Mr. Hughes pointed but that the developer, Mr. Wallace Kenneth, has agreed tl-1at

entirely from the plat. Mr. Hughes reviewed portions of the Findings of fact
prepared by the staff, a copy of which is attached and made a dart of these minutes,
and advised that, pursuant to instructions from the Council, he had received an
executed deed to Outlot A to the City of Edina , an executed Developer's Agree-
ment and a letter signed by the developer which sets forth various understandings
between the proponent and the City. Mr. Hughes specifically mentioned $iah Sections

Wiz; Mr. Rick Davies, 5412 Malibu Drive, said that lie spoke on behalf of

the Edina Coalition and asked that the record show the Coalition66 appreciation
to Mr. Luce for the manner in which 'Lie had dealt with. the problems connected with
this property. -fir. Davies objected that the area would be denuded of $5% of the
trees now existing on the property. He also expressed his concern about the
Eloise levels, stating that the Iiennepin County Highway tepartment has indicated
that there is no way that a sound barrier can be installed along County Road 18
at that point. He contended thatsgound levels would be at 75 decibles by 1935
and that M.P.C. regulations stipulate that property that is subject to over
65 decibles of sound cannot be intended. for outdoor usage in a residential area.
Attorney Robert ioffman, representing Mr. Kenneth, advised that, if these factors
are true, they will be taken into account and urged. that the Council proceed as
recommended by the staff and the Planning Commission. 11ayor Van Valkenburg said
that he did not believe that Mr. Davies' comments were germain to the actual
platting. Councilman Richards thereupon offered the following resolution and
moved its adoption:

WHEREAS, Wellington N. "Bud" Dickson was a long -time resident of the
City -of °Edina; =and - = - -=
WHEREAS, Wellington N. "Bud" Dickson was held in high esteem by all who
knew him and who were aware of his many civic interests; and
WHEREAS, over the years, Wellington N. "Bud" Dickson served his fellow
man as President of the Minneapolis Rotary Club in 1947, as President of
the Minneapolis Aquatennial in 1949, as President of the Viking Boy Scout
Council in 1965, and as head of the Minneapolis Better Business Bureau; and
WHEREAS, Wellington. N. "Bud" Dickson was active on the political scene as a
member of the Edina Good Government Group; and
WHEREAS, Wellington N. "Bud" Dickson served two terms as a member of the
Edina Village Council from January 1, 1957, to January 1, 1963; and
WHEREAS, Wellington N. "Bud" Dickson passed away on May 4, 1977, at the
age of 73;
NOW, THEREFORE, BE IT RESOLVED that the Edina City Council does hereby
express its most sincere condolences to the family of
WELLINGTON N. "BUD" DICKSON
at this time of bereavement; and
BE IT FURTHER RESOLVED that a copy of this Resolution be spread upon the
pages of the Minutes Book of the Edina City Council and that suitable
copies be presented to Mrs. Dickson and to William.R. Dickson and to
Wellington N. Dickson, Jr.

RESOLUTION OF CONDOLENCE
WHEREAS, as a long -time resident of the City of Edina, John W. Windhorst,
Sr., has been well known in the activities of the community and a leader
in the political scene; and
WHEREAS, over the years, John W. Windhorst, Sr., served as a founder and
President of the Citizens' League, as President of the Citizens' Organiza-
tion for Responsible Government, as Board Chairman of the Minnesota
Orchestral Association from 1974 to 1976, as President of the Minneapolis
Club in 1971, and as a member of the Edina Governmental Commission; and
WHEREAS, as a leader and..founder_of._the.Colonial Church of Edina and as
Board Chairman of the Minnesota Conference of the United Church of
Christ from 1964 to 1969, John W. Windhorst Sr.,. contributed generously
of his vast wisdom and expertise; and
WHEREAS, from 1950 to 1957, John W. Windhorst, Sr., as a member of the
law firm known today as Dorsey, Windhorst, Hannaford, Whitney and Halli-
day of which he was later to become a senior partner, John W. Windhorst,
Sr., served as Attorney for the Village of Edina, providing the Council
with sage advice during the formative years of the Village; and
WHEREAS, John W. Windhorst, Sr., passed away on May 3, 1977, at the
age of 64;
NOW, THEREFORE, BE IT RESOLVED that the Edina City Council does hereby
express its most sincere sympathy to the family of
JOHN W. WINDHORST, SR.
at this time of bereavement; and
BE IT FURTHER RESOLVED that this Resolution be spread upon the pages of
the Minutes Book of the Edina City Council and that appropriate copies

(Jerry's Enterprises).
Refer to: attached survey illustrating existing
and proposed parcels.
Jerry's Enterprises, Inc., has been attempting to develop separate
vacant and zoned parcels,of land between the grocery store and hardware
store.
Several months ago the necessary setback, parking, and other variances
were granted to allow the proposed multi - tenant commercial building adjacent
to the grocery stogie. Subsequently, a building permit was granted and has
been extended pending commencement of construction delayed, apparently due
to difficulties in securing financing.
It is now apparent that there will be three separate-mortgage companies
which require three distinct parcels. In addition, due to a party wall
agreement between the old and new structure a stip of land 114' in length
and varying in width from 70 feet to .1.70 feet will be transferred from the .
southerly tract to the middle tract.
Recommendation: Despite the apparent complexity. of the division, the requested
action conforms to the City's standards for simple lot division, i.e.
the existing parcels are platted and no additional buildable parcels.will be
created.
Approval is recommended'because the proposed division is a minor adjustment
of the property lines and consistent with the approved construction plans.
The staff would recommend the contingency that the north parcel (Tract III)
be attached to the Jerry's Tract B.in R.L.S. No._ 1393..

5. Lot Division Gregory D. Gustafson. Generally located south and
LD -77 -11 east of Vernon Avenue and west of Brookside Avenue
(Jerry's Enterprises)
Mr. G. Hughes showed the general location of the site and explained it
was located between Jerry's hardware and grocery store. Mr. G. Hughes noted
in the staff report that several months ago necessary parking, setback, and other
variances were granted to allow :a proposed multi- tenant commercial building.
He said subsequently a building permit was granted and has since been extended
pending construction delays due to financial reasons.
Mr. G. Hughes said it has now become apparent that there are three mortgage
companies involved.which require three distinct parcels for«ortgage purposes.
He explained that the requested lot division proposed the consolidation of a
number of lots that presently.exist on the site.
Mr. G. Hughes proceeded to show a graphic illustrating the present seven
separate parcels and their consolidation into three parcels. He then said staff
has discussed with the proponent the possibility of platting the property to
siipplify the legal description; however, according to the ordinance, despite
the apparent complexity of the division, a lot- division.does..qualif.y in this
instance because no additional buildable lots are being created.
Staff recommended approval of the requested lot division in that it is only
a minor adjustment of the property lines and is consistent with the approved
construction plans for the site. Approval, however, should be. contingent on the
attachment of Tract 3 to Tract B of Registered Land Survey No. 1393.
Mr. Greg Gustafson was present and said the lot division would affect no
other property owners other than the one concerned, Jerry' -s Enterprises, Inc.
He further said they applied for a lot division rather than a plat because of
financial reasons and lack of time.
Mr. Kremer moved for approval of the proposed division for -the reasons stated
by the staff and with the contingency as stated in the staff report. Mr. Runyan
seconded the motion. All voted aye.. Motion carried.

Some time ago, the owner of Lot 3 requested a variance from the City
in order to construct the garage closer than the required side yard setback.
At that time, staff advised the owner of Lot 3 that a lot division should be
prepared which would realign the lot line between Lots 2 and 3 in order
to provide an adequate side yard setback for the proposed garage-without the
necessity of a variance. This proposed lot division is agreeable to both the
owners of Lots 2 and 3. As proposed, the lot division would provide an additional
nine feet of width at the front lot line.
Recommendation: Staff recommends approval of the requested lot division in
that it will allow the construction of the proposed garage without the need
for a variance.

Mr. G. Hughes explained the location of the request and recalled that
some time ago the owner of Lot 3 requested a variance from the City to construct...
a garage closer to the minimum side yard setback as established in the zoning
ordinance No. 811. He continued that at that time, staff had advised the owner
of Lot 3 to meet with the owner.of the adjacent-lot (Lot 2) and prepare a
lot division which would realign.the lot line between lots 2 and 3 to allow
a larger side yard setback for the.proposed,garage, thus eliminating the need
fora variance. Mr. G.-Hughes said the owners of Lots 2 and 3 have met and
agreed upon the proposed lot division which would create an.additional nine feet
at the front of Lot 3 and an additional nine feet to the back of Lot 2. Staff
recommended approval of the proposed lot division in that it will eliminate the
necessity of a variance for the construction of the proposed garage. Mr. C. Johnson
moved for approval of the proposed lot division for the reason stated by the staff.
Mrs. McDonald seconded the motion. All voted aye. Motion carried.

quadrant of 66th Street and Highway 100. It is presently a registered land survey
with two tracts, A and B. He further said the proponent is requesting
permission to move the present division line between the two tracts of land
40 feet easterly to provide for an additional side yard area for the structure on
Tract A. Staff recommended approval because the division would provide additional
desirable side yard area for the structure on Tract A.

At Council Meeting last night, the proposal to separate Lots 7 and 8,
Griffis Subdivision of Block 18, was presented. During the discussion,
the question came up of when the property was conbined into one lot
and we pulled the attached record card in order to try to reach a
conclusion. It is very difficult for one unaccustomed to the Assessing
Department records to find out really what happened. I think there was
a division of other lots that had been previously owned by the Byes a
couple of years ago, but it is difficult to determine by the card. I
would think we ought to carry a little bit better history on a card
like this that can be readily understood.
When were Lots 7 and 8 combined and by what action? Were Lots 7 through
12 originally one parcel? The legal problem is whether, because the lots
were platted many years ago before the zoning ordinance required larger
lots, a building permit can be issued for the lot on which the old house
does not stand.

Many years ago, two 50 -foot lots were combined for tax purposes. The
proponents are now requesting to separate those two lots so they each
would be buildable (there presently is a house on the southernmost lot) .
Most of the lots on this side of the street are"50 feet 4Tide. On the west side
of the street, the lots are generally quite a bit larger. Because this
property was originally platted as two lots, the owners undoubtedly had some
dependence on the fact that there would to two lot-- evcntaally. They built.
their home with an adequate setback to allow for a second homesite.
Recommendation: Staff recommends approval of the proposed property division

Mr. Luce explained the general location of the request and presented a
graphic which illustrated the existing condition. He said the lot was originally
platted as two separate 50 -foot lots but for tax purposes, they were combined into
one 100 -foot lot. The proponent is now requesting to divide the present lot into
the two original lots. Mr. Luce noted the lots would not meet the minimum width
of 75 feet established by the Zoning Ordinance; - however, it should be noted that the
lots on the same side of Arthur Street are primarily 50 -foot lots but lots on the
other side are generally larger, consisting of some 100 -foot lots which have never
been divided. Staff recommended approval of the lot division contingent on the
cash parkland dedication in the amount of $200.00. The proponent was present.
Mr. Lewis felt the proponent should be allowed to divide the lot into *two
50 -foot lots, as it was originally platted. Mr. Robert Bonnett, 6501 Waterman
Avenue, said the entire neighborhood was now completely developed with the exception
of Lots 7 and.8 and that recently Mr. Roy Tor;,pkins, the proponent, developed Lots
9, 10, 11, -and 12 to the south of the property. Mr. Bonnett took issue with the
statement that the majority of homes are built on 50 -foot lots in that many lots
were 100 -foot lots. He emphasized the proposed lot division does not meet the 75-
foot minimum required. Mr. Luce said the majority of the lots are 50 feet wide but
where the road is vacated there is a 75 -foot lot. To clarify the parkland dedication
procedure, Mr. Luce said the amount of the parkland dedication is determined from
the raw land value, which is very much different from what someone would purchase the
lot for, as it is considered without the utility services, etc. Mr. Bonnett con-
tinued that the lot sizes on the other side of the street are generally 9,000 square
feet and the proposal includes 7,250 foot square lots. Mr. George Gould, 6516
Waterman Avenue, also expressed his objection to the proposal, as did Richard DeLeo,
609 Waterman Circle. After lengthy discussion, Mr. Kremer moved for denial of the
proposed lot division because the lots would not meet the minimum square footage
requirement under the current zoning ordinance. Mr. Runyan seconded. All voted
aye. Motion carried.
