LD -79 -9 Lot 1, Block 2, Replat of Part of Grandview Plateau
REFER TO: October 31, 1979, Staff Report and attached agreement
form.
The subject lot division was continued from the October 31, 1979, meeting. At
that time, staff reported that separate sewer and water connections were not
provided to the subject two family dwellings. According to ordinance
requirements, such connections must be provided as a condition to a lot
division. The Building Construction Appeals Board, however, may waive this
requirement upon finding that a hardship exists that is caused by the physical
character of, and cost of complying with, the connection requirement. If
such a waiver is granted, the property owner must then enter into the i
attached agreement with the City.
Staff also noted at the last meeting that-a swimming pool was located in
the rear yard of the subject property. This pool is located directly
behind one of the units. According to health ordinances, this pool must
either be completely fenced and assigned to one of the units or licensed
and upgraded to multi - family standards.
Redommendation:
Staff recommends approval of the lot division with the following conditions:
1. Separate sewer and water connections must be installed or a
waiver from this requirement obtained from the Building
Construction Appeals Board.
2. The swimming pool must-be entirely fenced and assigned to
one of the units or licensed and upgraded to multi family

REFER TO: Attached graphic
The proponent is requesting a party wall division of an .existing two family
dwelling located at 5200 Grandview Lane. At this time, staff has not .been
able to determine if separate sewer and water connections have been installed.
We will make this determination prior to Wednesday's meeting.
Recommendation:
Staff recommends approval of the lot division conditioned upon resolution of
the sewer and water connection question. In addition, a swimming.pool designed
for single family usage (according to City health ordinances) is located in the
rear yard of the lot. This pool will either have to be completely fenced and
assigned to one of the units or upgraded to multi- family standards.

AGREEMENT AND DECLARATION OF
COVENANTS AND RESTRICTIONS
(Connection of Water and Sewer Lines)
( "Owner" whether one or more) is the .
record fee owner of the following property located in
the City of Edina, Minnesota (the "City "):
(the "Property "); and
WHEREAS, a two family dwelling has been constructed
upon the Property and, pursuant to applicable ordinances, the
City has approved a division of the Property so that it may
be conveyed as two separate parcels with the portions of the
dwelling on the respective parcels, which two parcels are
described as follows:

and
WHEREAS, the City,.in connection with such
approval, and pursuant to its applicable ordinances, also
waived the ordinance requirement that each separate portion
of the dwelling as so divided have a separate and independent
connection with the water and sanitary sewer lines serving
each such portion to the public water and sewer lines, but
conditioned upon execution and delivery of this Agreement
and Declaration of Covenants and - Restrictions by Owner.
NOW, THEREFORE, for and in consideration of such
waiver by the City, Owner, for himself, and for all
future owners and occupants of the Property and each such
parcel thereof, does hereby:
1. Agree that the City shall not be liable
to any present or future owners or occupants of the Property,
or either of such parcels, for any damage or injury to
persons or property resulting from a lack of separate
and independent connections of each such portion of the
dwelling to the public.water and sanitary sewer systems, and
all claims or demands against the City due to such damage
or injury are .hereby waived and released;
2. Impose upon the Property, and each such
parcel thereof, the following covenants and restrictions:
a. the owners of each of such parcels of
the Property shall share equally with the owner of the
other of such parcels in any and all costs incurred by the
owners of either of such parcels as a result of not
having separate and independent connections for each of the
respective portions of the dwelling to the public water and
sanitary sewer systems; and

b. that if each of the portions of the
dwelling are not separately metered, the owners of each of
such parcels of the Property shall share equally in all water
and sanitary sewer charges made for supplying such services
to the .Property, and that the City.may determine charges
for water and sanitary sewer usage by allocating consumption
equally between said two parcels and totalling the separate
charges based on such allocation.
3. Agree that the City may discontinue supplying
water and sanitary sewer services to the Property, and both
of said parcels, pursuant to applicable City ordinances,
for any delinquency in paying to the City the whole of any
water and sewer charges for such services to the Property,
even though such discontinuance.is caused by the delinquency
of the owners of only one of such parcels.
4. Agree that the provisions hereof shall run
with the title to the Property and shall be binding upon each
and every present and future owner and occupant of all or
any part of the Property, and shall inure to the benefit
of the City and its successors and assigns.
5. Agree that if any term, condition, or provision
hereof, or the application thereof.to any person or circum-
stance, shall, to any extent, be held to be invalid or unen-
forceable, the remainder hereof and the application of such
min
term, provision, and condition to persons or circumstances
other than those as to whom it shall be held invalid or
unenforceable shall not be affected thereby, and this
Agreement, and all the terms, provisions, and conditions
hereof, shall, in all other respects, continue "to be
effective and to be complied with to the full extent permitted
by 1 aw. .

Craig Larsen reminded the Commission that the subject
lot division was continued from the October 31, 1979, meeting. At that time,
the staff reported that separate sewer and water connections were not provided
to the subject two family dwellings. He stated that according to ordinance

He informed the Commission that the Building Construction Appeals Board could

Mr. Johnson asked staff how the proponent could fence at
this time of year. Mr. Larsen stated that the proponent could possibly sign
a bond requiring a fence be built in the spring.
Richard Seaburg asked staff whether there was any
probability that proponent could get seperate sewer and water. Mr. Larsen
explained that it was not very feasible.
The Commission discussed the necessity of liability for
the proponent, so that he would-be protected legally.
Gordon Johnson moved approval of the lot division with
the two conditiors recommended by staff, stated above, and a condition that a
performance bond or another form of assurance is provided stating that construction
of the swimming pool will begin in the spring. David Runyan seconded the motion.
All voted aye; the. motion carried.

SUBJECT: Alarm Response User Fee
The attached memorandum is the culmination of the Police Department attempts
to abate a continuing false alarm problem.
Historically, police response to security alarms constitutes approximately.,
10% of all police calls for service. Of this 10% of calls, less than 1% are the
result of criminal.activity. In 1977, 1583 security alarms were answered by the
Police Department of which eight (8) were the result of criminal activity. In
1978 the numbers were 1364 and 12, respectively.
The reduction of total alarm calls in 1978 was due to a program that effectively
reduced alarm calls by approximately 14 %. False alarms were monitored and through
an educational process corrections were made.
At the same time, however, new alarm installations have.been made within the
City with an estimated 2000 users at the present time. The 1978 reduction is not
-and cannot hold with increased numbers of users. Additionally the 14% reduction is
not a satisfactory reduction in the overall management of false alarms.
The primary problem regarding false alarms is business and commercial
installations. They average an estimated rate of 4.1 falses per year. Residential
users average one false alarm per year.
The police response to security alarms is a priority -type call. An alarm
denotes a crime in progress and a minimum of two police units are dispatched.
Approximately 15 -20 minutes are committed to each alarm at an estimated cost-cif
$50.00 per response.
This committment of time and resources deters from the overall service
.strength of the department. To effectively utilize resources we should continue
to discourage those calls that can be easily.avoided. A properly designed, installed,
maintained, and operated alarm system should not produce false alarms. By the
adoption of the attached policy, we hope to further discourage false alarms by
requesting monetary reimbursement if problems are not corrected. Simply stated,
the City of Edina will charge for the service of answering a security alarm that
is not the result of criminal activity.

SUBJECT: Alarm Response User Fee
In 1978 the Edina Police Department instituted an Alarm Response Program_. The
ultimate objective of which has been to assist alarm subscribers in reducing false
alarms. In most cases police officers responding to an alarm left alarm response
reports which attempt to bring the false alarm condition to the subscriber's attention
and to identify the cause. In some chronic cases, a representative of the Police
Department follows up the initial contact to offer assistance and advice in correcting
the problem.
In spite of our efforts, response to false alarms continues to be a serious drain on
police resources: At the present time, approximately 10% of all police calls in Edina
are response to false alarms. These are urgent priority .calls which require the response
of at least two patrol cars. The Police Department will continue to respond to all
alarm calls on a priority basis, because a small fraction of these alarms do signal
criminal activity. To selectively screen out and not respond to certain locations based
on their prior:history of false alarms is- neither practical nor prudent. The present
situation, however, is not an equitable distribution of police services.
Effective January 1, 1980, the City of Edina will charge a user fee:-of - $50.00 per
response to alarms that are of unknown cause or not the result of criminal activity.
The Police will continue to respond to all alarms within the City regardless of the cause.
During the initial phase of this program, the City will waive the $50.00 fee for the
first two false alarms at your location. In this interim period, we-urge you to work
with your alarm company to correct any mechanical or procedural problems with your system.
An alarm system which is properly designed, properly installed, properly maintained,
and properly operated will not have false alarms. An alarm system should not false
during a power outage. The Edina Police Department will not mediate disputes, between
alarm subscribers and alarm companies.
The objective of Edina's Alarm Response Program and the above stated policies is to
provide the best possible service to all citizens of Edina. Vie urge your cooperation and

In the attached comparison of the present tree removal system
to the purchasing of an Hydraulic Log Loader, .I think you will
notice that the efficiency, high productivity and savings in
man -power will mean a tremendous savings in the tree maintenance
budget.
During the past two summers we have noticed a large number of
people doing their own tree removal and placing the brush on the
boulevard. With our present policy, if the home owner removes
the tree himself he sacrifices the subsidy and we pick up the
brush on the boulevard. In return for this, we receive the
total subsidy from the state. As mentioned above, this practice
has increased treilendcusl✓ Over the past +::^ years due to the
high cost of having a tree removed by a private contractor.
Although the city does gain the entire subsidy from the state
in this policy, it generates an enormous amount of pick up
work for .the men and there have been times over. the past two
years when we have been as far as four week behind in pick ups.
This is due in part to the increased work load and in part to
the present system we have of using smaller trucks and a loader
for pick up.
The cost and time spent on the above mentioned system caused us
to investigate_ the rental of an Hydaulic Loader and truck last
summer. Within one month's time we had caught up with the back-
log of pick ups in addition to continuing removal of our own
boulevard trees. In the summer of 1979 we rented the _ vehi.cle -:knowing
a similar situation existed. Although we had a much more
efficient operation in the summer of 1979 we were behind
in the beginning of the season because the Hydraulic Loader and
truck were notscheduled for rental early enough.'
Examination of the attached. comparison leaves no question in my
mind that the cost of the Hydraulic Loader and truck would be made
up in a matter of three or four years.
At the present time the outlook for tree removal and the Dutch
Elm problem has improved but we will be in a continuous tree removal
program on a smaller scale for at least another 5 to 10 years.

The truck loader will cost approximately $35,000. As you can observe from the
figures, by purchasing the vehicle, we would be saving approximately $16,800
over rental (which is what we do now); or $56,864 over the system where we do
not rent a loader. Another saving not tallied includes using the truck for hauling
the material. If we use the truck for hauling it would take the place of four
or five of the size trucks we are now using for this purpose. This would result
in a savings of man -power and gas for other City maintenance operations.

Edina HiSF held its regular meeting on November 6, at which time the following
officers were elected, to start serving in January, 1980: President, Irene Russell;
Vice President, At.halia Skaug; Secretary, Alice Regan; and Treasurer, Mary Burke.
Our December business meeting has been cancelled. However, we will have a
Christmas pot luck supper on December 12, 1979, on the 2nd floor of Yorktown
Continental Apts. A member of our Telephone Committee will call you about the
details of the supper and your reservation. If you have not been contacted by
December 3rd please call Irene at 835 -3962. Perhaps your Federation membership
is not recorded with us.
Following the supper we will go downstairs to the Edina Senior Center Community
Room where there will be some interesting entertainment by the Honey Bells from
Honeywell.
All Edina Seniors are welcome to join us in the Community Room for the entertain-
ment. Admission is 50¢. Members of the Federation will already have paid for
the entertainment at the time they make reservation for the supper. Only non-
members of the Federation will be charged 500 at the door.
Beginning with 1980 our Edina MSF meetings will be held on the 1st Tuesday of
each month and the new time will be 1:30 p.m. However, the January meeting
will be January 15, 1980 at 1:30 p.m. It is necessary to have the January
meeting later in the month because of New Year's Day and other conflicts, but
after January the meeting will be held on the lst Tuesday of each month at
1:30 p.m.

WHEREAS, the following described property is at present a single tract of
land:
Lot 7, Block 7, Braemar.Hills 9th Addition; and
WHEREAS, the .owners have .requested the subdivision of said tract into
separate parcels (herein called "Parcels ") described as follows:
That part of Lot 7, Block 7, Braemar Hills 9th Addition which lies North-
erly of a line drawn from a point on the East line of said Lot 7, distant
57.84 feet South of the Northeast corner of said Lot 7 to a point on the
Northwesterly line of said Lot 7, distant 61.85 feet Southerly as
measured along the curve of said Northwesterly line, from the Northwest
corner of said Lot 7; and
That part of Lot 7, Block 7, Braemar Hills 9th Addition, except that part
which lies Northerly of a line drawn from a point on the East line of
said Lot 7, distant 57.84 feet South of the Northeast corner of said
Lot 7 to a point on the Northwesterly line of said Lot 7, distant 61.85
feet Southerly as measured along the curve of said Northwesterly line
from the Northwest corner of said Lot 7; and
WHEREAS, the requested subdivision is authorized under Ordinance No. 801
and it has been determined that compliance with the Subdivision and Zoning
Regulations of the City of Edina will create an unnecessary hardship and
said Parcels as separate tracts of land do not interfere with the purpose
of the Subdivision and Zoning Regulations as contained in the City of Edina
Ordinance Nos. 811 and 801;
NOW, THEREFORE, BE IT RESOLVED by the Edina City Council that the conveyance
and ownership of the second above described Parcels as separate tracts of
land is hereby approved and the requirements and provisions of Ordinance Nos.
801 and 811 are hereby waived to allow said division and conveyance thereof
as separate tracts of land, but only to the extent permitted under Ordinance
No. 801 and Ordinance No. 811 and subject to the limitations set out in Ordi-
nance No. 811, and said Ordinances are not waived for any other purpose or
as to any other provisions thereof, and further subject, however, to the
provision that no further subdivision be made of said Parcels unless made
in compliance with the pertinent ordinances of the City of Edina or with the
prior approval of this Council as may be provided for by those ordinances."

Lot 1, Block 2, Replat of Part of Grandview Plateau, except the South
54.0 feet thereof; and
WHEREAS, the requested subdivision is authorized under Ordinance No. 801 and
it has been determined that compliance with the Subdivision and Zoning Regula-
tions of the City of Edina will create an unnecessary hardship and said Parcels
as separate tracts of land do not interfere with the purpose of the Subdivision
and Zoning Regulations as contained in the City of Edina Ordinance Nos. 811 and

waiver from the requirement obtained from the Building Construction
Appeals Board;
2. The swimming pool must be entirely fenced and assigned to one of the
units or licensed and upgraded to multi - family standards;
3. That a performance bond or other form of assurance be provided stating
that construction of the swimming pool fence will begin in the spring
of 1980.
