RESOLUTION
BE IT RESOLVED that that certain plat entitled The Timbers, platted,by
Folke R. Victorsen and Veown M. Victorsen, husband and wife, by the Folke
R. Victorsen Company, by the Minnesota South District of the Lutheran
Church - Missouri Synod and by Cross View Lutheran Church, and presented
at the Edina City Council Meeting of February 26, 1979, be and is hereby
granted final plat approval, subject to the following conditions:
1. That $40,000 be paid in lieu of subdivision dedication;
2. That Cross View Lutheran Church be added as a signer on the plat;
3. That Folke R. Victorsen Company become the record fee owner of all of
the property to be included within the Declaration of Protective Coven-
ants to be imposed on the land within the plat by the Folke R. Victor-
sen Company; this means that the Folke R. Victorsen Company will have
to close its purchase agreement with Cross View Lutheran Church and
the Missouri Synod for acquisition of a part of the property to be
included within the Declaration;
4. That no work be done on the property until all conditions have been
met.

SUBJECT: Tax Revenue Impact of the Construction of Low - Moderate Income
Housing Versus Market Rate Housing and Other Development.In
The Southeast Edina Redevelopment Area
At the special meeting of December 7, 1977, the City Council
requested a staff investigation of the impact of the construction of low- moderate
income housing upon the tax base of the City of Edina. Specifically, the City
Council was interested in receiving a comparison of the tax revenues generated
by subsidized housing and the amount of tax revenue generated by market rate
development.
Staff initiated the tax revenue comparison by studying the
Southeast Edina Redevelopment Area and used the tax revenues expected to be
generated by the subsidized housing in this redevelopment area pursuant.to the
financial section of the Southeast Edina Redevelopment Plan., These tax revenue
figures will be compared to hypothetical market rate development. Tax revenue
figures for the hypothetical market rate development are.based upon previous
developments that.have occurred in the City of Edina. Before considering comparable
market rate developments in any detail, a description of the Southeast Edina.
Redevelopment area is warranted.
The Southeast Edina Redevelopment Area is composed of approximately
130.24 acres, 75.92 which are vacant. Approximately 38.91 acres of the vacant
75.92 acres will be devoted to residential redevelopment with 15.0 acres to be
developed as parkland and the remaining 22.01 acres to be used for transitional
light industrial development. The 15.0 acres of parkland will be tax exempt and
will have no effect upon the tax revenues generated in the Southeast. Edina.
Redevelopment Area. The 22.01 acres. to be used for transitional light industrial
development will accommodate a light manufacturing function within the area's
ambient noise level or an office or warehouse land use. Any development
occupying the 22.01 acres of land zoned Planned Industrial District (PID) is
likely to be a market rate development, and will be assessed at full market

value (43% of the value of the land and building), the tax revenues derived from
the 22.01 acres zoned PID within the Southeast Edina Redevelopment will be
the same as if the acreage were located outside the redevelopment area.
With the net effect of tax revenues generated by the parkland
. and PID acreage in the Southeast Edina Redevelopment Area being the same as
if this acreage were not located in the redevelopment area, the 38.91 acres
proposed for low- moderate residential development would be the only land use
likely to have an effect upon the total tax revenues received by the City
of Edina.
The tax revenues that can be expected to be generated by the
38.91 acres of land to be devoted to low - moderate income housing are expected
to approximate $190,000. This figure is based upon the Southeast Edina
Redevelopment Finance Plan and average cost per unit figures obtained from
the Minnesota Housing and Finance Agency. The tax revenues will be generated
by a 90 unit family townhouse project, a.70 unit family townhouse project, a
100 unit elderly low -rise apartment project, and a.100 unit family townhouse
project. Table one below outlines the projects and their concommitant estimated
tax revenues.

The market rate development alternatives to subsidized housing in
the Southeast Edina Area are (1) apartment development; .(2) townhouse development;
(3) residential and non - residential development combined. These land uses are
based.on limitations imposed by "the South Edina Land Use Plan relative to trip
generation. Map one on the following page provides a magnified view of the
exception area currently used by Hedberg Sand and Gravel as part of the South
Edina Plan. The area east of the commuter trail is included within the
Southeast Edina Redevelopment Plan and the City of Edina should attempt to
honor the trip generation maximums listed for the area. The trip generation

limitations for this area east of the commuter trail allow residential land
uses and limited non - residential land uses such as office buildings.
The ensuing analysis of market rate residential development for
the Southeast Edina Redevelopment Area is based upon similar market rate
residential development in proximity to this area. The Assessing Department
was consulted to determine an average, per unit value for both apartment
buildings and townhouses in Edina. The average apartment unit was found to have
a value of $23,339. Townhouses were valued at $77,530 per unit. No comparison of
condominium market rate development was considered since- there are an insufficient
number of condominium units that have been divided for tax purposes to warrant
such a comparison.
APARTMENT DEVELOPMENT
A hypothetical market rate apartment development could be expected to
generate tax revenues totaling $460,159 for apartments of less than four stories,
type I construction. This figure is based upon building and land costs totaling.
$15,332,095. The hypothetical market rate apartment development includes 605 units
situated on the four sites scheduled to accommodate the proposed 360 units of
subsidized elderly apartment and family townhouse units. The apartment development
does not exceed the trip generation limitations and density requirements established
in the South Edina Land Use Plan. It was assumed each apartment unit would generate
seven trip ends per day. "This figure represents a typical traffic generation level
for this land use. 111 The low- moderate income housing slated for the Southeast Edina
Redevelopment Area can be expected to generate approximately $190,000.00 in tax
revenues. This figure is based on the tax revenue figures contained in the finance
..plan of the Southeast Edina Redevelopment Plan and "The per unit construction costs
of subsidized low- moderate housing in the metropolitan area. "? A tax revenue
comparison of apartment and subsidized housing development yields a difference
of $270,159.
The difference in revenues for fire proof apartments of five or more
stories is $236,765. This figure is based on 3 five story apartment developments
totaling 705 units and generating.$426,765 in tax revenues.

MARKET RATE TOWNHOUSES
The subsidized, low- moderate income housing proposal in the
SoutheasL Edina Redevelopment Plan can also be compared to a hypothetical
market rate townhouse development. The anticipated tax revenues totaling
$190,000 associated with the redevelopment plan compare with tax revenues
associated with the townhouse development equal to $636,456. The difference
in tax revenues is $446,980.
As was the case with the hypothetical market rate apartment
development, this proposal of 305 townhouse units totaling $23,646,650.00 in
building and land costs, conforms'to the density and trip generation limitations
of the South Edina Land Use Plan. Again, "The Traffic Generation Level (eight
trip ends per day) is Based on Typical Traffic Generation. Levels Associated With
This Land Use ".3
COMBINATION RESIDENTIAL -NON- RESIDENTIAL
The third and final hypothetical market rate proposal to be
considered in the Southeast Edina Redevelopment Plan Area is a.combination of
townhouses east of York Avenue and apartments and offices west of York Avenue.
The South.Edina -Land Use Plan specifies that no retailing facilities be located
in the South Edina Land.Use Plan Area,.so staff has assumed a development
containing small professional offices in separate structures or on the ground
floor of the apartment buildings located west of York Avenue.
The townhouse tax revenues for 160 units would approximate
$339,399 The area west of York could be expected to accommodate 350 apartment
units and 10,000 - 12,000 square feet of office space. This land use would
generate another $258,210 in tax revenues.. The .total tax revenues of $597,909
for the combined residential- non- residential.land:use is greater than the
subsidized housing tax revenue figure by $40.7,909. As was the case with the
other hypothetical.market rate developments, this proposal conforms to the.
density and trip generation limitations contained in the South Edina Land Use
Plan.
CONCLUSION
For the purpose of comparison, table one, below, lists the
expected tax revenues associated with the Southeast Edina Redevelopment Plan

and the three hypothetical market rate development proposals: (1) Residential
Apartment; (2) Residential Townhouse; and (3) Residential- Non - Residential
Combined.

The Southeast Edina Redevelopment Plan can be expected to generate tax
revenues from $236,765 to $446,980 less than typical market rate developments for
this area. The less intense use of the public facilities and improvements..(.parks,.. -
streets, sewers, etc.) as a result of the lower density may extend the lifetime
of these improvements, lower the number of repairs required and thereby reduce
municipal improvement costs.. However, even with this reduction.in municipal
improvement costs having a net effect of reducing the difference in potential tax
revenues, the magnitude of the tax revenue disparity should be assumed to
.approximate the figures listed in table one.
One other factor to consider when interpreting this data concerns the
density reduction formula for South Edina and West Edina. The Southeast Edina
Redevelopment Area, if developed at market rate, would be subject to the density
reduction features. The market rate proposals listed also were assumed to_have been
developed near the maximum allowable densities under the South Edina Land Use Plan.
The density reduction formula could.be expected to reduce the tax revenues received
by the City of Edina; the Richfield School District, Hennepin County and the other
political entities that may legally levy a tax on this property by as much a, s
fifty per cent of the revenues listed in table one.

Several months ago, the Planning Commission and City Council granted a
final zoning approval to PRD-1 to facilitate the construction of the
Colonial Church on Olinger Boulevard. This Church is now under
construction.
Colonial Church is now requesting an amendment to their final development
plans to allow the construction of a berm on the southeasterly portion of
the site. This berm would serve the dual purpose'of providing screening from
the Crosstown Highway as well as'a disposal site for excess fill located
on the property.
Recommendation:
The Planning and Engineering Departments have reviewed the plan amendment and
find no problems associated with the requested berm. The existing wooded
area located west of the Fire Station would be preserved and adequate
drainage swales provided.
Staff thus recommends approval of the plan amendment with the following
conditions:
1) Adequate temporary erosion control-measures must
be implemented including the construction of a
hay bale dike to prevent sediments from entering
the pond on the site.
2) The berm must be adequately vegetated with ground
cover in the same manner as the berm located on the
north end of the site.

Mr. Gordon Johnson stated that thi plan is part of the Amundson Avenue
problem and where do we stand on that?
Mr. Hughes reported that on J ry 4, 1978, the Lanvesco proposal had
been considered and the Planning Co fission referred it to the Council, which
set a hearing date of March 6 ;edson.will nsider the Lanvesco proposal and Amundson
Avenue. We would expect that play a big part in this development.
Mr. Cooperman, arch i ct for the project, stated that the plan would not be
changed much if the road re to go in or not.
In response to question from Mr. Runyan, Mr. Findell stated that he hoped
to begin construct the apartment building in the Spring.
Mr. Hughe also reported that there is a density reduction involved with
this project. reliminary rezoning was approved several months ago after the
density reduc ion plan was adopted by the Council. According to the density reduction
plan, 56 un' s were allowable on this site, However, 78 units were requested and
78 were ap roved by the Commission and Council.

Mr. Larry Laukka, representing the Church, noted that.the berm is to be
used for permanent storage of soil and excess material from the site.. The
Church needs to move 30,000 yards of dirt off the site, and a berm seems to be
the answer. The grades at the berm will be 5 to 1 and the majority of the trees
will remain.
After some additional discussion, Mr. Fernelius moved that the Commission
recommend approval of the plan amendment subject to the staff recommendations.
Mrs. McDonald seconded the motion. All Voted Aye.

On January 4, 1978, the Planning Commission reviewed the subject two lot
subdivision. At that time,. the Commission continued the subdivision to
the February 1, 1978, meeting to allow Hennepin.County sufficient opportunity
to review the plat in that it abuts a County Road (i.e. Gleason Road).
Staff has met with staff members of Hennepin County regarding the plat. The
County has indicated that if the plat were approved, they would grant permits
for .driveway curb cuts for both lots. The County recommends that 1) such
curb cuts should be located at the northerly extreme of Lot 1 and at the
southerly extreme of Lot 2, 2) driveways should intersect Gleason Road at
an angle of not less,than 60 degrees and 3).such driveways must include a
"turn around" to prevent cars £r61k'-backing`.onto'_`.G` eason Road.
The County and staff are very concerned about potential traffic hazards
resulting from the construction of dwellings on the proposed lots due to the
configuration of and allowable speeds on Gleason Road. Based upon the
allowable speed limit, a desirable sight distance for oncoming traffic for
Lot 1 is 440 feet and for Lot 2, 530 feet. Due to the configuration of
Gleason Road, however, sight distances of about 260 feet for Lot 1 and
320 feet for Lot 2 are possible which is significantly below the accepted
standard.. The very steep topography of the lots (i.e. about 25 %) compounds
this problem.
In regard to topography, staff is very concerned about the grading and
resultant loss of vegetation necessary for the construction of..dwellings
on the proposed lots. In addition, the Commission may recall that about two

Recommendation:
Following additional review and meetings with Hennepin County, staff is very
concerned -.with the potential traffic hazards created by the lots. Staff is
also very concerned with the grading and potential hazards associated with the
development of these lots. In summary, the proposed lots are characterized by
extremely severe limitations to..development.
From another standpoint, however, the Commission should be reminded that a
preliminary plat was approved in 1968 which showed the subject site divided
into three lots. Thus, the proponent was given.some assurances that such a division

The proponent is requesting a two -lot subdivision of Outlot B of Kil-
larney Shores. Each of the two newly created lots would measure over
19,000 square feet and would gain. access to Gleason Road.
Killarney Shores was platted in 1968. The preliminary plat
which ,.as submitted at that time showed three single family lots
located on the subject property.
However,, .t�nese three lots were
deleted and desijnated as "Outlot i" at the time of final plat ap-
proval. Staff has been unable to ascertain the reason, if any, for the
designation of this area as an outlot at the time of final approval
:in 1968.
Due to the very steep grades of the subject property together with
the configuration and traffic volumes of Gleason Road (which is a
county road), staff is concerned with potential traffic hazards associ-
ated with dwellings in this location.
Recommendation:
In that Hennepin County controls all curb cuts and access
from Gleason Road, staff recc:imc. -ndz that the proposed subdivision be
continued for one month to allow the County to review the plans and
determine if the driveway curb cuts -.to serve these lots will be al =owed.

Mr. Hughes reported that this proposal was held over from the January 4
meeting. At that time, the Commission continued the subdivision to the February .1
meeting to allow Hennepin County sufficient opportunity to review the plat as
it abuts a county road, Gleason Road.
The proponent is requesting a two lot subdivision of Outlot B, Killarney
Shores. Each.of the two newly created lots would measure over 19,000 square feet
and would gain access to Gleason Road.
City Staff has met with the County and the County has indicated that if the
plat is approved, they would grant permits for driveway curb cuts for both lots.
The County recommends that (1) such curb cuts should be located at the northerly
extreme of Lot 1 and the southerly extreme of Lot 2; (2) driveways should intersect
Gleason Road at an angle of not less 'than 60 degrees; and (3) such driveways
must include a turn around to prevent.cars from backing onto Gleason Road.
The County and City are concerned about potential traffic hazards resulting
from the construction of dwellings on the proposed lots due to the configuration of
and allowable speeds on Gleason Road. Based upon the allowable speed limit, a,
desirable sight distance for oncoming traffic for Lot. 1 is 440 feet and for Lot 2,
530 feet. Due to the configuration_ of Gleason Road, sight distances of about 260
feet for Lot 1 and 320 feet for Lot 2 are possible, which is.below the accepted
standard. The steep topography of the lots compounds the problem.
Staff is concerned with the grading and potential hazards associated with
the development of these lots. The proposed lots are characterized by extremely
severe limitations to development. However, the Commission is reminded that a

Mr. Hughes reported that the epeed limit on Gleason Road at this point is
40 MPH and it has been advised that the speed limit be reduced to 30 MPH at this

Mr. Thernell, the developer of the two lots stated that he proposes two
2 story houses and is agreeable with the driveway restrictions. He also noted
that the front setback would probably be 50 to 60 feet.
After additional discussion regarding the curb cuts,, traffic speeds and
visual problems, Mr. Runyan moved that the Commission recommend approval of the
subdivision with the six conditions as stated in the staff report. It is important
that the driveway cuts be monitored to see that they get as close to the back of
the property as possible. Mr. Gordon Johnson seconded the motion. All Voted
Aye. Motion Carried.

SUBJECT: Tax Increment Report, 50th and France Redevelopment Project
The Planning Department Staff has investigated and updated the
generation of tax increments.in the 50th and France Redevelopment Project. The
previous tax increment schedules submitted to the H.R.A..and.the City Council
have assumed the Red Barn will be demolished and.a zero lot line, 25,000 to
30,000 square foot office /retail structure will be erected by 1981.. The tax
revenues generated by the land and structure in 1981 would approximate.
$35,366.00. The City would receive the total tax. revenues from such a structure
and this has been entered into the previous tax increment analysis. However,
the Red Barn Restaurant will not be demolished and will remain as part of the
50th and France Redevelopment area. The Red Barn generates approximately
$5,831.00 in annual tax revenues and an annual tax increment of approximately
$291. The difference in annual tax revenues should be equal to $35,175 and
this will have�a slight impact on the tax increments generated for the.-retirement
of bonds sold in 1975.
Although a loss of annual tax revenues of $35,366 appreciating at
four percent.(4 %) per year would appear to have a devestating effect upon- the.
generation of annual tax increments necessary to repay principal and interest,
this loss of potential revenue should be mitigated by the appreciation of the
existing property in the 50th and France area at a rate greater than four percent
and by the tax increments generated by new construction in the plan area. A
simple linear regression of property values against time.or year for. 1972-through
1977, . indicated an increased rate of property appreciation from the 4% rate used
in the plan to an updated rate of 4.34 %. This new rate was applied as an
inflation rate for new construction only and the old or existing property was
appreciated at the more conservative rate of four percent. A change in.the
mill rate from .086091 to .089448 will also result in the generation of greater
annual tax increments.

The 49ers -,the union that.represents.our public works employees has
requested that the M.A.M.A. Joint Bargaining Committee re =open the
1978 contract. The proposed agreement provides for modifications -to
the 1978 contract and terms for a 1979 settlement.
Attached is a memorandum from Jim Andre explaining the changes and
the Memoranum of Understanding between the 49ers and each local city.
I have met with Jerry Dalen and discussed the financial implications.
It.will cost the City a total of about $10,000.00 for this year.
However, he feels there is that money in contingencies and that the
agreement seems reasonable and fair.
I also recommend adopting the Memorandum of Understanding. Union
membership in Edina has accepted the agreement for 1978 and 1979.

In December, 1977 the General Labor Relations Committee received a letter
from the Local 49 Union officials on the possibility of re- opening the 1978
M.A.M.A. public works settlement.
Discussions with Local 49 determined that if there was to be a re- opening
of the 1977 -1978 contract, it would have to be coupled with an acceptable
settlement for 1979.
Subsequent meetings with the Local 49 Union and with Joint 49 Cities
resulted in a Memorandum of Agreement.
Insurance
The present two year (1977 -1978) contract had established for the first
time a maximum monthly dollar contribution. This was set at $60 per month
for the period of the contract following the 1977 strike. This amoint
applies to the employee, dependent medical- hospital and life insurance
premiums. Previous to this contract the employer paid the entire employee
medical - hospital premium plus $15 (in 1976) of the dependent medical -
hospital premiums, and the life insurance premium on the employee. The
establishment of a maximum dollar contribution provided the Joint 49
Cities effective control over employee insurance costs.
The proposal is to increase the monthly contribution to $65 in 1978 and
$72 in 1979. The average monthly insurance contribution for metro cities
in 1978 for employee groups other than Local 49 will be $68 - $70 per month.
Wages
The 1977 -1978 contract provides for an average position (Heavy and Light
Equipment Operators) rate increase of 6.2% for 1977 and 5.9% for 1978;
or an average wage increase of 6.05% for the two year (1977 -1978) period.

The recommended proposal is to modify the 1978 settlement and add one
additional year to the present contract.. The average position rate
increase would be 6.2% for 1977, 6.8% for 1978 and 6.2% for 1979; or
an average increase of 6.4% for the three year (1977- 78 -79) period.
The principal advantage of accepting this.proposal is:that it gives the
Joint 49 Cities one additional year on the contract at a reasonable cost to
the cities. The insurance and wage adjustments would cost a maximum of $200
per man per year for 1978. It provides an average position rate increase of
6.2% for 1979.
Wage adjustments for non -union employees in the Joint 49 Cities will average
6.6% - 6.8% for 1978. The Minneapolis -St. , Paul CPI for the 12 month period
ending October 1977 is 7.8 %.
-The acceptance of this proposal involves, only wages and insurance. All other
terms and conditions of the master contract, including local issues are
deferred to the 1980 contract year negotiations.
It is believed the proposal is one of reasonable cost, reflects realistic
economic conditions and represents a.responsible position of the employer
vis -a -vis the employee.
The proposal is recommended for your favorable consideration.
A copy of a Memorandum of Agreement for presentation to your council and the
union for signature is attached.
Also attached is a list of those cities in which the public works employees
have accepted the agreement.

This Memorandum modifies the labor agreement negotiated and
in effect for calendar years 1977 and 1978 between the International
Union of Operating Engineers, Local No. 49, hereinafter called the
UNION and the City of . , hereinafter called the MPLOYER.
The UNION and the E!APLOYER modify the 1977 -1978 labor agreement
and extend the labor agreement through calendar 1979 according to the
following:

a) For calendar year 1977 - no change.
b) For calendar year 1978, effective January 1, 1978
Heavy Equipment Operator changed from $7.43
per hour to $7.50 per hour;
Light Equipment Operator changed from $6.99

2. Group Health and Life Insurance:

As you may be aware, over.the.past few years the Hennepin County .
Municipal Court has been discussing with city managers, chiefs of
police, prosecutors and other interested parties the.possibility
of redesigning the four suburban court divisions that presently.
exist and relocating various court offices. The desire of the
court stems'from changing suburban conditions pertaining to case-
load, population and the like over the past thirteen years since
the court was created.
Space has been. one of the most critical problems faced by the
court in the operation of its four suburban divisions. Rising
caseloads have necessitated increasing the number of judges, court
staff and probation officers, while the amount of office space and
courtroom space has remained - relatively constant. We anticipate
that the situation is likely to get progressively worse in the
future as workloads rise.
Various stop -gap measures have been instituted with the cooperation
of many of "the municipalities including the remodeling of space in
city halls where possible and the voluntary shift of workloads by
communities in- one division to another court division where court
calendars may be more current (i.e., Edina matters are handled at.
the Bloomington Court office rather than the St. Louis Park Court,
office as in the past). These changes have lessened some of the
critical space problems but in a temporary fashion only.
Last year Municipal Court officials met with a large number of sub-
urban managers and prosecutors formally and expressed many of the
concerns mentioned here. A Suburban Court Development Plan, with
a number of options, was presented to those who attended the meeting.
Since that time the Hennepin County.Prosecutors Association has
endorsed one of the options presented 'in the development plan which
would relocate the suburban courts in closer proximity with the
Brookdale, Ridgedale and Southdale Shopping Centers. Additionally,
the court feels that the relocation of permanent suburban court
offices to the "dale areas" provides a flexible and economical
option. One possible location which appears. quite feasible is to
locate the court facilities at the county regional library sites
that will be developed in those trade areas.

In an effort to receive input from as many communities as possible
in Hennepin County and to advise you of any possible legislation
affecting the suburban courts, members of the Bench and the Court
Administrator's staff have arranged to meet with the Hennepin
County City Managers at 10 a.m., February 23, 1978, prior to your
regular meeting of the Metropolitan Area Managers Association.
The meeting is scheduled for Gregory's Restaurant in Bloomington.
I realize that special legislation is required to relocate these
suburban division offices and that a good deal of discussion must
take place between court and suburban officials before any plan
could be arrived at. This meeting hopefully can be one of the
steps in that direction.
If you did not receive a copy of the Suburban Court Development
Plan last year, or may have misplaced your copy, we have a limited
number of them remaining. If you have questions or desire a copy,

Housing Assistance Plans
As part of our yearly Community Development B1ock.Grant Application,
we are required to submit a Housing Assistance Plan. This plan must contain
goals for the application year, and must also estimate goals for a three year
period. These goals are expressed in the number of family units assisted. The
attached Housing Assistance Plans propose two methods of assistance to families
with low and moderate incomes.
The first method of assistance would be the construction of new
units in the City. These goals are contained in Section A of both the current
year and three year goals. Both the one and three year goals will be satisfied
by construction in two areas. The proposed elderly project at 51st and France
accounts for 28 units in both plans. The remainder of units proposed are contained
within the Southeast Edina tax increment district. In the interest of presenting
realistic goals, no other new construction is suggested in these goals.
The second element in the Housing Assistance Plans is assistance
to low and moderate income Edina homeowners for rehabilitation and improvements
designed to increase the energy efficiency of single family homes. Goals for
rehabilitation are broken into three categories; city deferred payment loans,
Minnesota Housing Finance Agency (MHFA) Grants, and MHFA loans. Goals -for the
current year are relatively high, with the number decreasing with each successive
year. No new programs are anticipated by this plan.
This year, unlike past years, no units are suggested in the "Existing
Rental Unit" section. Although we retain an allotment of units in this area,
no units are included in this plan because of the past lack of success in this
area.

TABLE III NARRATIVE
As part of the.application for Community Development funds, the City of
Edina proposes a three year goal of 556 assisted units. The first year of the
three.year plan would assist 218 units. Both the one and three year plans
project nearly an even split between new construction.and rehabilitation of
single family homes:
Of -the 218 units projected in the current.year plan, 98 are new rental
construction. This involves two different projects. Seventy new family units
are projected in S.outheast.Edina, and 28.new elderly units are projected in
the 50th and France area. The family housing will be of the townhouse design
and will be developed at low densities. The elderly project will be a small
apartment project in an area well suited to the needs of the elderly.
The remainder of the current year goal (120 units) will be.met by Edina's
on -going housing rehabilitation programs. State Housing Finance agency loans
and grants as well as community development funds are utilized in this program.
The primary aims of this effort are to improve and preserve our exising housing
stock and to improve the energy efficiency of homes.
Goals for "existing" Section 8 units are not included in either the one or
three year goals. According to the Metropolitan Council's allocation of
Section 8 units, Edina continued to receive 47 units of Section 8 "existing" per
year. However, considering the low rent limits and the lack of any units under
contract at this time, no units are included in this application. The goals
for Section 8 "existing" have been deleted in an effort to present a realistic
program.
Presently, the final arrangements are being made for the construction of 90
family units in the Southeast Edina tax increment.district. This project will
be financed by the Minnesota Housing Finance Agency with individual unit rents

placed on the larger bedroom sizes. The project will also contain four
handicapped units.
New rental units suggested in Edina's three year HAP are, with the
exception of the 51st and France project, contained within the Southeast Edina
tax increment district. One hundred units will be developed at low densities
for low to moderate income families. An additional one hundred units will be
moderate density elderly housing. Completion of these projects will complete
construction in the tax increment district.

RE: Notice of intent to convey to the City of Edina for public
purposes attached property in Tupa Park from Minn. Department
of Transportation.
The necessary statutory procedure for the conveyance of real property
in statutory cities is contained in Minn. Stat. 412.201 which reads
as follows:
"EXECUTION OF INSTRUMENTS. Every contract, conveyance,
license or other written instrument shall be executed
on behalf of the city by the mayor and clerk, with the
corporate seal affixed, and only pursuant to authority
from the council."
This authority requires that whenever a document requires City
authorization, it must be signed by the City Clerk and Mayor after
it has been authorized by the Council. For that reason, even the
conveyance of the small portion of land from the State to the City
for the Frank Tupa Historical Park must pass through the Council and
be a matter of record through the Council minutes.
As you will note from the attached legal description, the description
is a metes and bounds description. The planning department bas - requested
that an estimate be given for the cost of surveying Tupa Park, City Hall
property. The cost seemed high for the value received. It is questionable
because of the location of these two properties whether there would be
a dispute with other property owners.

Enclosed are the proposed fees and charges for Braemar Arena,.
Braemar. Golf Course, Gun Range, Swimming Pool and recreational
activities.
The Park Board recommended approval of these at.their February 14th
meeting.
PROPOSED FEES AND CHARGES
FOR BRAEMAR GOLF COURSE
FOR 1973
The 1977 Golfing season was a financial success and we were blessed
with a very good early spring placing us some $30,000.00 ahead by
the end of May. However, please realize that our green fees did rise
by $1.00 per round over 1976. Moisture was spaced well and most usually
fell in the night hours which was pure heaven for our maintenance people.
The number of rounds for 1977 were down slightly over .1976. (1976 - 51 -,000

Requests on which the Committee recommends approval as requested or modified, and
the Council's authorization of recommended action.
1. Survey and sign Valley View Road to insure public safety vehicle passage and
access to Clover Ridge from Valley View Road with NO PARKING restrictions.
Mr. Clare Mattson, 5004 Clover Ridge, requests consideration on alleviating
the congestion on Valley View Road and Clover Ridge due to overflow parking
from the Normandale Lutheran Church. He is concerned that public safety
vehicles would not be able to answer emergency calls due to parking con-
gestion on the streets. (See attached notes from Officer Kane and Chief Feck
in response to Mr. Mattson's concern.)
ACTION TAKEN:
Lt. Kleven presented the situation to the Committee and suggested possible
solutions to the congestion problem. Mr. Hoffman commented that the congestion
problem be separated into two areas -- on- street and off - street parking
problems. He suggested that Fire Department officials contact Normandale
Lutheran Church officials on parking congestion in lots and driveways. Chief
Swanson commented that possibly the church could make announcements to the
people attending church and classes to use the lot for parking, as it is not
being fully utilized. Mr. Hughes commented that the parking restrictions
on- street should be initiated immediately if the public safety access is
questionable on Clover Ridge.
Chief Swanson moved that the Committee recommend a survey and signing of Valley
View Road and Clover Ridge access from Valley View Road with NO PARKING restric-
tions to.insure public safety passage and access. Mrs. Coon seconded the
motion. Motion carried 4 -1. Chief Swanson also moved that the residents on
Clover Ridge be surveyed about other parking restrictions for public safety
access and the Fire Department with church officials analyze the public safety
problems in the lots. Mrs. Coon seconded the motion. Motion carried.

Chief Swanson moved that the Committee recommend. denial of the request for
lack of warrants and a letter be sent to Richfield indicating same.
Mrs. Coon seconded the motion. Motion carried.
SECTION C
Requests which are deferred to a later date or referred to others.
1. Request for 4 -way STOP at West 69th Street and Xerxes Avenue.
ACTION TAKEN:
This has been held over pending action by Richfield on the request.
Chief Swanson moved that the matter be deferred again and a letter be sent
to Richfield indicating support for a westbound STOP at Xerxes. Mr. Hughes
seconded the motion. Motion carried.

on a total cost bid.
We do not feel that significant deviations have occurred on the
Minnesota Tractor Company bid. Your representative, Mr. Hanauska,

A demonstration comparison of the Fiat - Allis 545 -B (Minnesota,

During the past two months, several Metropolitan suburbs in conjunction with the
League of Minnesota Cities have been exploring the possibility of creating a Joint
Powers Risk Management Self Insurance Pool to serve as an alternative to an expen-
sive, very limited to non - existant insurance market, particularly in the area of
Worker's Compensation and General Liability. Such a pool could collectively purchase
and /or self insure the risks it decides to undertake. This is a relatively new _
area for municipal cooperation with only one such pool currently functioning in
the United States (Dade County, Florida). At the present time, the statutory
authority for self insurance by municipalities is unclear in Minnesota.
Given the -fact that the concept is relatively new, and the unclear statutory stance
of such an arrangement, the group exploring this area has been taking a two pronged
approach. The first has been to clarify the authority through a bill sponsored by
the League which would grant general_ authority for all municipalities to self insure.
The second approach has been to develop different arrangements for a pool which
could then be examined in depth by a consultant once legislative authority has been
granted. (Funding of the consultant would be shared by those who agree at that
point to participate in the study.)
At present the general bill has been introduced into both houses of the Legislature
but because of its broad scope and recentness of the issue, it is doubtful that
the general legislation will pass this session. As an alternative, the League
intends to introduce "special" legislation to permit establishment of one pool in
the Metropolitan area (composed.of cities currently working together). It has been
requested that cities interested show their support through a Council resolution to
the State Legislature. Attached is a sample resolution should the Council desire
to use that format.

Our trash collection became a problem in October of 1977. After
calling Edina- Morning_side Sanitation, we found that our account was
transferred to Able Sanitation. We were very upset about it since
our pavment in August (8- 16 -77) was through November with Fdina-
Morningside. No notice of this change was even sent to us or were
we allowed to choose which company to have.
We decided that since it was done it was of no major problem if the
service was comparable. However, we had to contact Able Sanitation and dem
demand that the contract be followed. After a few conservations with both com
companies, the service was finally delivered (two weeks were completely
missed and much garbage accumulated before the matter was resolved.
In November (11 -21 -77 - $9.50) we paid Able Sanitation for future
collection considering the matter resolved. However, nick -un
nroblems were off and on since days were interchanged without notice
(Wednesday or Thursday). We called and they explained that it was
due to a new driver which seemed to be a reasonable answer. After
much debate, we made a mistake by paying Able Sanitation for four more m
months of service (Jan. 20, 1978 - $19.00).
,The trash collection got worse, days kept changing, trash at the curb
was either picked up or left, our cans were either emptied or for-
gotten.
My wife spoke with LaVonne over the matter of Jan. 18, 25 on Feb. 1.
Again a new driver problem.
Finally on Monday, February 6, they came out to pick up the garbage
from the Thursday before and left a garbage can on the curb. My wife
called and left a message on their recording system to call me the
following morning, Feb. 7. I did not receive any call which is very
typical for them.

On Feb. 8, I called Able Sanitation and asked for the person respon-
sible for pick up. Got some lady and I reouested the service to
improve. The lady stated she would speak to the driver. I said
this stuff was goi.np on too long and I would write both city councils
if the poor service continued. Well, I pot a smart reply of "Okay,
if that is the way you feel, we'll drop you right now."
I stated that if that was the way it was, I wanted my $Iq.On back.
She said a check would be in the mail for the remainder of the service
and nothing more. She then hung up.
Sure enough she kept her word on collection of the trash. It was
not picked up. However, it is now Feb. 15 and no check has arrived.
I am a very patient person and it takes a long time before my
anger is aroused. But Able Sanitation has now pushed me too .far.
I demand a follow -up on the matter and a full refund. If the city
feels it is too time consuming to follow up, then their are other
Public means available.

not be accepted due to poor performance on.past contracts.
Schumann Bros., Inc. did the work on the Southdale Tower
and the Edina East Tower. The work was of poor quality
with streaks, etc. The firm was required to return
twice to rework the poor areas and was not very willing
to do so. The time and effort spent by City Staff to
obtain a satisfactory job on the last contract does not
warrant awarding this contract to Schumann Bros.
Therefore, we recommend award of the bid to Neumann Co.
Contractors, Inc., who have also work herein the past
and have done a very satisfactory job. They request that
they be allowed to do the work in the fall versus the
spring which is agreeable with-our department.

Gentlemen:
We have received your statement dated June 16, 1974, covering
subject work. Ire fail to understand your reason for submitting
this statement since none of the faulty work outlined in my
December 13, 1973, letter to you (copy enclosed) has been satis-
factorily corrected.
An inspection of the two tanks by.Mr. Woehler and myself on June
12, 1974, indicated the followings

The attempted patch painting is a failure. The east and
west sides.of the standpipe are different shades. Marks
remain or have reoccurred on the south side of the stand-
pipe. The leg patch spots are a different shade.
Southdale Tank
No change from conditions outlined in my December 13,
1973, letter.
We have been extremely dissatisfied with your lack of a plan of
work to complete this project. If you do not supply us with a
fires completion schedule for all of the retraining work on or
before July 1, 1974, we will be forced to take legal action to
enforce performance.

Gentlemen
Inspection of subject work by Mr. woehler and myself with you on
Monday, December 3, 1973, after your crew had finished the South-
dale Tarn at the close of the working day November 28 leads us to
the following conclusions concerning the work performed under sub-
ject contract:
A. Edina -East High School Tank
1. Legs have been marked by the painting scaffold.
2. Paint on exterior of riser pipe is-uneven in texture.
B. Southdale Tank
1. Lettering is black instead of specified color.
2. Lettering is sloppy.
3. Paint on exterior of riser is uneven and mottled.
It is our opinion that this project can be.crade acceptable only
by repainting, when weather permits, the legs and riser of the
Edina -East :sigh School Tank and all of the exterior of the South -
dale Tan's, including the lettering.
We have to date paid you $10,939.00 on this contract. We will
recommend at the January 21, 1974, Village Council meeting that
you be paid the contract amount less $8.100.00 ($3,500.00 for
repainting Southdale, $2,800.00 for repainting Edir_a -East and
$1,800.00 liquidated damages.) The $6,300.00 would be paid upon
satisfactory completion of the work in the Spring of 1974.
