Enclosed is a copy of the adopted Policy. and Legis-
lative Proposals of the Association for 1979 - 1980.
This Policy was adopted at the legislative membership
meeting in October and will be the focus of Associa-
tion lobbying efforts during the forthcoming legis-
lative session.
It would be very helpful if, in your contacts with
your State Senators and Representatives, you would
take that opportunity to discuss these proposals with
them. The Association staff will, of course, be lobby-
ing in support of these Proposals throughout the ses-
sion, but your direct contact with your local legis-
lators will greatly enhance these efforts. (copies
have been sent to each Legislator).
Please do not hesitate to contact either Roger Peterson
or myself should you have questions concerning this
matter.

NOTICE OF PUBLIC HEARINGS
THE EDINA CITY COUNCIL -will meet at the Edina City Hall, 4801 West 50th
Street, on Monday, January 15, 1979, at 7:00 p.m. and will at said time
and place consider the following:
1. Appeal by KMSP -TV of a Board of Appeals and Adjustments decision on
. December 21, 1978, denying their request for a.100 foot antenna
height variance to permit a 150 foot antenna. The.property .is
generally located at 6975 York Avenue South and described'as follows:
Registered Land Survey No. 629.
2. Appeal by United Properties /Twin City Federal of a Board of Appeals
and Adjustments decision on December 21, 1978, denying their request
for a sign variance to .permit an additional building identification
sign. The property is generally.located at 3400 West 66th Street and
described as follows: Part of Lot 4, Block 4, Southdale Acres, and
Part of Lot 4, Cassin's Outlots.
.3. Appeal by John J. Velie of a Board of Appeals and Adjustments decision
on December 21, 1978, denying their request for a 10 foot front yard
setback, a 25.foot rear yard setback, and-a 3,147 square foot lot area
variance. The property is generally located at 4300 -4302 .Valley View..
Road and described as follows: All that part of the northwest quarter
of Section 30, Township 28, Range 24, lying south of West. 62nd Street,
west of Brookview Avenue, and northeasterly of Valley View Road.
All recommendations and objections will be heard at said meeting.

COMPENSATION FOR OTHER THAN FULL TIME EMPLOYEES
Employees that are not permanent fulltime are used in a number of City depart-
ments to assist in handling the workload during certain times of the day, week
or year. In the past, it has been up to the individual departments to set
salary rates. This, however, has led to a wide disparity in rates among
departments and there are varying degrees of difficulty in obtaining part -
time employees. To alleviate some of these disparities, the following
compensation guidelines are issued. The rate schedules are split into two
sections. The first section is for jobs which are of a year- round, part -
time nature. The second section is for those jobs that are of a seasonal
or special event related nature (including the Recycling Center). As close
as possible, wages for these jobs follow the guidelines. Rate schedules
will be reviewed semi - annually in July and December. Raises are not
automatic and are at the discretion of the individual's supervisor.

YEAR ROUND (TEMPORARY /PART TIME)
Rates in this grouping are in two levels, again dependent on job
level and length in the job.
Level A - Basic part -time job
Level B - Part -time job that requires a level of responsibility
beyond basic part -time position, involving a degree of
trust, security, responsibility or specialized skill.
Appendix B outlines those jobs. If an individual is in
a managerial position, the permanent fulltime repre-
sentative should recommend a wage to the City Manager
(not to exceed established maximum).
SEASONAL /SPECIAL EVENT (TEMPORARY /PART TIME)
Wage rates in.this category are a function of the job level and
number of seasons in that job (level). Job will be slotted in a
level prior to season's commencement.
Level 1 - Minimum public contact, low level responsibility
Level 2 - Could handle money, works with public
Level 3 - Instructor level or specialized skill required
Level 4 - Supervisor F, director level

CONTRACT FOR SERVICE
As an- alternative to part -time employees, contract for personnel services
with either firms or individuals. may be a more cost effective approach.
P.E.R.A.
Part -time individuals who earn in excess of $250.00 per month, or $3,000.00
per year (and are not full -time students) are subject to P.E.R.A. contribu-
tions with the City responsible for a matching share.

RESOLUTION
WHEREAS, the actions brought by First Wisconsin National
Bank of Milwaukee [ "First Wisconsin "] against the City of Edina
and the Edina City Council, being Hennepin County District
Court Cases No. M- 731139, W- 731140, and W- 731141, relating
to removal of a one -story brick building [the "Building"] on
Outlot C, Walnut Ridge Third Addition, are now proposed to be
settled and dismissed by stipulation and with prejudice and
without costs to any party, with all rights of appeal waived,
with First Wisconsin to pay for the filing of record of a
Declaration and Agreement in which agreement is made for certain
payment to the City, the removal of the Building on or before
midnight of December 31, 1982, and for restoration and landscaping
all areas disturbed by such removal consistent with the then con-
tour of, and landscaping on, the property and in a manner
reasonably satisfactory to the Planning Department of the City,
and with City of Edina agreeing in said stipulation to the
terms of this Resolution; and
WHEREAS, such a settlement is acceptable to the City
and the City Council.
NOW, THEREFORE, IT IS RESOLVED that the above listed
lawsuits be settled on the above terms and conditions, and
the Mayor and Manager are authorized and directed to enter
into a stipulation so settling said lawsuits and providing
r
for the filing of such a Declaration and Agreement, and are
further authorized and directed to execute and deliver such a
Declaration and Agreement.
BE IT FURTHER RESOLVED, as consideration for and as
a part of such settlement, that the Building shall be allowed
to remain in its present location, and to be used as a dwelling
at such location, until December 31, 1982, unless prior thereto
said Building is lawfully ordered removed, or the
use thereof is lawfully stopped, pursuant to applicable codes,
ordinances, or statutes, other than the zoning statutes and the
zoning ordinance of the City, by reason of changes in the nature
or condition of the Building hereafter occurring; that once
the Building is removed, and the other agreements
as set out in the recorded Declaration and Agreement are ful-
filled, all pursuant to such Declaration and Agreement, and
upon written request, the City shall execute and deliver a
certificate in recordable form, reciting that the obligations
imposed by said Declaration and Agreement have been fully
performed.
This Resolution shall not be effective until, and shall
become immediately effective upon, the execution by the City and
First Wisconsin of the stipulation settling said lawsuits as
set forth above.

.racteristics:
In'the coefficient of dispersion, it is important that
the average deviation be related to the median ratio to
produce a meaningful index. The same illustrated average
deviation of 13.0, if applied to a median ratio of 70;
would produce a coefficient of 18.5; if applied to a
median ratio of 50, it would produce a coefficient of
26.0. The lower the coefficient of dispersion, the more
uniform are the assessments. On the other hand, a high
coefficient suggests a lack of equality among individual
assessments. For interpretation purposes, the following j
guidelines have been established in evaluating an area's
coefficient of dispersion.and resultant quality of assess-!

The relative difficulty of the assessment problem is an
important factor to be considered in the comparison of
coefficients of dispersion between areas and among classes
of property., It is reasonable to expect a higher degree
of equality in those areas with homogeneous properties
to be assessed. Conversely, a lesser degree of uniformity
is to be anticipated in those areas with a great variety
of properties and an absence•of market criteria.

THE APPEAL PROCESS
I. Boards of Review and Equalization
A. Local Board of Review or Equalization
1. Meets between April 1 and June 30 for no longer than 20 days
(unless extension granted by Commissioner of Revenue).
2. Comprised of Town Board Members or city council unless city
elects to have special board of review.
3. Board reviews current assessments in district and makes
necessary changes including picking up omitted property.
4. Authority of local board extends over individual assessments.
Does not have power to make percentage changes on given class
of property in the district.
5. Total of adjustments made by local board may not reduce the
aggregate assessments made by county assessor by more than 1 %.
6. If increases are made by local board property owner must be
notified.
7. Increases made by local board are subject to limitation laws.
8. Non - resident may file written objections to his assessment
with county assessor who must present it to local board for
consideration.
9. Board may make classification change..
B. County Board of Equalization
1. Meets between July 1 and July 15. (Commissioner of Revenue is
authorized to extend meeting to July 31.)
2. Board is comprised of county commissioners and county auditor,
unless county elects to have special appointed county board
of equalization.
3. Board may make percentage increases on each class of both real
and personal property in the entire county, or in any particular
city, town or district. It isn't necessary for the board to
give notices when applying aggregate increases.
4. Board may make percentage decreases and individual decreases
in the assessments of both real and personal property when the
board believes such property has been valued at more than market
value. The board can't reduce the aggregate value of property in
its county more than 1% of the aggregate value as returned by
the assessors.
5. Board may only consider current assessments.
6. Board may not exempt property from taxation.'
7. Board may not place omitted property on the-assessment books.
8. Increases made by board are subject to limitation laws.
"9. Taxpayer may not come to county board of equalization without
first going to local board of review.
10. Board may make classification changes.
C. .State Board of Equalization
1. Board meets between August 15 and October 15.
2. Commissioner of Revenue is State Board of Equalization.
3. Board may make percentage increases and decreases as it sees
fit in counties, cities and towns.

4. Board shall not reduce the aggregate valuation of all property
of the state.. More than one percent on the whole valuation
thereof.
5.. Board may make-individual increases when it first gives notice
of such increase to the individual or firm.
6. Board may apportion the levies of a district lying in two or
more counties when sales ratio studies show the average level
of assessment differs by more than ten percent.
7. Commissioner of Revenue permitted to make decreases in individual
assessments. _% n vidual must first appear before county
board of equalization.
II. The Abatement Process
A. Commissioner of Revenue has power to grant reduction or abatement
of assessed valuations.
B. Application for abatement must be accompanied by favorable recom-
mendation of the county board and the county auditor.
C. Abatement, reduction or refund of over $500 must also be approved
by Attorney General.
D. Types orders that do not require the approval of the Commissioner
and Attorney General and are final when approved by county board.
1. An order reducing the assessed value of property by reason of
its classification as a homestead for current year.
2. An order reducing property by not more than $300 in market
value.
E. Commissioner acts on abatements involving only current taxes and
two previous years.
F.- Individuals may now file for abatement even if property is'not up
to market value as long as property is assessed 10% or more above
the average level of assessment in the district.
III. Court Review
A. District Court
1. May appeal to district court whether or not he has appealed
to a board of review or equalization.
2. Petitioner pays half the taxes before filing petition.
Petition must be filed with clerk of district court on or
before June 1st.
B. Tax Court
1. Tax Court is independent agency of executive branch of
state government.
a. Three judges appointed by governor
b Circuit court.

THAT IS: The loss of trees on Morningside Road, whet-
her now or later because of road work or Dutch Elm will
result in Morningside Road becomming one of the ugliest
streets in the Twin Cities. The nearest comparable with
the same problem is in St. Paul.
THE CAUSE: A row of 60 foot utility poles carrying:
1. an old leaded telephone cable which serves no
resident and is above ground only in Edina!
2. a set of 3 high voltage lines which do not dir-
ectly serve residents and are part of a wide area
grid. Some of these are bare of insulation and
in 1967 two of them fell on the Novack propery
causing fire and damage to sidewalk, street and"
got so hot they melted the gas pipe shut - 6 feet
underground.
3. A set of three local lines which serve under
half the residents on the street. Itis arbitrary
in most cases whether the house was connected to

Informal realitor opinions indicate affected homes will
lose from $1000 to over $5000 in value each.

This is a major Public Works project governing the
next 30 to 40 years - it behooves us to do it right,
THE FIRST TIME, not at great expense later.
2. RESIDENT PROPOSED SOLUTIONS - TO DATE
These have been catagorized but any and all possible
combinations can be considered.
A. CREATE WIDER BOULEVARDS
h. To keep contractors equipment from injuring roots
2. To give trees room for future growth
3. To enable replanting directly on boulevard
4. Cut paving material and labor expense
5. Reduce highspeed Morningside road traffic if
street is reduced from oversize status.
HOW:
1. Set sidewalk width to 4 feet like the rest of
Morningside.
2. Set Street width to 30 feet - the standard Edina
two side parking width - instead of 32% as now.
Note Morningside Ls not o- thoroughfare - 44th whLch
Ls a state oLd street Ls only 30 feet.
3. Set street width to 26, 27 or 28 feet and ban
parking on north side where there are actually
few homes because of intersecting streets. ThLs
optLon to date seems to have more support than
30 feet - even on the north.
4. In either case of 2 or 3 above the present jog
at the church should be maintained and two side
parking allowed.
B. ELIMINATE THE POWERLINES - THE ACTUAL PROBLEM
1.. To prevent major loss of value to affected homes
2. To prevent having to tear things up again in
a few years when:
a) NSP decides the useful life of these is
over
b) Residents get fed up with the sight
HOW:
1. Bury the telephone cable - and apparently free !
2. Move the highlines to the existing back lot
easement.
3. Bury the highlines during street construction

DETAILS:
NSP appears to have a new policy of not burying
lines free with a major public works program
unless the end of useful life is near. A reasonable
case could be made that substantial useful life
has been expended and that some danger exists from
the worn lines.
NSP has been reluctant to give potential costs
without a formal request - and independent research
attempted by residents has not been completed in
the few days since this issue developed.
It is the feelings of residents that the city
should take the lead in dealing with NSP.
C. DENSELY PLANT NEW LARGE (6 ") TREES ON NEW WIDER
BOULEVARDS TO HIDE THE LINES
D. INSTALL NEW DECORATIVE ALUMINUM POLES
In place of the wooden ones - with No "T" on top
and to hold the highlines - but not telephone cable

No one has said this yet, despite possibly steep
costs of some options.

3. THE MORAL AND LEGAL CASE FOR EDINA TAKING CHARGE
Morally it is unreasonable to renew a whole area and
leave a Single street in worse shape than before —
especially when the area is a characteristicly co— hesive
unit. One uniquely different street of.a group will
stand out and hurt the entire area.
There is some legal question that Edina has the power
to deal with this'matter — the residents have not had
time to have their own attorneys research the matter.
But one thing can be assured, several residents already
are prepared to engage in legal actions if they feel
the net result of the project will be to hurt their
property. Even if they can not attack on the grounds
that the amount assessed must equal the economic benefit
derived , until after the project is completed there
appear to be other avenues now.
In any case we should avoid such confrontations as it
will only be expensive, time consuming, and delay
completion of the entire project. If the city will
attempt to work out a way to handle the problem it
is possible the project can be quickly completed.
We are sure that the residents are willing to give a
little if the city is willing to give too.
4. A REQUEST OF THE CITY
It is respectfully requested that the City of Edina
undertake with all due speed an effort to:
1. Alter any plans in a fashion to solve the problems
2. Find a way for the city to handle the NSP problem
3. Find a way to finance any costs necessary.
4. Report back to the residents or any representatives
at the earliest possible date.
Time has not made it possible for this request to be
made in the name of all affected residents — but for
those who have been a party to its development we
assure the city that there is a willingness to
cooperate in any way possible.

I am.writing to confirm our conversation of 6/22/78 regarding
the Morningside Improvement area. Generally, NSP will look at
areas of this type to see if our lines need to be moved, the cost
of such movement, the cost of replacement with underground, and
the useful life of our system.
In the Morningside area we do not need to move our system and
could not consider replacement with underground unless the
additional cost were borne by the benefiting customers.
Although the distribution system has been there for some years,
it has been ungraded and is generally in good condition with
approximately 25 years of useful life left. It does directly
serve the customers in that area.
We estimated that it would cost roughly $1,500 / lot adjacent
to Morningside Rd. to remove the existing overhead line and
replace it with an equivalent underground system.
Additionally each customer receiving service off of the line on
Morningside Rd. would have to have an electrician rewire their
service to accept our underground service lateral and install the
meter outside the house. If their wiring satisfies the current
National Electric Code Standards, we estimate they might incur
a charge of approximately $300 / home. If their wiring were
not up to code an additional estimated charge of $1,000.00
may occur. These are estimated costs and actual prices must
be obtained from an electrical contractor.'. Each customer
would be placed on the underground residential rate (an additional
$2.40 / month). The customer would be required to restore the
area -of the underground service.
100/ of the customers served from the line would be required
to take underground service or we would be forced to maintain a
duplicate overhead system and the above NSP costs / customer
would increase considerably.

Mr. John Maloney, 4014 Sunnyside Rd�.- Expressed concern about the number of
poles in his block. Mr. Rosland will see if the number can be reduced.
Mr. Lee Pertl, 4309 Morningside Road - Objected to lines in front and behind
his house. Mr. Rosland recalled that there would be a charge to change
the service.and that all neighbors would have to be agreeable to this
charge.

The Edina City Council heard the controversy regarding the
trees and powerlines and"has ordered a SPECIAL MEETING next
Monday night at 7:00 PM at the City Hall. You will have received
an official notice.
We have been asked to POLL residents as to their views on the
following matters so that a consensus.of opinion can be considered.
1. It is generally understood that making the boulevards wider
will keep contractors equipment from damaging tree roots, will
give trees more room for future growth, and will let us replant
new trees on the boulevard instead of your lawn.
A. The rest of %lorningside will have a foot sidewalks and if
we want it the city will gladly give us 4 foot instead of
the existing 6 foot ones.

May was a sad month for the Edina Swingin' Singin' Seniors. Art Graham passed away.
We will always remember him as the Happy Wanderer.
We participated in the "Gusty Golden Age Talent and Hobby Show" at the Edison High
School Auditorium. The Master of Ceremonies was Don Harrison of Channel 9 TV. One
lady said we looked like a spring garden in our colorful dresses and bonnets.
St. Louis Park Seniors were impressed with our corny skits. I guess there's a little
ham in all of us.
The Hennepin -Anoka Congregate Dining Project is happy to share your lovely Edina
Senior Center, and glad that more of you are finding -us daily. We hope you will think
of people who could benefit from this dining experience and invite them to come with .
you.
We will continue to do our best to be out of your way when you have scheduled events
here, even though our contract with the Center stipulates we are to have use of the
kitchen and dining area from 10 to 2 weekdays. When we serve a large group I trust
you will understand our inability to clear up early. Offers to help are always welcome!
We attempt to leave the area clean for other users and trust you will do the same for
US.

Phyllis Stroth, director of the Dance Studio, will be here with her students to enter-
tain us. There will be tap dancing, ballet and acrobatics. The girls are between
6 and 20 years old. It should be a fun afternoon; don't miss it.
FIDDLER ON THE ROOF, trip to the Country House, the Zoo and the parks! What a fun
month we had in June! And July promises to be-just as exciting. Be sure to keep
July 13 and July 27 open, plus all the other dates on which exciting and interesting
events are scheduled. Fun, fun, fun!
The city is going to add some space to our present parking to enable more guests to
park who come to the Center. Remember, all improvements take time, but it will
happen.
How many of you are game to join the health program? You will be helped with a proper
diet and will learn how to achieve a weight loss. It's a challenge and maybe by
competing with your neighbor on weight loss you'll succeed where otherwise you might

Congratulations, Edina.Singin' Swingin' Singers! You put on a fabulous Dixie Jubilee;
the music, costumes, decorations and food were fantastic. You brighten spirits every
time you perform!

the huge .Christmas tree that stands in the Southdale Center through the Christmas
holidays. There are several patterns to choose from and we.need everyone'to Help.

Geography, Interpersonal Communications, Nutrition, Personal and Community Health,
Drug Use and Abuse, Finance and Investment, or Political Science? These are a

in forthright way with care and concern for others by enrolling in ASSERTIVENESS

1. THE PROBLEM
The Green Striping- of every tree in sight brought
to Light something none of us - save the engineers
anticipated.
THAT IS: The loss of trees on Morningside Road, whet-
her now or later because of road work or Dutch Elm will
result in Morningside Road becomming one of the ugliest
streets in the Twin Cities. The nearest comparable with
the same problem is in St. Paul.
THE CAUSE: A row of 60 foot utility poles carrying:
1. an old leaded telephone cable which serves no
resident and is above ground only in Edina!
2. a set of 3 high voltage lines which do not dir-
ectly serve residents and are part of a wide area
grid. Some of these are bare of insulation and
in 1967 two of them fell on the Novack propery
causing fire and damage to sidewalk, street and
got so hot they melted the gas pipe shut - 6 feet
underground.
3. A set of three local lines which serve under
half the residents on the street. It is arbitrary
in most cases whether the house was connected to
lines in front or back of the house.
If the trees are lost to any degree these lines will
result in a "Powerline Alley" "appearance on Morningside.
Informal realitor opinions indicate affected homes will
lose from $1000 to over $5000 in value each.
This is a major Public Works project governing the
next 30 to 40 years - it behooves us to do it right,
THE FIRST TIME, not at great expense later.
2. RESIDENT PROPOSED SOLUTIONS - TO DATE
- These have been catagorized but any and all possible
combinations can be considered.
A. CREATE WIDER BOULEVARDS
1. To keep contractors equipment from injuring roots
2. To give trees room for future growth
3. To enable replanting directly on boulevard
4. Cut paving material and labor expense
5. Reduce highspeed Morningside road traffic if
street is reduced from oversize status.
HOW:
1. Set sidewalk width to 4 feet like the rest of
Morningside.
2. Set Street width to 30 feet - the standard Edina
two side parking width - instead of 32% as now.

Ls a state aLd street Ls only 30 feet.
3. Set street width to 26, 27 or 28 feet and ban
parking on north side where there are actually
few homes because of intersecting streets. ThLs
optLon to date seems to hove more support than
30 feet - even on the north.
4. In either case of 2 or 3 above the present jog
at the church should be maintained and two side
parking allowed.
B. ELIMINATE THE POWERLINES - THE'ACTUAL PROBLEM
1. To prevent major loss of value to affected homes
2. To prevent having to tear things up again in
a few years when:
a) NSP decides the useful life of these is
over
b) Residents get fed up with the sight
HOW:
1. Bury the telephone cable - and apparently free 1
2. Move the highlines to the existing back lot
easement.
3. Bury the highlines during street construction
4. Bury the local lines together with the street
lighting planned. Apparently Low bids for this

few front served homes Ls not dLffLcuLt or much
hLgher Ln cost.
DETAILS:
NSP appears to have a new policy of not burying
lines free with a major public works program
unless the end of useful life is near. A reasonable
case could be made that substantial useful life
has been expended and that some danger exists from
the worn lines.
NSP has been reluctant to give potential costs
without a formal request - and independent research
attempted by residents has not been completed in
the few days since this issue developed.
It is the feelings of residents that the city
should take the lead in dealing with NSP.
C. DENSELY PLANT NEW LARGE (6 ") TREES ON NEW WIDER
BOULEVARDS TO HIDE THE LINES
D. INSTALL NEW DECORATIVE ALUMINUM POLES
In place of the wooden ones - with No "T" on top
and to hold the highlines - but not telephone cable
E. DO NOTHING
No one has said this yet, despite possibly steep
costs of some options.
F. Other Suggestions ?. . . . .
3. THE MORAL AND LEGAL CASE FOR EDINA TAKING CHARGE
Morally it is unreasonable to renew a whole area and
leave a Single street in worse shape than before —
especial]y when the area is a characteristicly co— hesive
unit. One uniquely different street of a group will
stand out and hurt the entire area.
There is some legal question that Edina has the power
to deal with this matter — the residents have not had
time to have their own attorneys research the matter.
But one thing can be assured, several residents already
are prepared to engage in legal actions if they feel
the net result of the project will be to hurt their
property. Even if they can not attack on the grounds
that the amount assessed must equal the economic benefit
derived , until after the project is completed there
appear to be other avenues now.
In any case we should avoid such confrontations as it
will only be expensive, time consuming, and delay
completion of the entire project. If the city will
attempt to work out a way to handle the problem it
is possible the project can be quickly completed.
We are sure that the residents are willing to give a
little if the city is willing to give too.
4. A REQUEST OF THE CITY
It is respectfully requested that the City of Edina
undertake with all due speed an effort to:
1. Alter any plans in a fashion to solve the problems
2. Find a way for the city. to handle the NSP problem
3. Find a way to finance any costs necessary.
4. Report back to the residents or any representatives
at the earliest possible date.
Time has not made it possible for this request to be
made in the name of all affected residents — but for
those who have been a party to its development we
assure the city that there is a willingness to
cooperate in any way possible.

C O M P L A I N T
Plaintiff, Lois Schechter (hereinafter referred to as the
"Trustee "), for her complaint against defendant, City of Edina, a
municipal corporation (hereinafter referred to as "Edina "), alleges
as follows:
COUNT I
1. Herbert Schechter (hereinafter sometimes referred to
as "Herbert "), died on September 25, 1977 as a result of.injuries
sustained on August 27, 1977, as hereinafter alleged.
2. Herbert left surviving him, as his next of kin, the
following persons, of the following ages, bearing the following re-
lationship to him:

3. By an order of the District Court for the Fourth Judicial
District dated March 15, 1978, plaintiff was appointed trustee to
maintain an action for the wrongful death of Herbert for the benefit of
said next of kin.
4. Plaintiff is bringing this action under Minnesots Statutes
Sec. 573.02 for the benefit of the next of kin of Herbert, described
hereinabove.
5. At all times material herein, Edina owned and operated
a public golf course in the City of Edina known as Braemar Golf Course
(hereinafter sometimes referred to as "Braemar "). In connection with
the operation and business activity of Braemar,. Edina (a) invited and
permitted members of the general public to play golf at Braemar and
charged a fee to each person who so played golf at Braemar; and (b)
leased and rented electric or gas - propelled golf carts to persons
playing golf at Braemar and charged a rental fee for the use of said
carts. In addition, Braemar maintained a "Men's Club" at its golf
course, the members of which were invited by Edina to play golf at
Braemar for a fee.
6. At all times material herein, Herbert as a member of the
general public and as a member of Braemar's. "Men's Club" played golf
at Braemar with the knowledge and consent of Edina and Braemar and
paid a fee therefor. From time to time Herbert rented a golf cart
from Edina and Braemar and paid a rental fee therefor.
7. On August 27, 1977, Herbert as a resident.of the City
of Edina, a member of the general public, and a member of the Men "s
Club" of Braemar paid a fee to Braemar for golfing privileges on that
day and rented a golf cart from Braemar for a fee, which he paid to
Braemar. Herbert was on the premises of Braemar with the knowledge
and consent of Edina and at its invitation, and he played golf and
drove the rented golf cart on the premises of Braemar on that date.
8. Edina was negligent with respect to Herbert in that,
among other things, Edina failed to monitor, control, and direct the
movement and traffic of golf carts driven by persons playing golf at
Braemar, including Herbert; it failed to place and maintain warning
signs concerning routes and areas over which golf carts could not
safely be driven by Herbert and other golfers; it failed to place
barricades and other devices to prevent Herbert and other golfers fro; -!
driving golf carts in areas which were unsafe and dangerous for the
driving of golf carts; it failed otherwise to prevent Herbert and other

golfers from driving golf carts in areas which were unsafe and
dangerous for the operation and driving of golf carts; it rented a
golf cart to Herbert which did not function properly and which
was defective, unreasonably dangerous, unsafe and not fit for the
purposes for which it was intended.
9. As a proximate and direct result of Edina's negligence,
as hereinabove alleged, Herbert was driving a defective and dangerous
golf cart in an area of Braemar Golf Course which, unbeknown to
Herbert, was dangerous and unsafe for the operation of golf carts,
and the golf cart turned over; said golf cart struck Herbert on the
leg and other parts of his body.
10. As a direct and proximate result of said turning over
of the golf cart, Herbert sustained injuries to his leg and other
parts of his body.
11. As a direct and proximate result of the turning over
of said golf cart being driven by Herbert and as a direct and proximate
result of the injuries sustained by Herbert, Herbert died on September
25, 1977.
12. As a direct and proximate result of Edina's negligence,
of said turning over of the golf cart, of the injuries sustained by
Herbert, and of his death as hereinabove alleged, the next of kin of
Herbert suffered pecuniary loss, all to their damage in the sum of
$200,000.00.
13. Pursuant to Minnesota Statutes, Sec. 466.05, Lois
Schechter, the surviving spouse of Herbert and plaintiff herein, on
November 4, 1977, gave written notice to the City of Edina of her
claim for death by wrongful act and omission on the part of Edina,
and in said notice set forth the time, place and circumstances of
the injuries and loss sustained by Herbert and by his surviving
spouse and next of kin.
COUNT II.
14. Plaintiff realleges all and singular all of the allega-
tions of paragraphs 1 through 7 and paragraph 13 of COUNT ONE of the
complaint.

15. The golf cart rented by Edina to Herbert was in a
defective condition and was unreasonably dangerous and unsafe for
its intended use at the time it left Edina's possession and control.
16. Edina, as the lessor of the golf cart, knew that
the cart would be used by golfers such as Herbert and represented
to said users, including Herbert, that it would be safe for its
intended use.
17. Edina knew that the golf cart was in such a condition
that it was likely to be dangerous for those for those use the golf
cart was intended, including Herbert, and that users thereof, including
Herbert, would be endangered by its probable use.
18. Edina knew or had reason to know that Herbert would
rely upon Edina to furnish a golf cart which was in a safe condition
for the purpose for which it was rented to him, and Edina had no reason
to believe that Herbert would realize that the golf cart was in an
unreasonably dangerous condition.
19. Edina failed to inform Herbert of the unreasonably
dangerous condition of the golf cart which it rented to him.
20. Herbert was unaware of the dangerous condition of the
golf cart which Edina rented to him and.was unaware of any condition
which made it unsafe for its intended use.
21. As a direct result of all of the above, including
Edina's renting a defective and dangerous golf cart to Herbert, in the
course of Herbert's operating the same, the cart turned over and injured
Herbert.
22. As a direct result of the turning over of said golf
cart and as a direct result of the injuries sustained by Herbert,
Herbert died on September 25, 1977.
23. As a direct and proximate'.result of all of the above,
including the turning over of the cart, the injuries sustained by
Herbert, and his death, as hereinabove alleged, the next of kin of
Herbert suffered pecuniary loss, all to their damage in the sum of
$200,000.00.

is strictly liable to plaintiff and Herbert's next of kin in the
sum of $200,000.00.
WHEREFORE, plaintiff prays for judgment in her favor
and against defendant in the sum of $200,000.00, together with her

Gentlemen:
Pursuant to Minnesota Statutes, § 466.05, as the
surviving spouse of Herbert Schechter, I hereby give notice
to the governing body of the City of Edina, viz., the City
Council, of a claim for death by wrongful act and omission
as the result of the turning over a golf cart at Braemar
Golf Course.
The incident occurred on Saturday, August 27,. 1977,
at approximately 9:30 A.M. in the vicinity of the tenth tee
at Braemar Golf Course, a course owned and operated by the
City of Edina. Herbert Schechter was driving a golf cart
owned and rented to him by Braemar Golf Course. As he was
descending from the upper tenth tee, the cart tipped over
and fell upon him injuring his left leg and other parts of
his body, and as a result of said injuries, Mr. Schechter
died on September 25, 1977.
The undersigned claims that the City of Edina as
the owner and operator of Braemar Golf Course, through its
employees, servants and agents, was negligent and that such .
negligence was a direct cause of the golf cart's tipping
over and falling on Herbert Schechter and also the direct
cause of Mr. Schechter's injuries and subsequent death.
The compensation and damages claimed by those entitled
to recover for the death of Herbert Schechter are in the sum of
$200,000.00 or in the maximum amount permitted by statute, which-
ever is greater.
