Hughes, City Planner SUBJECT: Ordinance Amendment to Allow Laundries as a Principal Use in C -1 Commerical Districts On November 2, 1977, and November 30, 1977, the Planning Commission considered an ordinance amendment which would allow laundries in the C -1 zone. After review of this amendment as well as a proposal by Edina Cleaners and Launderers to expand its present operation into the Westgate Theater build- ing, the Planning Commission recommended adoption of the attached amendment to the zoning ordinance. This ordinance would allow laundries in C -1 zones but would limit the size of the floor area devoted to laundry process- ing to 2500 square feet. The proposed ordinance amendment would make the Edina Cleaners an allowable principal use at its present location. However, the Edina Cleaners would nevertheless have to obtain a variance from the Board of Appeals to facilitate its proposed expansion into the Westgate Theater in that the area proposed for laundry processing would exceed 2500 square feet. On November 30, 1977, the Planning Commission further recommended to the Board of Appeals that variance be granted to allow the proposed expansion project. GH:nr cc: Mayor and City Council PLANNING COMMISSION STAFF REPORT November 2, 1977 Zoning Ordinance Amendment to allow laundries- as a principal use in the C -1 Commercial District. Refer to: Attached Ordinance Amendment Some time ago, the Edina Cleaners and Launderers, 4500 France Avenue, requested permission to expand its present dry cleaning and laundry into the rear portion of the Westgate Theater building. At that time, staff advised the proponent that: 1) the existing laundry site and theater are presently zoned C -1, 2) laundries are not an allowable use in C -1 districts and thus the present laundry is a non - conforming use, 3) laundries are allowed in C -2 districts provided that the rooms containing the laundering process do not exceed 2500 square feet. It was determined that the existing laundry and dry cleaning establishment contains approximately 7,000 square feet,' although the exact area devoted to laundering processes was not determined. The proposed expansion of the laundry facility would add approximately 3000 square feet. Staff further advised the proponent that to accomplish the requested expansion, the City would have to either rezone the property C -2 or amend the zoning ordinance to allow laundries.,.; as a principle use in C -1 Districts. If either of these actions were taken, however, we advised the proponent that a variance would be required to exceed the 25010 square foot limitation. Staff further advised the proponent that if he decided to pursue. the matter (which he elected to do), we would prefer that an ordinance amendment be prepared which would allow launderies in C -1 districts. Attached is such an ordinance amendment. Recommendation: Staff has serious reservations regarding the adoption of the proposed ordinance amendment. The zoning ordinance states that "the. requirements set forth with respect to District C -1 have been adopted.in order. to create a neighborhood service district for the purpose of retailing "convenience" goods such as foods and drugs and providing personal services such as barber shops and laundry stations for the accommodation of the basic day -to -day shopping or service needs of persons living or working within the nearby area." Therefore, it is staff's opinion with respect to laundries that it was and is the intent of the zoning ordinance that relatively small laundry "drop off" stations should be located in C -1 areas but that the processing of such laundry is more appropriately located in other areas of the City: It is also apparent that in C -2 districts, laundries should be limited in size (i.e. 2500 square feet) to avoid large industrial -scale laundry processing facilities. In regard to the Edina Cleaners in particular, the proponent has indicated that the present laundry serves a significant number of commercial and industrial clients. We would assume that with the proposed expansion of Planning Commission Staff Report Page 2 Re: Ordinance Amendment - Laundries the facility, the number of such clients would also increase. Therefore, Staff believes that due to the scale of the opertion, this business would more appropriately be located in an industrial area. Staff would also note the undesirable precedence which would be established by amending only one of the 49 principle uses allowed in C -1 areas and 47 principle uses in C -2 areas. Staff believes that it may be difficult to deny future requests to allow C -2 uses in C -1 districts if the proposed amendment is adopted. Minneapolis, Minnesota September 22, 1977 City Planning Edina, Minnesota Gentlemen; It has come to the attention of the business men on the corner of- Sunnyside Avenue and France Avenue South that the Edina Laundry Co. would like to purchase the land and building immediately adjacent to it, the Westgate Theater. We have checked the.rumor with the Edina Laundry Co. owners and found that the story is correct, but that it is not presently consummated because of a restriction in the zoning. They tell us that a variance is needed to the present zoning to make it possible. We have a selfish interest in this matter because of the number of people the Edina Laundry Co. brings to the corner. Traffic is important to us. We have checked with the Edina Laundry and they have confirmed the fact that many more customers come to their office now than cane there five years ago. This letter is sent to you to request that this variance be issued so that the Drycleaner can go forward with his plans to further his present service to the people of this community. W. Lewis, Chairman, Clifford Johnson, Gordon Johnson, David Runyan, Helen McClelland, Richard Kremer and Mary McDonald Staff Present: Gordon L. Hughes, Director of Planning, Harold Sand, Assistant Planner,, Karen Sorensen, Secretary II. OLD BUSINESS Ordinance A Zoning Ordinance Amendment to Allow Laundries as a Amendment principal use in the C -1 Commercial District Chairman Lewis commented that he had gone through the Edina Cleaners and Laundry facility and as a result had changed his mind about the proposal and was now very sympathetic to improving that corner. He stated that the proposed expansion of the laundry would get the debris off the street, take the entrance away from the corner and improve the. whole area. Mr. G. Hughes stated that representatives of the laundry were at the meeting to make the presentation. He then introduced Mr. Howard Dahlgren of Dahlgren and Associates. Mr. Dahlgren congratulated the Commission on the fine work they had done and were still doing in the planning and development of the City. He then introduced the people who were involved with the project. In attendance were Mr. Kodet from the architectural firm, Dickey and Kodet, Mr..Mike Gair from Dahlgren and Associates, Mr. Martin Stein, owner of the Westgate Theater and Mr. Wes Stotts and Mr. Dave Stotts, owners and operators of the Edina Cleaners and Launderers. Mr. Dahlgren noted that Mr. Stotts and Mr. Stein had been Edina residents for many - years. The first theater was opened in 1934 and later the Westgate theater, which has been run successfully. The Edina Laundry has been located on. Sunnyside since 1960. Mr. Dahlgren noted that approximately one -half of their business comes over the counter and most.of their customers are from Edina. In the C -2 District, a dry cleaners is allowed, but the laundry is not. Mr. Dahlgren presented a rendering indicating the zoning of the surrounding properties in the area. He noted that a petition had been circulated among the businesses in the vicinity as well as several R -1 areas. All of those persons who signed the petition were in favor of the proposal. He stated that all of the drawings and renderings shown tonight were all preliminary and also'noted that the proposal would have to go before the variance beard and at that time the details will all be shown. He noted that this is merely a concept plan of what the building would look like when completed. The proposal does not adversely affect anyone in the community, and in this location, they have functioned well. Mr. Dahlgren noted that conversions of theater buildings to other uses are difficult to accomplish. He stated that if the Cleaners were not allowed to expand into the theater, it may be very difficult to utilize the theater building properly. Excerpt from Planning Commission Minutes November 30, 1977 Page 2 Mr. Runyan stated that the whole look of the property would not be altered, there would not be any more mass than there is.pr.esently. Mr. Dahlgren stated that the only change in mass would be the removal of a large sign and there would be no change in the building size itself. We want to clean up the triangle; organize the appearance of the parking lot and improve the exterior of the building itself with rough cedar and tie it all together so that there will be some unity. Mr. Runyan then asked what was to become of the lobby area. Mr. Dahlgren stated that it maybee used as a lunch room for the employees as there is no lunch facility for the employees at the present time. A portion of it may be used as shops. A final determination of. its use has not yet been made. The laundry operation will operate off the parking lot. The entrance to the dry cleaning area will remain the same. Mr. Cliff Johnson asked if there would be a problem with the solvents and their storage. Mr. Stotts replied that the, Fire Department had made an inspection of the property and the dry cleaning plant had complied with all regulations by burying the solvent tank and all equipment met code, so there would be no difficulty with that. Chairman Lewis introduced Mr. Warren Hyde who madethe following comments on the proposal. What we are faced with here is a problem with a specific problem in the ordinance. We are dealing with two properties that have never been nuisances and have been good for the community. Mr. Hyde 'stated that somehow the proposed expansion ought to be accorn,modated..-He noted that the ordinance allows 2500 'square feet for these two services and the two of them together are about 7500 square feet which would require a variance of about 10,0.00 square feet, and that is quite large. It might be possible to consider each use separately rather than together so that the variances won't be so big. Mrs. McDonald stated that if we are going to amend the ordinance and still have the square footage and then go to variances - could we just go to variance without changing the ordinance? Mr. G. Hughes replied that it was his understanding that the City cannot grant a variance to allow "a use not specifically allowed by the zoning ordinance. The other existing C -1 Districts within the City are located at 70th and Cahill and Wooddale and Valley View. Mr. Kremer noted that economics would likely prevent another person from putting a laundry in a C -1 District. Mrs. McClelland stated that there could be some difficulty with other areas now in the C -1 District. Others may want variances also. Mr. Stotts, Sr., stated that he moved into the laundry building in 1960. He appeared before the then Morningside Council and at that time no square footage was mentioned. n Excerpt from Planning Commission Minutes November 30, 1977 Page 3 Mr. Runyan stated that he was in sympathy with the project and thought that since the proponent is not changing the mass of the buildings, it could make the whole area much nicer. It is appealing and could be a nice addition. Mr. Kremer stated that perhaps the best way to accomplish the proposed expansion would be to leave it C -1 so that in the years ahead we won't be saddled with all the other uses allowed in C -2 zones. He stated that to accomplish the expansion we should leave the property C -1, make laundries a permitted use in C -1 with a recommendation to the Council to grant variances; amend the ordinance to combine laundry and dry cleaning and making the limit 10,000 square feet in that district. If something changes, the property will still be C -1. Mr. Kremer moved that the Commission recommend to the Council that we amend the zoning ordinance to allow laundries as a principal use in the C -1 District. Mr. Runyan seconded the motion. All Voted Aye. Motion Carried. After considerable discussion regarding the variance that may come about, Mrs. McDonald moved that we do not change the ordinance as far as the 2500 square foot requirement, but that the Planning Commission strongly recommend the passage of a variance for this project for the following reasons: 1) petition from the surrounding merchants supporting the project and the private property owners, and 2) a distinct benefit and an improvement to the corner. Mr. Runyan seconded the motion. All Voted Aye. Motion Carried. Following review by the Planning Commission, the proponent was able to include an additional one acre parcel of property into his development proposal. The effect of this additional acre is to provide 10 additional townhouse units, thus bringing the total number of units to 90. Although this revised proposal was not reviewed by the Planning Commission, the following factors should be considered. First, the original 80 unit proposal was designed in anticipation of including the one acre parcel at a later date. Thus, the locations, elevations, and design of the original 80 units remain unchanged. Secondly, the Planning Commission review on November 2, 1977, was a preliminary review. If granted preliminary rezoning by the Council, final plans will be submitted to the Planning Commission for review. Therefore, staff recommends preliminary rezoning approval at this time for the 90 unit townhouse proposal. GLH:ks 12/2/77 cc: Mayor and Council Z -77 -17 Ryan Construction Co. Attached preliminary zoning plans On September 28, 1977, the Planning Commission reviewed the proposed Southeast Edina Redevelopment Plan.which was subsequently approved by the City Council on October 17,. 1977.. The Planning Commission will recall that a 9.5 acre site lying east of York Avenue and north of 76th Street and within the redevelopment . plan area was proposed for the construction of 80 low and moderate income family townhouses. This project, which is proposed by Ryan Construction Company, was discussed briefly on September 28, 1977. Presently, Ryan Construction Company is requesting preliminary rezoning approval from R -1 to PRD -3, Planned Residential District. If approved by the Planning Commission and Council, the proponents will then return with final development plans for your review. The proposed development plans call for 80 units which include.8 one bedroom units, 48 two bedroom units, 20 three bedroom units, and 4 four bedroom units. Structures and parking areas comprise 33.3% of the site with the remainder devoted to open space areas, which include pedestrian walkways, tot lots, and landscape areas. Access to the southern portion of the development is provided from 76th Street and access to the northern portion from York Avenue. 100 enclosed garage spaces and 80 surface parking spaces are provided.' The subject property has been graded and altered significantly during past years. Thus, few trees and greed areas are present. The property is characterized by fairly level topography, however, a rather steep embarkment is present along York Terrace in the northwestern partion of the subject property. Recommendation: Although the proposed development will be constructed for housing for low and moderate income_ families, it must be emphasized that this is not "low cost" housing,, i.e., housing which is constructed to lesser design and construction standards and with fewer amenities. Rather, the proposed housing is designed and constructed in the same-manner as a market rate housing with similar amenities and should be reviewed by the Planning Commission in the same manner as a market rate housing development. Staff recommends preliminary zoning approval in that: 1. the proposal conforms with the South Edina Plan. 2. the proposal conforms with the Southeast Edina Redevelopment Plan. 3. , the low density development as proposed.is desirable to further reduce traffic impacts, to provide a less congested living environment for low and moderate income families, and to provide a suitable transition _from low _density_ dev_elopment_s_ to_the eas_t.___ -____ kyan Construction Co. Page 2 November 2, 1977 Recommendation: 4. building locations as proposed prevent an undesirable "row house" appearance and provide areas for adequate screening with land- scaping. Approval is recommended with the following conditions and modifications in conjunction with final plan approval: 1. dedication of an easement abutting York Terrace for roadway purposes. 2. deletion of the northerly driveway on York Avenue. 3. completion of preliminary and final platting of the subject property. 4. provision of an adequate landscape plan Lastly, City Ordinances require that individual sewer and water connections must be provided for townhouse developments. According to HUD and the Minnesota Housing Finance Agency agreements which the proponent must enter into, the proposed development must be used as rental property to low and moderate income families for at least 30 years. The findings of this investigation are shown in Exhibits A through G (see attachments). A meeting was held on October 27, 1977, at the Edina City Hall to discuss the situation. The discussion concluded that the condition of Melody Lake has been stable for a period of years. The only apparent change, which can be attributed to the reconstruction of T.H. 100, is the deposition of material in the immediate vicinity of the storm sewer outlet. The forming of a delta at a storm sewer outlet is a frequent occurrence and is a problem which requires routine maintenance. Therefore, other than the sediment in the delta, Mn /DOT feels that it has not caused any degradation of Melody Lake with the reconstruction of T.H. 100, nor would any treatment of the lake be appropriate. Three entry pipes have submerged deltas, highway delta is above water. 2) Lake fertility may be partially caused by nutrients applied to lawns adjacent to lake and also lawns indirectly draining to lake. (Chem -lawn truck was seen applying chemicals to lawns directly adjacent to lake.) 3) Lake is relatively shallow and uniformly deep at about 51. At time of samplings water looked to be about a foot higher than normal - grass under water. (Probably due to 8" rain which oc- curred shortly before sampling). 4) Very little submergent or emergent vegetation. Very narrow littoral zone. This condition probably caused by turbid water deleting light to bottom and prohibiting growth. Deletion of light could be caused by either suspended particles in water or algae growth. Although they don't save the data, He can't remember the values being excessively high. Nutrient values ob- tained by Hach Kit. Phosphorous measured was "ortho" phosphorous - this is a low value as compared to total phosphorous - (Ed Swaine.) b) He doesntt feel that this lake is much different in quality from other lakes in the area. Students periodically bring water sam- ples from other ponds & lakes and they seem to be similar to Melody Lake in quality. c) Don said that if this lake was of poor quality they would bring the students to other lakes - so far they haventt had to. d) He remembers fish kill 7 or 8 years ago from winter kill. e) He feels biggest problem for the lake is fertilizers.used for lawns in the area. f) He stated they had secci disc readings of about 1.0t before con- struction. Summary a) All teachers agree that this lake never was very clear - even prior to construction. b) During construction, lake was in poor shape. This deed, when executed by the City, should be forwarded to Earl Myhre. He should be advised to file the deed. Is it now necessary that we obtain a new easement from the Sheridans? Since the earlier easement was in error, I presume we should now obtain a corrected easement, at least as to that part of the prior easement that was in error. Dear Mr., Hoffman; PILE NO I am writing this letter as a.concerned businessman with an office located at the-above corner. I`would like'to make you aware of the dangers which occur here. This is a high traffic area -due to the number of businesses located between. York Avenue and Xerxes Avenue. On many occasions I have seen 11close calls" occur. This is probably because people assume there are stop signs located on 69th Street. There are none. Assuming the above a vehicle stopped on Xerxes will start through.the intersection before waiting to see if traffic will stop on -69th Street. Since the intersection is located -on a hill, it is difficult to see approaching traffic, and it.is difficult to speed up and "squeak" through the intersection upon the realization "that the traffic on 69th Street does not have to stop. Please see that this letter is placed in the appropriate.hands for immediate consideration. I am sure that with winter here there will be even more 'accidents due -.to the road conditions.
