They were not guaranteed that they would not have to pay an additional assessment if watermain was constructed on Paddock Lane. In 1977, Watermain (Project 320) was installed on Paddock Lane with a Fire Hydrant being placed mid -block for Fire Protection. Indidvidual House Services were not provided for Lots 13 and 14 Paddock Lane per Mr. Dunn's instructions. Three alternatives are possible at this time. (1) The first being to eliminate the two lots from the benefitted area which will increase the assessments to the remaining 86 lots from $2,863.49 to $2,930.08. (21 The second alternative would be to assess the full assessment based on providing water to the Rolling Green area per 1969 comments- in Council minutes. ($2,863.49 per lot for 88 lots) (3) The third alternative would be to assess the cost of improve- ment for the fire service line on Paddock Lane among the six potential users of that fire hydrant. The cost of the fire service line is $7,440.00 which includes construction, engineer- ing, clerical and capitalized interest costs. The suggested assessment to lots 13 and 14 Paddock Lane would be $1,240.00 each. The assessment to the remaining 86 lots would be $2,901.25. vl. It certainly seems to me that Edina Realty and Cramer -Weir Construction Co. should have been aware of any unpaid assessments especially when we are talking in the area of $13,000. I do not feel any responsibility for the property I purchased at 5508 Malibu Drive. I think that you and /or Craurer -Weir should straighten this out with the City of Edina. This division was granted to facilitate the construction of the Junior Achieve- ment Building at 69th Street and Valley View Road. At that time, the Council expressed concern about the potential use of the 48,000 square foot parcel lying east of the Junior Achievement site. Although this parcel was (and is) zoned C -3, Commercial, the Council felt that a Commercial use of the site would be undesirable. Dayton - Hudson. Corporation, the property owner, was not willing to rezone the parcel at that time, but did.pledge that the parcel would be marketed for only non - commercial uses. The attached Council minutes and correspondence document this intent. Dayton - Hudson has recently entered into a purchase agreement on the parcel with Spa Petite, a women's health spa. Spa Petite proposes to construct a two story building on the site which would contain a health spa on the first level and its corporate offices on the second level. The health spa and the office would each contain approximately 4500 square feet. The spa would be open from 9:00 a.m. to 9:00 p.m. and would serve approximately 200 patrons daily. Health spas are, of course, a commercial use. Staff suggests, however, that such a use is less intense than most uses allowed in the C -3 district. Also, based on ordinance requirements, a 24,000 square foot building could be con- structed on the site (assuming adequate parking) which would be more inten- sive than the 9,000 square foot building proposed. . From the negative standpoint, the health spa could vacate the building and a much more intense use, such as a retail outlet, could be established in con- formance with the zoning ordinance. Similarly, the building could be greatly expanded and thereby create a more intense use, again in conformance with the zoning ordinance. It must be reiterated that the site is zoned C -3, Commercial, and thus from a legal standpoint the proposed use as a health spa is in conformance with the zoning ordinance. Dayton - Hudson recognizes, however, that it pledged that the site would not be used for commercial purposes, and therefore has indicated that it will abide by the Council's wishes concerning the pro- posed use. Dayton - Hudson and Spa Petite have also expressed their willingness to enter into a deed restriction regulating 1) the re -use of the proposed building in the event of its vacation and 2) future expansions to the building. This was subject to a referendum if a petition was received within 30 days following publication of the resolution. The resolution was published on August 9 and 1:6. Thirty days following publication was September 7th and no petition was received. A letter is being submitted to the State Revenue - Department to complete the process. A separate letter was submitted to the Levy Limit Revenue Board requesting a further increase based on the surplus funds used for non- surplus purposes in 1971. A hearing on the matter is tentatively scheduled for 2 p.m. September 28th in St. Paul. In addition to that letter the Revenue staff will prepare -a report. Preliminary. indications are that the.amount that they calculated that the City can request is within a few thousand dollars of the City's'request of $302,813. ACTION TAKEN: The Traffic Safety Committee was asked to review and make a recommendation as to the need for having an ordinance amendment controlling driveway accesses in residential areas. Fran Hoffman indicated ;that both the County and the State have a permit system to control driveway cuts. The City of Edina has no such permit system. The City of Edina, therefore, has no legal control over where a resident may want his driveway to enter a City street. To prevent an arbitrary decision by a City staff member on this issue, an ordinance amendment would be necessary. A legal opinion by the City Attorney was that the City can regulate access points but cannot deny a resident reasonable access to his property. Chief Swanson opposed such an ordinance amendment indicating that the question of requesting an additional driveway access onto a higher volume street is very seldom requested and that this proposed ordinance amendment is more bureaucratic red tape which is not needed. Fran Hoffman moved that the Traffic Safety Committee recommend an ordinance amendment requiring driveway permits when those driveways enter onto State -aid streets. Seconded by Gordon Hughes.
