resolution correcting the legal description on an easement in
Interlachen Hills 3rd Addition.
I am returning to you three signed copies of the Affidavit in regard

Edina to execute this Affidavit on its behalf; and
That the City of Edina is the grantee of that certain
easement deed for utility and drainage purposes recorded in the
office of the Hennepin County Register of Deeds as Document No.
3674644 containing the following legal description:.
The North 35 feet of that part of Lot 1,
Block 1, Interlachen Hills 2nd Addition
lying East of the West 144 feet thereof;
and
That there is no plat known as Interlachen Hills 2nd
Addition; and
That the parties intended said easement to cover the
same area in Interlachen Hills 3rd Addition which has a platted
easement in the same location; and
That the City of Edina did not intend to secure any
easement over any part of the plat of Interlachen Hills(without
any addition designation) by said deed document 3674644.

STAFF REPORT

Z -77 -18 Gleaseon Road extended and north of W. 78th Street.
PRD-2 to R -1 and R -2. District.
Refer to: June 27, 1973 and August 1, 1973 Planning
Commission Minutes, Hills of Braemar Town-
house graphic, preliminary plat.
Four years ago, the subject property was rezoned to PRD -2, Planned Residential
District to allow the construction of 132 units in the form of 33 quadraminium
buildings. The location of such buildings and appurtenant access.. roadways
are shown on the attached graphic. To date, 4 quadraminiums and a
recreation building have been constructed in conformance with the approved
development plan for this property. In addition, the property surrounding
these completed units has been platted as Braemar Hills 8th Addition.
The proponents are presently requesting a rezoning from PRD -2 to R -1 and
R -2. A 45 lot subdivision is also requested. As proposed, the 29 lots
located in Blocks 1, 2, 3 and 4 would be zoned R -1 and the 16 lots located
in Blocks 5 and 6 would be zoned R -2. Outlot A which measures 3.56 acres
would be dedicated to the City according to the proposed subdivision.
As compared to the previously approved PRD -2 plan, the present subdivision
proposes to use essentially the same building sites for R -1 and R -2
dwellings which would have been used for quadraminiums. Stonewood Court
which is located northerly of Gleason Road is located on nearly the same
alignment as proposed by the previous plan. The alignment of Tanglewood
Court has been altered significantly to provide additional sight.distance
for traffic approaching its intersection -with Gleason-Road. Excluding
existing and planned quadraminiums in Braemar Hills 8th Addition, the
present plan proposes a reduction in the total number of dwelling units
from 112 to 61 as compared to the previously approved PRD -2 plan.
The Planning Commission may recall that the protection of the heavily wooded
steep slopes on the property was of such concern when reviewing the previous
PRD plan...The present subdivision proposes to limit considerably construction
on such slopes and proposes to dedicate most of these areas to the City.
Staff is somewhat concerned with the relationship of the subject property
with the vacant lands located easterly. The Planning Commission will
recall that a development plan entitled Indian Meadows was approved for
this property several years ago. However, this property has been sold
recently and the present owner has indicated his intent not to proceed
with the Indian Meadows concept. Of primary concern to staff is the
advisability of extending Stonewood Court on the subject property into the
property to the east to provide a secondary means of access. Therefore,
staff believes that adequate right -of -way should be reserved to facilitate
the extension of Stonewood Court if warranted by the development of the
property to the east.

Recommendation: Staff recommends approval of the requested subdivision
and rezoning in that:
1) the proposal conforms with the Southwest Edina Plan..
2) the heavily wooded steep slopes on the site are adequately
protected.
3) the realignment of Tanglewood Court is desirable.
4) adequate setbacks from existing and planned
quadraminiums are maintained.
Approval is recommended with the following conditions and modifications:
1) lots 8, 9 and 10, Block 4 must be identified as an
outlot to facilitate the easterly extension of
Stonewood Court if warranted.
2) a storm water storage easement must be' dedicated on
portions of Lots 1, 2,4, 5, and 6, Block 4.
3) an executed deed to the City of Edina for Outlot A.
4) an executed developer's agreement.
5) relocation, removals and re- sealing of existing storm
sewers, water services, and sewer services per the
attached preliminary engineering report.
6) dedication of a 15 foot wide strip of land on the north
.edge of Lot 14, Block 4.
7) submission of a suitable landscape plan for Braemar
Hills 8th Addition
8) all activities relating to the landscaping and snow
removal business located on Blocks 5 and 6 must be
terminated and all equipment, materials and supplies .
removed prior to final plat approval for any portion of
the subject property.
9) within -180 days following final plat approval for Blocks
5 and 6, all dwellings and structures located on Blocks
5-and 6 must be satisfactorily removed. A performance
bond in the amount of $5,000 will be required at the
time of final plat approval to assure removal of such
structures.
10) submission of an erosion control plan.

STAFF REPORT
February 1, 1978
S-78 -4 Normandale Carr Replat. Located north of W. 66th Street and
east .of Parnell Avenue.
Refer to: Attached May 2, 1973 Planning Commission Minutes,
Normandale - Bessesen Replat dated 1973, and
proposed plat and Parkland Dedication report.
In 1973, the Commission reviewed a four lot subdivision (i.e. Normandale
Bessesen Replat) of the subject property. At that time, the Commission
approved the requested subdivision provided that the proponent revise.the
subdivision by moving the west line of Lots 3 and 4 further west and the
south line of Lot l further south. Following this meeting,. the proposal
was dropped and the subdivision never received final approval.
A new subdivision (i.e.. Normandale -Carr Replat) has now been submitted which
is very similar to the plat proposed in 1973. In conformance with the Planning
Commission's past request, the west line of Lots 3`and 4 has been moved
westerly by about 10 feet and the south line of Lot l has been moved southerly
by about 20 feet.
Recommendation:
Staff believes that the realignment of the lot lines provides improved building
sites in comparison with the previous plat. However, staff suggests that due
to potential setback problems, the west line of.Lot 4 should be moved an
additional 10 feet westerly and the south line of Lot 1 should be moved an
additional 10 feet southerly.
With the above modifications, staff recommends plat approval.with the
following conditions:
1) Subdivision dedication in accordance with the attached
report.
2) Utility easements must be provided over Lot 3 for
existing services to the structure on Lot 2. These
services may have to be relocated.
3) A drainage easement.may be necessary over the swale
on Lot 1.

We are recommending that the bid of Schumann Bros., Inc.
not be accepted due to poor performance on past contracts.
Schumann Bros., Inc. did the work on the Southdale Tower
and the Edina East Tower. The work was of poor quality
with streaks, etc. The firm was required to return
twice to rework the poor areas and was not very willing
to do so. The time and effort spent by City Staff to
obtain a satisfactory job on the last contract does not
warrant awarding this contract to Schumann Bros.
Therefore, we recommend award of the bid to Neumann Co.
Contractors, Inc., who have also work here in the past
and have done a very satisfactory job. They request that
they be allowed to do the work in the fall versus the
spring which is agreeable with our department.

of the Radar Tower, at the Rosemount Naval station. We
have One hundred and twenty days completion schedule for
this project.
We are the low bidder for the painting of the water tank
for the City of Shakopee. The completion date for this job
would be June 15, 1978•

splits into two work crews. Although we are bidding on more
work, we will have no trouble in my having a crew to work
on your tank and in being able to complete the project on
schedule. In regards to getting more current letters of
reference; As for my phone conversation with you, Lloyd

a similar tank as yours, a 1,000,000 gallon spherioid, in
1976; he said he would send a letter to you at your request,
he said that the Citys policy is not to send a direct letter
to the contractors that have done work for them.

when I had called him for this request. lie said he would
send a letter as soon as he got back.. We completed a 1,500,

On March. 6th the Edina City Council behaved more like a kangaroo
court than like a body of responsible elected public officials in modern
Minnesota when it brawn], flouted the open appointment process and
voted to back W. C. Waym Courtney for a vacant seat on the Metropolitan
Council.
The Edina City Council voted to baak W. Courtney before it ey
bothered to take the trouble to find out the identity of other oandidates,
and then it gratuitously insulted other candidates by inviting them to
appear before the Maroh 20th meeting of the City Common. What possible

Now that Thomas Ponchik has been convicted in your county,
and is about to be returned to Milwaukee to face our charges,
let me express to you my gratitude for the help and cooperation
which your department, in general, and Detective Don Enger,in
particular, have given us in this case.
I was extremely impressed by the competence of your personnel
in the investigation of Ponchik,'.and in the preparation and
execution of the search warrant for his house. It was a
highly professional operation, the quality of which'I have
seldom seen in four and a half years as a prosecutor.
Ponchik's conviction is particularly a credit to Don Enger's .
tireless followup investigation. I was impressed as well
with your entire department, and with the cooperation we re-
ceived when we were in Edina.

We will now be trying Ponchik on Armed Robbery, Burglary and
Receiving Stolen Property charges. I hope that our prosecution
is as successful as yours.

Z -78 -2 F. Cardarelle. R -1 Single Family District to R -2 Multiple District
and
S -78 -5 Crosstown Hills. Generally located south of Vernon Avenue,
north of the Crosstown, west of Lincoln Drive. 5 lots

The proponent is requesting a rezoning from R -1, Single Family
Dwelling, to R -2, Two Family Dwelling District, as well as a five lot subdivision
of the subject.property. Lots 1, 2 and 3, Block 1 are proposed to gain access
from Vernon Avenue and Lots,l and 2, Block 2, will access onto a new roadway
which would presumably be extended easterly at the time of the development of the
property lying south of Krahl hill.
All lots are proposed to be zoned R -2 and measure from 18,700
square feet to 26,000 square feet. A proposed tennis court would be located
on Lot 2, 'Block 1 and would be shared by Lots 1, 2 and 3.. An existing house .; .
on Lot 3, Block 1 would be remodeled.
The topography of Block 1 is quite steep, especially, with regard
to Lot 1, The difference in elevation between Lot 1 and Vernon Avenue is
approximately 25 feet.
Recommendation: Staff believes that the requested rezoning to R -2 is appropriate
for this site. However, staff believes that the proposed subdivision should be
modified in several respects. First, due to the alignment and potential access`
points north of Vernon Avenue, the .direct access of Lots 1, 2 and 3, Block 1 is
undesirable, especially with regard to Lot 1. Second,.the.intersection of,the
proposed new roadway with Vernon Avenue is undesirable due to sight distance
problems and difficult turning movements. Third, the new roadway would require
a temporary cul -de -sac which would affect the setback of a dwelling located on
Lot 2, Block 2.

Therefore, staff would suggest a modified plat which would
locate the new roadway between Lots 2 and 3, Block 1. Staff believes that
with a revised roadway alignment, all lots could be served by the new
roadway rather than Vernon Avenue.
