %will be credited to y our individual account;
3. For the first six months of 1983, PERA will send 4 % :of the employer
contribution to the State of Minnesota;
4. By the end of 1983, PERA will have received the additional 2% employee
contributions which are intended to offset the 4% payments made to the
State;
5. If any employee terminates employment and takes a refund of
contributions, the extra 2 %..will be returned to the employee;
6. To offset any loss.to the PERA fund (and the other state funds included.)
from the provision in #5 above, and the -loss of investment interest,
the Legislature appropriated $8 Million to be distributed to the
affected funds.
The above information is to be considered a general outline of the provision
of the 2% legislation. It,_cannot be_ considered absolute, and any member
whose situation may be adversely affected, or who believes such to be the

be appointed as agent of the City of Edina to let as its agent, con-
tracts for the construction of local streets and bridges, and the
Mayor and the Clerk are hereby authorized and directed for and on
behalf of the City Council to execute and enter into a contract
with the Commissioner of Transportation prescribing the terms and
conditions of such contracts in the form as set forth and contained
in "Minnesota Department of Transportation Agency Agreement" a copy
of which said agreement was before the Council assuming on behalf
of the City all of the obligations therein contained.

WAYNE TRACY
Wayne Tracy's background is flavored with Edina history. He was
born and raised in Edina and attended Wooddale school, from there he
attended and graduated from St. Louis Park High School (due to the fact
that there was not a Edina High School at that time.) Tracy Avenue which
is named after his family, emerged from farm property owned by his grand-
father and great - uncle. At that time Tracy Avenue was a dirt road about
12 feet wide.
Wayne'.s father was employed by the City for 42 years and when Wayne
was about 10 years old he started riding with his father when he plowed
snow with the first motorized truck that the City owned.
Wayne began his career with the City as a seasonal employee during
the summers of 1945 and 1946. In September of 1947, after graduation
from High School, he started work as a fulltime employee with a starting
wage of 55Q per hour. When he started, he worked alongside and learned
his trade from members of the original crew of workers. During subsequent
years he has witnessed many technological changes in the Public Works
Deaprtment and has displayed the ability to handle any job within the
department with great skill including his current postion as Heavy
Equipment Operator.
