S -79 -2 Preliminary Registered Land %Survey.for.Halla Enterprises.
Described as Tracts A, B, C, and D of Registered Land Survey
No. 390, and Tracts A and B'of Registered Land Survey No.
1021. Generally located south of Eden Avenue, west of
Willson Road, and east of State Highway 100.
REFER TO: attached graphic
The Commission will recall that it considered a rezoning request by the
Kerr Companies from R -1 to 0 -2 Office for a portion of the subject pro-
perty several months ago..` This rezoning request subsequently was granted
first-reading (i.e. preliminary approval) by the City Council. A hearing
is tentatively scheduled for March 19, 1979, to consider second-reading.
In conjunction with this rezoning request, a new registered land survey
for the subject property is proposed. This registered land survey will
divide the subject property into two parcels. The Perkins Restaurant
and parking lot will be located on Tract A. The proposed new office
building will be located on Tract B.
. Recommendation
Staff recommends approval of the requested registered land survey
conditioned upon
1. Final approval of the rezoning request presently pening before the
Council for Tract B of -the proposed R.L.S.
2. Subdivision dedication.

Gordon Hughes asked the Commission to recall that it had
considered a rezoning request by the Kerr Companies from R -1 to 0 -2 Office
for a portion of the subject property several months ago. He continued to
note the rezoning request subsequently was granted first reading (i.e. pre-
liminary approval) by the City Council, and a hearing is tentatively set for
March 19, 1979, to consider• second reading.
Mr. Hughes indicated that in conjunction with this rezoning
request, a new registered land survey for the subject property is being proposed
to divide the subject property into two parcels, Tract A being the Perkins
Restaurant and parking lot, and Tract B consisting of the proposed office
site.
Staff recommended approval of the requested registered land
survey with the following conditions: that final approval of the rezoning
request presently pending before the Council for Tract B of the proposed R.L.S.
is granted, and that a subdivision dedication be received.
In response to Del Johnson's question as to why the condition
of approval of the rezoning was necessary, Gordon Hughes replied he\felt this
should go through as a package, and if the rezoning did not go through and the
property should change hands there could be some problems in changing the zoning.
Gordon Johnson observed that the recommendation was made by Staff to streamline
the legal description of the property, and staff felt that it would be a good
time to do.it in conjunction with the rezoning request. Mr. Hughes affirmed
that observation was correct.
Gordon Johnson asked Mr. Hughes what amount the Council was
considering in conjunction with the subdivision dedication. Mr. Hughes answered
that the Council was considering a fee of $16,000 which was an acceptable figure
to the Kerr Company.
Len Fernelius moved the Commission approve the R.L.S. request
with the two conditions recommended by staff: that final approval of the rezoning
request presently pending before the City Council for Tract B of the proposed
R.L.S. is granted, and that a subdivision dedication be received. Helen McClellnad
seconded the motion. All voted aye; the motion carried.

The subject property is a developed two family dwelling lot located on the
west side of Malibu Drive. The proponents are requesting a simple lot
division to divide the lot along the common party wall between the two
dwelling units. Each dwelling unit is not presently provided with separate
sewer and water.
Edina Ordinance No. 801 -A14 states that as conditions to the approval of
such division, the owner of the lot shall make separate and independent
sewer and water connections to each dwelling unit or obtain a waiver of
this requirement from the Building Construction Appeals Board. Further,
the City Clerk shall not give a certified Council resolution approving
such division until independent connections are made or until a waiver
is granted.
Recommendation:
Staff recommends approval of the lot division conditioned upon the proponents
making separate and independent sewer and water connections to each dwelling
unit or obtaining a waiver from this requirement from the Building Construction
Appeals Board. The resolution approving this :division -will not be released
until this condition has been met.

This lot, Gordon Hughes explained to the Commission, is
located immediately south of the previous lot division request on the west
side of Malibu Drive. He continued that the lot is an existing two family
dwelling, and the proponent is requesting a simple lot division to divide
the property down the common party wall between the two dwellings. Mr. Hughes
noted that the two double bungalows do not have separate sewer and water
connections. He indicated the proponent was informed that Edina Ordinance
No. 801 -A14 states that the owner of the lot shall make separate and inde-
pendent sewer and water connections to each dwelling unit or obtain a
waiver of this requirement from the Building Construction Appeals Board as
a condition to the approval of a lot division.
Gordon Hughes indicated that staff recommends approval of
the lot division conditioned upon independent sewer.and water connections
being made to each unit or the proponent receiving a waiver from that
requirement by the Building Construction Appeals Board. He noted that this
waiver is granted from time to time when due to the plumbing of the house
or the existing surfaces it would be a hardship to the property and owner
to provide independent- connections. -Gordon Hughes continued --that staff - would
recommend, then, that the resolution approving the division from the Council
be withheld until those connections are made or until a waiver is granted.
After general discussion, Mary McDonald moved the Commission
recommend approval of the lot division conditioned upon independent sewer and
water connections being made to each unit or the proponent receiving a waiver
from that requirement by the Building Construction Appeals Board, and that
the resolution approving this division should not be released until this
condition has been met. Helen McClelland seconded the motion. All voted aye;
the motion carried.

I. Approval of the Minutes
Richard Seaberg moved the minutes of the February 28, 1979,
Community Development and Planning Commission meeting be approved. Helen
McClelland seconded the motion. All voted aye; the minutes were approved.
II. New Business:
LD -79 -3 Lot Division. Lot 7, Block 1, Parkwood Knolls
15th Addition.
Gordon. Hughes explained to.the Commission that the subject
property is a developed two - family dwelling lot located on the west side of
Malibu Drive. He continued that the proponents are requesting a simple lot
division to divide the lot along the common party wall between the two dwelling

conditions to the approval of such divisions, the owner of the lot shall make
separate and independent sewer and water connections to each dwelling unit or
obtain a waiver of this requirement from the Building Construction Appeals
Board, Gordon Hughes elaborated that the City Clerk shall not give a ceritified
Council resolution approving such divisions until independent connections are
made or until a waiver is.granted.
Therefore, staff recommended approval of the lot division
conditioned upon the proponents making separate and independent sewer and water
connections to each dwelling unit or obtaining a waiver from this requirement
from the Building Construction Appeals Board. Mr. Hughes concluded that the
resolution approving this division will not.be released until this condition
has been met.

FOURTH ANNUAL STATE OF THE REGION CONFERENCE
The subject of this year's event is "The Condition of the
Older Part of the Region: What Do the Vital Signs Show ?" The
session is set for Saturday, April 28 at St. Paul's Landmark Center
The session will be devoted to taking a close look at what has
been occurring in the Region's central cities and fully developed
suburbs. What does the new R.L. Polk Co. data, just acquire
the Council, and other research data show? Is the demographic,
construction, economic, neighborhood and governmental fiscal
picture upbeat or bleak?
Council Chairman Charles Weaver will give the Council's
assessment of the condition of the older built -up area, followed
by panels on reinvestment activity, constraints on revitalization
and recycling communities. Q and A sessions will follow each
panel discussion. Panelists include Mayor Latimer, Tom Berg,
Dick Brustad, Glenn Hanggi, Van White, Sonia Sands, Jerry
Allen, Dick Krier, Laurie Clugg, plus representatives from the
business community.
Cost for the all -day session is $2. Mark your calendar and plan
to attend and participate. Please RSVP to the Council at 291 -6464.
COMING MEETINGS (March 26 -30)
Human Resources Committee — Monday, March 26, 6 p.m.,
Council Chambers.
The committee will meet with the Metropolitan Health Board
to discuss implementing long -range goals of Metropolitan Area
hospitals. Action is expected on proposed amendments to the
Council's Housing Development Guide which contains housing
guidelines communities should follow in preparing local compre-
hensive plans.
Metropolitan Health Board — Wednesday, March 28, 4 p.m.,
Council Chambers.
The board will consider the responsibilities of the Perinatal
Data Study Group and new sections of a proposed health sys-
tems plan dealing with ambulatory surgery and radiation therapy.
Action is expected on implementation procedures for long -range
hospital planning. Action is also expected on review waivers for
proposals by Fairview Hospital (Minneapolis) to buy an office
building and computer equipment.
Personnel and Work Program Committee — Wednesday, March
28, 5 p.m., Conference Room A.
The committee is expected to.act on designated depositories
for Council funds, amendments to Council bylaws and a contract
to help suburban communities carry out hiring procedures devel-
oped by the suburban police selection standards study conducted
by the Metropolitan Council.
Physical Development Committee — Thursday, March 29,
1:30 p.m., Council Chambers.
The committee is expected to act on a grant application from
St. Francis (Anoka County) to develop an industrial park; trail
funds for Phalen Park (St. Paul); a proposed grant policy on
development projects at regional parks; and a decision to involve
the Council in the proposed designation of the Metropolitan Area
by EPA as a "sole - source aquifer ' area. There will be a Council
staff briefing summarizing data from a park user survey done last
summer.

ACTIONS LAST WEEK (March 19 -23)
METROPOLITAN COUNCIL
In Sewer Planning, the Council said the interim comprehensive
sewer plans developed by Eagan and Bloomington are consistent
with regional plans and can be used by the communities until
they develop their municipal comprehensive plans.
The Council agreed to lift some of the restrictions it had earlier
placed on the use of the Lino Lakes regional interceptor based on
the planning work performed by the community. The Council
decision allows Lino Lakes, to add the equivalent of 300 residen-
tial connections to the system. The interceptor was originally
constructed to alleviate pollution problems in part of the com-
munity. I _
The Council said a grant request by St. Paul for federal funds
to construct storm sewers in the St. Anthony Hill area is consist
ent with regional planning. The new sewers would relieve the
present combined storm - sanitary sewer system, which backs up
into home basements during very heavy rainstorms.
In Transportation Planning, the Council set a public hearing
for April 12 to hear public comments on proposed transit policy
amendments and criteria and procedures to be used to review
proposed new or changed interstate highway interchanges (see
Public Hearings section below for details).
The Council approved the design for the 10 -mile I -94 segment
in Washington County as roposed by the state commissioner of
transportation. The new facility would be built along the present
Hwy. 12 right -of -way from 1-494 to the St. Croix River. Inter-
changes would be constructed at Co. Rds. 80, 19B, 15, and at
Hwy. 95. Bridges would be constructed, but no access provided,
at Co. Rds. 17, 71 and 21. The Council action includes a request
for an alternate design at Co. Rd. 80 (Radio Drive) to ease possible
local traffic congestion.
In Parks Planning, the Council concurred with a Ramsey
County request to acquire property along Upper Afton Road in
Maplewood as part of Battle Creek Regional Park. The Council
did not concur with a county request to delete certain land
parcels from the acquisition planned at Grass - Vadnais, Otter Lake
and Battle Creek Regional Parks.
In Criminal Justice Planning, the Council authorized its chair-
man to apply for a $200,000 LEAA and Juvenile Justice planning
grant and to enter into contracts with the Hennepin and Ramsey
County Criminal Justice Coordinating Councils.
In or-her actions, the Council: approved budget amendments
proposed by the Metropolitan Sports Facilities Commission;
approved the charges to regional operating commissions for ser-
vices rendered to them by the Council in 1978; approved a
$16,897 Title III aging grant to Washington County Human Ser-
vices, Inc.; and approved local planning assistance grants to the
following communities: Centerville, $2,756; Greenfield, $2,474;

of preparing local plans required by state law.
COMMITTEES OF THE COUNCIL
The Physical Development Committee recommended that the
Council begin to play an active role in planning for the water
transportation system in the Region. The planning effort would
be coordinated with the Upper Mississippi River Basin Commis-
sion. Any policies developed would be coordinated with other
agencies involved in water transportation planning.
PUBLIC HEARINGS
1979 Health Annual Implementation Plan and Application for
Renewal of Designation as a Health Systems Agency — March 28,
7:30 p.m., Council offices. The purpose of the hearing is to listen
to public comment on the one -year plan for implementing the
ob ectives and actions outlined in the Health Systems Plan and on
a Zcument containing the agency's proposed work program and
budget.
Health Systems Plan The Council and Health Board held the
hearing on the proposed plan on March 21. The hearing record
will be kept open for written comments through March 28. Writ-
ten comments should be sent care of Charles Weaver, Council
chairman, at the Council offices.
Transportation Policy Plan Amendments — April 12,1:30 p.m.,
Council offices. The purpose of the hearing is to provide an oppor-
tunity for the public to respond to proposed amendments to the
plan in two areas: 1) inclusion of more detailed policy direction
0 n the planning, operation and evaluation of transit projects, par-
cularly costs; and 2) the addition of criteria and procedures to
evaluate proposals for new highway interchanges and modifica-
tions of existing interchanges. Ask for the Proposed Amendments
to the Transportation Policy Plan, dated March 22. A background
report on the guidelines and procedures, entitled Metropolitan
Highway Interchanges: Criteria and a Procedure for Analyzing
Proposed Changes on the Highway System in the Metropolitan
Urban Service Are January 1979, is also available.

Dear Mayor. VanVilkenburg:
It is my understanding that your city has experienced some
degree of involvement with the National Flood Insurance
Program administered by the U. S. Department of Housing and
Urban Development (HUD) - Federal Insurance Administration
and by the State of Minnesota, Department of Natural Resources
(DNR) .
I would sincerely appreciate your cooperation in having the
subject matter of this correspondence placed on the agenda
for your next city council meeting and request that this
letter be read at said meeting to your city council.
For a number of years, our city council has attempted to
reach a reasonable understanding with the federal and.state
government agencies having jurisdiction over flood.plain
management matters, namely HUD and DNR. These attempts have
been less than satisfactory. The end result, has.always
been the same; no attention is given to solutions which we
sincerely believed to be reasonable and in the best interests
of the citizens of our community. A- 1- Y-local input; inc'lud'ing

It was the unanimous opinion of our city council and of the
vast majority of our constituents who have addressed them-
selves to this issue that our city should oppose involvement
with the National Flood Insurance Program with the attendant
flood plain management criteria required by both federal and
state legislation.

We were, however, not so provincial as to be unaware of the
futility of electing the option of nonparticipation in the
federal program. As you are aware, severe sanctions are
imposed on nonparticipants including loss of financing from
such sources as FHA, VA, and loss of grants and other programs
ordinarily available to local units of government. This is,
of course, a subtle form of extortion apparently precluding
the exercise of any reasonable option by those local govern-
mental units designated by the federal government for inclusion
in the program.
The immediate problem to be addressed by our city council is
the intransigence of the Minnesota Department of Natural
Resources. In addition to the dictates of the federal
legislation requiring protection against the regional flood
(also referred to as the 100 -year flood), the DNR has arbi-
trarily decreed an additional requirement of one -foot of
freeboard. This additional burden, which compounds elevation
and flood - proofing expenses, results in severe economic
hardships for our city and its inhabitants.
The Minnesota flood plain management legislation requiring
each participating city or county to enact an ordinance
which must be approved by the commissioner of Natural Resources,
is set forth in Minnesota Statutes 104.01 - 104.08. Nowhere
in the statutes are there any references to the imposition
of an additional one -foot of elevation or for that matter,
of any protection supplemental to that required by the
federal legislation. The imposition of the additional one
foot referred to by the DNR as "freeboard" is a classic
example of the exercise of arbitrary administrative fiat,
severely resented by myself and our entire city council.
The DNR rationalizes the imposition of the additional one -
foot by reference to power conferred by the Minnesota
legislature on the commissioner of Natural Resources to
issue rules and regulations necessary to carry out the
purposes of the state and federal law.
It is interesting to note that most state governments have
not deemed it necessary,to supplement the federal legislation
with state statutory language. It is our understanding that
out of the fifty (50) states, only approximately fifteen .
(15)--states have adopted supplemental flood plain legislation.
We have further been led to .believe in our conversations
with HUD officials, that on an overall basis, the State

of Minnesota currently imposes the most restrictive and
demanding requirements of any state having adopted additional
or supplemental flood plain management legislation.
In September, 1978, our city reluctantly passed a variation
of a model flood plain ordinance deleting, however, the one-
foot of freeboard demanded by the Commissioner of Natural
Resources. ,Our council did not believe this deletion to be
a unilateral expression of protest, having had, prior to
adoption of the ordinance, a meeting with HUD and DNR officials.,
including the Commissioner of Natural Resources. At the
conclusion of this meeting, our council was led to believe
by the Commissioner of Natural Resources that our ordinance
would be accepted without the controversial one -foot additional
requirement. The Commissioner stated, however, that he
could not approve any ordinance.until it was passed by the
council and submitted to him. Following passage of the
ordinance and submission to the DNR, our city council was
informed by the.Commissioner of Natural Resources that our
ordinance was not acceptable and we were given a deadline to
pass an ordinance deemed to be in compliance. Moreover,
this action prompted HUD officials to advise our city council
that unless the city received an approval of.our ordinance
by DNR, HUD would declare our city to be in a state of
noncompliance.with all the harsh sanctions resultant therefrom.
At that point our city was faced with the option of either
throwing in the towel and buckling under to the bureaucracy, or
electing nonparticipation, which with its obvious built -in
coercion factors, was not likely a viable alternative.
After considerable reflection, our city council pursued a
third option, novel perhaps, but possibly a portent of
things to come. -We commenced a legal action against the
Commissioner of Natural Resources in the District Court for
the State of Minnesota requesting the Court to issue a Writ
of Mandamus designed to require the Commissioner of Natural
Resources to accept our ordinance as passed by the city
council. It was our considered opinion that the Roseau City
Council was still the governing body of the city and that as
far as we knew, the Department of Natural Resources had not
yet .usurped this function. This legal action is currently
in progress-and one hearing has been held in District Court.
We have recently been advised by HUD that if our ordinance
has not been accepted by the Department-of Natural Resources

by April 2, 1979, HUD will hold us to be in noncompliance.
In the event that our action- against the Commissioner of
Natural Resources is not resolved.by April 2, 1979, and HUD
does not extend their deadline, our city -will commence an
action in the Federal District Court for the State of
Minnesota requesting an injunction -or restraining order
preventing HUD from implementing its threatened action.
We believe that the mood of the people of this state reflects
an abhorrence to the heavy handed tactics displayed over
these past many years by the DNR. We propose that the
time has arrived for city and county governments throughout
the state to join forces in cooperating and assisting each
other on problems similar to the one currently being experi-
enced.by our city.
Our city council suggests all interested units of:local
government consider sending representatives to a joint
meeting to be held at some convenient location; at a mutually
agreeable date and time. Would your council be interested
in such a meeting?
If your city identifies with our situation, we would appre-
ciate receiving a letter of support or a resolution from you
requesting deletion by the DNR of the one -foot additional
freeboard required by the Commissioner's rules and regulations.
You may also wish to consider in any resolution a recommendation
that the Minnesota legislature review the entire flood plain
management legislation and the powers conferred upon the
Department of Natural Resources in this and other Viers..

SUBJECT: WORK COMPENSATION LOSSES
DATE: March 28, 1979
As an item of interest, I thought I would send along the worker's
compensation losses from 7 -1 -78 to 2- 15 -79. To date, including
reserves, it has amounted to $7,300. If 30% administrative costs
are included, it would raise it to $10,000.
Our premiums to our insurance company which are a function of state
set rates and the City's experience modification will be about
$165,000 for 7 -1 -78 to 7 -1 -79. Admittedly, the City could have a
couple losses which could rapidly increase that figure, but the
experience over the last 5 years (with the exception of one year)
the City experienced losses at under 40% of premiums paid. The
minimal losses to present can be partially attributed to safe work
practices.

Thank you for forwarding to Ire last week your S.F. 1010 relating to elections, financial
disclosure, etc., applying to Hennepin County, city, and school district officials.
I believe the Hennepin County Board of Commissioners fully supports appropriate, necessary,
consistent; and - effective financial disclosure for all public officials and/or employees
iii Ylinnesota.
- = You probably know that some conmissioners have proposed "full disclosure " - resolutions for
the Hennepin County Board. Exhibit 1, attached, was rejected. Exhibit 2, is a response
from the County Attorney's Office generated by these same commissioners. Exhibit 3 is a
proposed answer to Exhibit 2 scheduled for hearing by our Ways and Means Corrrnittee on
April 5 and, as you will note, requests that the legislature "review fully the issue of
financial disclosure for all public officials and erployees in Minnesota ".
It strikes me that a simple approach you micht consider as an alternative to S.F. 1010
would be to add other public officials and employees to M.S. Chapter 10A, E`rHICS IN
GovERNMERr.- Particularly so since there seem to be so many Minnesota statutes covering._.
similar subjects ranging from elections, civil service, interests in contracts, conflicts .-
ofminterest, neglect of duty, speculations, etc., to Crimes Affecting Public Officer or.. -

along with language stating that the dissenters did not endorse the letter
because they supported the bill and believed that the letter did not

Ella Terry was unable to be with us at the Steven's Square monthly birthday
party because of the death of her brother. Our thoughts were with her. Frank
Lenske and Dorothy Samuelson filled in for her.
One elderly lady asked Frank Lenske, our *taurice Chevalier, to shake her hand.
It brought back memories of years ago. She had the honor of shaking hands with

MY TRIBUTE TO SCOUTIN
"I shall pass through this world but once. If I can do any kindness or good
turn as I go, let me do it now for I may not Pass this way again." These words
are among Stan Eddy .Tr.'s collection of beautiful thoughts. Although lie doesn't
remember who said those words, he has tried throughout his life-_ to put into
practice their meaning. [v'hether it's playing Santa Claus to children at Christ-
mas or speaking to a group of boy scouts, Eddy's philosophy of showings kindness
to others is repeated over and over. IIe recently received the 50 -year Cold
for service to scouting and here is his tribute to scouting:
In my 50 years of scouting, I've had many happy moments but four or five stand
out in my memory. The first was when I became a Tenderfoot Scout in Boy Scout
Troop :'.128 at St. dark Episcopal Church. We not only learned the scout oath and
laws but we learned to live them. Another was vlien I won the Dan Beard Fire By
Friction Cliamnionshi.p for _ five years and a record time of 8 -3/5 seconds in 1931,
a time that has never been beaten. Another, when I received the Fagle Scout
badge, scouting;'s highest boy award. I think it was then that I resolved to
serve Scouting the rest of my life. Another was receiving the Silver Beaver
Award, scouting's highest adult award, and this was important because it was
given by my peers and could not be earned. Last but not least were the wonder-
ful 16 years I served as Scout ,taster for a great bunch of boys. I think these
were my most rewarding years in Scouting.
Three people had a great part in my scouting; career in my first few years. The
first was my Scoutmaster, Lawrence Anderson, who taught me discipline. ?My
second, Scoutmaster F. ?Mariner Clark, who taught nie a love of nature and camping.
Third was Chief Scout Executive, George l ;Tychoff, who gave me the enthusiasm of
Scouting. These men with the great program of Scouting, based on the oath and
laws, camping program and always that great,motto "no a good turn daily" gave me
• love of Scouting I've never lost. If we could all live the scout rules, what
• better world this would be.
My 50 years in Scouting have none by all too fast. I salute a v onderful_ program.
We need Scouting's ideals so very much in this world today for the Scouts of
today are the citizens and leaders of tomorrow.

requesting action to prevent further accidents on County Road
62. This resolution has been referred to staff and I will
forward to you any action that the staff or County Board takes
with respect to this matter.
This is an issue I have been concerned with and working on
ever since I became a member of the County Board. It is very
helpful to have this kind of support for my "cause" from the
City of Edina. Unfortunately, it's a long slow process to
accomplish the needed changes, but it's one I intend to pursue.
Money, of course, is always the problem.

1) Dinner to be held at L' Hotel de France on Friday, 20 April
1979 with cocktails (cash bar) at 6:00 pm,.dinner at 7:30 pm,
band concert and program later.
2) The dinner will be as follows:

SUBJECT: Joint Meeting of Edina, Bloomington, and Richfield Health
Advisory Committees
DATE: March 28, 1979
A joint meeting of the Health Advisory Committees is scheduled to take place
on April 17, 1979, at 7:00 p.m. in the Ethel Barry Room at the Southdale
Library, 7001 York Avenue South.
Russ Stricker, Executive Director of the South Hennepin Human Services Council,
has agreed to act as moderator for the meeting. The meeting will consist of
a' presentation from each advisory committee and a presentation from each
health department of the three cities. After a brief presentation, the
meeting will be opened to a discussion session during which questions will
be answered about the various programs within the three cities.
This department will be sending invitations to other public officials
and would appreciate any suggestions as to other persons or organizations
which may be invited.
I hope you will be able to attend this meeting.

Contracting Company who would Tike to exchange approximately
104 thousand yards of gravel for grading work at Grand View
park site in the northwest corner of Edina. The Shafer
Contracting Company has the contract for building the bridge
across Excelsior Boulevard for the next 2 years.
At present we have 100 thousand yards which is owned by
Hennepin County and stock -piled in our park. In this
agreement, Hennepin�County is to grade this area according
to a Stockpile Lease Agreement signed and dated May 21, 1974.
1 would like to work out an exchange for the remaining 104 thousand
yards whereby the Shafer Contracting Company would final grade
ready to seed, sod and placing of black dirt which is on site;
the parking lots, entrance road, 2 Softball diamonds.and
Soccer field, according to the design plans by Brauer and
Associates and the City Engineers. The City Engineering Staff
would provide all surveying-and staking of the area according
to plan. Also, Shafer Contracting would install the storm
drainage construction and pipe according to the City Engineers
plan which consists of approximately 2100 lineal feet of 12"
RCP and 10 CB man hole structures. Under this exchange of
work there would be no exchange of money between the 2 organizations:
