Oliver Development Company. Blake Ridge Estates. Gen-
erally located south of Vernon Avenue and west of Olinger
Boulevard. PRD -3 Planned Residential District to R -1
Single Family Residence District.
Refer to: attached preliminary plat, Blake Ridge Town-
house Plans, Green Hills of Edina Subdivision.
Approximately five years ago, the subject - property was rezoned from R -1 Single
Family Dwelling District to PRD -3 Planned Residential District for the purpose of
constructing 82 townhouse units (refer to attached plans). Since that time, 20
townhouse units have been constructed on the northern portion of the site and
10 more units are scheduled for construction in the near future.
Since the 1972 PRD-3 rezoning, ownership of the subject property has changed
several times; the present owner is now requesting that Lots 2 and 3,-Block 1, of
Green Hills of Edina (southern two thirds of the townhouse project) be rezoned back
from PRD -3 to R -1. The proponent is also. requesting a 17 -lot subdivision of the
property. Lots sizes range from 12,325 square feet to 24,125 square feet.
The original townhouse plans proposed a rather large open space area located
in the center of the project and immediately south of the existing townhouses.
Based on'the assumption that the townhouse project would continue, the original
owners of the property were allowed to plat the boundary line between Lot 1 and
Lots 2 and 3 very close to the existing townhouses (six feet at one location).
Staff believes that individuals that purchased townhouses on the northern por=
tion of the site did so with some assurances and confidence on the continuation of
the townhouse plan. In that the proposed single family development would eliminate
the large open space area and would be uncomfortably close to the existing townhouses,
staff has requested that the proponent provide a 35 -foot wide open space easement
between the townhouses and single family lots. Staff has also requested a similar
easement along the remaining perimeter of the development to provide a buffer between
the single family structures and Bredesen Park. The proponent has agreed to pro-
vide such easements.
Recommendation: Although staff believes that the continuation of the townhouse
plan would be most desirable, staff would recommend preliminary plat and rezoning
approval in that:
1. The proposed land use and lot sizes are consistent with surrounding properties.
2. A single family development is a, logical transition between the townhouses and
Bredesen Park.
3. The proposed open space easements should provide an adequate buffer zone for
the development.

Since the July 6, 1977, Planning Commission meeting, staff, the proponent, and
representatives of Blake Ridge Townhouses have met on several occasions in'order
to.formulate an acceptable division of Lots 2 and 3, Block 1, Green'Hills of Edina._
Attached is a revised preliminary plat which is apparently acceptable to the pro-
ponent as well as the townhouse owners (see attached letter).
The revised plat proposed to eliminate the 35 -foot wide scenic easement originally
Located between the to %mmhouses and the single family development. In place of
the easement, an outlot measuring from 10.feet in'width to 35 feet in width is
proposed:to be deeded to the townhouse association. On the advice of staff, the
proponent has also deleted the 35 foot easement abutting Vernon Avenue in that
such an easement will provide no useful buffering effect.for Bredesen Park. The
easement along Olinger Boulevard, however, will remain as previously proposed.
Recommendation_: Based upon the apparent agreements reached among all parties con
cerned, staff recommends plat and rezoning approvals in that:

Mr. G. Hughes explained the general location of the subject property and
recalled that approximately five years ago, the property was rezoned from R -1
Single Family Residence District to PRD -3 Planned Residential District to allow
construction of 82 townhouse units. He said there are presently 20 constructed
townhouses on the north 1/3 of the site and 10 additional townhouses are scheduled
for construction in the near future. He noted that as part of the original town-
house project, a rather large open space area was proposed for the central portion
of the site and south of the existing townhouses. He said the property was platted
at that time into three lots; Lot 1 being the location of the existing townhouses
and Lots 2 and 3 the subject property which is proposed to be rezoned from PRD -3
to R -1 and subdivided into 17 single family lots. Mr. G. Hughes indicated the
lots are large in size and range from 1,000 to 24,000 square feet.
Mr. G_.Hughes noted that when the property was originally platted, the
continued townhouse development was anticipated; therefore the owners were allowed
to plat the boundary lines very close to the existing townhouses, with one loca-
tion being only six feet from the lot line.
Mr. G. Hughes said that at staff level, they believe that most individuals
purchased townhouses on the north side with assurance of future continuation of
the townhouse project and open space area, and that, because this proposed single
family development would eliminate the large open space area, staff has requested
the developer to provide a 35 -foot open space easement between the townhouse
development and rear portion of the single family lots. He said.staff also
recommended a similar easement along the remaining perimeter of the development
varying from 30 -35 feet to provide a buffer between the single family dwellings
and Bredesen Park.
Mr. G. Hughes said staff felt the townhouse development continuation would
be most desirable, but recognized single family use as a possible land use and
logical transition between Bredesen Park and the townhouse development. He said
staff was concerned with the technicality of the easements and would want their
approval. by staff prior to final approval. He said staff would recommend approval
of the subdivision and rezoning for the following reasons:
1. The proposed land use and lot sizes are consistent with surrounding properties.
2. A single family development is a logical transition between the townhouses
and Bredesen Park.

Mr. G. Hughes recalled this request was reviewed by the Planning Commission
at their July 6, 1977, meeting and explained the location of the property in
question as being bordered on the west by Olinger Boulevard and on the north by
Vernon Avenue and Blake Ridge Townhouses. He said the proponent brought in his
request approximately a month ago proposing to subdivide the southern two -thirds
of the townhouse project into 17 single family lots. Staff had suggested at that
time a 35 -foot easement be provided between the proposed single family lots and
existing townhouse development. Mr. G. Hughes said that during the past month,
they have met with representatives from the townhouse association as well as the
proponents in an attempt to resolve differences encountered at the last Planning
Commission meeting. He said the.result of those meetings was basically the elimi-
nation of the easement area between the townhouses and single family dwellings
which was replaced by an out)ot which varied from 10 to 35 feet in width. This
outlet would be dedicated by the proponent to the townhouse association. He con-
tinued that on staff's advice,' the proponent had deleted the 35 foot easement along
Vernon Avenue in that such an easement would provide no useful buffer for Bredesen
Park; the 35 -foot easement along Olinger Boulevard would remain as proposed.
Mr. G. Hughes referred to a letter addressed to himself from Arthur Ed-
wards, President of the Blake Ridge Corporation, Egil wefald, Chairman of
the Architectural Committee, and Jonathan Scoll, Industrial National Bank of
Rhode Island, which indicated that all parties agreed at this point to the trans-
fer of property and the proposal and that. they were authorized to act as agents
for the townhouse association.
Mr. G. Hughes said staff recommended approval of the rezoning and subdi-
vision request for the following reasons:
1. The proposed land use and lot sizes are consistent with surrounding properties.
2. A single family.development is a logical transition between the townhouses
and Bredesen Park.
3. The proposed outlet and open space easements should provide an adequate buf-
fer zone for the proposed development.
Approval sho»ld be contingent.on:
1. Access to all proposed lots must be from Olinger Circle. No driveway curb
cuts will be allowed on Olinger Boulevard.
2. Dedication of Outlot B'to Blake Ridge Townhouses at the time of final approval.
3. Submission and approval by the C }ty of a suitable landscaping plan for the
easement area prior to final approval.
4. An executed Developer's Agreement.
5. A grading permit from the Nine Mile Creek Watershed District.
6. Vacation and /or realignment of existing utility easements on the subject property.
Mrs. McDonald questioned the reason for naming the new street Olinger
Circle,noting an Olinger Circle already existed in Edina. Mr. G. Hughes said they
were not aware of that, but that the street could be renamed.
In response to Mr. S. Hughes., Mr. Mike Posnick, Oliver Development Company,
said tennis courts would no longer be constructed because of the strong objection
by townhouse residents. He further -aiO. they had previously discussed with staff
the possibility of converting the originally proposed tennis courts site to a
single family lot. To accomplish this, however, they would have to move the lot
lines eight feet on each side.
Following brief discussion, Mr. S. Hughes moved for approval of the requested
subdivision and rezoning for the reasons and with the contingencies stated by staff .
and with the additional condition the name of the proposed street be changed.
Mrs. McDonald seconded. All voted aye. Motion carried.

Request: 104 percent sign area variance.

Eberhardt Company is requesting permission to modify the existing
non- conforming freestanding building identification sign by adding the
words "Property Managers" in the same size letters as the words "Realtors and
Mortgage Bankers." The existing sign is 36' -4" by 2' -3" which is 81.75 square
feet. The proposed sign will be approximately 2' -3" by 51 feet which equals
114.75 square feet. The property is zoned Office District 0 -1 which is
allowed one building identification sign of 50 square feet. Corner lots are
allowed an additional 36 square foot sign. The requested variance will
allow a sign much more than twice the normally allowed sign, if approved.
Please note that the sign area is measured by the smallest rectangle that
can be placed around the entire sign (letters only, the brick wall has not
been included in the area).
The proponents applied for a sign variance in 1971, which was
denied.
Recommendation: The requested variance is grossly in excess of the district
requirements which have been adhered to by adjacent property owners. The
proponents have not demonstrated any unique or exceptional circumstances
that justify the variance. There is no substantial property right to pre-
serve because adequate identification of the site has not been denied and
the proponent can modify. the existing sign or construct a new sign within the
district sign area requiements. The staff views the proposed variance as
detrimental to the public welfare because the up to: now, well- enforced sign
ordinance would be weakened by an undesirable precedent. Therefore, the staff
recommends denial of the requested variance.

Last summer I contacted you regarding the condition of Melody Lake
after the Highway 100 construction.
In your letter of July 29, 1976 you suggested monitoring the lake
during the fall rains to better determine the siltation problem.
As we know there were no fall rains. Now that we have had a few
spring rains even a quick glance at the lake clearly shows it is
being rapidly transformed into a mud hole.
Your letter also seemed to contain a certain amount of reservation
or "buck passing" when you stated that the Highway Dept, had followed
the D.N.R. permit. It doesn't seem it should be necessary for the
I•'.elody Lake property owners to have the Court expense of determingng
what governmental body is at fault. It does seem reasonable that
the various departments use their combined skills to come up with
a solution to the problem.
Your letter does indicate a concern which hopefully means you will
get the proper wheels in action to correct and prevent further
deteriation of Melody Lake.
I would like to meet with you some time the early part of next week
to determine what action is going to take place. I will be happy to
meet at your office or perhaps even better we should meet at my home
or the pump station site where we can visually see the problem. l ou

RESOLUTION
WHEREAS, construction plans for Trunk Highway 100 between 74th Street
and Valley View Road, which included the installation of a 12' high wall to
be constructed between the off -ramp from westbound Crosstown Highway to
northbound Highway 100, for a distance of 350' northwesterly from 62nd
Street, were approved by the Edina City Council on March 21, 1977, and
WHEREAS, this wall had been contemplated by plans of the Minnesota
Department of Transportation which were fully explained to property owners
at an informational meeting on January 30, 1975, and
WHEREAS, after construction work which will include the noise abatement
wall started about July 5, 1977, affected residents requested that the City
of Edina reconsider its approval of the construction plans, and
WHEREAS, a poll of 36 residents who would be directly or indirectly
affected by the construction of the wall resulted in 27 of the residents
signing the following statement: "I do not desire to have the noise wall
constructed, realizing that if it is not built the State Department of
Transportation will not consider later requests for noise abatement facilities
in this area ", with only 4 favoring having the noise wall constructed as
originally proposed,
NOW, THEREFORE BE IT RESOLVED, that in view of the feelings of a signi-
ficant majority of the affected residents, the City Council of the City of
Edina direct the Minnesota Department of Transportation to delete this noise
abatement wall from the construction.

The following is a summary of my investigation of the Godfather Develop-
ment application for a 3.2 On Sale Beer License at 3650 Hazelton Road, a
business building previously owned and operated by Nelson's Family
Restaurant.
Godfather Development (Pizza Restaurants) are not affiliated with.the
Godfather Italian restaurant at 66th Street and Lyndale in Richfield.
Godfather Development are presently planning on opening two more rest-
aurants in the Greater Minneapolis Metropolitan area. One in Fridley
and the other in New Brighton.
James Hill the Public Safety Director. of Fridley said construction has
started on their building in his community and he has found no reason,
to refuse their application for a 3.2 On Sale Beer License, so it has
been approved.
Paul Holmes the Chief of Police in New Brighton.said they have not
started construction of their building in his community yet and he
does not know of any reason not to approve their 3.2 On Sale Beer License
application.
There are presently only two Godfather Pizza restaurants operating in
the State of Minnesota at this time that are affiliated with Godfather
Development. One is in Mankato and the other in Albert Lea.
The franchise in Mankato is owned by Ken Yackel, John Hagan, and James
Grove,.and has been in business since April 1977. All three of these
owners are listed as references on the Edina application -for -a 3.2 On
Sale Beer License. A telephone conversation with John Hagan gave me
this information.
I called Richard Alstad the Chief of Police of Albert Lea, and he told
me that Godfather Pizza has been in business since September 1976 in
his community. He said the Police Department has not had any problems
with them. However, he did say their restaurant has pinball machines
in it, which has caused an attraction and hang out for younger people.
This might be something we should consider as a possible problem if
they intend on putting them in their restaurant in Edina.

I see no reason that we should not approve their 3.2 On Sale Beer License
application based upon the information I was able to obtain.

SUBJECT: Management Study Update
As a result of the management study conducted during the latter half of 1976, Cresap,
McCormick and Paget outlined a Management Improvement. Plan and a recommended timetable
(see attachment). This document.is intended as an update of the police department's
activity in implementing that plan.
_Approximately fifteen steps are herein reported on. The evaluation of each step is
primarily a subjective evaluation prepared by the Chief of Police and is presented for
-your review and critique. Not all of the study's recommendations are included in this
report. These recommendations are currently at the police department.divisional level
and are being evaluated and implemented.
Generally speaking, the management study should be viewed as having had a very posi-
tive impact on the police department. First of all, it confirmed a number of aspects
of police work that the department was doing very well. Secondly, it identified a
number of discrepant areas in the department that may have been difficult, albeit
impossible, to identify internally. Lastly, after considerable analysis, it assisted
the department.in establishing "direction" for the considerable energy and expense
expended in "policing" the community.
The fifteen action steps are identified below, and a brief summary of their status is
included.
ACTION STEP 1 - "Prepare mission statement and obtain approval of City Council."

The mission statement has been developed: "The mission of the Edina Police
Department is the service and protection of the community within the trusts
and expectations placed in the department by the citizens."
This mission statement was included in 1978 budget preparations, and remain-
ing coordination through the City administration and government will be
sought.
Action Step 1 -- 90% completed.
ACTION STEP 2 - "Define and assign planning and research functions."
Planning and research functions are currently being assigned within the
police department in an adequate manner. The study recommended a singular
staff position for this activity. In reality, all staff personnel are
involved in research and planning, and this practice will be continued. The
position has been solidified and incorporated with the training function.
Action Step 2 -- Completed.

ACTION STEP 3 - "Develop goals and objectives."
A statement of goals and objectives was developed simultaneously with the
development of a mission statement. This is currently complete at the
organizational level and will soon be developed at the divisional level.
Action Step 3 -- Completed.
ACTION STEP 4 - "Adopt new organization."
This step was completed as of April 1, 1977. Edina Police Department General
Order No...7 -5 outlines the organizational structure and incorporates the job
descriptions of the various positions.
Action Step 4 -- Completed.
ACTION STEP 5 - "Imbalance patrol shift assignments."
"Imbalancing" was initiated on April 1, 1977, simultaneously with the establish-
ment of-the three - platoon system. Initially, the setting of the work schedule
in this manner was entered into the grievance procedure by the employee bargain-
ing group. It was determined by the City to be a management right and was not
recognized as a grievance. To date, this action is continuing.
Action Step 5 -- Completed.
ACTION STEP 6 - "Define and adopt new beat zone pattern."
A new beat zone pattern was established as of May 1, 1977. It is predicated on
calls for service and relative strength of police resources at any given time.
The system is.simple yet comprehensive,'-and-equitably allocates resources to
sections of the City.
Action Step 6 -- Completed.
ACTION STEP 7 - "Intensify responding officer's preliminary.investigation efforts."
This recommendation has been implemented as fully as possible given the
organizational structure and level of training of department personnel. The
patrol officer's involvement has been increased by supervisory emphasis and
review. Future improvement in training will further enhance the action step.
Action Step 7 -- Completed.

ACTION STEP 8 - "Take necessary steps to improve management of investigative
functions."
Initial steps dictated by this recommendation have been initiated. A master
case log and specific case assignments.are now in effect. The case priority
system and the quality review case closure system should not be undertaken
lightly or. rapidly. In -house research will be conducted prior to a firm
policy. A target date of October 1, 1977, will be for the full
implementation of the investigative management system.
Action Step 8 -- 30% completed.
ACTION -STEP 9 - "Develop and implement personnel evaluation system."
A performance appraisal system based on the Cook County, Illinois Sheriff's
Department was adopted. This form was expanded upon and the draft was completed
August 1, 1977. During the balance of 1977, a trial appraisal will be conducted
with the form, and it will be officially made a matter of record on December 31,
1977, for the second -half 1977 performance review.
Action Step 9 -- 50% completed.
ACTION STEP 10 - "Clarify promotional procedures and criteria."
Promotional procedures were established through the working process of pro -
motions to intermediate command within the police department. The sergeant
promotion shortly after that time was consistent with the original procedure.
Future promotions in 1977 will follow the same pattern. In the future, the same
criteria will be utilized with the possibility of interjecting the personnel
evaluation assessments depending on their validity.
Action Step 1.0 - Completed.
ACTION STEP 11 - "Implement 'Master Patrolman' designation."
This step has not been acted on and no plans have been made for future imple-
mentation. The department has recently experienced an expansion in its
supervisory ranks: that has tended to stratify the organization. Class dis-
tinctions in the patrol ranks could be detrimental to unity at this time, and
the action step has been discounted on that basis.
Action Step 11 -- No action.
ACTION STEP 12 - "Intensify use of information systems."
Improvement in this area-has been undertaken. The new beat zone patterns were
based on a statistical analysis of calls for service. Response time studies
have been made and will continue as a part of the management emphasis of the

department. The greatest difficulty in this area is the accessibility of
information that has been collected.. Currently, information is being gathered
on improving accessibility of information through LOGIS. Estimated completion
date is 12- 31 -77.
Action Step 12 -- 75% completed.
ACTION STEP 13 - "Improve departmental training programs."
Departmental training is currently being upgraded.. -Procedural and policy
training is being conducted at the platoon level by supervisors. The 1977
budget reflects a major effort to upgrade training - through attendance at
formal police schools and .seminars. The volume of training will be somewhat
reduced; however, the quality will be improved.
Action Step_13 -- Completed.
ACTION STEP 14 - "Designate evidence room officer and improve procedures for handling
physical evidence."
Three objectives were formulated concerning physical evidence: security,
accountability, and accessibility. As of May 1, 1977, an officer was designated
the responsibility of property management, including evidence,.and as of May 20,
1977, an evidence handling procedure was established which fulfilled the
objectives and fully implemented the action step.
Action Step 14 -- Completed.
ACTION STEP 15 - "Develop supervisory training program."
This step was..impaemented at the time of the intermediate commander promotions.
The promotees- entered one month of intensive training which.included the use
of outside resources. Shortly thereafter, all new promotees.entered the ICMA
Police Administration Course. Additionally, during September,1977, all police
department supervisors will participate in the BCA Intermediate Command School
which will be conducted in Edina. This action will be updated and future
activities will be based on needs as they are identified.
Action Step 15 -- Completed.
The above statement is a brief update on priority action steps recommended for the
police department. Great progress has been made in these and other areas. The
recommendations of the management study have been the catalyst to move the police
department to improving itself. Future updates will be forthcoming.

RESOLUTION
WHEREAS, citizens and property owners in the Melody Lake area are very much
concerned about the present condition of Melody Lake; and
WHEREAS, it is alleged by these citizens and property owners that the present
condition of Melody Lake is a result of the T.H. 100 reconstruction project;
and
WHEREAS, a number of agencies (among them the Minnesota Department of Trans-
portation, the Minnesota Department of Natural Resources, the Nine Mile Creek
Watershed District, the Minnehaha Creek Watershed District and the City of
Edina) have been involved in the planning, approvals and supervision of con-
struction of the T.H. 100 project as it affects Melody Lake; and
WHEREAS, it appears to the City Council of the City of Edina that the Minnesota
Department of Transportation as constructing agency with full responsibility
for the project area until November 1, 1977, should take the lead in the
determination of and correction of problems with Melody Lake that do exist or
may be expected to develop as a result of the T.H. 100 reconstruction;
NOW, THEREFORE, BE IT RESOLVED that the Minnesota Department of Transportation
assume the responsibility for bringing together interested citizens, property
owners and all involved agencies so that a determination can be made of the
effect of the T.H. 100 reconstruction on Melody Lake presently and in the
future, and appropriate measures instituted to correct existing problems and
prevent future problems; and
BE IT FURTHER RESOLVED that the date of transfer of T.H. 100 from the State of
Minnesota to the City of Edina be postponed until after such problems have
been alleviated; and
BE IT RESOLVED FURTHER that copies of this resolution be transmitted to the
Minnesota Department of Transportation, the Minnesota Department of Natural
Resources, the Nine Mile Creek Watershed District, the Minnehaha Creek Water-
shed District, the Office of the Attorney General and to Representative Mary
Forsythe.

In response to the appearance at the Council meeting August 1, of residents
who do not wish the approved noise abatement wall to be constructed by the
State, we circularized a total of 36 addresses on 62nd Street and in the
6100 and 6200 blocks of Ryan and Parnell Avenues.
Attached is a listing of the responses which shows that 27 are opposed to
the construction and 4 are in favor. Also attached is a copy of the letters
we sent and a statement sent by Mr. Binger.
In view of the preponderance of the opinions against construction, I asked
William Crawford, District Engineer, to put a hold on the contractor, which
he did. He would like, however, for a Council resolution to be passed
requesting formally that the wall be deleted from the contract.

Subject:: Noise Abatement Wall Construction Affecting
Residents in the Area of 62nd Street and Ryan Avenue
Construction plans for T.H. 100 from Hibiscus Avenue to Valley View. Road
were approved by the Edina City Council on March 21, 1977. These plans
include "noise attenuation devices" consisting of combinations of earth-
mounds and concrete walls of varying heights throughout most of the project.
These walls and mounds were incorporated into the plan by the Minnesota
Department of Transportation after an informational meeting on January 30,
1975, invitations to which were mailed to property owners immediately
adjacent to the project.
At the August 1 meeting of the City Council, three of the residents in the
area appeared to ask what could be done to eliminate the construction of this
noise abatement wall. F72 are advised by Mr. Dennis Luoto, project cnbincer,
that the actual construction is due to be started about August 15 and if a
majority of the affected residents so desire, the wall can -be eliminated.
However, if a decision is made that the wall is not wanted now,'the.State
Department of Transportation will_ not in the future consider any requests
for any type of noise abatement construction in the area.
In view of the short time before .construotion will'start, will you please
give this matter your immediate consideration and indicate your-desires on
the bottom of this letter, signing your name, please. Then please return.it
to me by Monday, August 8:

Dear eighbor,
As the residents mentioned in the letter you received from the
Edina Village Office on Friday pertaining to the noise abatement
wall, we would life to point out several facts not mentioned.
The pattern of the gall does not follow the contour of the clover-
leaf but parallels 62nd for approxioately the last third and will
actually increase the noise level for those residents south of 62nd
on Ryan and Parnell as they will be e)-.Dosed to the back: of the gall
A, noise reflection.
It's common knot: *ledge that the effectiveness of these walls is poor
where installed. Check if you have friends near one. They.cut off
the view, the breeze and cause the snots to drift in the wintertime,
v-hich is already bad. As for appearance, tai,e a drive dorm Highway
35.1, south of the Crosstown. That isn't t: *hat'we would like to see
in our nei- hborhood and we hope you feel the same.
The questionnaire letter from the village off ice must be in the
hands of the village by I•onday. To insure your 1710. vote ,netting to
the village office on tine, please deliver the question_na -1 re to the
village office over the weekend, or drop it off at 11. D. Binger's,

Hall, 4801 West 50th Street, at 11:00
A. M., Friday, August 5, 1977, and the
Edina City Council will meet at 7:00
P. M., Monday, August 15, 1977, at the
City Hall to consider said bids, being
for the following:
Installation of underground water-
ing systems at three parks: Pamela
Park located at 60th and Oaklawn;
Garden Park located at Vernon
Avenue and Hansen Road; and
Lake Edina Park located at West
76th Street and Kellogg Avenue.
Bids must be in conformance with
specifications which are available at
the Edina City Hall. No bids will be
considered unless securely sealed and
filed with the undersigned before 11:00
A. M., Friday, August 5, 1977, accom-
panied by bid security equal to at least
10% of the total net bid.
The City Council reserves the right
to reject any or all bids or any part

Dear Mr. Hyde:
Enclosed herewith for your information and file please find a copy
of a Stipulation of Dismissal with Prejudice in the above - captioned action.
The receipt of this Stipulation means that the City of Edina has been dis-
missed as a defendant in this lawsuit with no further exposure of any kind.
We were successful in persuading the plaintiffs' attorney that his claim
against the City was baseless as a matter of law. In so doing, we relied
upon the Minnesota Supreme Court decisions which hold that a city's building.
codes and building inspections are matters purely of public regulation for
the benefit of the community, and that the failure of a city to adequately
enforce these codes.or property inspect construction does not give rise to a
private right of action on the part of an individual homeowner.
You will note that the Stipulation has been signed on behalf of the
City of Edina by Judy Rogosheske of our Firm. This matter was originally
scheduled for trial during a week in which I had a conflicting trial assign-
ment. Judy agreed to prepare the case for trial in my absence and was instru-
mental in obtaining this Dismissal for the City.
Once again, it has been our pleasure to be of service to you in
this matter.

We, the undersigned residents of Parkwood Lane, petition
the Edina City Council to remove the One Way street on Dovre
Drive for the following reasons:
1. The One Way street causes excessive traffic on Parkwood
'Lane endangering the 21 children living in the 12 houses
on the street. 15 more children will move into the five.
houses to be completed in the next three months.
2. The hill and 90 degree turn on Parkwood Lane are
permanent street traffic hazards heightened by excesssive
traffic.
